Par Enerģētikas hartas protokolu par energoefektivitāti un ar to saistītajiem vides aizsardzības aspektiem

1.pants. 1994.gada 17.decembrī Lisabonā parakstītais Enerģētikas hartas protokols par energoefektivitāti un ar to saistītajiem vides aizsardzības aspektiem un tā pielikums (turpmāk — Protokols) ar šo likumu tiek pieņemti un apstiprināti.

2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināms Protokols angļu valodā un tā tulkojums latviešu valodā.

3.pants. Protokols stājas spēkā tā 18.pantā noteiktajā laikā un kārtībā, un par to Ārlietu ministrija paziņo laikrakstā "Latvijas Vēstnesis".

Energy Charter Protocol on Energy Efficiency and Related Environmental Aspects

PREAMBLE

THE CONTRACTING PARTIES to this Protocol,

Having regard to the European Energy Charter adopted in the Concluding Document of the Hague Conference on the European Energy Charter, signed at The Hague on 17 December 1991; and in particular to the declarations therein that co-operation is necessary in the field of energy efficiency and related environmental protection;

Having regard also to the Energy Charter Treaty, opened for signature from 17 December 1994 to 16 June 1995;

Mindful of the work undertaken by international organisations and for in the field of energy efficiency and environmental aspects of the energy cycle;

Aware of the improvements in supply security, and of the significant economic and environmental gains, which result from the implementation of cost-effective energy efficiency measures; and aware of their importance for restructuring economies and improving living standards;

Recognising that improvements in energy efficiency reduce negative environmental consequences of the energy cycle including global warming and acidification;

Convinced that energy prices should reflect as far as possible a competitive market, ensuring market-oriented price formation, including fuller reflection of environmental costs and benefits, and recognising that such price formation is vital to progress in energy efficiency and associated environmental protection;

Appreciating the vital role of the private sector including small and medium-sized enterprises in promoting and implementing energy efficiency measures, and intent on ensuring a favourable institutional framework for economically viable investment in energy efficiency;

Recognising that commercial forms of co-operation may need to be complemented by intergovernmental co-operation, particularly in the area of energy policy formulation and analysis as well as in other areas which are essential to the enhancement of energy efficiency but not suitable for private funding; and

Desiring to undertake co-operative and co-ordinated action in the field of energy efficiency and related environmental protection and to adopt a Protocol providing a framework for using energy as economically and efficiently as possible:

HAVE AGREED AS FOLLOWS:

Part I

INTRODUCTION

Article 1

SCOPE AND OBJECTIVES OF THE PROTOCOL

(1) This Protocol defines policy principles for the promotion of energy efficiency as a considerable source of energy and for consequently reducing adverse Environmental Impacts of energy systems. It furthermore provides guidance on the development of energy efficiency programmes, indicates areas of co-operation and provides a framework for the development of co-operative and co-ordinated action. Such action may include the prospecting for, exploration, production, conversion, storage, transport, distribution, and consumption of energy, and may relate to any economic sector.

(2) The objectives of this Protocol are:

(a) the promotion of energy efficiency policies consistent with sustainable development;

(b) the creation of framework conditions which induce producers and consumers to use energy as economically, efficiently and environmentally soundly as possible, particularly through the organisation of efficient energy markets and a fuller reflection of environmental costs and benefits; and

(c) the fostering of co-operation in the field of energy efficiency.

Article 2

DEFINITIONS

As used in this Protocol:

(1) "Charter" means the European Energy Charter adopted in the Concluding Document of the Hague Conference on the European Energy Charter signed at The Hague on 17 December 1991; signature of the Concluding Document is considered to be signature of the Charter.

(2) "Contracting Party" means a state or Regional Economic Integration Organisation which has consented to be bound by this Protocol and for which the Protocol is in force.

(3) "Regional Economic Integration Organisation" means an organisation constituted by states to which they have transferred competence over certain matters a number of which are governed by this Protocol, including the authority to take decisions binding on them in respect of those matters.

(4) "Energy Cycle" means the entire energy chain, including activities related to prospecting for, exploration, production, conversion, storage, transport, distribution and consumption of the various forms of energy, and the treatment and disposal of wastes, as well as the decommissioning, cessation or closure of these activities, minimising harmful Environmental Impacts.

(5) "Cost-Effectiveness" means to achieve a defined objective at the lowest cost or to achieve the greatest benefit at a given cost.

(6) "Improving Energy Efficiency" means acting to maintain the same unit of output (of a good or service) without reducing the quality or performance of the output, while reducing the amount of energy required to produce that output.

(7) "Environmental Impact" means any effect caused by a given activity on the environment, including human health and safety, flora, fauna, soil, air, water, climate, landscape and historical monuments or other physical structures or the interactions among these factors; it also includes effects on cultural heritage or socio-economic conditions resulting from alterations to those factors.

Part II

POLICY PRINCIPLES

Article 3

BASIC PRINCIPLES

Contracting Parties shall be guided by the following principles:

(1) Contracting Parties shall cooperage and, as appropriate, assist each other in developing and implementing energy efficiency policies, laws and regulations.

(2) Contracting Parties shall establish energy efficiency policies and appropriate legal and regulatory frameworks which promote, inter alia:

(a) efficient functioning of market mechanisms including market-oriented price formation and a fuller reflection of environmental costs and benefits;

(b) reduction of barriers to energy efficiency, thus stimulating investments;

(c) mechanisms for financing energy efficiency initiatives;

(d) education and awareness;

(e) dissemination and transfer of technologies;

(f) transparency of legal and regulatory frameworks.

(3) Contracting Parties shall strive to achieve the full benefit of energy efficiency throughout the Energy Cycle. To this end they shall, to the best of their competence, formulate and implement energy efficiency policies and co-operative or co-ordinated actions based on Cost-Effectiveness and economic efficiency, taking due account of environmental aspects.

(4) Energy efficiency policies shall include both short-term measures for the adjustment of previous practices and long-term measures to improve energy efficiency throughout the Energy Cycle.

(5) When co-operating to achieve the objectives of this Protocol, Contracting Parties shall take into account the differences in adverse effects and abatement costs between Contracting Parties.

(6) Contracting Parties recognise the vital role of the private sector. They shall encourage action by energy utilities, responsible authorities and specialised agencies, and close Cupertino between industry and administrations.

(7) Co-operative or co-ordinated action shall take into account relevant principles adopted in international agreements, aimed at protection and improvement of the environment, to which Contracting Parties are parties.

(8) Contracting Parties shall take full advantage of the work and expertise of competent international or other bodies and shall take care to avoid duplication.

Article 4

DIVISION OF RESPONSIBILITY AND COORDINATION

Each Contracting Party shall strive to ensure that energy efficiency policies are co-ordinated among all of its responsible authorities.

Article 5

STRATEGIES AND POLICY AIMS

Contracting Parties shall formulate strategies and policy aims for Improving Energy Efficiency and thereby reducing Environmental Impacts of the Energy Cycle as appropriate in relation to their own specific energy conditions. These strategies and policy aims shall be transparent to all interested parties.

Article 6

FINANCING AND FINANCIAL INCENTIVES

(1) Contracting Parties shall encourage the implementation of new approaches and methods for financing energy efficiency and energy-related environmental protection investments, such as joint venture arrangements between energy users and external investors (hereinafter referred to as "Third Party Financing").

(2) Contracting Parties shall endeavour to take advantage of and promote access to private capital markets and existing international financing institutions in order to facilitate investments in Improving Energy Efficiency and in environmental protection related to energy efficiency.

(3) Contracting Parties may, subject to the provisions of the Energy Charter Treaty and to their other international legal obligations, provide fiscal or financial incentives to energy users in order to facilitate market penetration of energy efficiency technologies, products and services. They shall strive to do so in a manner that both ensures transparency and minimises the distortion of international markets.

Article 7

PROMOTION OF ENERGY EFFICIENT TECHNOLOGY

(1) Consistent with the provisions of the Energy Charter Treaty, Contracting Parties shall encourage commercial trade and co-operation in energy efficient and environmentally sound technologies, energy-related services and management practices.

(2) Contracting Parties shall promote the use of these technologies, services and management practices throughout the Energy Cycle.

Article 8

DOMESTIC PROGRAMMES

(1) In order to achieve the policy aims formulated according to Article 5, each Contracting Party shall develop, implement and regularly update energy efficiency programmes best suited to its circumstances.

(2) These programmes may include activities such as the:

(a) development of long-term energy demand and supply scenarios to guide decision-making;

(b) assessment of the energy, environmental and economic impact of actions taken;

(c) definition of standards designed to improve the efficiency of energy using equipment, and efforts to harmonise these internationally to avoid trade distortions;

(d) development and encouragement of private initiative and industrial co-operation, including joint ventures;

(e) promotion of the use of the most energy efficient technologies that are economically viable and environmentally sound;

(f) encouragement of innovative approaches for investments in energy efficiency improvements, such as Third Party Financing and co-financing;

(g) development of appropriate energy balances and data bases, for example with data on energy demand at a sufficiently detailed level and on technologies for Improving Energy Efficiency;

(h) promotion of the creation of advisory and consultancy services which may be operated by public or private industry or utilities and which provide information about energy efficiency programmes and technologies, and assist consumers and enterprises;

(i) support and promotion of cogeneration and of measures to increase the efficiency of district heat production and distribution systems to buildings and industry;

(j) establishment of specialised energy efficiency bodies at appropriate levels, that are sufficiently funded and staffed to develop and implement policies.

(3) In implementing their energy efficiency programmes, Contracting Parties shall ensure that adequate institutional and legal infrastructures exist.

Part III

INTERNATIONAL COOPERATION

Article 9

AREAS OF COOPERATION

The co-operation between Contracting Parties may take any appropriate form. Areas of possible co-operation are listed in the Annex.

Part IV

ADMINISTRATIVE AND LEGAL ARRANGEMENTS

Article 10

ROLE OF THE CHARTER CONFERENCE

(1) All decisions made by the Charter Conference in accordance with this Protocol shall be made by only those Contracting Parties to the Energy Charter Treaty who are Contracting Parties to this Protocol.

(2) The Charter Conference shall endeavour to adopt, within 180 days after the entry into force of this Protocol, procedures for keeping under review and facilitating the implementation of its provisions, including reporting requirements, as well as for identifying areas of co-operation in accordance with Article 9.

Article 11

SECRETARIAT AND FINANCING

(1) The Secretariat established under Article 35 of the Energy Charter Treaty shall provide the Charter Conference with all necessary assistance for the performance of its duties under this Protocol and provide such other services in support of the Protocol as may be required from time to time, subject to approval by the Charter Conference.

(2) The costs of the Secretariat and Charter Conference arising from this Protocol shall be met by the Contracting Parties to this Protocol according to their capacity to pay, determined according to the formula specified in Annex B to the Energy Charter Treaty.

Article 12

VOTING

(1) Unanimity of Contracting Parties Present and Voting at the meeting of the Charter Conference where such matters fall to be decided shall be required for decisions to:

(a) adopt amendments to this Protocol; and

(b) approve accessions to this Protocol under Article 16.

Contracting Parties shall make every effort to reach agreement by consensus on any other matter requiring their decision under this Protocol. If agreement cannot be reached by consensus, decisions on non-budgetary matters shall be taken by a three-fourths majority of Contracting Parties Present and Voting at the meeting of the Charter Conference at which such matters fall to be decided.

Decisions on budgetary matters shall be taken by a qualified majority of Contracting Parties whose assessed contributions under Article 11(2) represent, in combination, at least three-fourths of the total assessed contributions.

(2) For purposes of this Article, "Contracting Parties Present and Voting" means Contracting Parties to this Protocol present and casting affirmative or negative votes, provided that the Charter Conference may decide upon rules of procedure to enable such decisions to be taken by Contracting Parties by correspondence.

(3) Except as provided in paragraph (1) in relation to budgetary matters, no decision referred to in this Article shall be valid unless it has the support of a simple majority of Contracting Parties.

(4) A Regional Economic Integration Organisation shall, when voting, have a number of votes equal to the number of its member states which are Contracting Parties to this Protocol; provided that such an Organisation shall not exercise its right to vote if its member states exercise theirs, and vice versa.

(5) In the event of persistent arrears in a Contracting Party's discharge of financial obligations under this Protocol, the Charter Conference may suspend that Contracting Party's voting rights in whole or in part.

Article 13

RELATION TO THE ENERGY CHARTER TREATY

(1) In the event of inconsistency between the provisions of this Protocol and the provisions of the Energy Charter Treaty, the provisions of the Energy Charter Treaty shall, to the extent of the inconsistency, prevail.

(2) Article 10(1) and Article 12(1) to (3) shall not apply to votes in the Charter Conference on amendments to this Protocol which assign duties or functions to the Charter Conference or the Secretariat, the establishment of which is provided for in the Energy Charter Treaty.

Part V

FINAL PROVISIONS

Article 14

SIGNATURE

This Protocol shall be open for signature at Lisbon from 17 December 1994 to 16 June 1995 by the states and Regional Economic Integration Organisations whose representatives have signed the Charter and the Energy Charter Treaty.

Article 15

RATIFICATION, ACCEPTANCE OR APPROVAL

This Protocol shall be subject to ratification, acceptance or approval by signatories. Instruments of ratification, acceptance or approval shall be deposited with the Depository.

Article 16

ACCESSION

This Protocol shall be open for accession, from the date on which the Protocol is closed for signature, by states and Regional Economic Integration Organisations which have signed the Charter and are Contracting Parties to the Energy Charter Treaty, on terms to be approved by the Charter Conference. The instruments of accession shall be deposited with the Depository.

Article 17

AMENDMENTS

(1) Any Contracting Party may propose amendments to this Protocol.

(2) The text of any proposed amendment to this Protocol shall be communicated to Contracting Parties by the Secretariat at least three months before the date on which it is proposed for adoption by the Charter Conference.

(3) Amendments to this Protocol, texts of which have been adopted by the Charter Conference, shall be communicated by the Secretariat to the Depository which shall submit them to all Contracting Parties for ratification, acceptance or approval.

(4) Instruments of ratification, acceptance or approval of amendments to this Protocol shall be deposited with the Depository. Amendments shall enter into force between Contracting Parties having ratified, accepted or approved them on the thirtieth day after deposit with the Depository of instruments of ratification, acceptance or approval by at least three-fourths of the Contracting Parties. Thereafter the amendments shall enter into force for any other Contracting Party on the thirtieth day after that Contracting Party deposits its instrument of ratification, acceptance or approval of the amendments.

Article 18

ENTRY INTO FORCE

(1) This Protocol shall enter into force on the thirtieth day after the date of deposit of the fifteenth instrument of ratification, acceptance or approval thereof, or of accession thereto, by a state or Regional Economic Integration Organisation which is a signatory to the Charter and a Contracting Party to the Energy Charter Treaty or on the same date as the Energy Charter Treaty enters into force, whichever is later.

(2) For each state or Regional Economic Integration Organisation for which the Energy Charter Treaty has entered into force and which ratifies, accepts, or approves this Protocol or accedes thereto after the Protocol has entered into force in accordance with paragraph (1), the Protocol shall enter into force on the thirtieth day after the date of deposit by such state or Regional Economic Integration Organisation of its instrument of ratification, acceptance, approval or accession.

(3) For the purposes of paragraph (1), any instrument deposited by a Regional Economic Integration Organisation shall not be counted as additional to those deposited by member states of such Organisation.

Article 19

RESERVATIONS

No reservations may be made to this Protocol.

Article 20

WITHDRAWAL

(1) At any time after this Protocol has entered into force for a Contracting Party, that Contracting Party may give written notification to the Depository of its withdrawal from the Protocol.

(2) Any Contracting Party which withdraws from the Energy Charter Treaty shall be considered as also having withdrawn from this Protocol.

(3) The effective date of withdrawal under paragraph (1) shall be ninety days after receipt of notification by the Depository. The effective date of withdrawal under paragraph (2) shall be the same as the effective date of withdrawal from the Energy Charter Treaty.

Article 21

DEPOSITARY

The Government of the Portuguese Republic shall be the Depository of this Protocol.

Article 22

AUTHENTIC TEXTS

In witness whereof the undersigned, being duly authorised to that effect, have signed this Protocol in English, French, German, Italian, Russian and Spanish, of which every text is equally authentic, in one original, which will be deposited with the Government of the Portuguese Republic.

Done at Lisbon on the seventeenth day of December in the year one thousand nine hundred and ninety-four.

PREAMBULA

Šī Protokola parakstītājas,

ņemot vērā ar Eiropas Enerģētikas Hartas Hāgas Konferences Noslēguma Dokumentu akceptēto Eiropas Enerģētikas Hartu, kas tika parakstīta 1991.gada 17.decembrī Hāgā, un īpaši tās nostādnes par sadarbības nepieciešamību energoefektivitātes un ar to saistīto vides aizsardzības problēmu jomā;

ņemot vērā Enerģētikas Hartas Līgumu, kuru ir iespējams parakstīt no 1994.gada 17.decembra līdz 1995.gada 16.jūnijam;

ņemot vērā starptautisko organizāciju uzsākto darbu energoefektivitātes un ar Enerģētisko Ciklu saistīto vides problēmu jomā;

apzinoties situācijas uzlabošanos piegāžu drošības ziņā un nozīmīgu tautsaimniecības un apkārtējās vides stāvokļa uzlabošanos, kas ir efektīvu energoefektivitātes pasākumu ieviešanas rezultāts, kā arī apzinoties šo pasākumu nozīmi tautsaimniecības pārstrukturēšanas un dzīves apstākļu uzlabošanas procesos;

atzīstot, ka energoefektivitātes uzlabošana samazina Enerģētiskā Cikla negatīvās, apkārtējo vidi ietekmējošās sekas, ieskaitot klimata izmaiņas un oksidēšanās procesu paātrināšanos;

atzīstot, ka konkurences tirgum cik pilnīgi vien iespējams jāatspoguļojas enerģijas cenās, garantējot uz tirgu orientētu cenu veidošanu, pilnīgi ietverot tajās ar vidi saistītās izmaksas un atzīstot, ka šāda cenu veidošanas kārtība ir būtiska energoefektivitātes un ar to saistīto dabas aizsardzības jautājumu progresam;

atbalstot privātā sektora t. sk. maza un vidēja izmēra uzņēmumu lomu energoefektivitātes pasākumu veicināšanā un ieviešanā, kā arī to nodomus nodrošināt labvēlīgu institucionālu pamatu ekonomiski pamatotām investīcijām energoefektivitātes jomā;

atzīstot, ka komerciālās sadarbības formas varētu tikt papildinātas ar starpvaldību sadarbību, īpaši enerģētikas politikas formulēšanas un analīzes jomās, kā arī citās sfērās, kas ir būtiski saistītas ar energoefektivitātes uzlabošanu, bet nav piemērotas privātai finansēšanai;

vēloties uzsākt kopīgus un koordinētus energoefektivitātes un apkārtējās vides stāvokļa uzlabošanas pasākumus, kā arī parakstīt Protokolu, kas nodrošinātu pēc iespējas ekonomiskāku un efektīvāku enerģijas izmantošanu:

I daļa

IEVADS

1. pants

PROTOKOLA MĒRĶIS UN SATURS

(1) Šis protokols definē energoefektivitātes kā ievērojama enerģijas avota, kas konsekventi samazina uz apkārtējo vidi neatgriezeniski iedarbojošos enerģētisko sistēmu ietekmi, veicināšanas politikas principus. Bez tam Protokols nosaka vadlīnijas enerģētikas efektivitātes programmām, norāda uz sadarbības jomām un rada pamatu kopējai un koordinētai darbībai. Šāda darbība var aptvert energoresursu iegūšanas iespēju pētīšanu, ieguvi, ražošanu, pārveidošanu, uzglabāšanu, transportēšanu, sadali un patēriņu, un var ietekmēt jebkuru tautsaimniecības sektoru.

(2) Šī Protokola mērķis ir:

(a) pastāvīgā attīstībā esošas energoefektivitātes politikas veicināšana;

(b) vispārēju nosacījumu radīšana, kas rosinātu ražotājus un patērētājus pēc iespējas ekonomiskāk un efektīvāk izmantot enerģiju apkārtējai videi nekaitīgā veidā, īpaši ar efektīvu energoresursu tirgu veidošanas un vides aizsardzības izmaksu pilnīgākas atspoguļošanas enerģijas cenās palīdzību; un

(c) sadarbības veicināšana energoefektivitātes jomā.

2. pants

DEFINĪCIJAS

Šī Protokola kontekstā:

(1) "Harta" nozīmē ar Eiropas Enerģētikas Hartas Hāgas Konferences Noslēguma Dokumentu pieņemto Eiropas Enerģētikas Hartu, kas parakstīta Hāgā 1991.gada 17.decembrī; paraksts zem Noslēguma Dokumenta tiek uzskatīts par parakstu zem Hartas.

(2) "Līgumslēdzējpuse" nozīmē valsti vai Reģionālu Ekonomiskās Integrācijas Organizāciju, kura ir piekritusi tam, ka šis Protokols būs tai saistošs, un attiecībā uz kuru šis Protokols ir spēkā.

(3) "Reģionāla Ekonomiskās Integrācijas Organizācija" nozīmē organizāciju, kuru ir izveidojušas atsevišķas valstis un kurai ir nodotas pilnvaras risināt noteiktus jautājumus, daļu no kuriem regulē šis Protokols, kā arī pilnvaras pieņemt lēmumus, kas ir saistoši un attiecas uz šiem jautājumiem.

(4) "Enerģētiskais Cikls" nozīmē veselu enerģētisko ķēdi, aptverot darbības, kas saistās ar dažādu enerģijas formu ieguves iespēju pētīšanu, ieguvi, ražošanu, pārveidošanu, uzglabāšanu, transportēšanu, sadali un patēriņu, atkritumu apstrādi un uzglabāšanu, kā arī šo darbību pārtraukšanu tādējādi samazinot kaitīgo ietekmi uz apkārtējo vidi.

(5) "Izmaksu efektivitāte" nozīmē definēto mērķu sasniegšanu ar viszemākajām izmaksām vai vislielākā labuma gūšana, balstoties uz dotajām izmaksām.

(6) "Energoefektivitātes palielināšana" nozīmē darbību, kas nodrošina to pašu ražošanas galaproduktu (preci vai pakalpojumu), samazinot šī galaprodukta saražošanai nepieciešamo energopatēriņu, tai pašā laikā nesamazinot galaprodukta kvalitāti.

(7) "Ietekme uz apkārtējo vidi" nozīmē jebkuru efektu, ko izraisījusi dotā darbība uz apkārtējo vidi, ietverot cilvēku veselību un drošību, floru, faunu, augsni, gaisu, ūdeni, klimatu, ainavu un vēsturiskos pieminekļus vai citas fiziskas struktūras vai mijiedarbību starp šiem faktoriem; tas ietver arī ietekmi uz kultūras mantojumu vai sociāli ekonomiskos apstākļu s, kas rodas, izmainot šos faktorus.

II daļa

POLITIKAS PRINCIPI

3. pants

PAMATPRINCIPI

Līgumslēdzējpuses vadās pēc sekojošiem principiem:

(1) Līgumslēdzējpuses sadarbojas un attiecīgi palīdz viena otrai attīstīt un īstenot energoefektivitātes politiku, likumus un noteikumus.

(2) Līgumslēdzējpuses izstrādā energoefektivitātes politiku un attiecīgus juridiskus principus, kas veicina:

(a) tirgus mehānisma, t. sk. tirgus cenu, efektīvu funkcionēšanu un pilnīgu vides aizsardzības izmaksu atspoguļošanos cenās;

(b) energoefektivitāti samazinošu barjeru novēršanu, tādējādi stimulējot investīcijas;

(c) mehānismus energoefektīvu pasākumu veicināšanai;

(d) izglītību un apzinīgumu;

(e) tehnoloģiju pārņemšanu un izplatīšanu;

(f) juridisko un regulējošo principu "caurspīdīgumu".

(3) Līgumslēdzējpuses cenšas sasniegt vislielākā mērā efektīvu Enerģētiskā Cikla funkcionēšanu. Šajā sakarā tās savas kompetences ietvaros formulē un realizē energoefektīvu politiku un sadarbojas vai koordinē savu darbību, balstoties uz izmaksu un ekonomisko efektivitāti, pienācīgi ņemot vērā vides aizsardzības aspektus.

(4) Energoefektīva politika ietver gan īstermiņa darbību, sakārtojot iepriekšējā perioda likumdošanu, gan ilgtermiņa darbību, uzlabojot Enerģētiskā Cikla energoefektivitāti.

(5) Sadarbojoties, lai sasniegtu šī Protokola izvirzītos mērķus, Līgumslēdzējpuses ņem vērā starpību starp nelabvēlīgām sekām un izmaksu samazināšanos, kas skar atsevišķas Līgumslēdzējpuses.

(6) Līgumslēdzējpuses atzīst privātā sektora vitāli svarīgo lomu. Tās veicina energouzņēmumu, atbildīgo amatpersonu un specializētu struktūru aktīvu darbību, kā arī ciešu sadarbību starp rūpniecību un pārvaldes struktūrām.

(7) Veicot koordinētu sadarbību, Līgumslēdzējpuses ņem vērā tām saistošajos starptautiskajos līgumos noteiktus būtiskus principus, kas veicina apkārtējās vides aizsardzību un tās stāvokļa uzlabošanos.

(8) Līgumslēdzējpuses pilnā mērā izmanto kompetentu starptautisku vai citu organizāciju pakalpojumus un ekspertīzi, kā arī rūpējas, lai atsevišķu struktūru darbība nepārklātos.

4. pants

ATBILDĪBA PAR SASKAŅOŠANU

Katra Līgumslēdzējpuse cenšas garantēt energoefektivitātes politikas koordinēšanu starp visām tās atbildīgajām struktūrām.

5. pants

STRATĒĢIJA UN POLITIKAS MĒRĶI

Līgumslēdzējpuses formulē stratēģiju un politikas mērķus energoefektivitātes paaugstināšanai un līdz ar to Enerģētiskā Cikla ietekmes uz vidi samazināšanai, vadoties pēc katras puses specifiskajiem apstākļiem enerģētikas sektorā. Par šo stratēģiju un politikas mērķiem ir informētas visas ieinteresētās puses.

6. pants

FINANSĒJUMS UN FINANSU STIMULI

(1) Līgumslēdzējpuses veicina jaunu pieeju un metožu ieviešanu energoefektīvu ražotņu un ar enerģētiku saistītu dabas aizsardzības projektu finansēšanā, kā piemēram kopuzņēmumu nodibināšana starp enerģijas patērētājiem un ārvalstu investoriem (tālāk — "Trešās puses finansēšana").

(2) Līgumslēdzējpuses cenšas izmantot privātā kapitāla tirgus un starptautisko aizdevējorganizāciju eksistences priekšrocības un veicināt pieeju tiem ar nolūku veicināt kapitālieguldījumus energoefektīvās ražotnēs un ar enerģētiku saistītos dabas aizsardzības projektos.

(3) Ievērojot Enerģētikas Hartas Līguma nosacījumus un tā noteiktās starptautiskās saistības Līgumslēdzējpuses drīkst noteikt finansiālus stimulus enerģijas patērētājiem nolūkā veicināt energoefektīvu tehnoloģiju, produktu un pakalpojumu konkurētspēju tirgus apstākļos. Līgumslēdzējpuses cenšas to veikt, garantējot vispārēju informētību un samazinot starptautiskā tirgus izkropļojumus.

7. pants

ENERGOEFEKTĪVU TEHNOLOĢIJU IEVIEŠANAS VEICINĀŠANA

(1) Saskaņā ar Enerģētiskās Hartas Līguma nosacījumiem Līgumslēdzējpuses veicina komerciālo tirdzniecību, kā arī sadarbību energoefektīvu un videi nekaitīgu tehnoloģiju, ar enerģētiku saistīto pakalpojumu un pārvaldes jomās.

(2) Līgumslēdzējpuses veicina šo tehnoloģiju, pakalpojumu un pārvaldes izmantošanu visos Enerģētikas Cikla posmos.

8. pants

VIETĒJĀS PROGRAMMAS

(1) Lai sasniegtu 5.paragrāfā formulētos politikas mērķus katra Līgumslēdzējpuse attīsta, realizē un regulāri aktualizē energoefektivitāti uzlabojošas programmas, kas ir vispiemērotākās vietējiem apstākļiem.

(2) Šīs programmas ietver tādas darbības kā:

(a) energoresursu pieprasījuma un piegāžu ilgtermiņa scenārijus kā vadlīnijas lēmumu pieņemšanai;

(b) izvērsto darbību enerģētisko, ekoloģisko un ekonomisko seku izvērtējums;

(c) energomateriālus izmantojošo iekārtu energoefektivitātes uzlabošanai domāto standartu un normu noteikšana un to starptautiska piemērošana, lai novērstu tirdzniecības nesaskaņas;

(d) pri vātās iniciatīvas un rūpnieciskās sadarbības attīstīšana un veicināšana, ieskaitot kopuzņēmumu veidošanu;

(e) ekonomiski pamatotu un ekoloģiski tīru energoefektīvu tehnoloģiju izmantošanas veicināšana;

(f) modernu pieeju investīciju apstrādei, kas domātas energoefektivitātes palielināšanai, veicināšana, piem. Trešās Puses finansējums un kofinansēšana;

(g) piemērotu enerģijas bilanču un datu bāžu attīstīšana, piemēram pietiekami detalizēti dati par enerģijas pieprasījumu vai tehnoloģijas, kas palielina energoefektivitāti;

(h) padomnieku un konsultantu pakalpojumu izmantošanas veicināšana, kurus var izmantot sabiedriskajā vai privātajā ražošanā un kuri var nodrošināt ar informāciju par energoefektivitātes programmām un tehnoloģijām, kā arī palīdzēt patērētājiem un uzņēmumiem;

(i) koģenerācijas un centralizētās siltumapgādes efektivitātes palielināšanas atbalsts un veicināšana;

(j) īpašu, par energoefektivitāti atbildīgu struktūru izveidošana dažādos līmeņos, kuras ir pietiekami labi finansētas un nokomplektētas ar kadriem, lai spētu attīstīt un realizēt energoefektīvu politiku.

(3) Realizējot energoefektivitātes programmas, Līgumslēdzējpuses garantē adekvātu institucionālu un juridisku infrastruktūru eksistenci.

III daļa

STARPTAUTISKĀ SADARBĪBA

9. pants

SADARBĪBAS JOMAS

Sadarbība starp Līgumslēdzējpusēm var notikt jebkurā piemērotā formā. iespējamās sadarbības jomas ir uzskaitītas Pielikumā.

IV daļa

ADMINISTRATĪVIE UN JURIDISKIE ASPEKTI

10. pants

HARTAS KONFERENCES LOMA

(1) Visu lēmumu pieņemšanā, kurus saskaņā ar šo Protokolu pieņem Hartas Konference, var piedalīties tikai tās Hartas Līguma Līgumslēdzējpuses, kas ir parakstījušas šo Protokolu.

(2) Hartas Konference 180 dienas pēc šī Protokola stāšanās spēkā centīsies izstrādāt kārtību, kādā tiks uzraudzīta un veicināta Protokola nosacījumu realizēšana, ieskaitot atskaišu prasības, kā arī kārtību, kādā tiks noteiktas 9.paragrāfā minētās sadarbības jomas.

11. pants

SEKRETARIĀTS UN FINANSĒJUMS

(1) Sekretariāts, kura izveidošanu nosaka Enerģētikas Hartas Līguma 35.paragrāfs, nodrošina Hartas Konferenci ar visu nepieciešamo palīdzību darbību veikšanā, ko nosaka šis Protokols, kā arī veic jebkādus citus laika gaitā radušos pakalpojumus saistībā ar šo Protokolu, ja Hartas Konference šīs darbības ir apstiprinājusi.

(2) Hartas Konferences un Sekretariāta ar šo Protokolu saistītās darbības finansējumu nodrošina Protokolu parakstījušās puses saskaņā ar to maksātspēju, ko nosaka Enerģētikas Hartas Nolīguma B pielikumā izstrādātā formula.

12. pants

BALSOŠANA

(1) Līgumslēdzējpušu, kas piedalās un balso Hartas Konferencē, vienprātība ir nepieciešama, pieņemot lēmumus par:

(a) izmaiņām Protokolā; un

(b) iespēju citām valstīm parakstīt šo Protokolu saskaņā ar 16.paragrāfu.

Līgumslēdzējpuses izmēģina visus līdzekļus vienošanās panākšanai uz consensus principa pamata par jebkuru citu jautājumu, ko nepieciešams izlemt šī Protokola kompetences ietvaros. Ja vienošanos panākt nav iespējams, tad lēmumus, kuri neskar budžeta jautājumus, pieņem ar trīs ceturtdaļām no Hartas Konferencē piedalošos un balsojošu pušu balsu skaita.

Lēmumus par jautājumiem, kas skar budžetu, pieņem ar to Līgumslēdzējpušu kvalificētu balsu vairākumu, kuru ieguldījums saskaņā ar 11.(2) paragrāfu summējot sastāda vismaz trīs ceturtdaļas no kopējā ieguldījuma.

(2) Šī paragrāfa ietvaros termins "piedalošās un balsojošās puses" nozīmē Līgumslēdzējpuses, kuras ir parakstījušas Protokolu, piedalās sapulcē un kuras nodod pozitīvas vai negatīvas balsis arī gadījumā, ja Hartas Konference nosaka, ka attiecīgi lēmumi var tikt pieņemti, balsojot "pa pastu".

(3) 1.punkts nosaka ar budžeta jautājumiem saistītu izņēmuma gadījumu — neviens lēmums saskaņā ar šo paragrāfu nevar stāties spēkā, kamēr to neatbalsta Līgumslēdzējpušu vienkāršs vairākums.

(4) Reģionālajai Ekonomiskās Integrācijas Organizācijai balsošanas laikā pieder tās dalībvalstu skaitam, kas parakstījušas šo protokolu, atbilstošs balsu skaits; ņemot vērā, ka šī organizācija neizmantos savas tiesības balsot, ja tās dalībvalstis izmanto savējās, un vice versa.

(5) Gadījumā, ja Līgumslēdzējpuse ilgstoši nepilda savas finansiālās saistības, ko uzliek šis Protokols, Hartas Konference var uz laiku daļēji vai pilnā mērā atņemt tai balss tiesības.

13. pants

ATTIECĪBAS AR ENERĢĒTIKAS HARTAS NOLĪGUMU

(1) Pretrunu gadījumā starp šī Protokola un Enerģētikas Hartas Nolīguma nosacījumiem dominē Enerģētikas Hartas Nolīguma nosacījumi.

5. daļa

GALA NOLIKUMS

14. pants

PARAKSTĪŠANA

Šo Protokolu valstīm un Reģionālās Ekonomiskās Integrācijas Organizācijām, kuras ir parakstījušas Enerģētikas Hartu un Enerģētikas Hartas Nolīgumu, ir iespēja parakstīt Lisabonā no 1994.gada 17.decembra līdz 1995.gada 16.jūnijam.

15. pants

RATIFIKĀCIJA, AKCEPTS UN ATZĪŠANA

Līgumslēdzējpuses šo Protokolu akceptē vai atzīst un ratificē. Attiecīgie dokumenti tiek iesniegti Glabātuvē.

16. pants

IESPĒJA PARAKSTĪT PROTOKOLU CITĀM VALSTĪM

Līgumslēdzējpuses, kuras ir parakstījušas Enerģētikas Hartu un Enerģētikas Hartas Nolīgumu, var pievienoties šim Protokolam, sākot ar 1995.gada 16.jūniju saskaņā ar Hartas Konferences apstiprinātiem nosacījumiem. Pievienošanās dokumenti tiek iesniegti Glabātuvē.

17. pants

LABOJUMI

(1) Jebkura Līgumslēdzējpuse var ierosināt veikt labojumus Protokolā.

(2) Jebkura ierosinātā labojuma tekstu Sekretariāts izsūta visām Līgumslēdzējpusēm vismaz trīs mēnešus pirms Hartas Konferences, kurā plānots šos labojumus pieņemt.

(3) Pēc tam, kad Hartas Konference ir akceptējusi izmaiņas Protokolā, Sekretariāts tos nodod Glabātuvei, kura, savukārt tās nosūta visām Līgumslēdzējpusēm akceptam un ratifikācijai.

(3) Akceptu vai ratifikāciju apstiprinoši dokumenti par izmaiņām Protokolā jāiesniedz Glabātuvei rakstveidā. Izmaiņas stājas spēkā Līgumslēdzējpusēm, kuras ir akceptējušas un ratificējušas šīs izmaiņas trīsdesmit dienas pēc brīža, kad no Glabātuves ir saņemts paziņojums, ka vismaz trīs ceturtdaļas Līgumslēdzējpušu ir akceptējušas un ratificējušas šīs izmaiņas. Pēc tam izmaiņas stājas spēkā jebkurai citai Līgumslēdzējpusei 30 dienas pēc brīža, kad šī Līgumslēdzējpuse ir iesniegusi Glabātuvei akcepta un ratifikācijas apstiprinājuma dokumentus.

18. pants

STĀŠANĀS SPĒKĀ

(1) Šis Protokols stājas spēkā 30.dienā pēc brīža, kad piecpadsmitā dalībvalsts vai Reģionālā Ekonomiskās Integrācijas Organizācija, kura ir parakstījusi Hartu un Hartas Nolīgumu, iesniedz akceptu un ratifikāciju apstiprinošu dokumentu vai dokumentu, kas apstiprina gatavību parakstīt šo Protokolu, vai arī brīdī, kad stājas spēkā Enerģētikas Hartas Nolīgums. Protokols stājas spēkā vēlākajā no šiem datumiem.

(2) Pēc Protokola spēkā stāšanās saskaņā ar 1.punktu, katrai valstij vai Reģionālās Ekonomiskās Integrācijas Organizācijai, kurai ir saistošs Enerģētikas Hartas Nolīgums un kura ir ratificējusi, akceptējusi vai izteikusi gatavību parakstīt šo Protokolu, Protokols kļūst saistošs trīsdesmitajā dienā pēc brīža, kad valsts vai Reģionālā Ekonomiskās Integrācijas Organizācija ir iesniegusi Glabātuvei akceptu, ratifikāciju vai gatavību parakstīt Protokolu apstiprinošu dokumentu.

(3) 1.punkta kontekstā, jebkurš dokuments, ko iesniegusi Reģionālā Ekonomiskās Integrācijas Organizācija, netiek pieskaitīts papildus tiem, ko iesniegušas šīs organizācijas atsevišķas dalībvalstis.

19. pants

IEBILDES

Iebildes nav.

20. pants

IZSTĀŠANĀS

(1) Jebkurā brīdī pēc tam, kad Protokols ir stājies spēkā un attiecīgā Līgumslēdzējpuse ir uzņēmusies saistības, Līgumslēdzējpuse var iesniegt rakstveida paziņojumu Glabātuvei par tās nodomu atteikties no šī Protokola uzliktajām saistībām.

(2) Jebkura Līgumslēdzējpuse, kura atsakās no Enerģētikas Hartas Nolīguma uzliktajām saistībām, reizē atsakās arī no Protokola uzliktajām saistībām.

(3) Izstāšanās saskaņā ar 1.punktu stājas spēkā deviņdesmitajā dienā pēc paziņojuma iesniegšanas Glabātuvei. Izstāšanās saskaņā ar 2.punktu stājas spēkā brīdī, kad Līgumslēdzējpusei vairs nav saistošs Enerģētikas Hartas Nolīgums.

21. pants

GLABĀTUVE

Portugāles Republikas valdība tiek uzskatīta par šī Protokola Glabātuvi.

22. pants

AUTENTISKIE TEKSTI

Kā pierādījums pienācīgi pilnvarotu personu rīcībai, parakstot šo Protokolu, Portugāles Republikas valdības glabāšanā tiek nodotas pa vienai parakstīta Protokola oriģināla kopijai angļu, franču, vācu, itāļu, krievu un spāņu valodās, bez tam visas tās ir vienlīdzīgi autentiskas.

Parakstīts Lisabonā tūkstoš deviņi simti deviņdesmit ceturtā gada decembra septiņpadsmitajā dienā.
