CHIEF OF DEFENCE OF THE ESTONIAN DEFENCE FORCES AND THE COMMANDER
OF THE LITHUANIAN ARMED FORCES, CONCERNIG THE BALTIC
NAVAL
MINE COUNTER MEASURE
EQUIPMENT MAINTENANCE AND REPAIR CENTRE IN LIEPAJA
Preamble
Referring to the Agreement between the Government of the Republic of Estonia, the Government of the Republic of Latvia and the Government of the Republic of Lithuania concerning the establishment of the Baltic Naval Squadron (BALTRON), signed in Riga on April 16, 1998 and to the Memorandum of Understanding between the Ministry of Defence of Republic of Estonia, the Ministry of Defence of Republic of Latvia and the Ministry of National Defence of the Republic of Lithuania concerning the organisation, operation, funding and administration of the Baltic Naval Squadron, signed in Riga on October 15, 1999;
Due to the fact that mine hunting maintenance and repair equipment has been installed in Latvian Naval Forces repair centre and has become available for maintenance and repair of Baltic States Navy's Lindau class mine hunter's mine hunting systems:
The Chief of Defence of the Estonian Defence Forces, the Latvian National Armed Forces represented by Chief of Defence of the Latvian National Armed Forces and the Commander of the Lithuanian Armed Forces - hereinafter referred as the Participants, have developed the following Technical Agreement (TA):
Section 1
Purpose
The purpose of The Baltic Naval Mine Counter Measure Equipment Maintenance and Repair Centre (Baltic Naval MCM EMRC) Technical Arrangement is to regulate the operation of MCM EMRC in connection with the BALTRON project.
Section 2
Status of Baltic Naval MCM EMRC
(1) The Baltic Naval MCM EMRC does not hold legal capacity.
(2) The Baltic Naval MCM EMRC is a Latvian Naval Forces military facility, located in Liepaja, Republic of Latvia, which conducts the repair and maintenance of naval MCM equipments for MCM vessels and is made available for the BALTRON project.
Section 3
Financial Provisions
(1) The costs of the ships' maintenance and repair provided by the Baltic Naval MCM EMRC will be covered by respective Participants in proportion to the received maintenance and repair assistance in accordance with their national regulations.
(2) The Baltic Naval MCM EMRC will provide the description of the accomplished work and the bill to the Participants every quarter of the year, respectively - by 1 January, 1 April, 1 July and 1 October.
(3) The Participants will transfer the payments to the Latvian National Armed Forces state main budget expenditure account duly designated by the Baltic Naval MCM EMRC not later than in 30 (thirty) days after the receipt of the bill.
Section 4
Operation of the Baltic Naval MCM EMRC
(1) The Participants will send requests about necessary maintenances and desirable time for it to the Baltic Naval MCM EMRC, by the 1st of June in the year before. The Baltic Naval MCM EMRC will make annual plans for next year and will send for confirmation to the Participants by 1 August.
(2) The Baltic Naval MCM EMRC will order and provide necessary repair parts for maintenance, as agreed in the annual plan, in accordance with national regulations.
(3) Upon request of the Estonian or Lithuanian Navies, technicians of the Baltic Naval MCM EMRC will conduct survey or technical assistance in Estonia or Lithuania before a ship comes to MCM EMRC
(4) In case of necessity of conducting works that are not covered by annual plans, the Participants will send request to the Baltic Naval MCM EMRC that will conduct the works as soon as possible without affecting the schedule stated in the annual plan.
Section 5
Settlement of Disputes
All disputes regarding the interpretation or application of this TA will be resolved through trilateral negations and will not be referred to a national or international tribunal or any other third party for settlement.
Section 6
Final Provisions
(1) This TA will come into effect on the date of its last signature, and will be in force while the BALTRON project exists.
(2) This TA will be amended in writing and signed by all Participants in order to be legally binding. Such amendments will be issued in 3 original copies, one for each Participant.
(3) This TA may be terminated by mutual consent of the Participants. Any Participant may withdraw from this TA by giving 12 months written notice to the other Participants.
(4) The provisions of Section 3 (Financial provisions), and Section 5 (Settlement of Disputes) will remain in effect until all outstanding payments, claims and disputes are settled.
(5) This TA is signed in three original copies in the English language.
