prezidents izsludina šādu likumu:
Par 1960.gada 21.septembra Līgumu par savstarpēju slepenības garantēšanu izgudrojumiem, kuri saistīti ar aizsardzību un kuriem iesniegti patentu pieteikumi

1.pants. 1960.gada 21.septembrī Parīzē parakstītais Līgums par savstarpēju slepenības garantēšanu izgudrojumiem, kuri saistīti ar aizsardzību un kuriem iesniegti patentu pieteikumi (turpmāk — Līgums), ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Līgumā paredzēto saistību izpildi koordinē Aizsardzības ministrija.

3.pants. Līgums stājas spēkā pēc pievienošanās dokumenta deponēšanas, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

4.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināms Līguma teksts angļu valodā un tā tulkojums latviešu valodā.

AGREEMENT
FOR THE MUTUAL SAFEGUARDING OF SECRECY OF INVENTIONS RELATING TO DEFENCE AND FOR WHICH APPLICATIONS FOR PATENTS HAVE BEEN MADE

The Governments of Belgium, Canada, Denmark, France, The Federal Republic of Germany, Greece, Italy, Luxembourg, The Netherlands, Norway, Portugal, Turkey, The United Kingdom and The United States of America,

parties to the North Atlantic Treaty signed in Washington on 4th April, 1949,

desirous of encouraging economic collaboration between any or all of their Governments, as agreed in Article 2 of the Treaty,

mindful of the undertaking they have entered into under the terms of Article 3, to maintain and develop, by means of continuous and effective self-help, their individual and collective capacity to resist armed attack,

considering that the imposition of secrecy on an invention relating to defence in one of the North Atlantic Treaty Organization countries has generally as its corollary, when a patent has been applied for, or granted, the prohibition to apply for a patent for the same invention in other countries, including North Atlantic Treaty Organization countries,

considering that the territorial limitation resulting from this prohibition may cause prejudice to the applicants for patents and consequently adversely affect economic collaboration between North Atlantic Treaty Organization countries,

considering that mutual assistance makes desirable reciprocal communication of inventions relating to defence and that in some cases such communication may be obstructed by this prohibition,

considering that if the Government originating the prohibition is prepared to authorise the filing of an application for a patent in one or more of the other North Atlantic Treaty Organization countries, provided that the Governments of these countries also impose secrecy on the invention, the latter should not be free to refuse to impose secrecy,

considering that provision has been made between the Governments of the Parties to the North Atlantic Treaty for the mutual protection and safeguarding of the classified information they may interchange,

have agreed as follows:

Article I

The Governments Parties to this Agreement shall safeguard and cause to be safeguarded the secrecy of inventions for which applications for patents have been received under agreed procedures whenever the secrecy has been imposed on such inventions in the interests of national defence by the Government, hereinafter referred

to as the "originating Government", which was the first to receive an application for a patent covering these inventions.

Provided that this provision shall not prejudice the right of the originating Government to prohibit the filing of an application for a patent for the invention with one or more of the other Governments Parties to this Agreement.

The Governments Parties to this Agreement agree to develop such operational procedures as may be required to effectuate this Article.

Article II

The provisions of Article I shall be applied at the request either of the originating Government, or of the applicant for the patent, provided that the latter produces evidence that secrecy has been imposed by the originating Government and that he has received authorisation from that Government to file his application for a secret patent in the country in question.

Article III

The Government called upon to safeguard the secrecy of an invention under the terms of Article I shall be entitled to demand from the applicant for the patent a waiver of any claim to compensation for loss or damage due solely to the imposition of secrecy on the invention as a condition prerequisite to the application of such safeguard.

Article IV

The secrecy measures imposed under Article I shall be removed only on the request of the originating Government. This Government shall give the other Governments concerned six weeks' notice of its intention to remove its own measures.

The originating Governments shall take into account as fas as possible, having due regard to the security of the North Atlantic Treaty Organization, the representations made by other Governments within the said six weeks' period.

Article V

This Agreement shall not prevent the signatory Governments from entering into bilateral agreements for the same purpose. Existing bilateral agreements shall remain unaffected.

Article VI

The instruments of ratification or approval of this Agreement shall be deposited as soon as possible with the Government of the United States of America which will inform each signatory Government of the date of deposit of each instrument.

This Agreement shall enter into force 30 days after deposit by two signatory Parties of their instruments of ratification or approval. It shall enter into force for each of the other signatory Parties 30 days after the deposit of its instrument of ratification or approval.

Article VII

This Agreement may be denounced by any contracting Party by written notice of denunciation given to the Government of the United States of America which will inform all the other signatory Parties of such notice. Denunciation shall take effect one year after receipt of notification by the Government of the United States of America but shall not affect obligations already contracted and the rights or prerogatives previously acquired by the signatory Parties under the provisions of this Agreement.

In witness whereof the undersigned Representatives duly authorised thereto, have signed this Agreement.

Done in PARIS this 21st day of September 1960 in the English and French languages, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Government of the United States of America which will transmit a duly certified copy to the Governments of the other signatory Parties.

Amerikas Savienoto Valstu, Apvienotās Karalistes, Beļģijas, Dānijas, Francijas, Grieķijas, Itālijas, Kanādas, Luksemburgas, Nīderlandes, Norvēģijas, Portugāles, Turcijas un Vācijas Federatīvās Republikas valdības,

būdamas 1949. gada 4. aprīlī Vašingtonā parakstītā Ziemeļatlantijas Līguma Puses,

vēloties veicināt ekonomisko sadarbību starp jebkuru vai visām to valdībām atbilstoši Līguma 2. pantā nolemtajam,

ievērojot saistības, kuras tās uzņēmušās saskaņā ar 3. panta noteikumiem saglabāt un attīstīt savas individuālās un kolektīvās spējas pretoties bruņotam uzbrukumam ar pastāvīgu un efektīvu pašpalīdzību,

ņemot vērā to, ka kopā ar slepenības piemērošanu kādam ar aizsardzību saistītam izgudrojumam kādā Ziemeļatlantijas Līguma Organizācijas valstī, ja ir iesniegts patenta pieteikums vai piešķirts patents, parasti tiek noteikts aizliegums iesniegt patenta pieteikumu par to pašu izgudrojumu citās valstīs, tostarp Ziemeļatlantijas Līguma Organizācijas valstīs,

ņemot vērā to, ka šī aizlieguma rezultātā radies teritoriālais ierobežojums var nodarīt kaitējumu patentu pieteikumu iesniedzējiem un tādējādi negatīvi ietekmēt ekonomisko sadarbību starp Ziemeļatlantijas Līguma Organizācijas valstīm,

ņemot vērā to, ka savstarpējai palīdzībai ir vēlama savstarpēja paziņošana par izgudrojumiem, kas saistīti ar aizsardzību, un ka dažos gadījumos minētais aizliegums šādu paziņošanu var kavēt,

ņemot vērā to, ka valdība, kas noteikusi aizliegumu, ir gatava atļaut patenta pieteikuma iesniegšanu vienā vai vairākās pārējās Ziemeļatlantijas Līguma Organizācijas valstīs ar nosacījumu, ka arī šo valstu valdības piemēro slepenību izgudrojumiem, kam vēlāk atteikt slepenību nedrīkstēs,

ņemot vērā to, ka Ziemeļatlantijas Līguma pušu valdības ir noteikušas klasificētās informācijas, ar ko tās varētu apmainīties, savstarpējās aizsardzības un drošības nosacījumus

ir vienojušās par sekojošo:

I pants

Valdības, kas ir šā nolīguma puses, garantē slepenību un nodrošina, lai tā tiktu garantēta izgudrojumiem, par ko saskaņā ar pieņemtajām procedūrām ir saņemti patentu pieteikumi, ja valdība, turpmāk tekstā — "pirmā valdība", kura pirmā saņēmusi patenta pieteikumu par šiem izgudrojumiem, tiem slepenību likusi piemērot valsts aizsardzības interesēs ar nosacījumu, ka šis noteikums neskar pirmās valdības tiesības aizliegt iesniegt patenta pieteikumu par izgudrojumu vienā vai vairākās citās valstīs, kas ir šā Līguma puses.

Valstis, kas ir šā Līguma puses, vienojas izstrādāt šā panta īstenošanai vajadzīgās operatīvās procedūras.

II pants

Šā Līguma I panta noteikumus piemēro vai nu pēc pirmās valdības, vai patenta pieteikuma iesniedzēja pieprasījuma, ja pēdējais sniedz apliecinājumu, ka pirmā valdība ir likusi piemērot slepenību un ka tas ir saņēmis šās valdības atļauju attiecīgajā valstī iesniegt savu slepenā patenta pieteikumu.

III pants

Valdībai, kura tiek aicināta garantēt kāda izgudrojuma slepenību atbilstoši I panta noteikumiem, kā priekšnosacījumu šādai garantijai ir tiesības pieprasīt no patenta pieteikuma iesniedzēja atteikšanos no pieprasījumiem pēc kompensācijas par zaudējumiem vai kaitējumiem, kas radušies tikai sakarā ar slepenības piemērošanu izgudrojumam.

IV pants

Saskaņā ar I pantu piemērotos slepenības pasākumus var izbeigt tikai pēc pirmās valdības pieprasījuma. Šī valdība sešas nedēļas iepriekš brīdina pārējās attiecīgās valdības par nodomu izbeigt savus pasākumus.

Pirmās valdības, pienācīgi ievērojot Ziemeļatlantijas Līguma Organizācijas drošību, cik iespējams ņem vērā protestus, ko pārējās valdības izsaka minētajā sešu mēnešu laika posmā.

V pants

Šis Līgums nekavē tā parakstītājas valdības tādam pašam nolūkam slēgt divpusējus Līgumus. Esošie divpusējie Līgumi paliek neskarti.

VI pants

Šā Līguma ratifikācijas vai apstiprinājuma dokumentus iespējami īsā laikā iesniedz Amerikas Savienoto Valstu valdībai, kura informē katru parakstītāju valdību par katra dokumenta iesniegšanas dienu.

Šis Līgums stājas spēkā pēc 30 dienām kopš tās dienas, kad savus ratifikācijas vai apstiprinājuma dokumentus iesniegušas divas parakstītājas puses. Katrai no visām pārējām parakstītājām pusēm Līgums stājas spēkā pēc 30 dienām kopš tās dienas, kad katra no tām iesniegusi savu ratifikācijas vai apstiprinājuma dokumentu.

VII pants

Jebkura līgumslēdzēja puse var denonsēt šo nolīgumu ar rakstveida paziņojumu par denonsēšanu, ko iesniedz Amerikas Savienoto Valstu valdībai, kura par to informē visas pārējās līgumslēdzējas puses. Denonsēšana stājas spēkā pēc viena gada kopš tās dienas, kad Amerikas Savienoto Valstu valdība paziņojumu saņēmusi, bet tā neskar jau esošās saistības un tiesības vai privilēģijas, ko līgumslēdzējas puses atbilstoši šim Līgumam ieguvušas iepriekš.

To apliecinot, attiecīgi pilnvarotie pārstāvji ir parakstījuši šo Līgumu.

Sastādīts PARĪZĒ, 1960. gada 21. septembrī angļu un franču valodā, un abi teksti ir vienlīdz autentiski, vienā eksemplārā, ko deponē Amerikas Savienoto Valstu valdības arhīvos, kura nosūta pienācīgi apliecinātu kopiju pārējo līgumslēdzēju pušu valdībām.
