Par Eiropas Padomes Konvenciju par cīņu pret cilvēku tirdzniecību

1.pants. Eiropas Padomes Konvencija par cīņu pret cilvēku tirdzniecību (turpmāk - Konvencija) ar šo likumu tiek pieņemta un apstiprināta.

2.pants. Saskaņā ar Konvencijas 31.panta 2.punktu Ārlietu ministrija informē Eiropas Padomes ģenerālsekretāru par to, ka Latvijas Republika nepiemēros jurisdikciju Konvencijas 31.panta 1.punkta "d" un "e" apakšpunkta noteikumiem.

3.pants. Iekšlietu ministrija koordinē Konvencijā paredzēto saistību izpildi.

4.pants. Konvencija stājas spēkā tās 42.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

5.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināma Konvencija angļu valodā un tās tulkojums latviešu valodā.

COUNCIL OF EUROPE CONVENTION ON ACTION AGAINST TRAFFICKING IN HUMAN BEINGS

Preamble

The member States of the Council of Europe and the other Signatories hereto,

Considering that the aim of the Council of Europe is to achieve a greater unity bet­ween its members;

Considering that trafficking in human beings constitutes a violation of human rights and an offence to the dignity and the integrity of the human being;

Considering that trafficking in human beings may result in slavery for victims;

Considering that respect for victims' rights, protection of victims and action to combat trafficking in human beings must be the paramount objectives;

Considering that all actions or initiatives against trafficking in human beings must be non-discriminatory, take gender equality into account as well as a child-rights approach;

Recalling the declarations by the Ministers for Foreign Affairs of the Member States at the 112th (14-15 May 2003) and the 114th (12-13 May 2004) Sessions of the Committee of Ministers calling for reinforced action by the Council of Europe on trafficking in human beings;

Bearing in mind the Convention for the Protection of Human Rights and Fundamental Freedoms (1950) and its protocols;

Bearing in mind the following recommendations of the Committee of Ministers to member states of the Council of Europe: Recommendation No. R (91) 11 on sexual exploitation, pornography and prostitution of, and trafficking in, children and young adults; Recommendation No. R (97) 13 concerning intimidation of witnesses and the rights of the defence; Recommendation No. R (2000) 11 on action against trafficking in human beings for the purpose of sexual exploitation and Recommendation Rec (2001) 16 on the protection of children against sexual exploitation; Recommendation Rec (2002) 5 on the protection of women against violence;

Bearing in mind the following recommendations of the Parliamentary Assembly of the Council of Europe: Recommendation 1325 (1997) on traffic in women and forced prostitution in Council of Europe member states; Recommendation 1450 (2000) on violence against women in Europe; Recommendation 1545 (2002) on a campaign against trafficking in women; Recommendation 1610 (2003) on migration connected with trafficking in women and prostitution; Recommendation 1611 (2003) on trafficking in organs in Europe; Recommendation 1663 (2004) Domestic slavery: servitude, au pairs and mail-order brides;

Bearing in mind the European Union Council Framework Decision of 19 July 2002 on combating trafficking in human beings the European Union Council Framework Decision of 15 March 2001 on the standing of victims in criminal proceedings and the European Union Council Directive of 29 April 2004 on the residence permit issued to third-country nationals who are victims of trafficking in human beings or who have been the subject of an action to facilitate illegal immigration, who cooperate with the competent authorities;

Taking due account of the United Nations Convention against Transnational
Organized Crime and the Protocol thereto to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children with a view to improving the protection which they afford and developing the standards established by them;

Taking due account of the other international legal instruments relevant in the field of action against trafficking in human beings;

Taking into account the need to prepare a comprehensive international legal instrument focusing on the human rights of victims of trafficking and setting up a specific monitoring mechanism,

Have agreed as follows:

Chapter I - Purposes, scope, non-discrimination principle and definitions

Article 1 - Purposes of the Convention

1 The purposes of this Convention are:

a to prevent and combat trafficking in human beings, while guaranteeing gender equality;

b to protect the human rights of the victims of trafficking, design a comprehensive framework for the protection and assistance of victims and witnesses, while guaranteeing gender equality, as well as to ensure effective investigation and prosecution;

c to promote international cooperation on action against trafficking in human beings.

2 In order to ensure effective implementation of its provisions by the Parties, this Convention sets up a specific monitoring mechanism.

Article 2 - Scope

This Convention shall apply to all forms of trafficking in human beings, whether national or transnational, whether or not connected with organised crime.

Article 3 - Non-discrimination principle

The implementation of the provisions of this Convention by Parties, in particular the enjoyment of measures to protect and promote the rights of victims, shall be secured without discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status.

Article 4 - Definitions

For the purposes of this Convention:

a "Trafficking in human beings" shall mean the recruitment, transportation, transfer, harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation. Exploitation shall include, at a minimum, the exploitation of the prostitution of others or other forms of sexual ex­ploitation, forced labour or services, slavery or practices similar to slavery, servitude or the removal of organs;

b The consent of a victim of "trafficking in human beings" to the intended exploitation set forth in subparagraph (a) of this article shall be irrelevant where any of the means set forth in subparagraph (a) have been used;

c The recruitment, transportation, transfer, harbouring or receipt of a child for the purpose of exploitation shall be considered "trafficking in human beings" even if this does not involve any of the means set forth in subparagraph (a) of this article;

d "Child" shall mean any person under eighteen years of age;

e "Victim" shall mean any natural person who is subject to trafficking in human beings as defined in this article.

Chapter II - Prevention, co-operation and other measures

Article 5 - Prevention of trafficking in human beings

1 Each Party shall take measures to establish or strengthen national co-ordination between the various bodies responsible for preventing and combating trafficking in human beings.

2 Each Party shall establish and/or strengthen effective policies and programmes to prevent trafficking in human beings, by such means as: research, information, awareness raising and education campaigns, social and economic initiatives and training programmes, in particular for persons vulnerable to trafficking and for professionals concerned with trafficking in human beings.

3 Each Party shall promote a Human Rights-based approach and shall use gender mainstreaming and a child-sensitive approach in the development, implementation and assessment of all the policies and programmes referred to in paragraph 2.

4 Each Party shall take appropriate measures, as may be necessary, to enable migration to take place legally, in particular through dissemination of accurate information by relevant offices, on the conditions enabling the legal entry in and stay on its territory.

5 Each Party shall take specific measures to reduce children's vulnerability to trafficking, notably by creating a protective environment for them.

6 Measures established in accordance with this article shall involve, where appropriate, non-governmental organisations, other relevant organisations and other elements of civil society committed to the prevention of trafficking in human beings and victim protection or assistance.

Article 6 - Measures to discourage the demand

To discourage the demand that fosters all forms of exploitation of persons, especially women and children, that leads to trafficking, each Party shall adopt or strengthen legislative, administrative, educational, social, cultural or other measures including:

a research on best practices, methods and strategies;

b raising awareness of the responsibility and important role of media and civil society in identifying the demand as one of the root causes of trafficking in human beings;

c target information campaigns involving, as appropriate, inter alia, public authorities and policy makers;

d preventive measures, including educational programmes for boys and girls during their schooling, which stress the unacceptable nature of discrimination based on sex, and its disastrous consequences, the importance of gender equality and the dignity and integrity of every human being.

Article 7 - Border measures

1 Without prejudice to international commitments in relation to the free movement of persons, Parties shall strengthen, to the extent possible, such border controls as may be necessary to prevent and detect trafficking in human beings.

2 Each Party shall adopt legislative or other appropriate measures to prevent, to the extent possible, means of transport operated by commercial carriers from being used in the commission of offences established in accordance with this Convention.

3 Where appropriate, and without prejudice to applicable international conventions, such measures shall include establishing the obligation of commercial carriers, including any transportation company or the owner or operator of any means of transport, to ascertain that all passengers are in possession of the travel documents required for entry into the receiving State.

4 Each Party shall take the necessary measures, in accordance with its internal law, to provide for sanctions in cases of violation of the obligation set forth in paragraph 3 of this article.

5 Each Party shall adopt such legislative or other measures as may be necessary to permit, in accordance with its internal law, the denial of entry or revocation of visas of persons implicated in the commission of offences established in accordance with this Convention.

6 Parties shall strengthen co-operation among border control agencies by, inter alia, establishing and maintaining direct channels of communication.

Article 8 - Security and control of documents

Each Party shall adopt such measures as may be necessary:

a To ensure that travel or identity documents issued by it are of such quality that they cannot easily be misused and cannot readily be falsified or unlawfully altered, replicated or issued; and

b To ensure the integrity and security of travel or identity documents issued by or on behalf of the Party and to prevent their unlawful creation and issuance.

Article 9 - Legitimacy and validity of documents

At the request of another Party, a Party shall, in accordance with its internal law, verify within a reasonable time the legitimacy and validity of travel or identity documents issued or purported to have been issued in its name and suspected of being used for trafficking in human beings.

Chapter III - Measures to protect and promote the rights of victims, guaranteeing gender equality

Article 10 - Identification of the victims

1 Each Party shall provide its competent authorities with persons who are trained and qualified in preventing and combating trafficking in human beings, in identifying and helping victims, including children, and shall ensure that the different authorities collaborate with each other as well as with relevant support organisations, so that victims can be identified in a procedure duly taking into account the special situation of women and child victims and, in appropriate cases, issued with residence permits under the conditions provided for in Article 14 of the present Convention.

2 Each Party shall adopt such legislative or other measures as may be necessary to identify victims as appropriate in collaboration with other Parties and relevant support organisations. Each Party shall ensure that, if the competent authorities have reasonable grounds to believe that a person has been victim of trafficking in human beings, that person shall not be removed from its territory until the identification process as victim of an offence provided for in Article 18 of this Convention has been completed by the competent authorities and shall likewise ensure that that person receives the assistance provided for in Article 12, paragraphs 1 and 2.

3 When the age of the victim is uncertain and there are reasons to believe that the victim is a child, he or she shall be presumed to be a child and shall be accorded special protection measures pending verification of his/her age.

4 As soon as an unaccompanied child is identified as a victim, each Party shall:

a provide for representation of the child by a legal guardian, organisation or authority which shall act in the best interests of that child;

b take the necessary steps to establish his/her identity and nationality;

c make every effort to locate his/her family when this is in the best interests of the child.

Article 11 - Protection of private life

1 Each Party shall protect the private life and identity of victims. Personal data regarding them shall be stored and used in conformity with the conditions provided for by the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data (ETS No. 108).

2 Each Party shall adopt measures to ensure, in particular, that the identity, or details allowing the identification, of a child victim of trafficking are not made publicly known, through the media or by any other means, except, in exceptional circumstances, in order to facilitate the tracing of family members or otherwise secure the well-being and protection of the child.

3 Each Party shall consider adopting, in accordance with Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms as interpreted by the European Court of Human Rights, measures aimed at encouraging the media to protect the private life and identity of victims through self-regulation or through regulatory or co-regulatory measures.

Article 12 - Assistance to victims

1 Each Party shall adopt such legislative or other measures as may be necessary to assist victims in their physical, psychological and social recovery. Such assistance shall include at least:

a standards of living capable of ensuring their subsistence, through such measures as: appropriate and secure accommodation, psychological and material assistance;

b access to emergency medical treatment;

c translation and interpretation services, when appropriate;

d counselling and information, in particular as regards their legal rights and the services available to them, in a language that they can understand;

e assistance to enable their rights and interests to be presented and considered at appropriate stages of criminal proceedings against offenders;

f access to education for children.

2 Each Party shall take due account of the victim's safety and protection needs.

3 In addition, each Party shall provide necessary medical or other assistance to victims lawfully resident within its territory who do not have adequate resources and need such help.

4 Each Party shall adopt the rules under which victims lawfully resident within its territory shall be authorised to have access to the labour market, to vocational training and education.

5 Each Party shall take measures, where appropriate and under the conditions provided for by its internal law, to co-operate with non-governmental organisations, other relevant organisations or other elements of civil society engaged in assistance to victims.

6 Each Party shall adopt such legislative or other measures as may be necessary to ensure that assistance to a victim is not made conditional on his or her willingness to act as a witness.

7 For the implementation of the provisions set out in this article, each Party shall ensure that services are provided on a consensual and informed basis, taking due account of the special needs of persons in a vulnerable position and the rights of children in terms of accommodation, education and appropriate health care.

Article 13 - Recovery and reflection period

1 Each Party shall provide in its internal law a recovery and reflection period of at least 30 days, when there are reasonable grounds to believe that the person concerned is a victim. Such a period shall be sufficient for the person concerned to recover and escape the influence of traffickers and/or to take an informed decision on cooperating with the competent authorities. During this period it shall not be possible to enforce any expulsion order against him or her. This provision is without prejudice to the activities carried out by the competent authorities in all phases of the relevant national proceedings, and in particular when investigating and prosecuting the offences concerned. During this period, the Parties shall authorise the persons concerned to stay in their territory.

2 During this period, the persons referred to in paragraph 1 of this Article shall be entitled to the measures contained in Article 12, paragraphs 1 and 2.

3 The Parties are not bound to observe this period if grounds of public order prevent it or if it is found that victim status is being claimed improperly.

Article 14 - Residence permit

1 Each Party shall issue a renewable residence permit to victims, in one or other of the two following situations or in both:

a the competent authority considers that their stay is necessary owing to their personal situation;

b the competent authority considers that their stay is necessary for the purpose of their co-operation with the competent authorities in investigation or criminal proceedings.

2 The residence permit for child victims, when legally necessary, shall be issued in accordance with the best interests of the child and, where appropriate, renewed under the same conditions.

3 The non-renewal or withdrawal of a residence permit is subject to the conditions provided for by the internal law of the Party.

4 If a victim submits an application for another kind of residence permit, the Party concerned shall take into account that he or she holds, or has held, a residence permit in conformity with paragraph 1.

5 Having regard to the obligations of Parties to which Article 40 of this Convention refers, each Party shall ensure that granting of a permit according to this provision shall be without prejudice to the right to seek and enjoy asylum.

Article 15 - Compensation and legal redress

1 Each Party shall ensure that victims have access, as from their first contact with the competent authorities, to information on relevant judicial and administrative proceedings in a language which they can understand.

2 Each Party shall provide, in its internal law, for the right to legal assistance and to free legal aid for victims under the conditions provided by its internal law.

3 Each Party shall provide, in its internal law, for the right of victims to compensation from the perpetrators.

4 Each Party shall adopt such legislative or other measures as may be necessary to guarantee compensation for victims in accordance with the conditions under its internal law, for instance through the establishment of a fund for victim compensation or measures or programmes aimed at social assistance and social integration of victims, which could be funded by the assets resulting from the application of measures provided in Article 23.

Article 16 - Repatriation and return of victims

1 The Party of which a victim is a national or in which that person had the right of permanent residence at the time of entry into the territory of the receiving Party shall, with due regard for his or her rights, safety and dignity, facilitate and accept, his or her return without undue or unreasonable delay.

2 When a Party returns a victim to another State, such return shall be with due regard for the rights, safety and dignity of that person and for the status of any legal proceedings related to the fact that the person is a victim, and shall preferably be voluntary.

3 At the request of a receiving Party, a requested Party shall verify whether a person is its national or had the right of permanent residence in its territory at the time of entry into the territory of the receiving Party.

4 In order to facilitate the return of a victim who is without proper documentation, the Party of which that person is a national or in which he or she had the right of permanent residence at the time of entry into the territory of the receiving Party shall agree to issue, at the request of the receiving Party, such travel documents or other authorisation as may be necessary to enable the person to travel to and re-enter its territory.

5 Each Party shall adopt such legislative or other measures as may be necessary to establish repatriation programmes, involving relevant national or international institutions and non governmental organisations. These programmes aim at avoiding re-victimisation. Each Party should make its best effort to favour the reintegration of victims into the society of the State of return, including reintegration into the education system and the labour market, in particular through the acquisition and improvement of their professional skills. With regard to children, these programmes should include enjoyment of the right to education and measures to secure adequate care or receipt by the family or appropriate care structures.

6 Each Party shall adopt such legislative or other measures as may be necessary to make available to victims, where appropriate in co-operation with any other Party concerned, contact information of structures that can assist them in the country where they are returned or repatriated, such as law enforcement offices, non-governmental organisations, legal professions able to provide counselling and social welfare agencies.

7 Child victims shall not be returned to a State, if there is indication, following a risk and security assessment, that such return would not be in the best interests of the child.

Article 17 - Gender equality

Each Party shall, in applying measures referred to in this chapter, aim to promote gender equality and use gender mainstreaming in the development, implementation and assessment of the measures.

Chapter IV - Substantive criminal law

Article 18 - Criminalisation of trafficking in human beings

Each Party shall adopt such legislative and other measures as may be necessary to establish as criminal offences the conduct contained in article 4 of this Convention, when committed intentionally.

Article 19 - Criminalisation of the use of services of a victim

Each Party shall consider adopting such legislative and other measures as may be necessary to establish as criminal offences under its internal law, the use of services which are the object of exploitation as referred to in Article 4 paragraph a of this Convention, with the knowledge that the person is a victim of trafficking in human beings.

Article 20 - Criminalisation of acts relating to travel or identity documents

Each Party shall adopt such legislative and other measures as may be necessary to establish as criminal offences the following conducts, when committed intentionally and for the purpose of enabling the trafficking in human beings:

a forging a travel or identity document;

b procuring or providing such a document;

c retaining, removing, concealing, damaging or destroying a travel or identity document of another person.

Article 21 - Attempt and aiding or abetting

1 Each Party shall adopt such legislative and other measures as may be necessary to establish as criminal offences when committed intentionally, aiding or abetting the commission of any of the offences established in accordance with Articles 18 and 20 of the present Convention.

2 Each Party shall adopt such legislative and other measures as may be necessary to establish as criminal offences when committed intentionally, an attempt to commit the offences established in accordance with Articles 18 and 20, paragraph a, of this Convention.

Article 22 - Corporate liability

1 Each Party shall adopt such legislative and other measures as may be necessary to ensure that a legal person can be held liable for a criminal offence established in accordance with this Convention, committed for its benefit by any natural person, acting either individually or as part of an organ of the legal person, who has a leading position within the legal person, based on:

a a power of representation of the legal person;

b an authority to take decisions on behalf of the legal person;

c an authority to exercise control within the legal person.

2 Apart from the cases already provided for in paragraph 1, each Party shall take the measures necessary to ensure that a legal person can be held liable where the lack of supervision or control by a natural person referred to in paragraph 1 has made possible the commission of a criminal offence established in accordance with this Convention for the benefit of that legal person by a natural person acting under its authority.

3 Subject to the legal principles of the Party, the liability of a legal person may be criminal, civil or administrative.

4 Such liability shall be without prejudice to the criminal liability of the natural persons who have committed the offence.

Article 23 - Sanctions and measures

1 Each Party shall adopt such legislative and other measures as may be necessary to ensure that the criminal offences established in accordance with Articles 18 to 21 are punishable by effective, proportionate and dissuasive sanctions. These sanctions shall include, for criminal offences established in accordance with Article 18 when committed by natural persons, penalties involving deprivation of liberty which can give rise to extradition.

2 Each Party shall ensure that legal persons held liable in accordance with Article 22 shall be subject to effective, proportionate and dissuasive criminal or non-criminal sanctions or measures, including monetary sanctions.

3 Each Party shall adopt such legislative and other measures as may be necessary to enable it to confiscate or otherwise deprive the instrumentalities and proceeds of criminal offences established in accordance with Articles 18 and 20, paragraph a, of this Convention, or property the value of which corresponds to such proceeds.

4 Each Party shall adopt such legislative or other measures as may be necessary to enable the temporary or permanent closure of any establishment which was used to carry out trafficking in human beings, without prejudice to the rights of bona fide third parties or to deny the perpetrator, temporary or permanently, the exercise of the activity in the course of which this offence was committed.

Article 24 - Aggravating circumstances

Each Party shall ensure that the following circumstances are regarded as aggravating circumstances in the determination of the penalty for offences established in accordance with Article 18 of this Convention:

a the offence deliberately or by gross negligence endangered the life of the victim;

b the offence was committed against a child;

c the offence was committed by a public official in the performance of her/his duties;

d the offence was committed within the framework of a criminal organisation.

Article 25 - Previous convictions

Each Party shall adopt such legislative and other measures providing for the possibility to take into account final sentences passed by another Party in relation to offences established in accordance with this Convention when determining the penalty.

Article 26 - Non-punishment provision

Each Party shall, in accordance with the basic principles of its legal system, provide for the possibility of not imposing penalties on victims for their involvement in unlawful activities, to the extent that they have been compelled to do so.

Chapter V - Investigation, prosecution and procedural law

Article 27 - Ex parte and ex officio applications

1 Each Party shall ensure that investigations into or prosecution of offences established in accordance with this Convention shall not be dependent upon the report or accusation made by a victim, at least when the offence was committed in whole or in part on its territory.

2 Each Party shall ensure that victims of an offence in the territory of a Party other than the one where they reside may make a complaint before the competent authorities of their State of residence. The competent authority to which the complaint is made, insofar as it does not itself have competence in this respect, shall transmit it without delay to the competent authority of the Party in the territory in which the offence was committed. The complaint shall be dealt with in accordance with the internal law of the Party in which the offence was committed.

3 Each Party shall ensure, by means of legislative or other measures, in accordance with the conditions provided for by its internal law, to any group, foundation, association or non-governmental organisations which aims at fighting trafficking in human beings or protection of human rights, the possibility to assist and/or support the victim with his or her consent during criminal proceedings concerning the offence established in accordance with Article 18 of this Convention.

Article 28 - Protection of victims, witnesses and collaborators with the judicial authorities

1 Each Party shall adopt such legislative or other measures as may be necessary to provide effective and appropriate protection from potential retaliation or intimidation in particular during and after investigation and prosecution of perpetrators, for:

a Victims;

b As appropriate, those who report the criminal offences established in accordance with Article 18 of this Convention or otherwise co-operate with the investigating or prosecuting authorities;

c witnesses who give testimony concerning criminal offences established in accordance with Article 18 of this Convention;

d when necessary, members of the family of persons referred to in subparagraphs a and c.

2 Each Party shall adopt such legislative or other measures as may be necessary to ensure and to offer various kinds of protection. This may include physical protection, relocation, identity change and assistance in obtaining jobs.

3 A child victim shall be afforded special protection measures taking into account the best interests of the child.

4 Each Party shall adopt such legislative or other measures as may be necessary to provide, when necessary, appropriate protection from potential retaliation or intimidation in particular during and after investigation and prosecution of perpetrators, for members of groups, foundations, associations or non-governmental organisations which carry out the activities set out in Article 27, paragraph 3.

5 Each Party shall consider entering into agreements or arrangements with other States for the implementation of this article.

Article 29 - Specialised authorities and co-ordinating bodies

1 Each Party shall adopt such measures as may be necessary to ensure that persons or entities are specialised in the fight against trafficking and the protection of victims. Such persons or entities shall have the necessary independence in accordance with the fundamental principles of the legal system of the Party, in order for them to be able to carry out their functions effectively and free from any undue pressure. Such persons or the staffs of such entities shall have adequate training and financial resources for their tasks.

2 Each Party shall adopt such measures as may be necessary to ensure co-ordination of the policies and actions of their governments' departments and other public agencies against trafficking in human beings, where appropriate, through setting up co-ordinating bodies.

3 Each Party shall provide or strengthen training for relevant officials in the prevention of and fight against trafficking in human beings, including Human Rights training. The training may be agency-specific and shall, as appropriate, focus on: methods used in preventing such trafficking, prosecuting the traffickers and protecting the rights of the victims, including protecting the victims from the traffickers.

4 Each Party shall consider appointing National Rapporteurs or other mechanisms for monitoring the anti-trafficking activities of State institutions and the implementation of national legislation requirements.

Article 30 - Court proceedings

In accordance with the Convention for the Protection of Human Rights and Fundamental Freedoms, in particular Article 6, each Party shall adopt such legislative or other measures as may be necessary to ensure in the course of judicial proceedings:

a the protection of victims' private life and, where appropriate, identity;

b victims' safety and protection from intimidation,

in accordance with the conditions under its internal law and, in the case of child victims, by taking special care of children's needs and ensuring their right to special protection measures.

Article 31 - Jurisdiction

1 Each Party shall adopt such legislative and other measures as may be necessary to establish jurisdiction over any offence established in accordance with this Convention, when the offence is committed:

a in its territory; or

b on board a ship flying the flag of that Party; or

c on board an aircraft registered under the laws of that Party; or

d by one of its nationals or by a stateless person who has his or her habitual residence in its territory, if the offence is punishable under criminal law where it was committed or if the offence is committed outside the territorial jurisdiction of any State;

e against one of its nationals.

2 Each Party may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, by a declaration addressed to the Secretary General of the Council of Europe, declare that it reserves the right not to apply or to apply only in specific cases or conditions the jurisdiction rules laid down in paragraphs 1 (d) and (e) of this article or any part thereof.

3 Each Party shall adopt such measures as may be necessary to establish jurisdiction over the offences referred to in this Convention, in cases where an alleged offender is present in its territory and it does not extradite him/her to another Party, solely on the basis of his/her nationality, after a request for extradition.

4 When more than one Party claims jurisdiction over an alleged offence established in accordance with this Convention, the Parties involved shall, where appropriate, consult with a view to determining the most appropriate jurisdiction for prosecution.

5 Without prejudice to the general norms of international law, this Convention does not exclude any criminal jurisdiction exercised by a Party in accordance with internal law.

Chapter VI - International co-operation and co-operation with civil society

Article 32 - General principles and measures for international co-operation

The Parties shall co-operate with each other, in accordance with the provisions of this Convention, and through application of relevant applicable international and regional instruments, arrangements agreed on the basis of uniform or reciprocal legislation and internal laws, to the widest extent possible, for the purpose of:

- preventing and combating trafficking in human beings;

- protecting and providing assistance to victims;

- investigations or proceedings concerning criminal offences established in accordance with this Convention.

Article 33 - Measures relating to endangered or missing persons

1 When a Party, on the basis of the information at its disposal has reasonable grounds to believe that the life, the freedom or the physical integrity of a person referred to in Article 28, paragraph 1, is in immediate danger on the territory of another Party, the Party that has the information shall, in such a case of emergency, transmit it without delay to the latter so as to take the appropriate protection measures.

2 The Parties to this Convention may consider reinforcing their co-operation in the search for missing people, in particular for missing children, if the information available leads them to believe that she/he is a victim of trafficking in human beings. To this end, the Parties may conclude bilateral or multilateral treaties with each other.

Article 34 - Information

1 The requested Party shall promptly inform the requesting Party of the final result of the action taken under this chapter. The requested Party shall also promptly inform the requesting Party of any circumstances which render impossible the carrying out of the action sought or are likely to delay it significantly.

2 A Party may, within the limits of its internal law, without prior request, forward to another Party information obtained within the framework of its own investigations when it considers that the disclosure of such information might assist the receiving Party in initiating or carrying out investigations or proceedings concerning criminal offences established in accordance with this Convention or might lead to a request for co-operation by that Party under this chapter.

3 Prior to providing such information, the providing Party may request that it be kept confidential or used subject to conditions. If the receiving Party cannot comply with such request, it shall notify the providing Party, which shall then determine whether the information should nevertheless be provided. If the receiving Party accepts the information subject to the conditions, it shall be bound by them.

4 All information requested concerning Articles 13, 14 and 16, necessary to provide the rights conferred by these articles, shall be transmitted at the request of the Party concerned without delay with due respect to Article 11 of the present Convention.

Article 35 - Co-operation with civil society

Each Party shall encourage state authorities and public officials, to co-operate with non-governmental organisations, other relevant organisations and members of civil society, in establishing strategic partnerships with the aim of achieving the purpose of this Convention.

Chapter VII - Monitoring mechanism

Article 36 - Group of experts on action against trafficking in human beings

1 The Group of experts on action against trafficking in human beings (hereinafter referred to as "GRETA"), shall monitor the implementation of this Convention by the Parties.

2 GRETA shall be composed of a minimum of 10 members and a maximum of 15 members, taking into account a gender and geographical balance, as well as a multidisciplinary expertise. They shall be elected by the Committee of the Parties for a term of office of 4 years, renewable once, chosen from amongst nationals of the States Parties to this Convention.

3 The election of the members of GRETA shall be based on the following principles:

a they shall be chosen from among persons of high moral character, known for their recognised competence in the fields of Human Rights, assistance and protection of victims and of action against trafficking in human beings or having professional experience in the areas covered by this Convention;

b they shall sit in their individual capacity and shall be independent and impartial in the exercise of their functions and shall be available to carry out their duties in an effective manner;

c no two members of GRETA may be nationals of the same State;

d they should represent the main legal systems.

4 The election procedure of the members of GRETA shall be determined by the Committee of Ministers, after consulting with and obtaining the unanimous consent of the Parties to the Convention, within a period of one year following the entry into force of this Convention. GRETA shall adopt its own rules of procedure.

Article 37 - Committee of the Parties

1 The Committee of the Parties shall be composed of the representatives on the Committee of Ministers of the Council of Europe of the member States Parties to the Convention and representatives of the Parties to the Convention, which are not members of the Council of Europe.

2 The Committee of the Parties shall be convened by the Secretary General of the Council of Europe. Its first meeting shall be held within a period of one year following the entry into force of this Convention in order to elect the members of GRETA. It shall subsequently meet whenever one-third of the Parties, the President of GRETA or the Secretary General so requests.

3 The Committee of the Parties shall adopt its own rules of procedure.

Article 38 - Procedure

1 The evaluation procedure shall concern the Parties to the Convention and be divided in rounds, the length of which is determined by GRETA. At the beginning of each round GRETA shall select the specific provisions on which the evaluation procedure shall be based.

2 GRETA shall define the most appropriate means to carry out this evaluation. GRETA may in particular adopt a questionnaire for each evaluation round, which may serve as a basis for the evaluation of the implementation by the Parties of the present Convention. Such a questionnaire shall be addressed to all Parties. Parties shall respond to this questionnaire, as well as to any other request of information from GRETA.

3 GRETA may request information from civil society.

4 GRETA may subsidiarily organise, in co-operation with the national authorities and the "contact person" appointed by the latter, and, if necessary, with the assistance of independent national experts, country visits. During these visits, GRETA may be assisted by specialists in specific fields.

5 GRETA shall prepare a draft report containing its analysis concerning the implementation of the provisions on which the evaluation is based, as well as its suggestions and proposals concerning the way in which the Party concerned may deal with the problems which have been identified. The draft report shall be transmitted for comments to the Party which undergoes the evaluation. Its comments are taken into account by GRETA when establishing its report.

6 On this basis, GRETA shall adopt its report and conclusions concerning the measures taken by the Party concerned to implement the provisions of the present Convention. This report and conclusions shall be sent to the Party concerned and to the Committee of the Parties. The report and conclusions of GRETA shall be made public as from their adoption, together with eventual comments by the Party concerned.

7 Without prejudice to the procedure of paragraphs 1 to 6 of this article, the Committee of the Parties may adopt, on the basis of the report and conclusions of GRETA, recommendations addressed to this Party (a) concerning the measures to be taken to implement the conclusions of GRETA, if necessary setting a date for submitting information on their implementation, and (b) aiming at promoting co-operation with that Party for the proper implementation of the present Convention.

Chapter VIII - Relationship with other international instruments

Article 39 - Relationship with the Protocol to prevent, suppress and punish trafficking in persons, especially women and children, supplementing the United Nations Convention against transnational organised crime

This Convention shall not affect the rights and obligations derived from the provisions of the Protocol to prevent, suppress and punish trafficking in persons, especially women and children, supplementing the United Nations Convention against trans­national organised crime, and is intended to enhance the protection afforded by it and develop the standards contained therein.

Article 40 - Relationship with other international instruments

1 This Convention shall not affect the rights and obligations derived from other international instruments to which Parties to the present Convention are Parties or shall become Parties and which contain provisions on matters governed by this Convention and which ensure greater protection and assistance for victims of trafficking.

2 The Parties to the Convention may conclude bilateral or multilateral agreements with one another on the matters dealt with in this Convention, for purposes of supplementing or strengthening its provisions or facilitating the application of the principles embodied in it.

3 Parties which are members of the European Union shall, in their mutual relations, apply Community and European Union rules in so far as there are Community or European Union rules governing the particular subject concerned and applicable to the specific case, without prejudice to the object and purpose of the present Convention and without prejudice to its full application with other Parties. (1)

4 Nothing in this Convention shall affect the rights, obligations and responsibilities of States and individuals under international law, including international humanitarian law and international human rights law and, in particular, where applicable, the 1951 Convention and the 1967 Protocol relating to the Status of Refugees and the principle of non-refoulement as contained therein.

Chapter IX - Amendments to the Convention

Article 41 - Amendments

1 Any proposal for an amendment to this Convention presented by a Party shall be communicated to the Secretary General of the Council of Europe and forwarded by him or her to the member States of the Council of Europe, any signatory, any State Party, the European Community, to any State invited to sign this Convention in accordance with the provisions of Article 42 and to any State invited to accede to this Convention in accordance with the provisions of Article 43.

2 Any amendment proposed by a Party shall be communicated to GRETA, which shall submit to the Committee of Ministers its opinion on that proposed amendment.

3 The Committee of Ministers shall consider the proposed amendment and the opinion submitted by GRETA and, following consultation of the Parties to this Convention and after obtaining their unanimous consent, may adopt the amendment.

4 The text of any amendment adopted by the Committee of Ministers in accordance with paragraph 3 of this article shall be forwarded to the Parties for acceptance.

5 Any amendment adopted in accordance with paragraph 3 of this article shall enter into force on the first day of the month following the expiration of a period of one month after the date on which all Parties have informed the Secretary General that they have accepted it.

Chapter X - Final clauses

Article 42 - Signature and entry into force

1 This Convention shall be open for signature by the member States of the Council of Europe, the non member States which have participated in its elaboration and the European Community.

2 This Convention is subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

3 This Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date on which 10 Signatories, including at least 8 member States of the Council of Europe, have expressed their consent to be bound by the Convention in accordance with the provisions of the preceding paragraph.

4 In respect of any State mentioned in paragraph 1 or the European Community, which subsequently expresses its consent to be bound by it, the Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date of the deposit of its instrument of ratification, acceptance or approval.

Article 43 - Accession to the Convention

1 After the entry into force of this Convention, the Committee of Ministers of the Council of Europe may, after consultation of the Parties to this Convention and obtaining their unanimous consent, invite any non-member State of the Council of Europe, which has not participated in the elaboration of the Convention, to accede to this Convention by a decision taken by the majority provided for in Article 20 d. of the Statute of the Council of Europe, and by unanimous vote of the representatives of the Contracting States entitled to sit on the Committee of Ministers.

2 In respect of any acceding State, the Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date of deposit of the instrument of accession with the Secretary General of the Council of Europe.

Article 44 - Territorial application

1 Any State or the European Community may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, specify the territory or territories to which this Convention shall apply.

2 Any Party may, at any later date, by a declaration addressed to the Secretary General of the Council of Europe, extend the application of this Convention to any other territory specified in the declaration and for whose international relations it is responsible or on whose behalf it is authorised to give undertakings. In respect of such territory, the Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date of receipt of such declaration by the Secretary General.

3 Any declaration made under the two preceding paragraphs may, in respect of any territory specified in such declaration, be withdrawn by a notification addressed to the Secretary General of the Council of Europe. The withdrawal shall become effective on the first day of the month following the expiration of a period of three months after the date of receipt of such notification by the Secretary General.

Article 45 - Reservations

No reservation may be made in respect of any provision of this Convention, with the exception of the reservation of Article 31, paragraph 2.

Article 46 - Denunciation

1 Any Party may, at any time, denounce this Convention by means of a notification addressed to the Secretary General of the Council of Europe.

2 Such denunciation shall become effective on the first day of the month following the expiration of a period of three months after the date of receipt of the notification by the Secretary General.

Article 47 - Notification

The Secretary General of the Council of Europe shall notify the member States of the Council of Europe, any State signatory, any State Party, the European Community, to any State invited to sign this Convention in accordance with the provisions of Article 42 and to any State invited to accede to this Convention in accordance with the provisions of Article 43 of:

a any signature;

b the deposit of any instrument of ratification, acceptance, approval or accession;

c any date of entry into force of this Convention in accordance with Articles 42 and 43;

d any amendment adopted in accordance with Article 41 and the date on which such an amendment enters into force;

e any denunciation made in pursuance of the provisions of Article 46;

f any other act, notification or communication relating to this Convention,

g any reservation made under Article 45.

EIROPAS PADOMES KONVENCIJA PAR CĪŅU PRET CILVĒKU TIRDZNIECĪBU

Preambula

Eiropas Padomes dalībvalstis un pārējās valstis, kuras parakstījušas šo Konvenciju,

uzskatīdamas, ka Eiropas Padomes mērķis ir panākt lielāku vienotību starp dalībvalstīm;

uzskatīdamas, ka cilvēku tirdzniecība ir cilvēktiesību pārkāpums un noziedzīgs nodarījums pret cilvēka cieņu un integritāti;

uzskatīdamas, ka cilvēku tirdzniecība var radīt upuru paverdzināšanu;

uzskatīdamas, ka upuru tiesību ievērošanai, upuru aizsardzībai un cilvēku tirdzniecības apkarošanai jābūt par svarīgākajiem mērķiem;

uzskatīdamas, ka visām darbībām vai iniciatīvām pret cilvēku tirdzniecību jābūt nediskriminējošām, ņemot vērā dzimumu līdztiesību, kā arī bērnu tiesības;

atsaucoties uz Dalībvalstu Ārlietu ministru 112. sesijā (2003. gada 14.-15.maijs) un Ministru Komitejas 114. sesijā (2004. gada 12.-13. maijs) pieņemtajām deklarācijām, kas pieprasa Eiropas Padomes pastiprinātu rīcību pret cilvēku tirdzniecību;

ņemot vērā 1950.gada Cilvēktiesību un pamatbrīvību aizsardzības konvenciju un tās protokolus;

ņemot vērā šādas Eiropas Padomes dalībvalstu Ministru Komitejas rekomendācijas: Rekomendāciju Nr. R (91) 11 par bērnu un jauniešu seksuālo izmantošanu, pornogrāfiju, prostitūciju un tirdzniecību; Rekomendāciju Nr. R (97) 13 attiecībā uz liecinieku iebaidīšanu un aizsardzības tiesībām; Rekomendāciju Nr. R (2000) 11 par cilvēku tirdzniecību seksuālas izmantošanas nolūkā un Rekomendāciju Rec (2001) 16 par bērnu aizsardzību pret seksuālu ekspluatāciju; Rekomendāciju Rec (2002) 5 par sieviešu aizsardzību pret vardarbību;

ņemot vērā šādas Eiropas Padomes Parlamentārās asamblejas rekomendācijas: Rekomendāciju 1325 (1997) par sieviešu tirdzniecību un piespiedu prostitūciju Eiropas Padomes dalībvalstīs; Rekomendāciju 1450 (2000) par vardarbību pret sievietēm Eiropā; Rekomendāciju 1545 (2002) par kampaņu pret sieviešu tirdzniecību; Rekomendāciju 1610 (2003) par migrāciju, kas saistīta ar sieviešu tirdzniecību un prostitūciju; Rekomendāciju 1611 (2003) par orgānu tirdzniecību Eiropā; Rekomendāciju 1663 (2004) - Iekšzemes verdzība: kalpones, aukles un līgavas pa pastu

ņemot vērā Eiropas Savienības Padomes 2002. gada 19. jūlija Pamatlēmumu par cilvēku tirdzniecības apkarošanu, Eiropas Savienības Padomes 2001. gada 15. marta Pamatlēmumu par upuru stāvokli kriminālprocesā un Eiropas Savienības Padomes 2004. gada 29. aprīļa Direktīvu par uzturēšanās atļaujām, kas izdotas tādiem trešo valstu valstspiederīgajiem, kuri ir cilvēku tirdzniecības upuri vai bijuši iesaistīti darbībās, kas veicina nelegālo imigrāciju, kuri sadarbojas ar kompetentajām iestādēm;

ievērojot Apvienoto Nāciju Konvenciju pret Transnacionālo organizēto noziedzību un tās Protokolu par cilvēku tirdzniecības, jo sevišķi tirdzniecības ar sievietēm un bērniem, novēršanu, apkarošanu un sodīšanu par to, nolūkā uzlabot viņiem sniegto aizsardzību un izstrādājot vispārējus standartus;

ievērojot citus starptautiskos juridiskos dokumentus, kas saistīti ar pasākumiem pret cilvēku tirdzniecību;

ievērojot nepieciešamību sagatavot vispārēju starptautisku juridisku dokumentu, kas pievēršas tirdzniecības upuru cilvēktiesībām un izveido speciālu uzraudzības mehānismu,

ir vienojušās par sekojošo:

I sadaļa - Mērķi, saturs, nediskriminācijas princips un definīcijas

1. pants - Konvencijas mērķi

1. Šīs Konvencijas mērķi ir:

a. novērst un apkarot cilvēku tirdzniecību, vienlaikus garantējot dzimumu līdztiesību;

b. aizsargāt tirdzniecības upuru cilvēktiesības, izstrādāt vispārējus pamatnoteikumus upuru un liecinieku aizsardzībai un atbalstam, vienlaikus garantējot dzimumu līdztiesību, kā arī nodrošināt efektīvu izmeklēšanu un kriminālvajāšanu;

c. veicināt starptautisko sadarbību pasākumos pret cilvēku tirdzniecību.

2. Lai nodrošinātu, ka Puses veic efektīvu tās noteikumu īstenošanu, šī Konvencija izveido speciālu uzraudzības mehānismu.

2. pants - Saturs

Šī Konvencija attiecas uz visiem cilvēku tirdzniecības veidiem - valsts iekšienē veiktiem vai starptautiskiem, ar organizēto noziedzību saistītiem vai nesaistītiem.

3. pants - Nediskriminācijas princips

Puses nodrošina šīs Konvencijas noteikumu īstenošanu, īpaši - pasākumus upuru tiesību aizsardzībai un veicināšanai, bez jebkādas dzimuma, rases, ādas krāsas, valodas, reliģiskās piederības, politisku vai citu uzskatu, nacionālās vai sociālās dabas, nacionālās minoritātes, īpašuma, dzimšanas vai citu apstākļu diskriminācijas.

4. pants - Definīcijas

Šajā Konvencijā:

a. "cilvēku tirdzniecība" nozīmē personu savervēšanu, pārvadāšanu, nodošanu, slēpšanu vai saņemšanu, lietojot draudus vai spēku, vai arī citus piespiešanas, aizvešanas, krāpšanas, maldināšanas, ļaunprātīgas izmantošanas veidus vai izmantojot personas neaizsargatības stāvokli, vai arī dodot vai saņemot materiālā vai citāda rakstura labumus, lai panāktu tās personas, kura kontrolē citu personu, piekrišanu ekspluatēšanas nolūkā. Ekspluatēšana obligāti ietver citu personu izmantošanu prostitūcijā vai citus seksuālās izmantošanas veidus, piespiedu darbu vai pakalpojumu sniegšanu, verdzību vai darbības, kas līdzinās verdzībai, kalpību vai orgānu izņemšanu;

b. "cilvēku tirdzniecības" upura piekrišana iecerētajai ekspluatēšanai, kas izklāstīta šā panta a) apakšpunktā, netiek ņemta vērā, ja izmantoti jebkādi no a) apakšpunktā izklāstītajiem līdzekļiem;

c. bērnu savervēšana, pārvadāšana, nodošana, slēpšana vai saņemšana ekspluatēšanas nolūkā ir uzskatāma par "cilvēku tirdzniecību", pat ja tā neietver nevienu no šā panta a) apakšpunktā izklāstītajiem līdzekļiem;

d. "bērns" nozīmē jebkuru personu, kas ir jaunāka par astoņpadsmit gadiem;

e. "upuris" nozīmē jebkuru fizisku personu, kas pakļauta cilvēku tirdzniecībai, kā tas izklāstīts šajā pantā.

II sadaļa - Novēršana, sadarbība un citi pasākumi

5. pants - Cilvēku tirdzniecības novēršana

1. Ikviena Puse veic pasākumus, lai nodibinātu vai stiprinātu nacionālo sadarbību starp dažādām institūcijām, kas ir atbildīgas par cilvēku tirdzniecības novēršanu un apkarošanu.

2. Ikviena Puse nodibina un/vai stiprina efektīvus darbības plānus un programmas, lai novērstu cilvēku tirdzniecību, ar tādiem līdzekļiem kā: pētījumi, informācija, izpratnes veidošana un izglītojošas akcijas, sociālas un ekonomiskas iniciatīvas un apmācības programmas, īpaši - personām, kas ir neaizsargātas pret cilvēku tirdzniecību, un profesionāļiem, kas nodarbojas ar jautājumiem, kas saistīti ar cilvēku tirdzniecību.

3. Ikviena Puse sekmē uz cilvēktiesībām balstītu pieeju un izmanto integrēto pieeju dzimumu nevienlīdzības novēršanai un uz bērna interesēm atbilstošu pieeju visu 2. punktā minēto darbības plānu un programmu izveidē, īstenošanā un novērtēšanā.

4. Ikviena Puse veic atbilstošus pasākumus, kādi ir nepieciešami, lai sekmētu legālu migrāciju, it sevišķi caur attiecīgu iestāžu precīzas informācijas izplatīšanu ar nosacījumiem, kuri veicina likumīgu ieceļošanu un uzturēšanos tās teritorijā.

5. Ikviena Puse veic īpašus pasākumus, lai samazinātu bērnu neaizsargātības stāvokli pret tirdzniecību, it īpaši radot viņiem drošu apkārtējo vidi.

6. Pasākumi, kas ieviesti saskaņā ar šo pantu, ietver, attiecīgajos gadījumos, nevalstiskās organizācijas, citas atbilstošas organizācijas un citus pilsoniskās sabiedrības elementus, kas uzņemas novērst cilvēku tirdzniecību un aizsargāt upurus vai sniegt viņiem palīdzību.

6. pants - Pasākumi, lai apkarotu pieprasījumu

Lai apkarotu pieprasījumu, kas veicina personu, it īpaši - sieviešu un bērnu, visu veidu ekspluatēšanu, kas noved līdz tirdzniecībai, ikviena Puse pieņem vai stiprina likumdošanas, administratīvos, izglītojošos, sociālos, kultūras vai citus pasākumus, ieskaitot:

a. pētījumus par labāko pieredzi, metodēm un stratēģijām;

b. atbildības izpratnes veidošanu un plašsaziņas līdzekļu un pilsoniskās sabiedrības svarīgo lomu pieprasījuma noskaidrošanā, kas ir viens no cilvēku tirdzniecības pamatcēloņiem;

c. informācijas kampaņas, iesaistot tajās inter alia arī publiskās iestādes un darbības plānu izstrādātājus;

d. preventīvus pasākumus, ieskaitot izglītojošās programmas zēniem un meitenēm, kas uzsver uz dzimumu balstītās diskriminācijas nepieņemamo dabu un tās postošās sekas, dzimumu līdztiesības un ikviena cilvēka cieņas un integritātes nozīmīgumu.

7. pants - Pasākumi uz robežas

1. Neierobežojot starptautiskās saistībās attiecībā uz personu brīvu kustību, Puses cik ir iespējams stiprina tādu robežas kontroli, kāda ir nepieciešama, lai novērstu un atklātu cilvēku tirdzniecību.

2. Ikviena Puse veic likumdošanas un citus atbilstošus pasākumus, lai iespēju robežās novērstu to, ka transporta līdzekļi, kurus izmanto komerciālie pārvadātāji, netiktu izmantoti tādu noziedzīgo nodarījumu izdarīšanai, kādi ir uzskaitīti šajā Konvencijā.

3. Attiecīgajos gadījumos un neierobežojot piemērojamās starptautiskās konvencijas, šādi pasākumi paredz noteikt komerciālajiem pārvadātājiem, ieskaitot jebkādu transportēšanas uzņēmumu vai jebkādu transporta līdzekļu īpašniekus vai operatorus, pienākumu pārliecināties, ka visiem pasažieriem ir ceļošanas dokumenti, kas nepieciešami iebraukšanai valstī.

4. Ikviena Puse saskaņā ar tās iekšējiem normatīvajiem aktiem veic nepieciešamos pasākumus, lai paredzētu sankcijas šā panta 3. punktā minētā pienākuma pārkāpumu gadījumos.

5. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai saskaņā ar tās iekšējiem normatīvajiem aktiem paredzētu iebraukšanas atteikumu vai vīzu anulēšanu personām, kas iesaistītas šajā Konvencijā minēto noziedzīgo nodarījumu izdarīšanā.

6. Puses stiprina sadarbību starp robežu kontroles dienestiem, tai skaitā izveidojot un uzturot tiešus sakaru kanālus.

8. pants - Dokumentu drošība un kontrole

Ikviena Puse veic tādus pasākumus, kādi ir nepieciešami, lai:

a. nodrošinātu, ka tās izdotajiem ceļošanas vai personu apliecinošajiem dokumentiem būtu tāda kvalitāte, ka tos nevarētu ļaunprātīgi izmantot un viegli viltot vai nelikumīgi pārveidot, pārkopēt vai izsniegt, un

b. nodrošinātu Puses vai tās vārdā izdoto ceļošanas vai personu apliecinošo dokumentu integritāti un drošību un novērstu to nelikumīgu izgatavošanu un izsniegšanu.

9. pants - Dokumentu likumība un derīgums

Puse saskaņā ar tās iekšējiem normatīvajiem aktiem pēc citas Puses pieprasījuma sapratīgā termiņā pārbauda to ceļošanas vai personu apliecinošu dokumentu likumību un derīgumu, kurus Puse izdevusi vai ir pamats uzskatīt, ka tie izdoti Puses vārdā, attiecībā uz kuriem pastāv aizdomas, ka tie tiek izmantoti cilvēku tirdzniecības nolūkos.

III sadaļa - Pasākumi, lai aizsargātu un veicinātu upuru tiesības, garantējot dzimumu līdztiesību

10. pants - Upuru identifikācija

1. Ikviena Puse nodrošina savas kompetentās iestādes ar personām, kas ir apmācītas un kvalificētās cilvēku tirdzniecības novēršanā un apkarošanā un upuru, ieskaitot bērnu, identificēšanā un palīdzības sniegšanā, kā arī nodrošina, ka dažādas iestādes sadarbojas viena ar otru un ar attiecīgām atbalsta organizācijām, lai upuri tiktu savlaicīgi identificēti, ņemot vērā upuru - sieviešu un bērnu īpašo stāvokli, un lai attiecīgos gadījumos izsniegtu uzturēšanās atļaujas saskaņā ar šīs Konvencijas 14. panta nosacījumiem.

2. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai, sadarbojoties ar citām Pusēm un attiecīgām atbalsta organizācijām, identificētu upurus. Ikviena Puse nodrošina, ka gadījumā, ja kompetentām iestādēm ir pietiekams pamats uzskatīt, ka persona ir cilvēku tirdzniecības upuris, šī persona nevar tikt pārvietota no tās teritorijas līdz laikam, kamēr kompetentās iestādes nav pabeigušas šīs Konvencijas 18. pantā noteiktā noziedzīga nodarījuma upura identifikācijas procesu un nodrošinājušas, ka persona saņem 12. panta 1. un 2. punktā paredzēto palīdzību.

3. Ja upura vecums ir neskaidrs un ir iemesls uzskatīt, ka upuris ir bērns, viņu uzskata par bērnu un viņam /viņai nodrošina īpašus aizsardzības pasākumus, līdz tiek pārbaudīts viņa/viņas vecums.

4. Tiklīdz bez pavadības atstātais bērns ir identificēts kā upuris, ikviena Puse:

a. nodrošina bērna pārstāvībai likumīgo aizbildni, organizāciju vai iestādi, kas rīkojas šī bērna vislabākajās interesēs;

b. veic nepieciešamos pasākumus, lai noskaidrotu bērna identitāti un valstisko piederību;

c. pieliek visas pūles, lai atrastu viņa/viņas ģimeni, ja tas ir bērna labākajās interesēs.

11. pants - Privātās dzīve aizsardzība

1. Ikviena Puse aizsargā upuru privāto dzīvi un identitāti. Upuru personas dati tiek glabāti un izmantoti atbilstoši Konvencijas par personu aizsardzību attiecībā uz personisko datu automātisku apstrādi (ETS Nr. 108) nosacījumiem.

2. Ikviena Puse veic tādus pasākumus, lai jo īpaši nodrošinātu, ka cilvēku tirdzniecības upura - bērna dati vai informācija, kas pieļauj viņa identificēšanu, netiek publiski atklāti caur plašsaziņas līdzekļiem vai kādiem citiem līdzekļiem, izņemot ārkārtēju apstākļu gadījumā, lai paātrinātu ģimenes locekļu noskaidrošanu vai citādi nodrošinātu bērna labklājību un aizsardzību.

3. Ikviena Puse apsver iespēju veikt pasākumus nolūkā mudināt plaš­saziņas līdzekļus aizsargāt upuru privāto dzīvi un identitāti ar pašregulējošiem vai re­glamentējošiem vai līdzreglamentējošiem pasākumiem saskaņā ar Eiropas Cilvēktiesību tiesas Cilvēktiesību un pamatbrīvību aizsardzības konvencijas 10. panta skaidrojumu.

12. pants - Palīdzība upuriem

1. Ikviena Puse veic tādus likumdošanas vai citus pasākumus, kādi ir nepieciešami, lai sniegtu palīdzību upuriem viņu fiziskajā, psiholoģiskajā un sociālajā atlabšanā. Šāda palīdzība ietver vismaz:

a. tādu dzīves līmeni, kāds spēj nodrošināt viņu eksistēšanu: atbilstošu un drošu pajumti, psiholoģisko un materiālo palīdzību,

b. pieeju neatliekamajai medicīniskajai ārstēšanai,

c. ja nepieciešams - tulkošanas un izskaidrošanas pakalpojumus,

d. padomu sniegšanu un informāciju, jo īpaši to, kas attiecas uz viņu likumīgajām tiesībām un pieejamajiem pakalpojumiem, tādā valodā, ko viņi saprot,

e. palīdzību, lai nodrošinātu, ka tiek pārstāvētas un ievērotas viņu tiesības un intereses uzsākta kriminālprocesa attiecīgajos posmos,

f. bērniem - pieeju izglītībai.

2. Ikviena Puse ievēro upura vajadzības pēc drošības un aizsardzības.

3. Turklāt ikviena Puse nodrošina upuriem nepieciešamo medicīnisko vai citu palīdzību, ja viņiem ir tiesības likumīgi uzturēties tās teritorijā un ja viņiem trūkst līdzekļu, bet ir nepieciešamība pēc šādas palīdzības.

4. Ikviena Puse pieņem noteikumus, saskaņā ar kuriem upuri, ja viņiem ir tiesības likumīgi uzturēties tās teritorijā, ir tiesīgi piekļūt darba tirgum, arodapmācībai un izglītībai.

5. Ikviena Puse, attiecīgajos gadījumos un saskaņā ar tās iekšējo normatīvo aktu nosacījumiem, veic pasākumus, lai sadarbotos ar nevalstiskajām organizācijām, citām atbilstošām organizācijām vai citiem pilsoniskās sabiedrības elementiem, kas nodarbojas ar palīdzības sniegšanu upuriem.

6. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai nodrošinātu, ka palīdzība upurim tiek sniegta neatkarīgi no viņa/viņas gatavības būt par liecinieku.

7. Lai ieviestu šajā pantā izklāstītos noteikumus, ikviena Puse nodrošina, ka palīdzība tiek sniegta, pamatojoties uz vienprātību un kompetenci, ievērojot neaizsargātības stāvoklī esošo personu īpašās vajadzības un bērnu tiesības uz pajumti, izglītību un atbilstošu veselības aprūpi.

13. pants - Atkopšanās un nogaidīšanas periods

1. Ikviena Puse savos iekšējos normatīvajos aktos paredz vismaz 30 dienu ilgu atkopšanās un nogaidīšanas periodu attiecīgajai personai, ja ir pamatots iemesls uzskatīt, ka viņa ir upuris. Šāds periods ir pietiekams, lai persona atkoptos un atgūtos no cilvēku tirgotāju ietekmes un/vai apzināti pieņemtu lēmumu par sadarbošanos ar kompetentām iestādēm. Šajā periodā pret upuri nevar piemērot izraidīšanu. Šis noteikums neierobežo kompetento iestāžu veiktajās darbības nevienā no attiecīgo nacionālo procedūru stadijām un jo īpaši, ja notiek izmeklēšana un kriminālvajāšana. Šajā periodā Puses atļauj iesaistītajām personām palikt to teritorijā.

2. Šajā periodā šā panta 1. punktā minētajām personām ir tiesības uz 12. panta 1. un 2. punktā minētajiem pasākumiem.

3. Puses nav saistītas ievērot šo periodu, ja ir apdraudēta sabiedriskā kārtība vai ja tiek atklāts, ka upura statuss ir bijis nepareizi noteikts.

14. pants - Uzturēšanās atļauja

1. Ikviena Puse upuriem izsniedz atjaunojamu uzturēšanās atļauju vienā vai otrā vai arī abās šādās situācijās:

a. kompetentā iestāde uzskata, ka viņu uzturēšanās valstī ir nepieciešama viņu personīgā stāvokļa dēļ,

b. kompetentā iestāde uzskata, ka viņu uzturēšanās valstī ir nepieciešama sadarbībai ar kompetentajām iestādēm izmeklēšanā un krimināllietas iztiesāšanā.

2. Uzturēšanās atļauju upuriem - bērniem, ja tā likumīgi nepieciešama, izsniedz bērna vislabākajās interesēs un, attiecīgajos gadījumos, atjauno saskaņā ar tiem pašiem nosacījumiem.

3. Uzturēšanās atļaujas neatjaunošanu vai anulēšanu nosaka Puses iekšējo normatīvo aktu nosacījumi.

4. Ja upuris iesniedz pieteikumu cita veida uzturēšanās atļaujas saņemšanai, saistītā Puse ņem vērā to, ka viņam vai viņai ir vai ir bijusi uzturēšanās atļauja saskaņā ar 1. punktu.

5. Ņemot vērā Pušu saistības, uz kurām attiecas šīs Konvencijas 40. pants, ikviena Puse nodrošina, ka atļaujas piešķiršana saskaņā ar šo noteikumu neierobežo tiesības lūgt vai izmantot patvērumu.

15. pants - Kompensācija un likumīgā atlīdzība

1. Ikviena Puse nodrošina, ka upuriem, sākot no pirmās saskarsmes ar kompetentajām iestādēm, ir pieeja informācijai par attiecīgām tiesu un administratīvajām procedūrām tajā valodā, kādu viņi saprot.

2. Ikviena Puse tās iekšējos normatīvajos aktos nodrošina upuru tiesības uz juridisku atbalstu un bezmaksas juridisko palīdzību saskaņā ar tās iekšējos normatīvajos aktos noteiktajiem nosacījumiem.

3. Ikviena Puse tās iekšējos normatīvajos aktos nodrošina upuru tiesības uz kompensācijas saņemšanu no likumpārkāpējiem.

4. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai upuriem garantētu kompensācijas saskaņā ar tās iekšējo normatīvo aktu nosacījumiem, piemēram, dibinot upuru kompensāciju fondus vai veicot pasākumus vai programmas, kas paredzētas upuru sociālajam atbalstam un sociālajai integrācijai un kas varētu būt finansētas no līdzekļiem, kuri iegūti 23. pantā noteikto pasākumu veikšanas rezultātā.

16. pants - Repatriācija un upuru atgriešanās

1. Puse, kuras pilsonis ir upuris vai kurā šai personai ir bijusi pastāvīgās uzturēšanās tiesības laikā, kad tā ieceļojusi uzņēmējas Puses teritorijā, pienācīgi rūpējoties par viņa vai viņas tiesībām, drošību un cieņu, veicina un bez nepamatotas vai pārmērīgas vilcināšanās akceptē viņa vai viņas atgriešanos.

2. Ja Puse upuri nosūta atpakaļ citai valstij, šāda atpakaļnosūtīšana notiek, pienācīgi rūpējoties par šīs personas tiesībām, drošību un cieņu, ņemot vērā jebkādas juridiskās procedūras, kas ir saistītas ar faktu, ka persona ir upuris, un ir vēlams, lai šī atpakaļnosūtīšana būtu labprātīga.

3. Pēc uzņēmējas Puses pieprasījuma, pieprasījuma saņēmēja Puse pārbauda, vai persona ir tās pilsonis vai arī tai bijusi pastāvīgās uzturēšanās tiesības tās teritorijā laikā, kad persona ieceļojusi uzņēmējas Puses teritorijā.

4. Lai atvieglotu upura, kam nav atbilstošu dokumentu, atpakaļnosūtīšanu, tā Puse, kuras pilsonis ir šī persona vai kurā viņam vai viņai bijušas pastāvīgās uzturēšanās tiesības laikā, kad persona ieceļojusi uzņēmējas Puses teritorijā, piekrīt pēc uzņēmējas Puses pieprasījuma izsniegt tādus ceļošanas dokumentus vai citu atļauju, kādi nepieciešami, lai dotu tiesības personai ieceļot un atgriezties tās teritorijā.

5. Ikviena Puse veic tādus likumdošanas vai citus pasākumus, kādi ir nepieciešami, lai izveidotu repatriācijas programmas, iesaistot tajās attiecīgas valsts un starptautiskās institūcijas un nevalstiskās organizācijas. Šo programmu mērķis ir izvairīties no situācijas, kas persona atkārtoti kļūst par upuri. Ikviena Puse pieliek visas pūles, lai veicinātu upuru reintegrēšanos sabiedrībā valstī, kurā viņš atgriežas, ieskaitot integrēšanos izglītības sistēmā un darba tirgū, jo īpaši caur profesionālo iemaņu iegūšanu un uzlabošanu. Attiecībā uz bērniem šīs programmas ietver tiesības uz izglītību un pasākumus, lai nodrošinātu adekvātu ģimenes vai attiecīgas aizgādības iestādes aprūpi vai uzņemšanu.

6. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai upuriem padarītu pieejamu, ja nepieciešams - sadarbībā ar jebkādu citu iesaistīto Pusi, kontaktinformāciju par iestādēm, kas var sniegt viņiem palīdzību valstī, uz kuru viņi ir nosūtīti atpakaļ vai kurā ir repatriēti, šādas iestādes var būt tiesību aizsardzības iestādes, nevalstiskās organizācijas, konsultējošie juristi un sociālās apgādes aģentūras.

7. Upurus - bērnus nesūta atpakaļ uz valsti, ja pēc riska un drošības novērtēšanas pastāv norāde, ka šāda atgriešanās nebūs bērna labākajās interesēs.

17. pants - Dzimumu līdztiesība

Ikviena Puses mērķis, piemērojot šajā sadaļā minētos pasākumus, ir veicināt dzimumu līdztiesību un izmantot integrēto pieeju dzimumu nevienlīdzības novēršanai šo pasākumu izstrādāšanā, īstenošanā un novērtēšanā.

IV sadaļa - Pastāvošais krimināllikums

18. pants - Cilvēku tirdzniecības kriminalizācija

Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai klasificētu šīs Konvencijas 4. pantā minētās darbības kā noziedzīgus nodarījumus, ja tās izdarītas ar nodomu.

19. pants - Upura pakalpojumu izmantošanas kriminalizācija

Ikviena Puse apsver iespēju veikt tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai savos iekšējos normatīvajos aktos klasificētu kā noziedzīgo nodarījumu pakalpojumu izmantošanu, kas ir šīs Konvencijas 4. panta a) apakšpunktā izklāstītās ekspluatācijas priekšmets, zinot, ka persona ir cilvēku tirdzniecības upuris.

20. pants - Ar ceļošanas vai personas apliecinošiem dokumentiem saistītu darbību kriminalizācija

Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai klasificētu kā noziedzīgos nodarījumus šādas darbības, ja tās izdarītas ar nodomu un cilvēku tirdzniecības veicināšanas nolūkā:

a. ceļošanas vai personas apliecinošo dokumentu viltošana,

b. šāda dokumenta iegūšana vai apgādāšana ar to,

c. citas personas ceļošanas vai personas apliecinošo dokumentu paturēšana, atņemšana, paslēpšana, sabojāšana vai iznīcināšana.

21. pants - Mēģinājums un atbalstīšana vai uzkūdīšana

1. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai klasificētu kā noziedzīgus nodarījumus atbalstīšanu vai uzkūdīšanu jebkādā no šīs Konvencijas 18. vai 20. pantā noteikto noziedzīgo nodarījumu veikšanā, ja tas darīts ar nodomu.

2. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai klasificētu kā noziedzīgus nodarījumus mēģinājumu veikt noziedzīgus nodarījumus, kādi ir noteikti šīs Konvencijas 18. un 20. punkta a) apakšpunktā, ja tas darīts ar nodomu.

22. pants - Korporatīvā atbildība

1. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai nodrošinātu, ka juridiska persona varētu tikt saukta pie atbildības par šajā Konvencijā minētajiem noziedzīgajiem nodarījumiem, kurus to labā veikusi jebkāda fiziska persona, darbojoties individuāli vai kā juridiskas personas iestādes daļa, kam ir vadošs amats juridiskajā personā, balstoties uz:

a. juridiskas personas pārstāvniecības tiesībām,

b. pilnvarām pieņemt lēmumus juridiskas personas vārdā,

c. pilnvarām veikt juridiskās personas vadību.

2. Ikviena Puse bez 1. punktā minētajiem gadījumiem veic tādus pasākumus, kādi ir nepieciešami, lai nodrošinātu, ka juridiska persona var tikt saukta pie atbildības gadījumā, ja 1. punktā minētās fiziskās personas uzraudzības vai kontroles trūkums devis iespēju fiziskai personai, kas darbojas saskaņā ar juridiskās personas pilnvarām, veikt šajā Konvencijā noteiktos noziedzīgos nodarījumus šīs juridiskās personas labā.

3. Saskaņā ar Puses tiesību principiem juridiskās personas atbildība var būt krimināla, civila vai administratīva.

4. Šāda atbildība neierobežo tiesības saukt pie kriminālatbildības arī fizisko personu, kas izdarījusi noziedzīgo nodarījumu.

23. pants - Sankcijas un pasākumi

1. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai nodrošinātu to, ka 18. un 21. punktā minētie noziedzīgie nodarījumi ir sodāmi ar efektīvām, samērīgām un atbilstošām sankcijām. Šīs sankcijas attiecībā uz 18. pantā minētajiem noziedzīgajiem nodarījumiem, ko izdarījusi fiziska persona, iekļauj sodus, kas ietver brīvības atņemšanu, kas var dot pamatu izraidīšanai.

2. Ikviena Puse nodrošina, ka juridiskas personas, kas atbild saskaņā ar 22. pantu, tiek pakļautas efektīvām, samērīgām un atbilstošām kriminālām vai citām sankcijām vai pasākumiem, ieskaitot naudas sodus.

3. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai dotu tiesības konfiscēt vai kā citādi atņemt šīs Konvencijas 18. un 20. panta a) apakšpunktā minēto noziedzīgo nodarījumu izdarīšanas rīkus un nelegāli iegūtos līdzekļus vai īpašumu, kura vērtība atbilst šādiem līdzekļiem.

4. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai dotu tiesības pastāvīgi vai uz laiku slēgt jebkādu iestādi, kas tika izmantota cilvēku tirdzniecībā, neierobežojot trešās puses bona fide tiesības vai neatļaujot likumpārkāpējiem pastāvīgi vai uz laiku veikt tādas darbības, ar kurām šis noziedzīgais nodarījums tika izdarīts.

24. pants - Atbildību pastiprinošiapstākļi

Ikviena Puse nodrošina, ka, nosakot sodu par šīs Konvencijas 18. pantā minētajiem noziedzīgajiem nodarījumiem, par atbildību pastiprinošiem apstākļiem tiek uzskatīti šādi apstākļi:

a. noziedzīgs nodarījums, kas ar iepriekšēju nodomu vai noziedzīgas nevērības dēļ ir apdraudējis upuru dzīvību,

b. noziedzīgs nodarījums, kas izdarīts pret bērnu,

c. noziedzīgs nodarījums, ko izdarījusi amatpersona, pildot savus pienākumus,

d. noziedzīgs nodarījums, kas pastrādāts organizētās grupas ietvaros.

25. pants - Iepriekšējās sodāmības

Ikviena Puse veic tādus likumdošanas un citus pasākumus, lai nodrošinātu iespēju ņemt vērā galīgos tiesas spriedumus, ko pieņēmusi cita Puse, nosakot sodu par šajā Konvencijā noteiktajiem noziedzīgajiem nodarījumiem.

26. pants - Nesodāmības noteikumi

Ikviena Puse saskaņā ar tās tiesību sistēmas pamatprincipiem nodrošina iespēju nepiespriest sodus cilvēku tirdzniecības upuriem par viņu līdzdalību nelikumīgās darbībās, ja viņi tika piespiesti to darīt.

V sadaļa - Izmeklēšana, kriminālvajāšana un procesuālais likums

27. pants - Ex parte un ex officio piemērošana

1. Ikviena Puse nodrošina, ka šajā Konvencijā noteikto noziedzīgo nodarījumu izmeklēšana vai kriminālvajāšana nav atkarīga no upura iesnieguma vai ziņojuma, vismaz ja noziedzīgais nodarījums tika izdarīts pilnībā vai daļēji tās teritorijā.

2. Ikviena Puse nodrošina, ka upuri var iesniegt iesniegumu viņu mītnes zemes kompetentām iestādēm par noziedzīgo nodarījumu, kas izdarīts citas Puses teritorijā. Ja iestādes, kas ir saņēmušas iesniegumu, nav kompetentās to izskatīt, tās nekavējoties pārsūta to tās Puses kompetentajām iestādēm, kuras teritorijā noziedzīgais nodarījums tika izdarīts. Iesniegums tiek izskatīta saskaņā ar tās Puses iekšējiem normatīvajiem aktiem, kurā noziedzīgs nodarījums tika izdarīts.

3. Ikviena Puse ar likumdošanas vai citu pasākumu palīdzību saskaņā ar tās iekšējo normatīvo aktu nosacījumiem nodrošina jebkādai grupai, labdarības fondam, asociācijai vai nevalstiskai organizācijai, kuru mērķi ir cīņa pret cilvēku tirdzniecību vai cilvēktiesību aizsardzība, iespēju palīdzēt un/vai atbalstīt upuri ar viņa vai viņas piekrišanu krimināllietas iztiesāšanas laikā attiecībā uz šīs Konvencijas 18. pantā noteiktu noziedzīgu nodarījumu.

28. pants - Upuru, liecinieku un personu, kas sadarbojas ar tiesību aizsardzības iestādēm, aizsardzība

1. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai nodrošinātu efektīvu un atbilstošu aizsardzību no iespējamās atriebības vai iebiedēšanas, it īpaši apsūdzēto izmeklēšanas un kriminālvajāšanas laikā un pēc tās:

a. upuriem,

b. attiecīgajos gadījumos - tiem, kas ziņo par šīs Konvencijas 18. pantā noteiktajiem noziedzīgiem nodarījumiem vai kā citādi sadarbojas ar izmeklēšanas vai kriminālvajāšanas iestādēm,

c. lieciniekiem, kas liecina par šīs Konvencijas 18. pantā noteiktajiem noziedzīgiem nodarījumiem,

d. ja nepieciešams - a) un c) apakšpunktā minēto personu ģimenes locekļiem.

2. Ikviena Puse veic tādu likumdošanas vai citus pasākumus, kādi ir nepieciešami, lai nodrošinātu un piedāvātu dažādus aizsardzības veidus. Tie var ietvert fizisko aizsardzību, pārvietošanu, personas apliecinošo dokumentu nomaiņu un palīdzību darba iegūšanā.

3. Upurim - bērnam tiek sniegti īpaši aizsardzības pasākumi, ņemot vērā bērna labākās intereses.

4. Ikviena Puse veic tādus likumdošanas vai citus pasākumus, kādi ir nepieciešami, lai nodrošinātu, ja nepieciešams, atbilstošu aizsardzību no iespējamās atriebības vai iebiedēšanas it īpaši apsūdzēto izmeklēšanas un kriminālvajāšanas laikā grupu, labdarības fondu, asociāciju vai nevalstisko organizāciju biedriem, kas veic 27. panta 3. punktā izklāstītās darbības.

5. Ikviena Puse šā panta īstenošanai apsver iespējas noslēgt līgumus vai vienošanās ar citām valstīm.

29. pants - Specializētās iestādes un koordinējošās institūcijas

1. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai nodrošinātu, ka personas vai organizācijas ir specializētās cilvēku tirdzniecības apkarošanā un upuru aizsardzībā. Šādām personām vai organizācijām saskaņā ar Puses tiesību sistēmas pamatprincipiem ir nepieciešama patstāvība, lai tās varētu veikt savas funkcijas efektīvi un bez jebkāda nepamatota spiediena. Šādām personām vai šādu organizāciju darbiniekiem ir atbilstoša apmācība un finansiālie resursi savu uzdevumu veikšanai.

2. Ikviena Puse veic tādus pasākumus, kādi ir nepieciešami, lai nodrošinātu savu valsts pārvaldes iestāžu un citu sabiedrisko organizāciju darbības plānu un rīcību saskaņošanu pret cilvēku tirdzniecību, attiecīgajos gadījumos - caur koordinējošo institūciju izveidošanu.

3. Ikviena Puse nodrošina vai stiprina attiecīgo amatpersonu apmācību cilvēku tirdzniecības novēršanā un apkarošanā, ieskaitot izglītošanu cilvēktiesībās. Apmācība var būt īpaši izstrādāta kādai aģentūrai un, ja lietderīgi, virzīta uz: šādas tirdzniecības novēršanas metodēm, tirgotāju kriminālvajāšanu un upuru tiesību aizsardzību, ieskaitot upuru aizsargāšanu no tirgotājiem.

4. Ikviena Puse apsver iespēju iecelt valsts ziņotājus vai izveidot citus mehānismus, lai uzraudzītu valsts institūciju pasākumus pret cilvēku tirdzniecību un valsts nacionālo normatīvo aktu noteikumu īstenošanu.

30. pants - Tiesas process

Saskaņā ar Cilvēktiesību un pamatbrīvību aizsardzības konvenciju un īpaši tās 6. pantu ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai tiesvedības gaitā nodrošinātu:

a. upuru privātās dzīves un, ja nepieciešams, identitātes aizsardzību,

b. upuru drošību un aizsardzību pret iebiedēšanu

saskaņā ar tās iekšējo normatīvo aktu nosacījumiem un upuru - bērnu gadījumā - īpaši rūpējoties par bērnu vajadzībām un nodrošinot viņu tiesības uz īpašiem aizsardzības pasākumiem.

31. pants - Jurisdikcija

1. Ikviena Puse veic tādus likumdošanas un citus pasākumus, kādi ir nepieciešami, lai nodibinātu jurisdikciju pār jebkādu šajā Konvencijā minēto noziedzīgo nodarījumu, ja tas izdarīts:

a. tās teritorijā vai

b. uz kuģa, kas brauc ar tās Puses karogu, vai

c. uz lidmašīnas, kas reģistrēta saskaņā ar tās Puses normatīvajiem aktiem, vai

d. ja to izdarījuši tās pilsoņi vai bezvalstnieki ar pastāvīgu dzīvesvietu tās teritorijā, ja noziedzīgais nodarījums ir sodāms saskaņā ar krimināllikumu teritorijā, kur tas izdarīts, vai ja noziedzīgais nodarījums ir izdarīts ārpus ikvienas valsts teritoriālās jurisdikcijas,

e. pret kādu no tās pilsoņiem.

2. Ikviena Puse laikā, kad tiek parakstīta šī Konvencija vai iesniegts glabāšanā tās ratifikācijas, akceptēšanas, apstiprināšanas vai pievienošanās dokuments, var iesniegt Eiropas Padomes ģenerālsekretāram adresētu deklarāciju, kurā tā norāda, ka patur tiesības nepiemērot vai piemērot tikai īpašos gadījumos vai nosacījumos jurisdikcijas noteikumus, kādi noteikti šā panta 1. punkta d) un e) apakšpunktā vai jebkurā citā punktā.

3. Ikviena Puse veic tādus pasākumus, kādi ir nepieciešami, lai nodibinātu jurisdikciju pār šajā Konvencijā minētiem noziedzīgiem nodarījumiem gadījumos, kad iespējamais likumpārkāpējs atrodas tās teritorijā un pēc izdošanas pieprasījuma viņš/viņa netiek izdota citai Pusei, pamatojoties vienīgi uz viņa/viņas pilsonību.

4. Ja vairāk kā viena Puse pieprasa jurisdikciju pār šajā Konvencijā noteiktu noziedzīgu nodarījumu, iesaistītās Puses, ja nepieciešams, konsultējas, lai noteiktu vispiemērotāko jurisdikciju kriminālvajāšanai.

5. Neierobežojot vispārējas starptautisko tiesību normas, šī Konvencija neizslēdz tādas kriminālās jurisdikcijas īstenošanu, ko viena Puse nodibinājusi saskaņā ar tās iekšējiem normatīvajiem aktiem.

VI sadaļa - Starptautiskā sadarbība un sadarbība ar pilsonisko sabiedrību

32. pants - Starptautiskās sadarbības vispārīgie principi un pasākumi

Puses sadarbojas viena ar otru saskaņā ar šīs Konvencijas noteikumiem un piemērojot attiecīgos starptautiskos un reģionālos dokumentus, vienošanās, kas noslēgtas, pamatojoties uz vienotu vai atbilstošu likumdošanu un iekšējiem normatīvajiem aktiem, visplašākajā iespējamā mērā ar nolūku:

- novērst un apkarot cilvēku tirdzniecību,

- aizsargāt upurus un sniegt viņiem palīdzību,

- veikt izmeklēšanu vai krimināllietas iztiesāšanu attiecībā uz šajā Konvencijā noteiktajiem noziedzīgiem nodarījumiem.

33. pants - Pasākumi attiecībā uz apdraudētām vai bezvēsts pazudušām personām

1. Ja Pusei, pamatojoties uz tās rīcībā esošo informāciju, ir pietiekams pamats uzskatīt, ka 28. panta 1. punktā minētās personas dzīvība, brīvība vai fiziskā integritāte ir apdraudēta citas Puses teritorijā, Puse, kurai ir šī informācija, šādā ārkārtējā gadījumā nosūta to bez vilcināšanās pēdējai Pusei, lai tā varētu veikt atbilstošus aizsardzības pasākumus.

2. Šīs Konvencijas Puses var apsvērt savstarpējās sadarbības pastiprināšanu bezvēsts pazudušo personu, sevišķi - pazudušo bērnu meklēšanā, ja pieejamā informācija liek uzskatīt, ka viņa/viņš ir cilvēku tirdzniecības upuris. Šim nolūkam Puses viena ar otru var noslēgt divpusējus vai daudzpusējus nolīgumus.

34. pants - Informācija

1. Pieprasījuma saņēmēja Puse nekavējoties informē pieprasījumu iesniedzēju Pusi par saskaņā ar šo sadaļu veiktās darbības rezultātu. Pieprasījuma saņēmēja Puse tāpat nekavējoties informē pieprasījumu iesniedzēju Pusi par jebkādiem apstākļiem, kas padara neiespējamu prasītās darbības izpildīšanu vai arī to ievērojami aizkavē.

2. Puse tās iekšējo normatīvo aktu robežās var bez iepriekšēja pieprasījuma nosūtīt citai Pusei informāciju, kas iegūta tās izmeklēšanas ietvaros, ja tā uzskata, ka šādas informācijas izpaušana varētu palīdzēt saņēmējai Pusei uzsākt vai veikt izmeklēšanu vai krimināllietas iztiesāšanu attiecībā uz šajā Konvencijā noteiktajiem noziedzīgiem nodarījumiem vai var būt par pamatu tās Puses sadarbības pieprasījumam saskaņā ar šo sadaļu.

3. Pirms šādas informācijas nosūtīšanas, tās iesniedzējas Puse var pieprasīt, lai informācija tiktu turēta slepenībā vai arī izmantota saskaņā ar nosacījumiem. Ja informācijas saņēmēja Puse nevar izpildīt šādu pieprasījumu, tā informē iesniedzēju Pusi, kura lemj, vai informācija ir jāsniedz. Ja saņēmēja Puse piekrīt informācijas izmantošanai saskaņā ar nosacījumiem, tā rīkojas saskaņā ar tiem.

4. Visa informācija, kas pieprasīta saistībā ar 13., 14. un 16. pantu un kas nepieciešama, lai nodrošinātu šajos pantos minētās tiesības, tiek nosūtīta ieinteresētajai Pusei bez vilcināšanās, saskaņā ar šīs Konvencijas 11. pantu.

35. pants - Sadarbība ar pilsonisko sabiedrību

Ikviena Puse mudina valsts iestādes un valsts amatpersonas sadarboties ar nevalstiskajām organizācijām, citām atbilstošām organizācijām un pilsoniskās sabiedrības locekļiem, lai izveidotu stratēģiskas partnerattiecības nolūkā sasniegt šīs Konvencijas mērķi.

VII sadaļa - Uzraudzības mehānisms

36. pants - Ekspertu darbības grupa pret cilvēku tirdzniecību

1. Ekspertu darbības grupa pret cilvēku tirdzniecību (turpmāk "GRETA") uzrauga, kā Puses ievieš šo Konvenciju.

2. GRETA sastāv no minimums 10 un maksimums 15 locekļiem, ņemot vērā dzimumu un ģeogrāfisko līdzsvaru, kā arī daudzdisciplīnu zināšanas. Locekļus ievēl Pušu Komiteja uz 4 gadiem ar vienreizēju termiņa pagarināšanas iespēju, izvēloties tos starp šīs Konvencijas Pušu valstu pilsoņiem.

3. GRETA locekļu ievēl saskaņā ar šādiem principiem:

a. viņus izvēlas no personu loka, kas ir ar augstu morāli, pazīstami ar savu kompetenci cilvēktiesību, upuru palīdzības un aizsardzības jomās un darbību pret cilvēku tirdzniecību vai kam ir profesionāla pieredze sfērās, ko aptver šī Konvencija,

b. viņi grupā ieņem individuālu posteni, ir neatkarīgi un objektīvi savu funkciju izpildē un var veikt savus pienākumus efektīvi,

c. grupā nevar būt divi locekļi no vienas un tās pašas valsts pilsoņiem,

d. viņi pārstāv galvenās tiesību sistēmas.

4. GRETA locekļu ievēlēšanas procedūru nosaka Ministru Komiteja pēc šīs Konvencijas Pušu konsultācijām un iegūstot to vienprātīgu piekrišanu viena gada laikā pēc šīs Konvencijas stāšanās spēkā. GRETA pieņem pati savus procedūras noteikumus.

37. pants - Pušu Komiteja

1. Pušu Komiteja sastāv no šīs Konvencijas Pušu dalībvalstu Eiropas Padomes Ministru Komitejas pārstāvjiem un šīs Konvencijas Pušu, kas nav Eiropas Padomes dalībvalstis, pārstāvjiem.

2. Pušu Komiteju sasauc Eiropas Padomes ģenerālsekretārs. Tās pirmo sēdi sasauc viena gada laikā pēc šīs Konvencijas stāšanās spēkā, lai ievēlētu GRETA locekļus. Turpmāk tā sanāk, kad viena trešdaļa no Pusēm, GRETA prezidents vai ģenerālsekretārs to pieprasa.

3. Pušu Komiteja pieņem pati savus iekšējās kārtības noteikumus.

38. pants - Procedūra

1. Izvērtēšanas procedūra, ko veic šīs Konvencijas Puses, ir sadalīta posmos; tās ilgumu nosaka GRETA. Katra posma sākumā GRETA izvēlas konkrētus noteikumus, uz kuriem balstās izvērtēšanas procedūra.

2. GRETA nosaka vispiemērotākos izvērtēšanu līdzekļus. GRETA var izveidot katram izvērtēšanas posmam savu aptaujas anketu, kas var kalpot par šīs Konvencijas Pušu ieviešanas izvērtēšanas pamatu. Šāda aptaujas anketa ir adresēta visām Pusēm. Puses sniedz savas atbildes uz aptaujas anketu, kā arī uz citiem GRETA informācijas pieprasījumiem.

3. GRETA var pieprasīt informāciju no pilsoniskās sabiedrības.

4. Papildus GRETA var organizēt valsts apmeklējumus sadarbībā ar valsts iestādēm un to ieceltajām "kontaktpersonām" un, ja nepieciešams, ar neatkarīgu valsts ekspertu palīdzību. Šajās vizītēs GRETAI var palīdzēt konkrētu nozaru speciālisti.

5. GRETA sagatavo ziņojuma projektu, kas satur tās analīzi attiecībā uz nosacījumu ieviešanu, uz kādiem balstīta izvērtēšana, kā arī tās priekšlikumus un ieteikumus attiecībā uz veidu, kā izvērtētā Puse varētu risināt identificētās problēmas. Ziņojuma projektu nosūta izvērtētajai Pusei komentāru sniegšanai. Gatavojot ziņojumu GRETA ņem vērā Puses komentārus.

6. Pamatojoties uz to, GRETA pieņem tās ziņojumu un secinājumus attiecībā uz pasākumiem, kurus pieņēmusi izvērtējamā Puse šīs Konvencijas noteikumu ieviešanai. Šo ziņojumu un secinājumus nosūta izvērtētajai Pusei un Pušu Komitejai. GRETA ziņojumu un secinājumus publisko no to pieņemšanas brīža kopā ar izvērtētās Puses komentāriem.

7. Neierobežojot šī panta 1. un 6. punkta procedūru, Pušu Komiteja, pamatojoties uz GRETA ziņojumu un secinājumiem, var pieņemt rekomendācijas, kas adresētas šai Pusei a) attiecībā uz pasākumiem, kādi būtu jāveic, lai īstenotu GRETA secinājums, ja nepieciešams, nosakot laiku, līdz kuram iesniedzama informācija par to veikšanu, un b) ar mērķi sekmēt sadarbību ar šo Pusi, lai pareizi ieviestu šo Konvenciju.

VIII sadaļa - Saistība ar citiem starptautiskajiem dokumentiem

39. pants - Saistība ar Protokolu par cilvēku tirdzniecības, jo sevišķi tirdzniecības ar sievietēm un bērniem, novēršanu, apkarošanu un sodīšanu par to, kas papildina Apvienoto Nāciju Konvenciju pret transnacionālo organizēto noziedzību

Šī Konvencija neietekmē tiesības un saistības, kas izriet no Protokola par cilvēku tirdzniecības, jo sevišķi tirdzniecības ar sievietēm un bērniem, novēršanu, apkarošanu un sodīšanu par to noteikumiem, kas papildina Apvienoto Nāciju Konvenciju pret transnacionālo organizēto noziedzību un kas paredzēts, lai uzlabotu tās sniegto aizsardzību un attīstītu tajā ietvertos standartus.

40. pants - Saistība ar citiem starptautiskajiem dokumentiem

1. Šī Konvencija neietekmē tiesības un saistības, kas noteiktas citos starptautiskos dokumentos, kuru Puses ir vai kļūs par šīs Konvencijas Pusēm un kuri ietver noteikumus šajā Konvencijā noteiktajos jautājumos, un nodrošina lielāku aizsardzību un palīdzību tirdzniecības upuriem.

2. Šīs Konvencijas Puses viena ar otru var noslēgt divpusējus vai daudzpusējus nolīgumus par šajā Konvencijā aplūkotajiem jautājumiem ar mērķi papildināt vai stiprināt tās noteikumus vai sekmēt tajā ietverto principu piemērošanu.

3. Neierobežojot šīs Konvencijas priekšmetu un mērķi un tās pilnīgu piemērošanu ar citām Pusēm, Puses, kas ir Eiropas Savienības dalībvalstis, savās savstarpējās attiecībās piemēro Kopienas un Eiropas Savienības noteikumus tiktāl, ciktāl Kopienas un Eiropas Savienības noteikumi, kas regulē attiecīgo jautājumu, ir piemērojami konkrētajam gadījumam.

4. Nekas no šīs Konvencijas neaizskar valstu un atsevišķu personu tiesības, saistības un atbildību saskaņā ar starptautiskajām tiesībām, ieskaitot starptautiskās humanitārās tiesības, starptautiskās cilvēktiesības un, jo īpaši, 1951. gada Konvenciju un 1967. gada Protokolu par bēgļu statusu un tajos ietverto neizraidīšanas principu.

IX sadaļa - Konvencijas grozījumi

41. pants - Grozījumi

1. Jebkādus priekšlikumus par grozījumiem Konvencijā Puse iesniedz Eiropas Padomes ģenerālsekretāram, kurš tos paziņo Eiropas Padomes dalībvalstīm, visiem Konvencijas parakstītājiem, visām Pušu valstīm, Eiropas Kopienai, visām tām valstīm, kuras ir uzaicinātas parakstīt šo Konvenciju saskaņā ar 42. panta noteikumiem, un visām tām valstīm, kuras ir uzaicinātas pievienoties šai Konvencijai saskaņā ar 43. panta noteikumiem.

2. Par jebkuru grozījumu, ko ierosinājusi kāda Puse, tiek informēta GRETA, kura iesniedz Ministru Komitejai savu atzinumu par piedāvāto grozījumu.

3. Ministru Komiteja izskata priekšlikumu par grozījumu un GRETA sniegto atzinumu un, konsultējoties ar šīs Konvencijas Pusēm un iegūstot to vienprātīgu piekrišanu, var pieņemt šo grozījumu.

4. Jebkura grozījuma teksts, ko ir pieņēmusi Ministru Komiteja saskaņā ar šā panta 3. punktu, tiek nosūtīts Pusēm akceptēšanai.

5. Jebkurš grozījums, kas ir pieņemts saskaņā ar šā panta 3. punktu, stājas spēkā tā mēneša pirmajā dienā, kurš seko viena mēneša periodam, skaitot no datuma, kad visas Puses ir paziņojušas ģenerālsekretāram par šī grozījuma akceptēšanu.

X sadaļa - Nobeiguma noteikumi

42. pants - Parakstīšana un stāšanās spēkā

1. Šo Konvenciju var parakstīt Eiropas Padomes dalībvalstis, tās valstis, kas nav Eiropas Padomes dalībvalstis, bet ir piedalījušās šīs Konvencijas izstrādāšanā, un Eiropas Kopiena.

2. Šo Konvenciju ratificē, akceptē vai apstiprina. Ratifikācijas, akceptēšanas vai apstiprināšanas dokumenti iesniedzami glabāšanā Eiropas Padomes ģenerālsekretāram.

3. Šī Konvencija stājas spēkā tā mēneša pirmajā dienā, kurš seko triju mēnešu periodam, skaitot no datuma, kurā desmit Konvencijas parakstītājas, no kurām vismaz astoņas ir Eiropas Padomes dalībvalstis, saskaņā ar iepriekšējā punkta noteikumiem ir apliecinājušas savu piekrišanu uzņemties Konvencijā paredzētās saistības.

4. Jebkurā citā 1. punktā minētā valstī vai Eiropas Kopienā, kas ir apliecinājušas savu piekrišanu uzņemties šajā Konvencijā paredzētās saistības vēlāk, Konvencija stājas spēkā tā mēneša pirmajā dienā, kurš seko triju mēnešu periodam, skaitot no datuma, kurā tiek iesniegti glabāšanā tās ratifikācijas, akceptēšanas vai apstiprināšanas dokumenti.

43. pants - Pievienošanās Konvencijai

1. Pēc šīs Konvencija stāšanās spēkā, Eiropas Padomes Ministru Komiteja, konsultējoties ar šīs Konvencijas Pusēm un iegūstot to vienprātīgu piekrišanu, ar lēmumu, kas pieņemts ar Eiropas Padomes statūtu 20. d. pantā noteikto balsu vairākumu un ar šīs Konvencijas valstu pārstāvju vienprātīgu balsojumu, kuras ir tiesīgas piedalīties Ministru Komitejā, var uzaicināt jebkuru valsti, kas nav Eiropas Padomes dalībvalsts un nav piedalījusies Konvencijas izstrādāšanā, pievienoties šai Konvencijai.

2. Katrā Valstī, kas pievienojas šai Konvencijai, tā stājas spēkā tā mēneša pirmajā dienā, kurš seko triju mēnešu periodam, skaitot no datuma, kurā šī Valsts iesniegusi Eiropas Padomes ģenerālsekretāram glabāšanā pievienošanās dokumentu.

44. pants - Teritoriālā piemērošana

1. Ikviena valsts vai Eiropas Kopiena, parakstot šo Konvenciju vai iesniedzot glabāšanā tās ratifikācijas, akceptēšanas, apstiprināšanas vai pievienošanās dokumentu, var norādīt teritoriju vai teritorijas, kurās šī Konvencija piemērojama.

2. Ikviena Puse jebkurā laikā vēlāk var iesniegt Eiropas Padomes ģenerālsekretāram adresētu deklarāciju, kurā tā norāda, ka paplašina šīs Konvencijas piemērošanas teritoriju, kas norādīta deklarācijā, un par kurām starptautiskajām attiecībām tā atbild vai kura vārdā tā ir pilnvarota uzņemties saistības. Šajā teritorijā Konvencija stājas spēkā tā mēneša pirmajā dienā, kurš seko triju mēnešu periodam, skaitot no dienas, kad ģenerālsekretārs ir saņēmis šādu deklarāciju.

3. Ikvienu deklarāciju, kas iesniegta saskaņā ar diviem iepriekšējiem panta punktiem par jebkuru teritoriju, kas norādīta attiecīgajā deklarācijā, var atsaukt ar Eiropas Padomes ģenerālsekretāram adresētu paziņojumu. Atsaukums stājas spēkā tā mēneša pirmajā dienā, kurš seko triju mēnešu periodam, skaitot no dienas, kad ģenerālsekretārs ir saņēmis šādu paziņojumu.

45. - Atrunas

Nekādas atrunas nevar veikt attiecībā uz jebkādu šīs Konvencijas noteikumu, izņemot 31. panta 2. punktu.

46. pants - Denonsēšana

1. Ikviena Puse var jebkurā laikā denonsēt Konvenciju, iesniedzot Eiropas Padomes ģenerālsekretāram adresētu paziņojumu.

2. Šāda denonsēšana stājas spēkā tā mēneša pirmajā dienā, kurš seko triju mēnešu periodam, skaitot no dienas, kad ģenerālsekretārs ir saņēmis šādu paziņojumu.

47. pants - Informēšana

Eiropas Padomes ģenerālsekretārs informē Eiropas Padomes dalībvalstis, visas parakstītājvalstis, Eiropas Kopienu, ikvienu valsti, kas uzaicināta parakstīt šo Konvenciju saskaņā ar 42. panta noteikumiem, un ikvienu valsti, kas uzaicināta pievienoties šai Konvencijai saskaņā ar 43. panta noteikumiem, par:

a. katru valsti, kas parakstījusi šo Konvenciju,

b. katru ratifikācijas, akceptēšanas, apstiprināšanas vai pievienošanās dokumenta iesniegšanu glabāšanā,

c. katru datumu, kad Konvencija stājas spēkā saskaņā ar tās 42. un 43. pantu,

d. katru grozījumu, kas pieņemts saskaņā ar 41. pantu, un datumu, kādā šis grozījums stājas spēkā,

e. katru denonsēšanu, kas veikta, izpildot 46. panta noteikumus,

f. katru citu ar šo Konvenciju saistītu darbību, paziņojumu vai informāciju,

g. katru atrunu, kas veikta saskaņā ar 45. pantu.
