prezidents izsludina šādu likumu:
Par Līgumu par trešo valstu pārstāvniecību un pārstāvju Ziemeļatlantijas līguma organizācijā statusu

1.pants. 1994.gada 14.septembrī Briselē parakstītais Līgums par trešo valstu pārstāvniecību un pārstāvju Ziemeļatlantijas līguma organizācijā statusu (turpmāk — Līgums) ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Līgumā paredzēto saistību izpildi koordinē Aizsardzības ministrija.

3.pants. Līgums stājas spēkā tā 3.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

4.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināms Līgums angļu valodā un tā tulkojums latviešu valodā.

Likums Saeimā pieņemts 2004.gada 28.oktobrī.

AGREEMENT
ON THE STATUS OF MISSIONS AND REPRESENTATIVES OF THIRD STATES TO THE NORTH ATLANTIC TREATY ORGANIZATION

Considering the Declaration on Peace and Cooperation issued by the Heads of State and Government participating in the meeting of the North Atlantic Council in Rome on 7th and 8th November 1991 calling for the establishment of a North Atlantic Cooperation Council and the North Atlantic Cooperation Council Statement on Dialogue, Partnership and Cooperation of 20th December 1991;

Noting the Partnership for Peace invitation issued and signed by the Heads of State and Government of the member States of the North Atlantic Treaty Organization at the meeting of the North Atlantic Council in Brussels on 10th January 1994;

Recognizing the need to determine the status of the missions and representatives of third States to the Organization;

Considering that the purpose of immunities and privileges contained in the present Agreement is not to benefit individuals but to ensure the efficient performance of their function in connection with the Organization;

The Parties to the present Agreement have agreed as follows:

Article 1

For the purpose of the present Agreement:

"Organization" means: The North Atlantic Treaty Organization;

"Member State" means: A State Party to the North Atlantic Treaty done in Washington on 4th April 1949;

"Third State" means: A State which is not a Party to the North Atlantic Treaty done in Washington on 4th April 1949, and which has accepted the invitation to the Partnership for Peace and subscribed to the Partnership for Peace Framework Document, is a member State of the North Atlantic Cooperation Council or is any other State invited by the North Atlantic Council to establish a Mission to the Organization.

Article 2

(a) The member State in whose territory the Organization has its headquarters shall accord to the missions of third States to the Organization and the members of their Staff the immunities and privileges accorded to diplomatic missions and their staff;

(b) In addition, the member State in whose territory the Organization has its headquarters shall accord the customary immunities and privileges to the representatives of third States, on temporary mission, who are not covered by paragraph (a) of the present Article, while present in its territory for the purpose of ensuring the representation of third States in relation to the proceedings of the Organization.

Article 3

(a) The present Agreement shall be open for signature by member States and shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Government of the Kingdom of Belgium which shall notify all signatory States of the deposit of each such instrument;

(b) As soon as two or more signatory States, including the member State in whose territory the Organization has its headquarters, have deposited their instruments of ratification, acceptance or approval, the present Agreement shall come into force in respect of those States. It shall come into force in respect of each other signatory State on the date of the deposit of its instrument.

Article 4

(a) The present Agreement may be denounced by any contracting State by giving written notification of denunciation of the Government of the Kingdom of Belgium which shall notify all signatory States of each such notification;

(b) The denunciation shall take effect one year after the receipt of the notification by the Government of the Kingdom of Belgium.

In witness whereof the undersigned, being duly authorized by their respective governments, have signed the present Agreement pf which the English and French texts are equally authentic.

Done in Brussels, this 14 th day of September 1994.

LĪGUMS
PAR TREŠO VALSTU PĀRSTĀVNIECĪBU UN PĀRSTĀVJU ZIEMEĻATLANTIJAS LĪGUMA ORGANIZĀCIJĀ STATUSU

Ņemot vērā Deklarāciju par Mieru un Sadarbību, ko pieņēmuši valstu un valdību vadītāji, kuri 1991. gada 7. un 8. novembrī Romā piedalījās Ziemeļatlantijas Padomes sanāksmē, aicinot izveidot Ziemeļatlantijas Sadarbības Padomi, kā arī 1991. gada 20. decembra Ziemeļatlantijas Sadarbības Padomes paziņojumu par dialogu, partnerattiecībām un sadarbību;

Atzīmējot aicinājumu pievienoties programmai "Partnerattiecības - mieram", kuru 1994. gada 10. janvārī Ziemeļatlantijas Padomes sanāksmē Briselē pieņēma un parakstīja Ziemeļatlantijas Līguma Organizācijas dalībvalstu un valdību vadītāji;

Atzīstot vajadzību noteikt trešo valstu pārstāvniecību un pārstāvju statusu Organizācijā;

Ņemot vērā to, ka šajā līgumā iekļautās neaizskaramības un privilēģiju mērķis ir nevis dot priekšrocības atsevišķām personām, bet gan nodrošināt šo personu funkciju efektīvu izpildi saistībā ar Organizāciju;

Šā Līguma slēdzējas puses ir vienojušās par sekojošo:

1. pants

Šajā Līgumā:

"Organizācija" nozīmē Ziemeļatlantijas Līguma Organizāciju;

"Dalībvalsts" nozīmē valsti, kas ir 1949. gada 4. aprīlī Vašingtonā noslēgtā Ziemeļatlantijas Līguma slēdzēja puse;

"Trešā valsts" nozīmē valsti, kas nav 1949. gada 4. aprīli Vašingtonā noslēgtā Ziemeļatlantijas Līguma slēdzēja puse, kas ir pieņēmusi aicinājumu pievienoties programmai "Partnerattiecības - mieram", parakstījusi "Partnerattiecības - mieram" pamatdokumentu un ir Ziemeļatlantijas Sadarbības Padomes dalībvalsts vai jebkura cita valsts, kuru Ziemeļatlantijas Padome ir aicinājusi izveidot savu pārstāvniecību Organizācijā.

2. pants

a) Dalībvalsts, kuras teritorijā atrodas Organizācijas galvenā mītne, piešķir trešo valstu pārstāvniecībām Organizācijā un to personālam neaizskaramību un privilēģijas, kas ir piešķirtas diplomātiskajām pārstāvniecībām un to personālam;

b) Dalībvalsts, kuras teritorijā atrodas Organizācijas galvenā mītne, piešķir arī parasto neaizskaramību un privilēģijas trešo valstu pārstāvjiem, kuri atrodas īslaicīgā misijā un kuru statusu nereglamentē šā Līguma a) apakšpunkts, uz to laiku, kamēr viņi atrodas dalībvalsts teritorijā, lai nodrošinātu trešo valstu pārstāvību saistībā ar Organizācijas darbību.

3. pants

a) Šis Līgums dalībvalstīm ir jāparaksta un jāratificē, jāpieņem vai jāapstiprina. Ratifikācijas, pieņemšanas vai apstiprināšanas dokumentus iesniedz Beļģijas Karalistes valdībai, kura informē visas parakstītājvalstis par katra šāda dokumenta iesniegšanu;

b) Tiklīdz divas vai vairākas parakstītājas valstis, ieskaitot dalībvalsti, kuras teritorijā atrodas Organizācijas galvenā mītne, ir iesniegušas savus ratifikācijas, pieņemšanas vai apstiprināšanas dokumentus, šis Līgums stājas spēkā attiecībā uz šīm valstīm. Attiecībā uz ikvienu citu parakstītāju valsti šis Līgums stājas spēkā šīs valsts dokumenta iesniegšanas dienā.

4. pants

a) Jebkura līgumslēdzēja valsts var denonsēt šo Līgumu, iesniedzot rakstisku denonsēšanas paziņojumu Beļģijas Karalistes valdībai, kas informē visas parakstītājvalstis par katru šādu paziņojumu.

b) Denonsēšana stājas spēkā vienu gadu pēc tam, kad Beļģijas Karalistes valdība ir saņēmusi denonsēšanas paziņojumu.

To apliecinot, savu valdību attiecīgi pilnvarotas personas ir parakstījušas šo Līgumu, kura teksts angļu un franču valodā ir vienlīdz autentisks.

Parakstīts Briselē, tūkstoš deviņi simti deviņdesmit ceturtā gada četrpadsmitajā septembrī.
