prezidents izsludina šādu likumu:
Par Saprašanās memorandu starp Latvijas Republikas valdību un Sabiedroto spēku augstāko virspavēlniecību Eiropā, un Sabiedroto spēku augstākās virspavēlniecības transformācijas komandiera štābu par uzņemošās valsts atbalsta sniegšanu Ziemeļatlantijas līguma organizācijas operāciju/mācību īstenošanai

1.pants. Saprašanās memorands starp Latvijas Republikas valdību un Sabiedroto spēku augstāko virspavēlniecību Eiropā, un Sabiedroto spēku augstākās virspavēlniecības transformācijas komandiera štābu par uzņemošās valsts atbalsta sniegšanu Ziemeļatlantijas līguma organizācijas operāciju/mācību īstenošanai (turpmāk — Memorands) ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Memorandā paredzēto saistību izpildi koordinē Aizsardzības ministrija.

3.pants. Memorands stājas spēkā tā 10.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

4.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināms Memorands latviešu un angļu valodā.

SAPRAŠANĀS MEMORANDS STARP LATVIJAS REPUBLIKAS VALDĪBU UN SABIEDROTO SPĒKU AUGSTĀKO VIRSPAVĒLNIECĪBU EIROPĀ UN SABIEDROTO SPĒKU AUGSTĀKĀS VIRSPAVĒLNIECĪBAS TRANSFORMĀCIJAS KOMANDIERA ŠTĀBU PAR UZŅEMOŠĀS VALSTS ATBALSTA SNIEGŠANU ZIEMEĻATLANTIJAS LĪGUMA ORGANIZĀCIJAS OPERĀCIJU/MĀCĪBU ĪSTENOŠANAI

IEVADS

Latvijas Republikas valdība, kuru pārstāv Aizsardzības ministrija (AiM), un Sabiedroto spēku Augstākā virspavēlniecība Eiropā (SSAVE), un Sabiedroto spēku Augstākās virspavēlniecības transformācijas komandiera štābu (SSAVTKŠ), turpmāk saukti par Dalībniekiem:

ŅEMOT VĒRĀ 1949. gada 4. aprīlī parakstītā Ziemeļatlantijas Līguma noteikumus un, jo īpaši tā 3. pantu;

ŅEMOT VĒRĀ programmas "Partner­attiecības — mieram" pamatdokumentu, ko 1994. gada 10. janvārī pieņēmuši valstu un valdību vadītāji, kas piedalījās Ziemeļatlantijas Padomes sēdē (Pamatdokumentu);

ŅEMOT VĒRĀ 1995. gada 19. jūnijā parakstītā Ziemeļatlantijas līguma organizācijas dalībvalstu un valstu, kas piedalās programmā "Partnerattiecības — mieram", līguma par to bruņoto spēku statusu (PfP SOFA) un šā līguma 1995.gada 19.jūnijā parakstītā protokola noteikumus;

ŅEMOT VĒRĀ 1951. gada 19. jūnijā parakstītā Ziemeļatlantijas līguma organizācijas dalībvalstu līguma par to bruņoto spēku statusu (NATO SOFA) noteikumus;

ŅEMOT VĒRĀ 1952. gada 28. augustā parakstītā Protokola par starptautisko militāro štābu statusu, kas izveidoti saskaņā ar Ziemeļatlantijas līgumu (Parīzes protokols), noteikumus;

ŅEMOT VĒRĀ 1997.gada 19.decembrī parakstītā Papildu protokola Ziemeļatlantijas Līguma Organizācijas dalībvalstu un valstu, kas piedalās programmā "Partner­attiecības — mieram", līgumam par to bruņoto spēku statusu (turpmāk — Papildu protokols), noteikumus;

ŅEMOT VĒRĀ koncepciju par NATO vadībā un kontrolē esošo NATO spēku un koalīcijas spēku izvēršanu uz vai caur Latvijas Republikas teritorijai miera laikā, krīžu periodos, ārkārtas situāciju un konfliktu laikā NATO operāciju atbalstam;

ŅEMOT VĒRĀ koncepciju par mācībām un operācijām, ko paredzēts veikt, piedaloties NATO spēkiem, programmā "Part­nerattiecības mieram" (PfP) iesaistītajiem un citiem NATO vadītajiem spēkiem;

UN IEVĒROJOT Latvijas Republikas, turpmāk sauktas par Uzņemošo valsti, kā arī SSAVE, turpmāk sauktas par Stratēģisko pavēlniecību, vajadzības;

DALĪBNIEKI IR PANĀKUŠI ŠĀDU VIENOŠANOS:

PIRMAIS PANTS

DEFINĪCIJAS

Šī Saprašanās memoranda un tā atbalsta dokumentu nolūkā tiek izmantotas šādas definīcijas:

1.1 Spēki. Visi NATO vadīto spēku komponenti, tostarp viss personāls, dzīvnieki, materiāli un uzkrājumi, kā arī jebkuri šādu spēku civilie komponenti, kā noteikts NATO SOFA, Parīzes protokolā un atbilstošajos PfP dokumentos. Termins ietver arī kuģus, gaisa kuģus, transportlīdzekļus, krājumus, ekipējumu un munīciju, kā arī visus gaisa, sauszemes un jūras pārvadājumu resursus, līdz ar visiem to atbalsta dienestiem, tostarp līgumdarbiniekiem, kas īsteno spēku izvietošanu vai atbalsta šos spēkus.

1.2 NATO operācijas. Militāras darbības, tostarp mācības, vai stratēģisko, taktisko, tehniskās apkopes, mācību vai administratīvo militāro uzdevumu izpilde, ko veic spēki; kaujas norises process, tostarp uzbrukumi, karaspēka izvēršana, apgāde un manevri, kas jāveic, lai sasniegtu jebkuras kaujas vai kampaņas mērķus.

1.3 NATO komandieris. Militārs komandieris NATO komandķēdē.

1.4 NATO organizācijas. Štābi un organizētas spēku vienības, kas atrodas NATO pavēlniecībā un kontrolē.

1.5 Starptautiskais štābs. Starptautiskais militārais štābs NATO integrētajā komandstruktūrā. Ietver štāba pagaidu nodaļas vai vienības.

1.6 Nacionālie štābi. NATO pavēlniecībā un kontrolē esošo nacionālo spēku štābi.

1.7 Daudznacionālie štābi. Štābi, kas sakomplektēti no vairāk nekā vienas valsts militārpersonām, un kuri izveidoti saskaņā ar iesaistīto valstu vienošanos un atrodas NATO pavēlniecībā un kontrolē.

1.8 Nosūtošās valstis (NV). Valstis un štābi, vai to apakšvienības, kas izvieto savus spēkus UV teritorijā NATO operāciju atbalstam.

1.9 Uzņemošā valsts (UV). Latvijas Republika.

1.10 Stratēģiskā pavēlniecība (SP). Sabiedroto spēku Augstākais komandieris Eiropā (SSAKE) un Sabiedroto spēku Augstākais transformācijas komandieris (SSATK), kura štābi attiecīgi ir SSAVE un SSAVTKŠ.

1.11 Uzņemošās valsts atbalsts (UVA). Civilais un militārais atbalsts, ko miera laikā, ārkārtas situācijās, krīzes apstākļos un konfliktu laikā uzņemošā valsts sniedz sabiedroto spēkiem un organizācijām, kas izvietotas uzņemošās valsts teritorijā, teritoriālajos ūdeņos vai gaisa telpā, kā arī veic tur operācijas vai šķērso šo teritoriju, teritoriālos ūdeņus vai gaisa telpu.

1.12 Spēku aizsargāšana (SA). Visi pasākumi un līdzekļi, ko izmanto, lai samazinātu līdz minimumam personāla, objektu, ekipējuma un operāciju ne aizsargātību pret jebkuriem apdraudējumiem visās situācijās, nolūkā saglabāt spēku rīcības brīvību un operatīvo efektivitāti.

1.13 Izmaksas. Izdevumi, kas saistīti ar nacionālo, daudznacionālo vai starptautisko štābu, spēku vai NATO organizāciju izveidi, atbalstīšanu un uzturēšanu. Šajā Saprašanās memorandā un tā turpmākajos dokumentos:

a. NATO kopīgās izmaksas. Izmaksas, par kuru apmaksāšanu saskaņā ar iepriekšēju vienošanos kolektīvi atbildīga ir visa Alianse.

b. Dalītas izmaksas. Izmaksas, par kuru apmaksāšanu saskaņā ar iepriek­šēju vienošanos atbildīga vairāk nekā viena valsts. Vienošanās par dalītām izmaksām parasti pamatojas uz kārtību, kas sīki izklāstīta attiecīgajās tehniskajās vienošanās un/vai kopīgas izpildes vienošanās.

c. Valsts tiešās izmaksas. Izmaksas, kuru apmaksāšana uzskatāma par atsevišķas NV pienākumu.

1.14 NATO kopējais finansējums. Līdzekļi, kurus piešķir NATO dalībvalstis un kuri pēc attiecīgā apstiprinājuma pieejami ar NATO budžetu starpniecību, lai segtu kopīgās izmaksas, kas radušās, īstenojot šeit norādītās operācijas vai mācības.

1.15 Pievienošanās paziņojums (PP). Dokuments, kurā norādīts NV nodoms piedalīties UVA pasākumos saskaņā ar šā Saprašanās memoranda noteikumiem konkrētās NATO vadītās operācijas īstenošanai (piemēra PP pievienots kā B pielikums).

1.16 Nodomu protokols (NP). Dokuments, kurā norādīts NV nodoms piedalīties UVA pasākumos saskaņā ar šā Saprašanās memoranda noteikumiem, bet atbilstoši atsevišķām konkrētām atrunām. UV apstiprina, vai šīs atrunas UVA sniegšanai tai ir vai nav pieņemamas (piemēra NP pievienots kā B pielikums).

1.17 Tehniskā vienošanās (TV). Divpusēja papildu vienošanās par konkrēto NATO vadīto operāciju. Tajā sīki izklāstīti UV pienākumi un procedūras, sniedzot UVA NATO komandierim un NV.

1.18 Kopīgas izpildes vienošanās (KIV). Divpusēja papildu vienošanās, kurā noteiktas parakstītāju saistības, sniedzot un saņemot UVA. Tajā ietverta sīka informācija par nepieciešamo un sniedzamo atbalstu, ar atrašanās vietu saistītās izpildes procedūras un atlīdzinājuma vai maksājuma noteikumi.

1.19 Apvienotā Uzņemošās valsts atbalsta koordinācijas komiteja (AUVAKK). Speciāli izveidota komiteja, kuru kopīgi vada UV un NATO komandieris. Komiteja, kuras sastāvā ir visu NV, UV un NATO komandiera pilnvarotie pārstāvji, sapulcējas, lai attiecīgajos gadījumos saskaņotu nepieciešamās precizējošās vienošanās par UVA, tādas kā TV un KIV.

1.20 Operatīvie punkti. Punkti, kas izvietoti UV teritorijā, lai sniegtu operatīvo un/vai loģistikas atbalstu spēkiem NATO vadīto operāciju nodrošināšanai. Šie punkti ir stratēģiskās pavēlniecības atdalītās vienības, kas darbojas NATO komandiera vadībā un kontrolē.

1.21 Ja attiecīgā termina nozīme nav norādīta šajā Saprašanās memorandā, tiek izmantota NATO terminu un definīciju vārdnīca (AAP—6).

OTRAIS PANTS

MĒRĶIS

2.1 Šā Saprašanās memoranda mērķis ir NATO operāciju laikā noteikt darbības plānu un procedūras, kas reglamentē operatīvo punktu izveidi un UVA sniegšanu NATO spēkiem UV vai no UV sniedzot atbalstu šiem spēkiem.

2.2 Šis Saprašanās memorands un tā turpmākie dokumenti ir paredzēti, lai izveidotu pamatu plānošanai, ko veic kompetenta UV iestāde un NATO komandieris, plānojot UVA vienošanās, kuras attiecas uz dažādām NATO vadītajām operācijām. Šie pamatuzdevumi ietver tādus uzdevumus, kuriem izvietojamie spēki jau noteikti, un arī tādus uzdevumus, kuriem spēki vēl jāizvēlas.

TREŠAIS PANTS

DARBĪBAS JOMA UN VISPĀRĒJIE NOTEIKUMI

3.1 NATO vai PfP SOFA, Parīzes protokola un Papildu protokola, kā arī jebkuru citu attiecīgo spēkā esošu vienošanos starp SP un UV noteikumi attiecas uz visām NATO operācijām.

3.2 UV atzīst, ka operatīvie punkti, kas izveidoti šā Saprašanās memoranda īstenošanas gaitā, ir attiecīgās SP atdalītās vienības un šādu vienību struktūrvienības ir SP iestādes. Izveidojamie punkti tiks norādīti turpmākajos papildus dokumentos. Vadības un kontroles sistēma tiks noteikta attiecīgajos operatīvajos plānos.

3.3 Šis Saprašanās memorands atbilst NATO doktrīnai un politikai, un tas ir jumta vienošanās un ietvars UVA nodrošināšanai.

3.4 NATO operāciju ietvaros izvietotajiem spēkiem UV sniedz maksimālo atbalstu atkarībā no iespējām un praktiskajiem ierobežojumiem, ko rada attiecīgajā brīdī pastāvošie apstākļi. Sīkāka informācija par šo atbalstu tiks sniegta turpmākajos papildus dokumentos.

3.5 Šā Saprašanās memoranda noteikumi ir spēkā miera laikā, ārkārtas, krīzes un konflikta situācijās, vai arī starptautiska saspīlējuma periodos, kā to kopīgi noteikušas UV un NATO iestādes.

3.6 Kaut arī NV ir aicinātas piedalīties NATO vadītajās operācijās un pieņemt šā Saprašanās memoranda kā jumta dokumenta noteikumus, saskaņā ar kuriem UV sniedz UVA, katrā atsevišķā gadījumā UV var ievērot specifiskos divpusējos līgumus, kas noslēgti ar atsevišķām valstīm.

3.7 UV un SP var nozīmēt pārstāvjus, kas apspriež un vienojas par turpmākiem papildus dokumentiem, ar kuriem šis Saprašanās memorands tiek papildināts un precizēts.

3.8 Šajā Saprašanās memorandā aplūkoto NATO vadīto operāciju īstenošanai var būt nepieciešamas daudznacionālā atbalsta gaisa spēku operācijas, kurās piedalās gaisa kuģi (tai skaitā helikopteri), un gadījumā, ja izmanto ostas, var būt nepieciešami tirdzniecības un militārā atbalsta kuģi. UV atzīst, ka šādu gaisa kuģu, (tai skaitā helikopteru), kuģu un to apkalpju iebraukšana UV teritoriālajās zonās un pārvietošanās caur tām notiks saskaņā ar kopējo atļauju, kas izsniegta uz operācijas laiku. UV risina/kontrolē visus jautājumus, kas saistīti ar šo atļauju.

PIENĀKUMI

Saskaņā ar šā Saprašanās memoranda noteikumiem:

5.1 Uzņemošā valsts.

a. Papildu dokumentu sagatavošanas laikā un izmaiņu gadījumā, un pēc šo dokumentu izstrādes pabeigšanas, UV savlaicīgi sniedz paziņojumu attiecīgajam NATO komandierim par savām iespējām vai jebkuru UVA spēju samazināšanos. UV ņem vērā, ka NATO plānotāji paļaujas uz izstrādātajiem šā Saprašanās memoranda papildu dokumentiem, un ka viņiem savlaicīgi jāsaņem informācija par plānotajām izmaiņām valsts iestādēs un spējās.

b. Lai sniegtu atbalstu, UV veic nepieciešamos pasākumus attiecībā uz atbalsta līdzekļiem, tostarp civilajiem un komerciālajiem līdzekļiem. komerciāli iepērkamos līdzekļus iegūst konkursa procesā no pretendenta, kas piekrīt viszemākajai cenai.

c. UV kārto administratīvo un finanšu uzskaiti, kas nepieciešama, lai noteiktu atlīdzību par spēkiem piešķirtajiem resursiem. Grāmatvedības dokumentus, kuros dokumentēti darījumi, ko finansē ar NATO budžetu starpniecību, dara pieejamus NATO, kad tas nepieciešams revīzijas vajadzībām.

d. UV piegādāto preču un sniegto pakalpojumu standarts atbilst prasībām, kas noteiktas papildu dokumentos ietvertajā informācijā.

e. UV saglabā kontroli pār saviem UVA resursiem, ja vien tā netiek atbrīvota no pienākuma kontrolēt šādus resursus.

f. Pirms katras NATO vadītās operācijas UV iesniedz cenrādi par jebkuru attiecīgo vai noteikto UV atbalstu.

g. UV lūdz NV akceptēt šā Saprašanās memoranda noteikumus vai nu ar pievienošanās paziņojumu, vai nodomu protokolu.

h. UV nosaka procedūras, lai nodrošinātu medicīnisko saikni starp UV un NV, tai skaitā medicīniskajām kontaktpersonām.

i. UV (saskaņojot ar NATO komandieri) nodrošina spēkiem medicīnisko un zob­ārstniecības atbalstu, kuru pēc tādiem pašiem noteikumiem kā UV militārpersonām sniedz UV militārais personāls/iestādes.

j. Papildu dokumentu sagatavošanas laikā UV iesniedz NATO komandierim to veselības aizsardzības, drošības, ekoloģisko un lauksaimniecības noteikumu kopijas, kuras var attiekties uz NATO vadīto operāciju, kā arī jebkuru tādu noteikumu kopijas, kas regulē bīstamo materiālu uzglabāšanu, pārvietošanu vai iznīcināšanu.

5.2 NATO komandieris

a. NATO komandieris, cik vien iespējams, nodrošina, lai papildu dokumentos būtu norādīts nepieciešamā atbalsta veids, apjoms un kvalitāte. Jāievēro, ka pamatuzdevuma un spēku struktūru nevar norādīt pirms tā nav noteikta operācijas plānā (OPLAN), operatīvajā pavēlē (OPAV) vai mācību operatīvajā pavēlē (MOPAV). Cik ātri vien iespējams, NATO komandieris sniedz papildinformāciju, kas UV nepieciešama plānošanai.

b. NATO komandieris savlaicīgi sniedz UV informāciju par jebkurām apstākļu izmaiņām un attiecīgā gadījumā ierosina izdarīt grozījumus papildu dokumentos.

c. NATO komandieris nosaka, vai ir pieejams kopējais finansējums, un kādas prasības jāizpilda, lai iegūtu tiesības uz kopējo finansējumu.

d. NATO komandieris nosaka vajadzīgo UVA un nosaka tā prioritāti, kā arī apstiprina kopīgo izmaksu izcenojumus.

e. NATO komandieris nodrošina finansiālās atlīdzības atmaksu UV par saskaņoto UVA, ja to maksā, izmantojot kopējo finansējumu. Visos pārējos gadījumos NATO komandieris, cik tas iespējams, sniedz palīdzību finansiālo saistību nokārtošanā starp UV un NV.

f. Ja NV prasības ir pretrunā ar NATO komandiera resursu sadales prioritātēm, attiecīgais NATO komandieris atrisina domstarpības ar iesaistīto NV.

g. NATO komandieris nosaka prasības attiecībā uz personālu un citas prasības, kas jāievēro, lai varētu darboties NV izveidotie objekti.

h. NATO komandieris palīdz standartizēt atbalsta prasības un izmaksas sarunu procesā un/vai AUVAKK.

5.3 Nosūtošās valstis

a. NV var izlemt piedalīties UVA struktūrā un procedūrās, akceptējot šā Saprašanās memoranda noteikumus PP, vai arī pieņemot NP konkrētai NATO operācijai.

b. NV norāda UVA prasības UV un atbildīgajam NATO komandierim.

c. Lai apspriestu prasības attiecībā uz valsts tiešajām izmaksām, NV piedalās sarunās par UVA AUVAKK sēdēs, vai arī apspriež tieši ar UV, ja AUVAKK nav izveidota. NV veic tiešos maksājumus vai izmaksā tiešo atlīdzību UV par UVA tikai par pakalpojumiem, ko sniedz no militārajiem avotiem, ja vien saskaņā ar vienošanos neizmanto citas maksājuma procedūras. Saskaņā ar UV un NV noslēgto līgumu noteikumiem, par atbalstu, ko sniedz no komerciālajiem vai civilajiem līdzekļiem, NV samaksā tieši UV.

d. Ja izveidota AUVAKK, NV nosūta pilnvarotos darbiniekus, kas šajā komitejā piedalās UVA apspriešanā.

e. Ja mainījušās UVA prasības, NV par šīm izmaiņām ziņo UV un attiecīgajam NATO komandierim, un iesniedz pārskatītās UVA prasības un/vai ziņojumus par stāvokli.

f. NV ir atbildīga par jebkuru UN sniegto civilo medicīnisko vai zobārstniecības pakalpojumu izmaksu segšanu.

g. NV ievēro UV veselības aizsardzības, drošības, ekoloģiskie un lauksaimniecības noteikumi un procedūras, kas noteiktas operatīvajiem punktiem, kā arī visi UV noteikumi, kas regulē bīstamo materiālu uzglabāšanu, pārvietošanu vai iznīcināšanu.

SESTAIS PANTS

FINANŠU NOTEIKUMI

6.1 Saskaņā ar savstarpējo vienošanos un/vai starptautiskajām konvencijām, starptautisko štābu dienesti, operatīvie punkti, NATO piederošie un/vai fraktētie kuģi, gaisa kuģi, transportlīdzekļi, degviela un eļļas (POL), un spēki, kas nodoti NATO rīcībā, ir atbrīvoti no visiem nodokļiem, nodevām, valsts nodevām, maksām un citiem līdzīga veida maksājumiem.

6.2 Parīzes protokolu, Papildu protokolu un starptautiskās paražu tiesību normas, kas garantē neaizskaramību un privilēģijas sabiedroto spēku štābiem, piemēro attiecībā uz jebkuriem starptautiskajiem štābiem, štābu struktūrvienībām, atdalītajām vienībām, kas NATO vadītās operācijas īstenošanas laikā var tikt izvietotas UV.

6.3 Ja minētos objektus nav iespējams pilnībā atbrīvot no nodokļiem, nodevām, maksām un līdzīgiem maksājumiem, tie netiek iekasēti par likmi, kas augstāka par UV bruņotajiem spēkiem piemēroto likmi. Visi šie izdevumi jāapmaksā tādā veidā, lai būtu jāievēro pēc iespējas mazāk saistīto administratīvo prasību.

6.4 Finanšu darījumus, tostarp naudas līdzekļu pārskaitījumus un rēķinu atvēršanu jebkurā valsts bankas iestādē veic, neiekasējot nekāda veida maksas vai nodevas. Finanšu darījumus, tostarp naudas līdzekļu pārskaitījumus un rēķinu atvēršanu jebkurā privātā bankas iestādē arī veic pēc iespējas, neiekasējot nekāda veida maksas vai nodevas. Kur pilnīgs atbrīvojums no maksām un nodevām nav iespējams, tas netiek iekasēti par likmi, kas augstāka par UV bruņotajiem spēkiem piemēroto likmi.

6.5 Galīgos finanšu nosacījumus, it īpaši tos, kas saistīti ar NATO kopējo finansējumu, var būt iespējams noteikt tikai pirms pašas NATO operācijas īstenošanas sākuma. Visiem finanšu nosacījumiem, par kuriem panākta iepriekšēja vienošanās, tomēr jāatbilst maksimālajām iespējām, kas noteiktas NATO finansiālajās saistībās. Izdevumiem, kas pirms to segšanas saskaņā ar speciālu vienošanos nav atzīti par NATO finansētiem izdevumiem, NATO kopējais finansējums netiek piešķirts.

6.6 Papildu dokumentos sniegti sākotnējie tāmes aprēķini, un šie dokumenti ir pamats, lai izmaksas varētu klasificēt kā NATO kopīgās izmaksas (attiecīgos gadījumos), dalītas izmaksas vai valsts tiešās izmaksas.

6.7 Ja NATO komandieris izlemj, ka attiecīgās izmaksas drīkst un var atļauties segt no NATO kopējā finansējuma (no apstiprinātām budžeta dotācijām), SP atļauj piešķirt kopējo finansējumu šo izmaksu segšanai, un SP veic tiešo maksājumu vai arī atmaksā attiecīgo summu UV.

6.8 Ja attiecīgās izmaksas tiek noteiktas par tādām, kas jāapmaksā vairāk kā vienai valstij, tās var uzskatīt par dalītām izmaksām, un saskaņā ar iesaistīto valstu savstarpējo vienošanos tās var sadalīt pēc apstiprinātās izmaksu dalīšanas formulas, kas ietverta TV vai citos papildu dokumentos.

6.9 Par UV nodrošināto civilo un militāro materiālu, kā arī UV sniegtajiem pakalpojumiem netiek ņemta augstāka maksa kā no UV bruņotajiem spēkiem, un šajā maksā neietilpst administratīvās vai pieskaitāmās papildu izmaksas, taču tā var tikt koriģēta atkarībā no piegādes grafika, piegādes vietas vai līdzīgiem apsvērumiem. Par atbalstu, ko sniedz militārpersonas, atlīdzību neizmaksā.

6.10 NATO komandieris un NV var noslēgt tiešos līgumus ar komerciālajiem piegādātājiem par piegādēm, pakalpojumiem vai citu atbalstu.

6.11 NATO piederošie transportlīdzekļi un NV militārie transportlīdzekļi ir iepriekš apdrošināti un šādā statusā var tikt lietoti bez komerciālās apdrošināšanas.

6.12 UV neuzņemas nekādu finansiālu atbildību NATO komandiera vai NV uzdevumā, izņemot gadījumus, kad iepriekš šādu lūgumu īpaši izteicis pilnvarotais pārstāvis, un ja vien pienākums veikt izdevumu apmaksu nav saskaņots. Turklāt nekādas norēķinu saistības netiek kārtotas, kamēr SP vai NV attiecīgajos gadījumos nav akceptējušas attiecīgos papildu dokumentus un nolēmušas tos ieviest.

6.13 Finansējums netiek piešķirts saistībā ar šo Saprašanās memorandu, un šis dokuments neuzliek NATO komandierim vai NV konkrētas finansējuma nodrošināšanas saistības. Sīki finanšu nosacījumi un atlīdzības izmaksas procedūras tiks norādītas papildu dokumentos.

6.14 Operatīvo punktu izveidošana NATO operācijas atbalstam neietver infrastruktūras izbūvi vai atjaunošanu.

SEPTĪTAIS PANTS

JURIDISKIE APSVĒRUMI

7.1 sP veic tiesiskas darbības vai var pilnvarot citus veikt šādas darbības, kas nepieciešamas, lai izpildītu pamatuzdevumus, tostarp izmantot tiesības slēgt līgumus, iesaistīties tiesvedībā vai administratīvā tiesvedībā, iegādāties un pārdot īpašumu, kā arī veikt vai pilnvarot veikt citas tiesiskas darbības.

7.2 UV teritorijā izvietoto spēku statusu nosaka saskaņā ar NATO vai PfP SOFA, Parīzes protokolu un/vai Vēlāko Papildprotokolu.

7.3 Ekipējums, krājumi, produkti un materiāli, kas uz laiku ievesti UV teritorijā un izvesti no tās saistībā ar NATO operāciju, ir atbrīvoti no visām nodevām, nodokļiem un maksām. Citas muitas procedūras attiecīgajos gadījumos tiek noteiktas saskaņā ar NATO vai PfP SOFA, Parīzes protokolu un Papildu protokolu.

7.4 Prasības, kas neattiecas uz līgumsaistībām, kas izriet no šā Saprašanās memoranda izpildes vai radušās saistībā ar tā izpildi, izskata saskaņā ar NATO vai PfP SOFA noteikumiem.

7.5 Prasības, kas izriet no līguma, ierosina un izskata UV, ievērojot kārtību, kas noteikta valsts līgumiem, kā arī saskaņā ar UV likumiem, attiecīgajos gadījumos saņemot atlīdzību no NATO komandiera vai NV.

ASTOTAIS PANTS

SPĒKU AIZSARGĀŠANA

8.1 NATO stacionārajiem štābiem, operācijām, apmācībām un mācībām izplāno visaptverošu un efektīvu FP, kas tiek sīki aprakstīts OPLAN, EXPI vai papildu nolīgumos. FP īsteno saskaņā ar NATO politiku un procedūrām un realizē atbilstoši NATO vai PfP SOFA. Pieprasītā vai nodrošinātā FP nekādā gadījumā nedrīkst būt pretrunā ar NATO vai PfP SOFA, vai UV likumiem.

8.2 HN attiecīgajos gadījumos informē NV un NATO komandieri par NV piedāvātajiem FP pasākumiem un ierobežojumiem.

8.3 Attiecīgajā gadījumā katra NV ir atbildīga par savu FP prasību un ierobežojumu noteikšanu un paziņošanu UV un NATO komandierim.

8.4 Papildus FP pienākumiem, kas sīki aprakstīti NATO FP politikā un procedūrās, NATO komandieris ir atbildīgs par visas nepieciešamās un nodrošinātās UV un NV FP koordinēšanu, lai attiecīgajos gadījumos būtu nodrošināta spēku aizsardzība.

DEVĪTAIS PANTS

DROŠĪBA UN INFORMĀCIJAS IZPAUŠANA

9.1 Glabājot, pārvietojot, pārraidot un aizsargājot visus klasificētos materiālus to glabāšanas, izmantošanas, sagatavošanas, nosūtīšanas vai apmaiņas procesā, dalībnieki un NV ievēro NATO drošības procedūras.

9.2 Informācijai, ko jebkurš dalībnieks vai NV konfidenciāli nodod jebkuram citam dalībniekam vai NV, kā arī šādai informācijai, ko sagatavojis jebkurš dalībnieks vai NV, kas lūdz nodrošināt konfidencialitāti, tiek saglabāta vai nu tās sākotnējā slepenības pakāpe, vai arī tiek piešķirta tāda aizsargātības pakāpe pret tās izpau­šanu, kura atbilst tai pakāpei, ko pieprasa cits dalībnieks vai NV.

9.3 Katrs dalībnieks un NV izmanto visus pieejamos tiesiskos līdzekļus, lai pasargātu no izpaušanas visu informāciju, kuras apmaiņa notikusi konfidenciāli, ja vien pārējie dalībnieki un/vai NV nepiekrīt šādai izpaušanai.

9.4 Lai palīdzētu nodrošināt nepieciešamo aizsardzību, katrs dalībnieks vai NV šādai informācija, kas konfidenciāli nodota citam dalībniekam vai NV, norāda tās avotu, slepenības pakāpi, izpaušanas nosacījumus, to, ka informācija attiecas uz konkrētu NATO operāciju un ka informācija tiek nodota konfidenciāli.

9.5 Personāla apmeklējumus organizē saskaņā ar procedūrām, kas norādītas C—M (2002)49 (ar attiecīgajiem grozījumiem).

DESMITAIS PANTS

STĀŠANĀS SPĒKĀ, DARBĪBAS LAIKS UN LAUŠANA

10.1 Dalībnieki paraksta šo Saprašanās memorandu un tas stājas spēkā dienā, kad UV ir paziņojusi par to, ka šim nolūkam nepieciešamās iekšējās procedūras ir pabeigtas. Šis Saprašanās memorands paliek spēkā, ja vien kāds no dalībniekiem to neizbeidz, sešus mēnešus iepriekš par to rakstiski brīdinot visus pārējos dalībniekus.

10.2 Gadījumā, ja kāds no dalībniekiem no šī Saprašanās memoranda izstājas, vai arī tā izbeigšanas gadījumā, visi 6., 7., un 9. panta noteikumi paliek spēkā līdz brīdim, kad izpildītas visas saistības. NV izpilda visas saistības jebkurā gadījumā, kad Saprašanās memorands tiek izbeigts vai notiek izstāšanās no tā.

VIENPADSMITAIS PANTS

GROZĪŠANA UN INTERPRETĒŠANA

11.1 Šo Saprašanās memorandu var papildināt vai grozīt rakstveidā pēc abu dalībnieku savstarpējas vienošanās.

11.2 Iespējamos strīdus par šā Saprašanās memoranda interpretēšanu un piemērošanu atrisina, dalībniekiem apspriežoties viszemākajā iespējamajā līmenī, un tos nenodod izšķiršanai nevienam nacionālajai tiesai vai starptautiskajam tribunālam, vai trešajai pusei.

11.3 Šis Saprašanās memorands ir parakstīts trīs eksemplāros, un katrs eksemplāra teksts ir latviešu un angļu valodā.

11.4 Domstarpības, kas saistītas ar šā Saprašanās memoranda tulkošanu vai interpretēšanu atrisina, par pamatu ņemot tekstu angļu valodā.

Par iepriekšminēto un še minētajiem jautājumiem ir panākta vienošanās starp Latvijas Republikas valdību un Sabiedroto spēku Augstāko virspavēlniecību Eiropā un Sabiedroto spēku Augstākās virspavēlniecības transformācijas komandiera štābu.

MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE GOVERNMENT OF THE REPUBLIC OF LATVIA AND SUPREME HEADQUARTERS ALLIED POWERS EUROPE AND HEADQUARTERS SUPREME ALLIED COMMANDER TRANSFORMATION REGARDING THE PROVISION OF HOST NATION SUPPORT FOR THE EXECUTION OF NATO OPERATIONS/EXERCISES

INTRODUCTION

The Government of the Republic of Latvia, represented by the Ministry of Defence (MoD), and Supreme Headquarters Allied Powers Europe (SHAPE) and Headquarters Supreme Allied Commander Transformation (HQ SACT) hereinafter referred to as the Participants:

HAVING REGARD to the provisions of the North Atlantic Treaty, dated 4 April 1949, and in particular Article 3 thereof;

HAVING REGARD to the Partnership for Peace Framework Document Issued by the Heads of State and Government Participating in the Meeting of the North Atlantic Council (Framework Document), dated 10 January 1994;

HAVING REGARD to the provisions of the Agreement Among States Parties to the North Atlantic Treaty and the Other States Participating in the Partnership for Peace Regarding the Status of Their Forces (PfP SOFA), dated 19 June 1995, and including the Additional Protocol to this Agreement, dated 19 June 1995;

HAVING REGARD to the provisions of the Agreement between the Parties to the North Atlantic Treaty Regarding the Status of Their Forces (NATO SOFA), dated 19 June 1951;

HAVING REGARD to the provisions of the Protocol on the Status of International Military Headquarters set up Pursuant to the North Atlantic Treaty (Paris Protocol), dated 28 August 1952;

HAVING REGARD to the provisions of the Further Additional Protocol to the Agreement among the States Parties to the North Atlantic Treaty and the other States Participating in the Partnership for Peace Regarding the Status of Their Forces (Further Additional Protocol), dated 19 December 1997;

HAVING REGARD to the concept of deploying NATO forces and coalition forces under NATO command and control to or through the territory of the Republic of Latvia during periods of peace, crisis, emergency, and conflict in support of NATO operations;

HAVING REGARD to the concept of exercises and operations anticipated to take place with NATO, Partnership for Peace (PfP) and other NATO-led forces;

AND IN CONSIDERATION of the needs of the Republic of Latvia, hereinafter called the Host Nation, and the needs of the SHAPE and HQ SACT, hereinafter referred to as the Strategic Commands;

THE PARTICIPANTS HAVE REACHED THE FOLLOWING UNDERSTANDING:

SECTION ONE

DEFINITIONS

For the purposes of this MOU and its supporting documents the following definitions apply:

1.1 Forces. All components of a NATO-led force, to include all personnel, animals, materiel, and provisions, together with any civilian components of such forces as defined in the NATO SOFA, Paris Protocol and PfP counterparts. The term also includes all ships, aircraft, vehicles, stores, equipment, and ammunition, as well as all air land and sealift movement resources, together with their support services including contractors deploying or supporting the force.

1.2 NATO Operations. Military actions including exercises, or the carrying out of a strategic, tactical, service, training, or administrative military mission performed by forces; the process of carrying on combat, including attack, deployment, supply and manoeuvres needed to gain the objectives of any battle or campaign.

1.3 NATO Commander. A military commander in the NATO chain of command.

1.4 NATO Organisations. Headquarters and organized units of forces under NATO command and control.

1.5 International Headquarters. International Military Headquarters in the NATO integrated command structure. Includes temporary detachments or units of the Headquarters.

1.6 National Headquarters. Head­quarters of national forces under NATO command and control.

1.7 Multinational Headquarters. Headquarters with personnel from more than one nation formed by agreement of participating nations and under NATO command and control.

1.8 Sending Nations (SNs). Those nations and HQ or its elements deploying to the territory HN in support of NATO Operations.

1.9 Host Nation (HN). The Republic of Latvia.

1.10 Strategic Commanders or Command (SCs). Supreme Allied Commander Europe (SACEUR) and Supreme Allied Commander Transformation (SACT) whose headquarters are SHAPE and HQ SACT respectively.

1.11 Host Nation Support (HNS). The civil and military assistance rendered in peace, emergencies, crisis and conflict by a Host Nation to allied forces and organisations, which are located on, operating in or transiting through the Host Nation's territory, territorial waters or airspace.

1.12 Force Protection (FP). All measures taken and means used to minimize the vulnerability of personnel, facilities, equipment and operations to any threat and in all situations, to preserve freedom of action and the operational effectiveness of the force.

1.13 Expenses. Those expenditures associated with the establishment, support and sustainment of national, multinational or International Headquarters, forces or NATO organisations. For the purposes of this MOU and its follow-on documents:

a. NATO Common Costs. Those expenses agreed in advance to be the collective responsibility of the Alliance.

b. Shared Costs. Those expenses agreed in advance to be the shared responsibility of more than one nation. Shared Cost arrangements are usually based on a formula detailed in the relevant Technical Arrangement and/or Joint Implementation Arrangements.

c. Direct National Costs. Those expenses considered the responsibility of a single SN.

1.14 NATO Common Funding. Funds provided by NATO nations and made available upon approval through NATO budgets for Common Costs incurred during the conduct of the operation or exercise specified therein.

1.15 Note of Accession (NOA). A document indicating the intent of an SN to participate in arrangements for HNS under the provisions of this MOU for a specified NATO-led operation (Example NOA attached at Annex B).

1.16 Statement of Intent (SOI). A document indicating an SN's intent to participate in arrangements for HNS under the provisions of this MOU, but subject to certain specific reservations. The HN will confirm whether or not the reservations are acceptable for the provision of HNS (Example SOI attached at Annex B).

1.17 Technical Arrangement (TA). A follow-on bilateral arrangement for a specified NATO-led operation. It details the responsibilities and procedures for the provision of HNS by the HN to the NATO Commander and SN(s).

1.18 Joint Implementation Arrangement (JIA). A follow-on bilateral arrangement that establishes the commitment between the signatories concerning the provision and receipt of HNS. It includes detailed information on the required and offered support, site-specific procedures for implementation and reimbursement or payment terms.

1.19 Joint Host Nation Support Steering Committee (JHNSSC). A committee established on an ad-hoc basis and co-chaired by the HN and NATO Commander. The committee, comprised of authorised representatives from all SNs, the HN and NATO Commander, will meet to coordinate the necessary amplifying arrangements regarding HNS, such as the TA and JIA(s), as appropriate.

1.20 Operational Sites. Sites situated in the territory of the HN for the purpose of operational and/or logistics support to the force for NATO-led operations. These sites are detachments of a Strategic Command under the command and control of the NATO Commander.

1.21 Unless a meaning is specified within this MOU, the NATO Glossary of Terms and Definitions (AAP-6) will apply.

SECTION TWO

PURPOSE

2.1 The purpose of this MOU is to establish policy and procedures for the establishment of operational sites and the provision of HNS to NATO forces in, or supported from the HN, during NATO operations.

2.2 This MOU and its follow-on documents are intended to serve as the basis for planning by the appropriate HN authority and by the NATO Commander anticipating HNS arrangements for a variety of NATO-led operations. These missions include those for which deploying forces have been identified and those for which forces are yet to be identified.

SECTION THREE

SCOPE AND GENERAL ARRANGEMENTS

3.1 The provisions of the, NATO or PfP SOFA, Paris Protocol and the Further Additional Protocol and any other relevant agreements as may be in force between the SC and HN, will apply to all NATO operations.

3.2 The HN recognises operational sites set up under implementation of this MOU to be detachments of the establishing SC and the activities of such detachments to be undertakings of the SC. The sites to be established will be identified in follow-on documents. Command and control arrangements will be assigned in applicable operational plans.

3.3 This MOU is intended to be in accord with NATO doctrine and policy and provides an umbrella arrangement and structure for HNS.

3.4 The HN will provide support within its fullest capacity, subject to availability and within the practical limitations of the circumstances that then exist, to the forces deployed on NATO-led operations. The details of this support will be addressed in follow-on documents.

3.5 The provisions of this MOU apply in peace, emergencies, crisis and conflict or periods of international tension as may be mutually determined by the appropriate HN and NATO authorities.

3.6 While SNs are encouraged to participate in NATO-led operations and to accept the provisions of this MOU as the umbrella document under which HNS is provided by the HN, separate bilateral agreements with individual nations may be taken into account by the HN on a case-by-case basis.

3.7 The HN and SC may designate representatives to negotiate follow-on documents that support and amplify this MOU.

3.8 NATO-led operations supported by this MOU may require multinational support air operations by fixed wing aircraft (including helicopters), and in the case of ports, by merchant and military support vessels. The HN acknowledges that movement of such aircraft (including helicopters), ships and their crews in and through HN territorial areas, will take place under a general clearance for the duration of the operation. The HN will administer/control all aspects of such a clearance.

SECTION FOUR

REFERENCE DOCUMENTS

Reference documents that may be applicable to this MOU are contained at Annex A.

SECTION FIVE

RESPONSIBILITIES

Within the provisions of this MOU:

5.1 Host Nation.

a. During development of supporting documents and as changes occur, and following completion of these documents, the HN will provide timely notice to the appropriate NATO Commander concerning the availability or any deficiencies of HNS capabilities. The HN takes note that NATO planners rely on the developed supporting documents to this MOU and require timely notice of planned changes to the national establishment and capabilities.

b. In order to provide support, the HN will make the necessary arrangements with sources of support, to include civil and commercial sources. Commercially procured support will be obtained via a competitive bidding process from the lowest compliant bidder.

c. The HN will keep the administrative and financial records necessary to establish reimbursement to the HN for resources provided to the forces. Records documenting transactions funded through NATO budgets will be made available to NATO as required for audit purposes.

d. The standard of goods and services supplied by the HN will be in accordance with the details set out in the supporting documents.

e. The HN will retain control over its own HNS resources, unless control of such resources is released.

f. The HN will provide, in advance of any NATO-led operation, a price list for any relevant or identified HN support.

g. The HN will invite SNs to accept the provisions of this MOU by either a Note of Accession or Statement of Intent.

h. The HN will provide the procedures for the medical links between HN and SN, including medical POCs.

i. The HN (in coordination with the NATO Commander) will provide to the force, medical and dental support by HN military personnel/facilities under the same conditions as provided to the HN military.

j. During development of supporting documents, the HN will provide the NATO Commander with copies of any health, safety, environmental and agricultural regulations, which may apply to a NATO-led operation, as well as any regulations in respect to the storage, movement, or disposal of hazardous materials.

5.2 NATO Commander

a. The NATO Commander will ensure, to the maximum extent possible, that supporting documents specify the type, quantity, and quality of support required. It is noted that the mission and force structure cannot be specified before designation in an Operation plan (OPLAN) an Operational Order (OPORD), or an Exercise Operational Order (EXOPORD). The NATO Commander will provide supplementary information necessary for HN planning as soon as practicable.

b. The NATO Commander will give timely notice of any change in circumstances to the HN and will propose modification of follow-on documents, as appropriate.

c. The NATO Commander will determine whether Common Funding is available and which requirements are eligible for Common Funding.

d. The NATO Commander will define and prioritise required HNS and approve the pricing for Common Costs.

e. The NATO Commander will ensure financial reimbursement to the HN for agreed HNS if paid for through Common Funding. In all other cases, the NATO Commander will aid so far as possible in the resolution of financial obligations between the HN and the SNs.

f. If SN requirements conflict with the NATO Commander's resource distribution priorities, the appropriate NATO Commander will resolve the conflict with the SNs involved.

g. The NATO Commander will identify personnel and other requirements for the operation of sites to be established in the HN.

h. The NATO Commander will facilitate standardisation of support requirements and costs during negotiations and/or at the JHNSSC.

5.3 Sending Nations

a. SNs may elect to participate in the structure and procedures for HNS by accepting the provisions of this MOU through an NOA or by issuing an SOI for a specified NATO operation.

b. SNs will identify HNS requirements to the HN and responsible NATO Commander.

c. For Direct National Cost requirements, the SN will normally participate in negotiations for HNS during the JHNSSC or directly with the HN if a JHNSSC is not established. SNs will provide direct payment or reimbursement for HNS to the HN only for services provided from military sources unless other payment procedures are used as agreed. Under contractual arrangements made by the HN and the SNs, the support provided from commercial or civilian resources will be paid for directly by the SNs.

d. SNs will provide authorised personnel to participate in HNS discussions during the JHNSSC, if established.

e. SNs will report changes in HNS requirements to the HN and appropriate NATO Commander as they occur and shall submit revised HNS requirements and/or status reports.

f. SNs are responsible for the cost of any civilian medical or dental services rendered by the HN.

g. SNs must follow HN health, safety, environmental and agricultural regulations and procedures that have been identified for operational sites as well as any HN regulations for the storage, movement, or disposal of hazardous materials.

SECTION SIX

FINANCIAL PROVISIONS

6.1 By mutual agreement and/or international convention, activities of International Headquarters, operational sites, NATO-owned and/or chartered vessels, aircraft, vehicles, POL and forces provided to NATO will be free from all taxes, duties, state tolls, fees, and all similar charges to the maximum extent possible.

6.2 The Paris Protocol, Further Additional Protocol and customary international law which implements immunities and privileges respecting Allied Headquarters will be applied to any International Head­quarters, headquarters element, detachment that may deploy to HN following the implementation of a NATO-led operation.

6.3 Where complete exemption from taxes, duties, fees, and similar charges is not possible, charges will not be levied at a higher rate than applied to the HN Armed Forces. All expenses should be processed with the least amount of accompanying administrative requirements.

6.4 Financial transactions, to include the transfer of funds and creation of accounts, at any governmental bank institution are to be conducted without acquiring charges or fees of any kind. Financial transactions, to include the transfer of funds and creation of accounts, at any private bank are also to be conducted, to the maximum extent possible, without acquiring charges or fees of any kind. Where complete exemption from acquiring charges or fees of any kind is not possible, charges will not be levied at a higher rate than applied to the HN Armed Forces.

6.5 Final financial arrangements, particularly those related to NATO Common Funding, will likely only be determined just prior to the implementation of a NATO operation. All financial arrangements negotiated beforehand must, however, be specific as to NATO's maximum financial liabilities. Expenses not specifically agreed to as being a NATO funded expense, prior to the expense being incurred, will not receive NATO Common Funding.

6.6 Follow-on documents will provide the initial basis for cost estimates and will serve as the basis for the categorization of expenses as either NATO Common Costs (if applicable), Shared Costs, or Direct National Costs.

6.7 Where the NATO Commander determines that certain costs are both eligible and affordable for NATO Common Funding (from approved budget allocations) the SC will authorize Common Funding for those expenses and will either pay directly or reimburse the HN.

6.8 Where certain expenses are determined to be attributable to more than one nation, such expenses may be identified as Shared Costs and may, by the mutual agreement of the nations involved, be shared in accordance with a cost-share formula approved in the TA or other supporting documents.

6.9 Charges for civil and military materiel and services provided by the HN will not be levied at a higher rate than the HN Armed Forces is charged and will not include administrative or overhead surcharges, but may reflect adjustments due to delivery schedules, points of delivery, or similar considerations. Reimbursement will not be paid for support provided by military personnel.

6.10 The NATO Commander and SNs may contract directly with commercial suppliers for supplies, services or other support.

6.11 NATO-owned vehicles and SN military vehicles are self-insured and as such may operate without commercial insurance.

6.12 The HN will not incur any financial liability on behalf of the NATO Commander or the SNs, unless specifically requested to do so in advance by an authorised representative, and unless responsibility for payment of the expenses is agreed. Furthermore, no funds will be committed until the SC or the SNs, as appropriate, approve the relevant supporting documents and direct their implementation.

6.13 Funding has not been allocated in association with this MOU, and this document does not represent a specific funding obligation on the part of the NATO Commander or SNs. Detailed financial arrangements and reimbursement procedures will be specified in the follow-on documents.

6.14 Establishment of operational sites to support a NATO operation does not contemplate construction or rehabilitation of infrastructure.

SECTION SEVEN

LEGAL CONSIDERATIONS

7.1 The SC will perform, or may delegate, legal actions essential for the performance of missions, including, but not limited to, the exercise of capacity to enter into contracts, engage in legal or administrative proceedings, and acquire and dispose of property.

7.2 The status of the forces deployed to the territory of the HN will be determined in accordance with the NATO or PfP SOFA, Paris Protocol and/or Further Additional Protocol.

7.3 Equipment, supplies, products, and materials temporarily imported into and exported from HN territory in connection with a NATO operation, are exempt from all duties, taxes and fees. Other customs procedures will be determined in accordance with the NATO or PfP SOFA, Paris Protocol and Further Additional Protocol, as applicable.

7.4 Non-contractual claims arising out of, or in connection with, the execution of this MOU, will be dealt with in accordance with the provisions of the NATO or PfP SOFA.

7.5 Contract claims will be processed and adjudicated by the HN, through the process governing public contracts and in accordance with HN law, with reimbursement from the NATO Commander or SN, as applicable.

SECTION EIGHT

FORCE PROTECTION

8.1 Comprehensive and effective FP will be planned for NATO static headquarters, operations, training and exercises, and will be detailed in OPLANS, EXPIs or supplementary agreements, as appropriate. FP will be implemented in accordance with NATO policy and procedures and in a manner consistent with the NATO or PfP SOFA. Under no circumstances will the FP required or provided be contrary to the NATO or PfP SOFA or HN laws.

8.2 As appropriate, the HN will inform the SN and NATO Commander of its proposed FP measures, limitations and restrictions.

8.3 As appropriate, each SN is responsible for identifying and providing its FP requirements and limitations to the HN and NATO Commander.

8.4 In addition to those FP responsibilities detailed in NATO FP policy and procedures, the NATO Commander is responsible for co-ordinating all required and provided HN and SN FP as appropriate to the protection of the Force.

SECTION NINE

SECURITY AND DISCLOSURE OF INFORMATION

9.1 Participants and SNs will conform to NATO security procedures in the storage, handling, transmitting and safeguarding of all classified material held, used, generated, supplied or exchanged.

9.2 Information provided by any Participant or SN to any other in confidence, and such information produced by any Participant or SN requiring confidentiality, will either retain its original classification, or be assigned a classification that will ensure a degree of protection against disclosure, equivalent to that required by the other Participant or SN.

9.3 Each Participant and SN will take all lawful steps available to it to keep free from disclosure all information exchanged in confidence, unless the other Participants and/or SNs consent to such disclosure.

9.4 To assist in providing the desired protection, each Participant or SN will mark such information furnished to the other in confidence with a legend indicating its origin, the security classification, the conditions of release, that the information relates to a specific NATO operation, and that it is furnished in confidence.

9.5 Visits by personnel will be arranged in accordance with the procedures specified in C-M (2002)49, as amended.

SECTION TEN

COMMENCEMENT, DURATION AND TERMINATION

10.1 This MOU will be signed by the Participants and will enter into force upon notification by the HN that all necessary internal procedures for this purpose have been fulfilled. This MOU will remain in effect unless terminated by any Participant giving six months prior notice in writing to all other Participants.

10.2 All provisions of Sections 6, 7, and 9 will remain in effect in the event of withdrawal of any Participant or upon termination of this MOU until all obligations are fulfilled. SNs will fulfil all obligations in the event of any termination or withdrawal.

SECTION ELEVEN

MODIFICATION AND INTERPRETATION

11.1 This MOU may be amended or modified in writing by the mutual consent of all Participants.

11.2 Apparent conflicts in interpretation and application of this MOU will be resolved by consultation among Participants at the lowest possible level and will not be referred to any national or international tribunal or third party for settlement.

11.3 This MOU is signed in three copies each of them containing the text in the Latvian and English language.

11.4 Problems in translation or interpretation of this MOU will be resolved under the English language version.

The foregoing represents the understandings reached between the Government of the Republic Latvia and Supreme Headquarters Allied Powers Europe and Headquarters Supreme Allied Commander Transformation, upon the matters referred to herein.
