Par Pasaules veselības organizācijas Vispārējo konvenciju par tabakas uzraudzību

1.pants. Pasaules veselības organizācijas 2003.gada 21.maija Vispārējā konvencija par tabakas uzraudzību (turpmāk — Konvencija) ar šo likumu tiek pieņemta un apstiprināta.

2.pants. Konvencijā paredzēto saistību izpildi koordinē Veselības ministrija.

3.pants. Konvencija stājas spēkā tās 36.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

4.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināma Konvencija angļu valodā un tās tulkojums latviešu valodā.

WHO Framework Convention on Tobacco Control

Preamble

The Parties to this Convention,

Determined to give priority to their right to protect public health,

Recognizing that the spread of the tobacco epidemic is a global problem with serious consequences for public health that calls for the widest possible international cooperation and the participation of all countries in an effective, appropriate and comprehensive international response,

Reflecting the concern of the international community about the devastating worldwide health, social, economic and environmental consequences of tobacco consumption and exposure to tobacco smoke,

Seriously concerned about the increase in the worldwide consumption and production of cigarettes and other tobacco products, particularly in developing countries, as well as about the burden this places on families, on the poor, and on national health systems,

Recognizing that scientific evidence has unequivocally established that tobacco consumption and exposure to tobacco smoke cause death, disease and disability, and that there is a time lag between the exposure to smoking and the other uses of tobacco products and the onset of tobacco-related diseases,

Recognizing also that cigarettes and some other products containing tobacco are highly engineered so as to create and maintain dependence, and that many of the compounds they contain and the smoke they produce are pharmacologically active, toxic, mutagenic and carcinogenic, and that tobacco dependence is separately classified as a disorder in major international classifications of diseases,

Acknowledging that there is clear scientific evidence that prenatal exposure to tobacco smoke causes adverse health and developmental conditions for children,

Deeply concerned about the escalation in smoking and other forms of tobacco consumption by children and adolescents worldwide, particularly smoking at increasingly early ages,

Alarmed by the increase in smoking and other forms of tobacco consumption by women and young girls worldwide and keeping in mind the need for full participation of women at all levels of policy-making and implementation and the need for gender-specific tobacco control strategies,

Deeply concerned about the high levels of smoking and other forms of tobacco consumption by indigenous peoples,

Seriously concerned about the impact of all forms of advertising, promotion and sponsorship aimed at encouraging the use of tobacco products,

Recognizing that cooperative action is necessary to eliminate all forms of illicit trade in cigarettes and other tobacco products, including smuggling, illicit manufacturing and counterfeiting,

Acknowledging that tobacco control at all levels and particularly in developing countries and in countries with economies in transition requires sufficient financial and technical resources commensurate with the current and projected need for tobacco control activities,

Recognizing the need to develop appropriate mechanisms to address the long-term social and economic implications of successful tobacco demand reduction strategies,

Mindful of the social and economic difficulties that tobacco control programmes may engender in the medium and long term in some developing countries and countries with economies in transition, and recognizing their need for technical and financial assistance in the context of nationally developed strategies for sustainable development,

Conscious of the valuable work being conducted by many States on tobacco control and commending the leadership of the World Health Organization as well as the efforts of other organizations and bodies of the United Nations system and other international and regional intergovernmental organizations in developing measures on tobacco control,

Emphasizing the special contribution of nongovernmental organizations and other members of civil society not affiliated with the tobacco industry, including health professional bodies, women's, youth, environmental and consumer groups, and academic and health care institutions, to tobacco control efforts nationally and internationally and the vital importance of their participation in national and international tobacco control efforts,

Recognizing the need to be alert to any efforts by the tobacco industry to undermine or subvert tobacco control efforts and the need to be informed of activities of the tobacco industry that have a negative impact on tobacco control efforts,

Recalling Article 12 of the International Covenant on Economic, Social and Cultural Rights, adopted by the United Nations General Assembly on 16 December 1966, which states that it is the right of everyone to the enjoyment of the highest attainable standard of physical and mental health,

Recalling also the preamble to the Constitution of the World Health Organization, which states that the enjoyment of the highest attainable standard of health is one of the fundamental rights of every human being without distinction of race, religion, political belief, economic or social condition,

Determined to promote measures of tobacco control based on current and relevant scientific, technical and economic considerations,

Recalling that the Convention on the Elimination of All Forms of Discrimination against Women, adopted by the United Nations General Assembly on 18 December 1979, provides that States Parties to that Convention shall take appropriate measures to eliminate discrimination against women in the field of health care,

Recalling further that the Convention on the Rights of the Child, adopted by the United Nations General Assembly on 20 November 1989, provides that States Parties to that Convention recognize the right of the child to the enjoyment of the highest attainable standard of health,

Have agreed, as follows:

Part I: INTRODUCTION

Article 1

Use of terms

For the purposes of this Convention:

(a) "illicit trade" means any practice or conduct prohibited by law and which relates to production, shipment, receipt, possession, distribution, sale or purchase including any practice or conduct intended to facilitate such activity;

(b) "regional economic integration organization" means an organization that is composed of several sovereign states, and to which its Member States have transferred competence over a range of matters, including the authority to make decisions binding on its Member States in respect of those matters1;

(c) "tobacco advertising and promotion" means any form of commercial communication, recommendation or action with the aim, effect or likely effect of promoting a tobacco product or tobacco use either directly or indirectly;

(d) "tobacco control" means a range of supply, demand and harm reduction strategies that aim to improve the health of a population by eliminating or reducing their consumption of tobacco products and exposure to tobacco smoke;

(e) "tobacco industry" means tobacco manufacturers, wholesale distributors and importers of tobacco products;

(f) "tobacco products" means products entirely or partly made of the leaf tobacco as raw material which are manufactured to be used for smoking, sucking, chewing or snuffing;

(g) "tobacco sponsorship" means any form of contribution to any event, activity or individual with the aim, effect or likely effect of promoting a tobacco product or tobacco use either directly or indirectly;

Article 2

Relationship between this Convention and other agreements and legal instruments

1. In order to better protect human health, Parties are encouraged to implement measures beyond those required by this Convention and its protocols, and nothing in these instruments shall prevent a Party from imposing stricter requirements that are consistent with their provisions and are in accordance with international law.

2. The provisions of the Convention and its protocols shall in no way affect the right of Parties to enter into bilateral or multilateral agreements, including regional or subregional agreements, on issues relevant or additional to the Convention and its protocols, provided that such agreements are compatible with their obligations under the Convention and its protocols. The Parties concerned shall communicate such agreements to the Conference of the Parties through the Secretariat.

Part II: OBJECTIVE, GUIDING PRINCIPLES AND GENERAL OBLIGATIONS

Article 3

Objective

The objective of this Convention and its protocols is to protect present and future generations from the devastating health, social, environmental and economic consequences of tobacco consumption and exposure to tobacco smoke by providing a framework for tobacco control measures to be implemented by the Parties at the national, regional and international levels in order to reduce continually and substantially the prevalence of tobacco use and exposure to tobacco smoke.

Article 4

Guiding principles

To achieve the objective of this Convention and its protocols and to implement its provisions, the Parties shall be guided, inter alia, by the principles set out below:

1. Every person should be informed of the health consequences, addictive nature and mortal threat posed by tobacco consumption and exposure to tobacco smoke and effective legislative, executive, administrative or other measures should be contemplated at the appropriate governmental level to protect all persons from exposure to tobacco smoke.

2. Strong political commitment is necessary to develop and support, at the national, regional and international levels, comprehensive multisectoral measures and coordinated responses, taking into consideration:

(a) the need to take measures to protect all persons from exposure to tobacco smoke;

(b) the need to take measures to prevent the initiation, to promote and support cessation, and to decrease the consumption of tobacco products in any form;

(c) the need to take measures to promote the participation of indigenous individuals and communities in the development, implementation and evaluation of tobacco control programmes that are socially and culturally appropriate to their needs and perspectives; and

(d) the need to take measures to address gender-specific risks when developing tobacco control strategies.

3. International cooperation, particularly transfer of technology, knowledge and financial assistance and provision of related expertise, to establish and implement effective tobacco control programmes, taking into consideration local culture, as well as social, economic, political and legal factors, is an important part of the Convention.

4. Comprehensive multisectoral measures and responses to reduce consumption of all tobacco products at the national, regional and international levels are essential so as to prevent, in accordance with public health principles, the incidence of diseases, premature disability and mortality due to tobacco consumption and exposure to tobacco smoke.

5. Issues relating to liability, as determined by each Party within its jurisdiction, are an important part of comprehensive tobacco control.

6. The importance of technical and financial assistance to aid the economic transition of tobacco growers and workers whose livelihoods are seriously affected as a consequence of tobacco control programmes in developing country Parties, as well as Parties with economies in transition, should be recognized and addressed in the context of nationally developed strategies for sustainable development.

7. The participation of civil society is essential in achieving the objective of the Convention and its protocols.

Article 5

General obligations

1. Each Party shall develop, implement, periodically update and review comprehensive multisectoral national tobacco control strategies, plans and programmes in accordance with this Convention and the protocols to which it is a Party.

2. Towards this end, each Party shall, in accordance with its capabilities:

(a) establish or reinforce and finance a national coordinating mechanism or focal points for tobacco control; and

(b) adopt and implement effective legislative, executive, administrative and/or other measures and cooperate, as appropriate, with other Parties in developing appropriate policies for preventing and reducing tobacco consumption, nicotine addiction and exposure to tobacco smoke.

3. In setting and implementing their public health policies with respect to tobacco control, Parties shall act to protect these policies from commercial and other vested interests of the tobacco industry in accordance with national law.

4. The Parties shall cooperate in the formulation of proposed measures, procedures and guidelines for the implementation of the Convention and the protocols to which they are Parties.

5. The Parties shall cooperate, as appropriate, with competent international and regional intergovernmental organizations and other bodies to achieve the objectives of the Convention and the protocols to which they are Parties.

6. The Parties shall, within means and resources at their disposal, cooperate to raise financial resources for effective implementation of the Convention through bilateral and multilateral funding mechanisms.

Part III: MEASURES RELATING TO THE REDUCTION OF DEMAND FOR TOBACCO

Article 6

Price and tax measures to reduce the demand for tobacco

1. The Parties recognize that price and tax measures are an effective and important means of reducing tobacco consumption by various segments of the population, in particular young persons.

2. Without prejudice to the sovereign right of the Parties to determine and establish their taxation policies, each Party should take account of its national health objectives concerning tobacco control and adopt or maintain, as appropriate, measures which may include:

(a) implementing tax policies and, where appropriate, price policies, on tobacco products so as to contribute to the health objectives aimed at reducing tobacco consumption; and

(b) prohibiting or restricting, as appropriate, sales to and/or importations by international travellers of tax- and duty-free tobacco products.

3. The Parties shall provide rates of taxation for tobacco products and trends in tobacco consumption in their periodic reports to the Conference of the Parties, in accordance with Article 21.

Article 7

Non-price measures to reduce the demand for tobacco

The Parties recognize that comprehensive non-price measures are an effective and important means of reducing tobacco consumption. Each Party shall adopt and implement effective legislative, executive, administrative or other measures necessary to implement its obligations pursuant to Articles 8 to 13 and shall cooperate, as appropriate, with each other directly or through competent international bodies with a view to their implementation. The Conference of the Parties shall propose appropriate guidelines for the implementation of the provisions of these Articles.

Article 8

Protection from exposure to tobacco smoke

1. Parties recognize that scientific evidence has unequivocally established that exposure to tobacco smoke causes death, disease and disability.

2. Each Party shall adopt and implement in areas of existing national jurisdiction as determined by national law and actively promote at other jurisdictional levels the adoption and implementation of effective legislative, executive, administrative and/or other measures, providing for protection from exposure to tobacco smoke in indoor workplaces, public transport, indoor public places and, as appropriate, other public places.

Article 9

Regulation of the contents of tobacco products

The Conference of the Parties, in consultation with competent international bodies, shall propose guidelines for testing and measuring the contents and emissions of tobacco products, and for the regulation of these contents and emissions. Each Party shall, where approved by competent national authorities, adopt and implement effective legislative, executive and administrative or other measures for such testing and measuring, and for such regulation.

Article 10

Regulation of tobacco product disclosures

Each Party shall, in accordance with its national law, adopt and implement effective legislative, executive, administrative or other measures requiring manufacturers and importers of tobacco products to disclose to governmental authorities information about the contents and emissions of tobacco products. Each Party shall further adopt and implement effective measures for public disclosure of information about the toxic constituents of the tobacco products and the emissions that they may produce.

Article 11

Packaging and labelling of tobacco products

1. Each Party shall, within a period of three years after entry into force of this Convention for that Party, adopt and implement, in accordance with its national law, effective measures to ensure that:

(a) tobacco product packaging and labelling do not promote a tobacco product by any means that are false, misleading, deceptive or likely to create an erroneous impression about its characteristics, health effects, hazards or emissions, including any term, descriptor, trademark, figurative or any other sign that directly or indirectly creates the false impression that a particular tobacco product is less harmful than other tobacco products. These may include terms such as "low tar", "light", "ultra-light", or "mild"; and

(b) each unit packet and package of tobacco products and any outside packaging and labelling of such products also carry health warnings describing the harmful effects of tobacco use, and may include other appropriate messages. These warnings and messages:

(i) shall be approved by the competent national authority,

(ii) shall be rotating,

(iii) shall be large, clear, visible and legible,

(iv) should be 50% or more of the principal display areas but shall be no less than 30% of the principal display areas,

(v) may be in the form of or include pictures or pictograms.

2. Each unit packet and package of tobacco products and any outside packaging and labelling of such products shall, in addition to the warnings specified in paragraph 1(b) of this Article, contain information on relevant constituents and emissions of tobacco products as defined by national authorities.

3. Each Party shall require that the warnings and other textual information specified in paragraphs 1(b) and paragraph 2 of this Article will appear on each unit packet and package of tobacco products and any outside packaging and labelling of such products in its principal language or languages.

4. For the purposes of this Article, the term "outside packaging and labelling" in relation to tobacco products applies to any packaging and labelling used in the retail sale of the product.

Article 12

Education, communication, training and public awareness

Each Party shall promote and strengthen public awareness of tobacco control issues, using all available communication tools, as appropriate. Towards this end, each Party shall adopt and implement effective legislative, executive, administrative or other measures to promote:

(a) broad access to effective and comprehensive educational and public awareness programmes on the health risks including the addictive characteristics of tobacco consumption and exposure to tobacco smoke;

(b) public awareness about the health risks of tobacco consumption and exposure to tobacco smoke, and about the benefits of the cessation of tobacco use and tobacco-free lifestyles as specified in Article 14.2;

(c) public access, in accordance with national law, to a wide range of information on the tobacco industry as relevant to the objective of this Convention;

(d) effective and appropriate training or sensitization and awareness programmes on tobacco control addressed to persons such as health workers, community workers, social workers, media professionals, educators, decision-makers, administrators and other concerned persons;

(e) awareness and participation of public and private agencies and nongovernmental organizations not affiliated with the tobacco industry in developing and implementing intersectoral programmes and strategies for tobacco control; and

(f) public awareness of and access to information regarding the adverse health, economic, and environmental consequences of tobacco production and consumption.

Article 13

Tobacco advertising, promotion and sponsorship

1. Parties recognize that a comprehensive ban on advertising, promotion and sponsorship would reduce the consumption of tobacco products.

2. Each Party shall, in accordance with its constitution or constitutional principles, undertake a comprehensive ban of all tobacco advertising, promotion and sponsorship. This shall include, subject to the legal environment and technical means available to that Party, a comprehensive ban on cross-border advertising, promotion and sponsorship originating from its territory. In this respect, within the period of five years after entry into force of this Convention for that Party, each Party shall undertake appropriate legislative, executive, administrative and/or other measures and report accordingly in conformity with Article 21.

3. A Party that is not in a position to undertake a comprehensive ban due to its constitution or constitutional principles shall apply restrictions on all tobacco advertising, promotion and sponsorship. This shall include, subject to the legal environment and technical means available to that Party, restrictions or a comprehensive ban on advertising, promotion and sponsorship originating from its territory with cross-border effects. In this respect, each Party shall undertake appropriate legislative, executive, administrative and/or other measures and report accordingly in conformity with Article 21.

4. As a minimum, and in accordance with its constitution or constitutional principles, each Party shall:

(a) prohibit all forms of tobacco advertising, promotion and sponsorship that promote a tobacco product by any means that are false, misleading or deceptive or likely to create an erroneous impression about its characteristics, health effects, hazards or emissions;

(b) require that health or other appropriate warnings or messages accompany all tobacco advertising and, as appropriate, promotion and sponsorship;

(c) restrict the use of direct or indirect incentives that encourage the purchase of tobacco products by the public;

(d) require, if it does not have a comprehensive ban, the disclosure to relevant governmental authorities of expenditures by the tobacco industry on advertising, promotion and sponsorship not yet prohibited. Those authorities may decide to make those figures available, subject to national law, to the public and to the Conference of the Parties, pursuant to Article 21;

(e) undertake a comprehensive ban or, in the case of a Party that is not in a position to undertake a comprehensive ban due to its constitution or constitutional principles, restrict tobacco advertising, promotion and sponsorship on radio, television, print media and, as appropriate, other media, such as the internet, within a period of five years; and

(f) prohibit, or in the case of a Party that is not in a position to prohibit due to its constitution or constitutional principles restrict, tobacco sponsorship of international events, activities and/or participants therein.

5. Parties are encouraged to implement measures beyond the obligations set out in paragraph 4.

6. Parties shall cooperate in the development of technologies and other means necessary to facilitate the elimination of cross-border advertising.

7. Parties which have a ban on certain forms of tobacco advertising, promotion and sponsorship have the sovereign right to ban those forms of cross-border tobacco advertising, promotion and sponsorship entering their territory and to impose equal penalties as those applicable to domestic advertising, promotion and sponsorship originating from their territory in accordance with their national law. This paragraph does not endorse or approve of any particular penalty.

8. Parties shall consider the elaboration of a protocol setting out appropriate measures that require international collaboration for a comprehensive ban on cross-border advertising, promotion and sponsorship.

Article 14

Demand reduction measures concerning tobacco dependence and cessation

1. Each Party shall develop and disseminate appropriate, comprehensive and integrated guidelines based on scientific evidence and best practices, taking into account national circumstances and priorities, and shall take effective measures to promote cessation of tobacco use and adequate treatment for tobacco dependence.

2. Towards this end, each Party shall endeavour to:

(a) design and implement effective programmes aimed at promoting the cessation of tobacco use, in such locations as educational institutions, health care facilities, workplaces and sporting environments;

(b) include diagnosis and treatment of tobacco dependence and counselling services on cessation of tobacco use in national health and education programmes, plans and strategies, with the participation of health workers, community workers and social workers as appropriate;

(c) establish in health care facilities and rehabilitation centres programmes for diagnosing, counselling, preventing and treating tobacco dependence; and

(d) collaborate with other Parties to facilitate accessibility and affordability for treatment of tobacco dependence including pharmaceutical products pursuant to Article 22. Such products and their constituents may include medicines, products used to administer medicines and diagnostics when appropriate.

Part IV: MEASURES RELATING TO THE REDUCTION OF THE SUPPLY OF TOBACCO

Article 15

Illicit trade in tobacco products

1. The Parties recognize that the elimination of all forms of illicit trade in tobacco products, including smuggling, illicit manufacturing and counterfeiting, and the development and implementation of related national law, in addition to subregional, regional and global agreements, are essential components of tobacco control.

2. Each Party shall adopt and implement effective legislative, executive, administrative or other measures to ensure that all unit packets and packages of tobacco products and any outside packaging of such products are marked to assist Parties in determining the origin of tobacco products, and in accordance with national law and relevant bilateral or multilateral agreements, assist Parties in determining the point of diversion and monitor, document and control the movement of tobacco products and their legal status. In addition, each Party shall:

(a) require that unit packets and packages of tobacco products for retail and wholesale use that are sold on its domestic market carry the statement: "Sales only allowed in (insert name of the country, subnational, regional or federal unit)" or carry any other effective marking indicating the final destination or which would assist authorities in determining whether the product is legally for sale on the domestic market; and

(b) consider, as appropriate, developing a practical tracking and tracing regime that would further secure the distribution system and assist in the investigation of illicit trade.

3. Each Party shall require that the packaging information or marking specified in paragraph 2 of this Article shall be presented in legible form and/or appear in its principal language or languages.

4. With a view to eliminating illicit trade in tobacco products, each Party shall:

(a) monitor and collect data on cross-border trade in tobacco products, including illicit trade, and exchange information among customs, tax and other authorities, as appropriate, and in accordance with national law and relevant applicable bilateral or multilateral agreements;

(b) enact or strengthen legislation, with appropriate penalties and remedies, against illicit trade in tobacco products, including counterfeit and contraband cigarettes;

(c) take appropriate steps to ensure that all confiscated manufacturing equipment, counterfeit and contraband cigarettes and other tobacco products are destroyed, using environmentally-friendly methods where feasible, or disposed of in accordance with national law;

(d) adopt and implement measures to monitor, document and control the storage and distribution of tobacco products held or moving under suspension of taxes or duties within its jurisdiction; and

(e) adopt measures as appropriate to enable the confiscation of proceeds derived from the illicit trade in tobacco products.

5. Information collected pursuant to subparagraphs 4(a) and 4(d) of this Article shall, as appropriate, be provided in aggregate form by the Parties in their periodic reports to the Conference of the Parties, in accordance with Article 21.

6. The Parties shall, as appropriate and in accordance with national law, promote cooperation between national agencies, as well as relevant regional and international intergovernmental organizations as it relates to investigations, prosecutions and proceedings, with a view to eliminating illicit trade in tobacco products. Special emphasis shall be placed on cooperation at regional and subregional levels to combat illicit trade of tobacco products.

7. Each Party shall endeavour to adopt and implement further measures including licensing, where appropriate, to control or regulate the production and distribution of tobacco products in order to prevent illicit trade.

Article 16

Sales to and by minors

1. Each Party shall adopt and implement effective legislative, executive, administrative or other measures at the appropriate government level to prohibit the sales of tobacco products to persons under the age set by domestic law, national law or eighteen. These measures may include:

(a) requiring that all sellers of tobacco products place a clear and prominent indicator inside their point of sale about the prohibition of tobacco sales to minors and, in case of doubt, request that each tobacco purchaser provide appropriate evidence of having reached full legal age;

(b) banning the sale of tobacco products in any manner by which they are directly accessible, such as store shelves;

(c) prohibiting the manufacture and sale of sweets, snacks, toys or any other objects in the form of tobacco products which appeal to minors; and

(d) ensuring that tobacco vending machines under its jurisdiction are not accessible to minors and do not promote the sale of tobacco products to minors.

2. Each Party shall prohibit or promote the prohibition of the distribution of free tobacco products to the public and especially minors.

3. Each Party shall endeavour to prohibit the sale of cigarettes individually or in small packets which increase the affordability of such products to minors.

4. The Parties recognize that in order to increase their effectiveness, measures to prevent tobacco product sales to minors should, where appropriate, be implemented in conjunction with other provisions contained in this Convention.

5. When signing, ratifying, accepting, approving or acceding to the Convention or at any time thereafter, a Party may, by means of a binding written declaration, indicate its commitment to prohibit the introduction of tobacco vending machines within its jurisdiction or, as appropriate, to a total ban on tobacco vending machines. The declaration made pursuant to this Article shall be circulated by the Depositary to all Parties to the Convention.

6. Each Party shall adopt and implement effective legislative, executive, administrative or other measures, including penalties against sellers and distributors, in order to ensure compliance with the obligations contained in paragraphs 1-5 of this Article.

7. Each Party should, as appropriate, adopt and implement effective legislative, executive, administrative or other measures to prohibit the sales of tobacco products by persons under the age set by domestic law, national law or eighteen.

Article 17

Provision of support for economically viable alternative activities

Parties shall, in cooperation with each other and with competent international and regional intergovernmental organizations, promote, as appropriate, economically viable alternatives for tobacco workers, growers and, as the case may be, individual sellers.

Part V: PROTECTION OF THE ENVIRONMENT

Article 18

Protection of the environment and the health of persons

In carrying out their obligations under this Convention, the Parties agree to have due regard to the protection of the environment and the health of persons in relation to the environment in respect of tobacco cultivation and manufacture within their respective territories.

Part VI: QUESTIONS RELATED TO LIABILITY

Article 19

Liability

1. For the purpose of tobacco control, the Parties shall consider taking legislative action or promoting their existing laws, where necessary, to deal with criminal and civil liability, including compensation where appropriate.

2. Parties shall cooperate with each other in exchanging information through the Conference of the Parties in accordance with Article 21 including:

(a) information on the health effects of the consumption of tobacco products and exposure to tobacco smoke in accordance with Article 20.3(a); and

(b) information on legislation and regulations in force as well as pertinent jurisprudence.

3. The Parties shall, as appropriate and mutually agreed, within the limits of national legislation, policies, legal practices and applicable existing treaty arrangements, afford one another assistance in legal proceedings relating to civil and criminal liability consistent with this Convention.

4. The Convention shall in no way affect or limit any rights of access of the Parties to each other's courts where such rights exist.

5. The Conference of the Parties may consider, if possible, at an early stage, taking account of the work being done in relevant international fora, issues related to liability including appropriate international approaches to these issues and appropriate means to support, upon request, the Parties in their legislative and other activities in accordance with this Article.

Part VII: SCIENTIFIC AND TECHNICAL COOPERATION AND COMMUNICATION OF INFORMATION

Article 20

Research, surveillance and exchange of information

1. The Parties undertake to develop and promote national research and to coordinate research programmes at the regional and international levels in the field of tobacco control. Towards this end, each Party shall:

(a) initiate and cooperate in, directly or through competent international and regional intergovernmental organizations and other bodies, the conduct of research and scientific assessments, and in so doing promote and encourage research that addresses the determinants and consequences of tobacco consumption and exposure to tobacco smoke as well as research for identification of alternative crops; and

(b) promote and strengthen, with the support of competent international and regional intergovernmental organizations and other bodies, training and support for all those engaged in tobacco control activities, including research, implementation and evaluation.

2. The Parties shall establish, as appropriate, programmes for national, regional and global surveillance of the magnitude, patterns, determinants and consequences of tobacco consumption and exposure to tobacco smoke. Towards this end, the Parties should integrate tobacco surveillance programmes into national, regional and global health surveillance programmes so that data are comparable and can be analysed at the regional and international levels, as appropriate.

3. Parties recognize the importance of financial and technical assistance from international and regional intergovernmental organizations and other bodies. Each Party shall endeavour to:

(a) establish progressively a national system for the epidemiological surveillance of tobacco consumption and related social, economic and health indicators;

(b) cooperate with competent international and regional intergovernmental organizations and other bodies, including governmental and nongovernmental agencies, in regional and global tobacco surveillance and exchange of information on the indicators specified in paragraph 3(a) of this Article; and

(c) cooperate with the World Health Organization in the development of general guidelines or procedures for defining the collection, analysis and dissemination of tobacco-related surveillance data.

4. The Parties shall, subject to national law, promote and facilitate the exchange of publicly available scientific, technical, socioeconomic, commercial and legal information, as well as information regarding practices of the tobacco industry and the cultivation of tobacco, which is relevant to this Convention, and in so doing shall take into account and address the special needs of developing country Parties and Parties with economies in transition. Each Party shall endeavour to:

(a) progressively establish and maintain an updated database of laws and regulations on tobacco control and, as appropriate, information about their enforcement, as well as pertinent jurisprudence, and cooperate in the development of programmes for regional and global tobacco control;

(b) progressively establish and maintain updated data from national surveillance programmes in accordance with paragraph 3(a) of this Article; and

(c) cooperate with competent international organizations to progressively establish and maintain a global system to regularly collect and disseminate information on tobacco production, manufacture and the activities of the tobacco industry which have an impact on the Convention or national tobacco control activities.

5. Parties should cooperate in regional and international intergovernmental organizations and financial and development institutions of which they are members, to promote and encourage provision of technical and financial resources to the Secretariat to assist developing country Parties and Parties with economies in transition to meet their commitments on research, surveillance and exchange of information.

Article 21

Reporting and exchange of information

1. Each Party shall submit to the Conference of the Parties, through the Secretariat, periodic reports on its implementation of this Convention, which should include the following:

(a) information on legislative, executive, administrative or other measures taken to implement the Convention;

(b) information, as appropriate, on any constraints or barriers encountered in its implementation of the Convention, and on the measures taken to overcome these barriers;

(c) information, as appropriate, on financial and technical assistance provided or received for tobacco control activities;

(d) information on surveillance and research as specified in Article 20; and

(e) information specified in Articles 6.3, 13.2, 13.3, 13.4(d), 15.5 and 19.2.

2. The frequency and format of such reports by all Parties shall be determined by the Conference of the Parties. Each Party shall make its initial report within two years of the entry into force of the Convention for that Party.

3. The Conference of the Parties, pursuant to Articles 22 and 26, shall consider arrangements to assist developing country Parties and Parties with economies in transition, at their request, in meeting their obligations under this Article.

4. The reporting and exchange of information under the Convention shall be subject to national law regarding confidentiality and privacy. The Parties shall protect, as mutually agreed, any confidential information that is exchanged.

Article 22

Cooperation in the scientific, technical, and legal fields and provision of related expertise

1. The Parties shall cooperate directly or through competent international bodies to strengthen their capacity to fulfill the obligations arising from this Convention, taking into account the needs of developing country Parties and Parties with economies in transition. Such cooperation shall promote the transfer of technical, scientific and legal expertise and technology, as mutually agreed, to establish and strengthen national tobacco control strategies, plans and programmes aiming at, inter alia:

(a) facilitation of the development, transfer and acquisition of technology, knowledge, skills, capacity and expertise related to tobacco control;

(b) provision of technical, scientific, legal and other expertise to establish and strengthen national tobacco control strategies, plans and programmes, aiming at implementation of the Convention through, inter alia:

(i) assisting, upon request, in the development of a strong legislative foundation as well as technical programmes, including those on prevention of initiation, promotion of cessation and protection from exposure to tobacco smoke;

(ii) assisting, as appropriate, tobacco workers in the development of appropriate economically and legally viable alternative livelihoods in an economically viable manner; and

(iii) assisting, as appropriate, tobacco growers in shifting agricultural production to alternative crops in an economically viable manner;

(c) support for appropriate training or sensitization programmes for appropriate personnel in accordance with Article 12;

(d) provision, as appropriate, of the necessary material, equipment and supplies, as well as logistical support, for tobacco control strategies, plans and programmes;

(e) identification of methods for tobacco control, including comprehensive treatment of nicotine addiction; and

(f) promotion, as appropriate, of research to increase the affordability of comprehensive treatment of nicotine addiction.

2. The Conference of the Parties shall promote and facilitate transfer of technical, scientific and legal expertise and technology with the financial support secured in accordance with Article 26.

Part VIII: INSTITUTIONAL ARRANGEMENTS AND FINANCIAL RESOURCES

Article 23

Conference of the Parties

1. A Conference of the Parties is hereby established. The first session of the Conference shall be convened by the World Health Organization not later than one year after the entry into force of this Convention. The Conference will determine the venue and timing of subsequent regular sessions at its first session.

2. Extraordinary sessions of the Conference of the Parties shall be held at such other times as may be deemed necessary by the Conference, or at the written request of any Party, provided that, within six months of the request being communicated to them by the Secretariat of the Convention, it is supported by at least one-third of the Parties.

3. The Conference of the Parties shall adopt by consensus its Rules of Procedure at its first session.

4. The Conference of the Parties shall by consensus adopt financial rules for itself as well as governing the funding of any subsidiary bodies it may establish as well as financial provisions governing the functioning of the Secretariat. At each ordinary session, it shall adopt a budget for the financial period until the next ordinary session.

5. The Conference of the Parties shall keep under regular review the implementation of the Convention and take the decisions necessary to promote its effective implementation and may adopt protocols, annexes and amendments to the Convention, in accordance with Articles 28, 29 and 33. Towards this end, it shall:

(a) promote and facilitate the exchange of information pursuant to Articles 20 and 21;

(b) promote and guide the development and periodic refinement of comparable methodologies for research and the collection of data, in addition to those provided for in Article 20, relevant to the implementation of the Convention;

(c) promote, as appropriate, the development, implementation and evaluation of strategies, plans, and programmes, as well as policies, legislation and other measures;

(d) consider reports submitted by the Parties in accordance with Article 21 and adopt regular reports on the implementation of the Convention;

(e) promote and facilitate the mobilization of financial resources for the implementation of the Convention in accordance with Article 26;

(f) establish such subsidiary bodies as are necessary to achieve the objective of the Convention;

(g) request, where appropriate, the services and cooperation of, and information provided by, competent and relevant organizations and bodies of the United Nations system and other international and regional intergovernmental organizations and nongovernmental organizations and bodies as a means of strengthening the implementation of the Convention; and

(h) consider other action, as appropriate, for the achievement of the objective of the Convention in the light of experience gained in its implementation.

6. The Conference of the Parties shall establish the criteria for the participation of observers at its proceedings.

Article 24

Secretariat

1. The Conference of the Parties shall designate a permanent secretariat and make arrangements for its functioning. The Conference of the Parties shall endeavour to do so at its first session.

2. Until such time as a permanent secretariat is designated and established, secretariat functions under this Convention shall be provided by the World Health Organization.

3. Secretariat functions shall be:

(a) to make arrangements for sessions of the Conference of the Parties and any subsidiary bodies and to provide them with services as required;

(b) to transmit reports received by it pursuant to the Convention;

(c) to provide support to the Parties, particularly developing country Parties and Parties with economies in transition, on request, in the compilation and communication of information required in accordance with the provisions of the Convention;

(d) to prepare reports on its activities under the Convention under the guidance of the Conference of the Parties and submit them to the Conference of the Parties;

(e) to ensure, under the guidance of the Conference of the Parties, the necessary coordination with the competent international and regional intergovernmental organizations and other bodies;

(f) to enter, under the guidance of the Conference of the Parties, into such administrative or contractual arrangements as may be required for the effective discharge of its functions; and

(g) to perform other secretariat functions specified by the Convention and by any of its protocols and such other functions as may be determined by the Conference of the Parties.

Article 25

Relations between the Conference of the Parties and intergovernmental organizations

In order to provide technical and financial cooperation for achieving the objective of this Convention, the Conference of the Parties may request the cooperation of competent international and regional intergovernmental organizations including financial and development institutions.

Article 26

Financial resources

1. The Parties recognize the important role that financial resources play in achieving the objective of this Convention.

2. Each Party shall provide financial support in respect of its national activities intended to achieve the objective of the Convention, in accordance with its national plans, priorities and programmes.

3. Parties shall promote, as appropriate, the utilization of bilateral, regional, subregional and other multilateral channels to provide funding for the development and strengthening of multisectoral comprehensive tobacco control programmes of developing country Parties and Parties with economies in transition. Accordingly, economically viable alternatives to tobacco production, including crop diversification should be addressed and supported in the context of nationally developed strategies of sustainable development.

4. Parties represented in relevant regional and international intergovernmental organizations, and financial and development institutions shall encourage these entities to provide financial assistance for developing country Parties and for Parties with economies in transition to assist them in meeting their obligations under the Convention, without limiting the rights of participation within these organizations.

5. The Parties agree that:

(a) to assist Parties in meeting their obligations under the Convention, all relevant potential and existing resources, financial, technical, or otherwise, both public and private that are available for tobacco control activities, should be mobilized and utilized for the benefit of all Parties, especially developing countries and countries with economies in transition;

(b) the Secretariat shall advise developing country Parties and Parties with economies in transition, upon request, on available sources of funding to facilitate the implementation of their obligations under the Convention;

(c) the Conference of the Parties in its first session shall review existing and potential sources and mechanisms of assistance based on a study conducted by the Secretariat and other relevant information, and consider their adequacy; and

(d) the results of this review shall be taken into account by the Conference of the Parties in determining the necessity to enhance existing mechanisms or to establish a voluntary global fund or other appropriate financial mechanisms to channel additional financial resources, as needed, to developing country Parties and Parties with economies in transition to assist them in meeting the objectives of the Convention.

Part IX: SETTLEMENT OF DISPUTES

Article 27

Settlement of disputes

1. In the event of a dispute between two or more Parties concerning the interpretation or application of this Convention, the Parties concerned shall seek through diplomatic channels a settlement of the dispute through negotiation or any other peaceful means of their own choice, including good offices, mediation, or conciliation. Failure to reach agreement by good offices, mediation or conciliation shall not absolve parties to the dispute from the responsibility of continuing to seek to resolve it.

2. When ratifying, accepting, approving, formally confirming or acceding to the Convention, or at any time thereafter, a State or regional economic integration organization may declare in writing to the Depositary that, for a dispute not resolved in accordance with paragraph 1 of this Article, it accepts, as compulsory, ad hoc arbitration in accordance with procedures to be adopted by consensus by the Conference of the Parties.

3. The provisions of this Article shall apply with respect to any protocol as between the parties to the protocol, unless otherwise provided therein.

Part X: DEVELOPMENT OF THE CONVENTION

Article 28

Amendments to this Convention

1. Any Party may propose amendments to this Convention. Such amendments will be considered by the Conference of the Parties.

2. Amendments to the Convention shall be adopted by the Conference of the Parties. The text of any proposed amendment to the Convention shall be communicated to the Parties by the Secretariat at least six months before the session at which it is proposed for adoption. The Secretariat shall also communicate proposed amendments to the signatories of the Convention and, for information, to the Depositary.

3. The Parties shall make every effort to reach agreement by consensus on any proposed amendment to the Convention. If all efforts at consensus have been exhausted, and no agreement reached, the amendment shall as a last resort be adopted by a three-quarters majority vote of the Parties present and voting at the session. For purposes of this Article, Parties present and voting means Parties present and casting an affirmative or negative vote. Any adopted amendment shall be communicated by the Secretariat to the Depositary, who shall circulate it to all Parties for acceptance.

4. Instruments of acceptance in respect of an amendment shall be deposited with the Depositary. An amendment adopted in accordance with paragraph 3 of this Article shall enter into force for those Parties having accepted it on the ninetieth day after the date of receipt by the Depositary of an instrument of acceptance by at least two-thirds of the Parties to the Convention.

5. The amendment shall enter into force for any other Party on the ninetieth day after the date on which that Party deposits with the Depositary its instrument of acceptance of the said amendment.

Article 29

Adoption and amendment of annexes to this Convention

1. Annexes to this Convention and amendments thereto shall be proposed, adopted and shall enter into force in accordance with the procedure set forth in Article 28.

2. Annexes to the Convention shall form an integral part thereof and, unless otherwise expressly provided, a reference to the Convention constitutes at the same time a reference to any annexes thereto.

3. Annexes shall be restricted to lists, forms and any other descriptive material relating to procedural, scientific, technical or administrative matters.

Part XI: FINAL PROVISIONS

Article 30

Reservations

No reservations may be made to this Convention.

Article 31

Withdrawal

1. At any time after two years from the date on which this Convention has entered into force for a Party, that Party may withdraw from the Convention by giving written notification to the Depositary.

2. Any such withdrawal shall take effect upon expiry of one year from the date of receipt by the Depositary of the notification of withdrawal, or on such later date as may be specified in the notification of withdrawal.

3. Any Party that withdraws from the Convention shall be considered as also having withdrawn from any protocol to which it is a Party.

Article 32

Right to vote

1. Each Party to this Convention shall have one vote, except as provided for in paragraph 2 of this Article.

2. Regional economic integration organizations, in matters within their competence, shall exercise their right to vote with a number of votes equal to the number of their Member States that are Parties to the Convention. Such an organization shall not exercise its right to vote if any of its Member States exercises its right, and vice versa.

Article 33

Protocols

1. Any Party may propose protocols. Such proposals will be considered by the Conference of the Parties.

2. The Conference of the Parties may adopt protocols to this Convention. In adopting these protocols every effort shall be made to reach consensus. If all efforts at consensus have been exhausted, and no agreement reached, the protocol shall as a last resort be adopted by a three-quarters majority vote of the Parties present and voting at the session. For the purposes of this Article, Parties present and voting means Parties present and casting an affirmative or negative vote.

3. The text of any proposed protocol shall be communicated to the Parties by the Secretariat at least six months before the session at which it is proposed for adoption.

4. Only Parties to the Convention may be parties to a protocol.

5. Any protocol to the Convention shall be binding only on the parties to the protocol in question. Only Parties to a protocol may take decisions on matters exclusively relating to the protocol in question.

6. The requirements for entry into force of any protocol shall be established by that instrument.

Article 34

Signature

This Convention shall be open for signature by all Members of the World Health Organization and by any States that are not Members of the World Health Organization but are members of the United Nations and by regional economic integration organizations at the World Health Organization Headquarters in Geneva from 16 June 2003 to 22 June 2003, and thereafter at United Nations Headquarters in New York, from 30 June 2003 to 29 June 2004.

Article 35

Ratification, acceptance, approval, formal confirmation or accession

1. This Convention shall be subject to ratification, acceptance, approval or accession by States and to formal confirmation or accession by regional economic integration organizations. It shall be open for accession from the day after the date on which the Convention is closed for signature. Instruments of ratification, acceptance, approval, formal confirmation or accession shall be deposited with the Depositary.

2. Any regional economic integration organization which becomes a Party to the Convention without any of its Member States being a Party shall be bound by all the obligations under the Convention. In the case of those organizations, one or more of whose Member States is a Party to the Convention, the organization and its Member States shall decide on their respective responsibilities for the performance of their obligations under the Convention. In such cases, the organization and the Member States shall not be entitled to exercise rights under the Convention concurrently.

3. Regional economic integration organizations shall, in their instruments relating to formal confirmation or in their instruments of accession, declare the extent of their competence with respect to the matters governed by the Convention. These organizations shall also inform the Depositary, who shall in turn inform the Parties, of any substantial modification in the extent of their competence.

Article 36

Entry into force

1. This Convention shall enter into force on the ninetieth day following the date of deposit of the fortieth instrument of ratification, acceptance, approval, formal confirmation or accession with the Depositary.

2. For each State that ratifies, accepts or approves the Convention or accedes thereto after the conditions set out in paragraph 1 of this Article for entry into force have been fulfilled, the Convention shall enter into force on the ninetieth day following the date of deposit of its instrument of ratification, acceptance, approval or accession.

3. For each regional economic integration organization depositing an instrument of formal confirmation or an instrument of accession after the conditions set out in paragraph 1 of this Article for entry into force have been fulfilled, the Convention shall enter into force on the ninetieth day following the date of its depositing of the instrument of formal confirmation or of accession.

4. For the purposes of this Article, any instrument deposited by a regional economic integration organization shall not be counted as additional to those deposited by States Members of the organization.

Article 37

Depositary

The Secretary-General of the United Nations shall be the Depositary of this Convention and amendments thereto and of protocols and annexes adopted in accordance with Articles 28, 29 and 33.

Article 38

Authentic texts

The original of this Convention, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.

IN WITNESS WHEREOF the undersigned, being duly authorized to that effect, have signed this Convention.

Atspoguļo starptautiskās sabiedrības bažas par pasaules mēroga postošo tabakas patēriņa un pakļaušanu tabakas dūmiem iedarbību uz veselību, par šīs iedarbības sociālajām, ekonomiskajām un vides sekām,

Nopietni satraucas par pieaugošo starptautisko cigarešu un citu tabakas izstrādājumu patēriņu, īpaši jaunattīstības valstīs, kā arī par slogu, ko tas rada ģimenēm, maznodrošinātajiem un valstu veselības sistēmām,

Apzinoties, ka zinātniskie pētījumi ir nepārprotami pierādījuši to, ka tabakas patēriņš un pakļaušana tabakas dūmu iedarbībai var izraisīt nāvi, slimības un invaliditāti, un pastāv nobīde laikā starp pakļaušanu smēķēšanai un cita veida tabakas izstrādājumu lietošanu un uz tabaku attiecināmu slimību cēloņiem,

Konstatējot arī to, ka cigaretes un vairāki citi tabaku saturoši produkti ir izstrādāti ar augstu atkarības pakāpi ar mērķi radīt un uzturēt atkarību, un daudzas saturošās sastāvdaļas, kā arī to radītie dūmi ir farmakoloģiski aktīvi, toksiski, mutagēni un kancerogēni, un to, ka atkarība no tabakas tiek atsevišķi klasificēta kā traucēklis lielākajos starptautiskajos slimību klasifikatoros,

Atzīstot, ka pastāv nepārprotami zinātniski pierādījumi, ka pirmsdzemdību pakļaušana tabakas dūmiem izraisa kaitīgu veselības un attīstības vidi bērniem,

Ļoti norūpējušies par smēķēšanas un citu tabakas patēriņa veidu eskalāciju bērnu un pusaudžu vidū pasaules mērogā, īpaši smēķēšanu agrīnā vecumā, kam ir tendence pieaugt,

Satraukušies par pieaugošo smēķēšanu un citu tabakas patēriņa veidu pieaugumu sieviešu un jaunu meiteņu vidū pasaules mērogā, un paturot prātā nepieciešamību pilnīgai sieviešu dalībai politikas veidošanā un ieviešanā visos līmeņos, un nepieciešamību pēc dzimumu specifiskas tabakas uzraudzības stratēģijas,

Ļoti norūpējušies par augsto smēķēšanas un citu tabakas izstrādājumu augsto patēriņa līmeni iezemiešu tautu vidū,

Nopietni nobažījušies par visa veida reklāmu, veicināšanas un sponsorēšanas formu ietekmi, mērķētu uz tabakas izstrādājumu lietošanu,

Konstatējot, ka ir nepieciešama saskaņota rīcība ar mērķi ierobežot visas cigarešu un citu tabakas izstrādājumu nelikumīgas tirdzniecības formas, ieskaitot kontrabandu, nelikumīgu ražošanu un viltošanu,

Atzīstot, ka tabakas uzraudzība visos līmeņos un īpaši jaunattīstības valstīs un valstīs ar pārejas ekonomiku prasa pietiekamus finansu un tehniskos resursus, atbilstošus esošajām un paredzamajām tabakas uzraudzības aktivitātēm,

Konstatējot nepieciešamību attīstīt atbilstošas struktūras ar mērķi līdzdarboties un iesaistīties ilgtermiņa sociālo un ekonomisko problēmu risināšanā, sekmīgai tabakas pieprasījuma samazināšanas stratēģijas ieviešanai,

Piesardzīgi paturot prātā sociālās un ekonomiskās grūtības, kuras var izraisīt tabakas uzraudzības programmas vidēja un ilgtermiņa perspektīvā atsevišķās attīstības valstīs un valstīs ar pārejas ekonomiku, un konstatējot vajadzību pēc tehniskas un finansu palīdzības, ilgtspējīgas nacionālās attīstības stratēģiju kontekstā,

Apzinoties daudzu Valstu paveikto vērtīgo darbu tabakas uzraudzības jomā un uzticoties Pasaules Veselības organizācijas vadībai, kā arī citu organizāciju un Apvienoto Nāciju sistēmas struktūru pūlēm un citām starptautiskām un reģionālām starpvalstu organizācijām, izstrādājot pasākumus tabakas uzraudzībai,

Uzsverot īpašo nevalstisko organizāciju un citu civilās sabiedrības locekļu, nesaistītu ar tabakas industriju, ieguldījumu, ieskaitot veselības profesionāļu struktūras, sieviešu, jauniešu, vides un patērētāju grupas, un akadēmiskās un veselības aprūpes institūcijas, tabakas uzraudzības centienus valstiskā un starptautiskā līmenī un to nozīmīgo darbu un piedalīšanos valsts un starptautiska mēroga tabakas uzraudzības pasākumu ieviešanā,

Atsaucoties uz Starptautisko līgumu par ekonomiskajām, sociālajām un kultūras tiesībām, kuras akceptēja Apvienoto Nāciju Vispārējā Asamblejā 1966.gada 16.decembrī, 12.pantu, kas nosaka, ka katrs cilvēks ir tiesīgs baudīt visaugstākos fiziskās un garīgās veselības standartus,

Atsaucoties arī uz Pasaules Veselības organizācijas Konstitūciju, kas nosaka, ka visaugstāko veselības standartu baudīšana ir viena no katra cilvēka pamata tiesībām, nediskriminējot pēc rases, reliģijas, politiskās pārliecības, ekonomiskiem vai sociāliem faktoriem,

Apņemties veicināt tabakas uzraudzības pasākumus, balstoties uz esošajiem un saistītiem zinātniskiem, tehniskiem un ekonomiskiem apsvērumiem,

Atsaucoties uz Konvenciju par visu sieviešu diskriminācijas formu likvidēšanu, kuru akceptēja Apvienoto Nāciju Vispārējā Asamblejā 1979.gada 18.decembrī, kura nosaka, ka Konvencijas Dalībvalstis veiks atbilstošus pasākumus, lai likvidētu sieviešu diskrimināciju veselības aprūpes jomā,

Atsaucoties tālāk uz Bērnu tiesību konvenciju, kuru akceptēja Apvienoto Nāciju Vispārējā Asambleja 1989.gada 20.novembrī, atzīstot bērnu tiesības baudīt visaugstākos veselības standartus,

Vienojās par sekojošo:

I daļa: IEVADS

1.pants

Terminu lietošana

Šīs Konvencijas nolūkā:

(a) "nelikumīga tirdzniecība" nozīmē jebkura ar likumu aizliegta prakse vai darbība, attiecināma uz ražošanu, nosūtīšanu, saņemšanu, piederību, izplatīšanu, pārdošanu vai pirkšanu, ieskaitot jebkuru praksi vai darbību, kas vērsta uz šādas aktivitātes veicināšanu;

(b) "reģionālās ekonomiskās integrācijas organizācija" nozīmē organizāciju, kas sastāv no vairākām suverēnām valstīm un kurai tās Dalībvalstis ir nodevušas kompetenci attiecībā uz virkni jautājumu, ieskaitot pilnvaru pieņemt lēmumus, kas ir saistoši tās Dalībvalstīm attiecībā uz tiem jautājumiem;1

(c) "tabakas reklāmā un veicināšana" nozīmē jebkuru komerciālu komunikāciju, rekomendāciju vai darbību ar mērķi ietekmēt vai iespējami ietekmēt tabakas izstrādājumu vai tabakas izmantošanu vai nu tiešā vai netiešā veidā;

(d) "tabakas uzraudzība" nozīmē virkni piedāvājuma, pieprasījuma un kaitīguma samazināšanas stratēģijas ar mērķi uzlabot iedzīvotāju veselību, ierobežojot vai samazinot tabakas izstrādājumu patēriņu un iedzīvotāju pakļaušanu tabakas dūmiem;

(e) "tabakas industrija" nozīmē tabakas ražotāji, vairumtirgotāji un tabakas izstrādājumu importētāji;

(f) "tabakas izstrādājumi" nozīmē izstrādājumus, kas ir pilnībā vai daļēji izgatavoti no tabakas lapām kā izejmateriāla, kas paredzēti smēķēšanai, sūkšanai, košļāšanai vai šņaukšanai;

(g) "tabakas sponsorēšana" nozīmē jebkura veida ieguldījumu jebkuram pasākumam, aktivitātei vai indivīdam ar mērķi ietekmēt vai iespējami ietekmēt tabakas izstrādājumu vai tabakas izmantošanu vai nu tiešā vai netiešā veidā;

2.pants

Saistība starp šo Konvenciju un citiem līgumiem un juridiskiem dokumentiem

1. Puses tiek iedrošinātas ieviest pasākumus ārpus šajā Konvencijā un tās protokolos noteiktajiem pasākumiem, ar mērķi labāk aizsargāt cilvēku veselību, un nekas no šajos dokumentos noteiktajiem pasākumiem neatturēs Pusi no stingrāku pasākumu ieviešanas, saskaņā ar šiem noteikumiem un starptautisko likumdošanu.

2. Konvencijas noteikumi un tās protokoli nekāda veidā neietekmēs Pušu tiesības stāties divpusējos vai daudzpusējos līgumos, ieskaitot reģionālos vai mazāka administratīvā iedalījuma reģionos, saistībā ar vai papildus jautājumiem, attiecībā uz Konvenciju un tās protokoliem, nodrošinot to, ka šādi līgumi ir savienojami ar to saistībām šīs Konvencijas un tās protokolu ietvaros. Ieinteresētās Puses paziņos par šādiem līgumiem Pušu Konferencei ar Sekretariāta starpniecību.

II daļa: MĒRĶIS, VADOŠIE PRINCIPI UN VISPĀRĒJĀS SAISTĪBAS

3.pants

Mērķis

Šīs Konvencijas un tās protokolu mērķis ir aizsargāt esošās un nākotnes paaudzes no postošām veselības, sociālām, vides un ekonomiskām tabakas patēriņa un pakļaušanu tabakas dūmiem sekām, nodrošinot ietvarus tabakas uzraudzības pasākumiem, kuri ir jāievieš Pusēm valsts, reģionālajā un starptautiskajā līmenī, nolūkā samazināt nepārtraukti un pamatīgi tabakas izmantošanas un pakļaušanu tabakas dūmiem izplatību.

4.pants

Vadošie principi

Lai sasniegtu šīs Konvencijas un tās protokolu mērķi un ieviestu tās nosacījumus, Puses, cita starpā, darbosies saskaņā ar šeit izklāstītajiem principiem:

1. Katram cilvēkam ir jābūt informētam par tabakas patēriņa un pakļaušanu tabakas dūmiem radītām veselības sekām, kaitīgu ieradumu veicināšanu un mirstības briesmām, un attiecīgajā valdības līmenī būtu jāpārskata efektīvi likumdošanas, izpildvaras, administratīvie un citi pasākumi ar mērķi aizsargāt visus cilvēkus no pakļaušanas tabakas dūmiem.

2. Ir nepieciešama stingra politiskā apņemšanās, lai izstrādātu un atbalstītu valsts, reģionālajā un starptautiskajā līmenī visaptverošus starpsektoru pasākumus un koordinētu attiecīgo rīcību, ņemot vērā sekojošo:

(a) nepieciešamība veikt pasākumus, lai aizsargātu visus cilvēkus no pakļaušanas tabakas dūmiem;

(b) nepieciešamība veikt pasākumus, lai novērstu veicināšanu un atbalstītu pārtraukšanu un samazinātu tabakas izstrādājumu lietošanu jebkurā formā;

(c) nepieciešamība veikt pasākumus, lai veicinātu vietējo iedzīvotāju un sabiedrības piedalīšanos tabakas uzraudzības programmu izstrādē, ieviešanā un novērtēšanā, kas ir sociāli un no vietējās kultūras pieņemami vietējo iedzīvotāju vajadzībām un perspektīvām; un

(d) nepieciešamība veikt pasākumus, lai apzinātu dzimuma specifiskus riskus, izstrādājot tabakas uzraudzības stratēģijas.

3. Starptautiskā sadarbība, īpaši tehnoloģiju, zināšanu nodošana un finansu palīdzības sniegšana un attiecīgās ekspertīzes nodrošināšana ar mērķi izveidot un ieviest efektīvas tabakas uzraudzības programmas, ņemot vērā vietējo kultūru, kā arī sociālos, politiskos un likumdošanas faktorus, ir svarīga Konvencijas sastāvdaļa.

4. Visaptveroši daudzsektoru pasākumi un centieni samazināt visu tabakas izstrādājumu lietošanu valsts, reģionālajā un starptautiskajā līmenī ir būtiski, saskaņā ar sabiedrības veselības principiem, saslimstības izraisīšanas, priekšlaicīgas invaliditātes un mirstības tabakas patēriņa un pakļautības tabakas dūmiem novēršanai.

5. Jautājumi, kas attiecas uz atbildību, kā noteikts katrai Pusei tās jurisdikcijas ietvaros, ir svarīga visaptverošas tabakas uzraudzības sastāvdaļa.

6. Tehniskās un finansu palīdzības nozīmība, lai sekmētu tabakas audzētāju un strādnieku ekonomisko pāreju, kuru iztikas līdzekļi tiek nopietni apdraudēti tabakas uzraudzības kontroles programmu ieviešanas rezultātā attīstības valstu Pusēs, kā arī Pusēm ar pārejas ekonomiku, tās būtu jāreorganizē un jāpārskata valsts ilgtspējīgas attīstības stratēģijas kontekstā.

7. Civiliedzīvotāju piedalīšanās ir būtiska Konvencijas un tās protokolos noteikto mērķu sasniegšanai.

5.pants

Vispārējie pienākumi

1. Katra Puse izstrādās, ieviesīs, periodiski papildinās un pārskatīs visaptverošas daudzsektoru valsts tabakas uzraudzības stratēģijas, plānus un programmas, saskaņā ar šo Konvenciju un protokoliem, kuras dalībniece ir Puse.

2. Līdz ar šo katra Puse, atbilstoši savām iespējām:

(a) izveidos vai pastiprinās un finansēs valsts koordinācijas mehānismu vai galvenās struktūras tabakas uzraudzībai; un

(b) pieņems un ieviesīs efektīvus likumdošanas, izpildvaras, administratīvos un/vai citus pasākumus un sadarbosies, kur piemērots, ar citām Pusēm, izstrādājot atbilstošas politikas tabakas patēriņa novēršanai un samazināšanai, atkarībai no nikotīna un pakļaušanai tabakas dūmiem.

3. Puses, ieviešot un nosakot attiecīgās sabiedrības veselības politikas tabakas uzraudzības jomā, darbosies ar mērķi aizsargāt šīs politikas no komerciālām un cita veida likumīgām tabakas industrijas interesēm, saskaņā ar valsts likumdošanu.

4. Puses sadarbosies piedāvāto pasākumu, procedūru un vadlīniju formulēšanā Konvencijas un tās protokolu, kuru dalībnieces ir Puses, ieviešanā.

5. Puses, kur piemērots, sadarbosies, ar kompetentām starptautiskām un reģionālām starpvaldību organizācijām un citām struktūrām, lai sasniegtu Konvencijas un tās protokolu mērķus, kuru dalībnieces ir Puses.

6. Puses, tām pieejamo līdzekļu un resursu ietvaros, sadarbosies ar mērķi iegūt finansu resursus efektīvai Konvencijas ieviešanai ar divpusēju un daudzpusēju finansēšanas mehānismu palīdzību.

III daļa: PASĀKUMI TABAKAS PIEPRASĪJUMA SAMAZINĀŠANAI

6.pants

Cenu un nodokļu pasākumi tabakas pieprasījuma samazināšanai

1. Puses atzīst, ka cenu un nodokļu pasākumi ir iedarbīgs un svarīgs tabakas pieprasījuma patēriņa samazināšanas līdzeklis dažādos iedzīvotāju segmentos, īpaši jauniešu vidū.

2. Bez aizspriedumiem attiecībā uz Pušu suverenām tiesībām noteikt un nodibināt nodokļu politikas, katrai Pusei būtu jāņem vērā tās valstiskie veselības mērķi attiecībā uz tabakas uzraudzību un adopciju vai uzturēšanu, kur piemērojams, tādi pasākumi var ietvert sekojošo:

(a) nodokļu politiku ieviešana un, kur piemērojams, cenu politika tabakas izstrādājumiem ar mērķi sniegt ieguldījumu veselībai tabakas patēriņa samazināšanas nolūkā; un

(b) aizliegt vai ierobežot, kur piemērojams, starptautiskiem ceļotājiem bez nodokļu un bez nodevu tabakas izstrādājumu pārdošanu un/vai importu.

3. Puses nodrošinās nodokļu likmes tabakas izstrādājumiem un informāciju par tendencēm tabakas patēriņam savos periodiskajos ziņojumos Pušu Konferencei, saskaņā ar 21.pantu.

7.pants

Necenu pasākumi tabakas pieprasījuma samazināšanai

Puses atzīst, ka visaptveroši necenu pasākumi ir efektīvs un svarīgs līdzeklis tabakas patēriņa samazināšanai. Katra Puse pieņems un ieviesīs efektīvus likumdošanas, izpildvaras, administratīvos un citus pasākumus, kas nepieciešami tās saistību ieviešanai, saskaņā ar 8. līdz 13. pantam, un sadarbosies, kur piemērots, viena ar otru tiešā veidā vai ar kompetentu starptautisko organizāciju starpniecību ar nolūku to ieviest. Pušu Konference piedāvās atbilstošas vadlīnijas šo pantu nosacījumu ieviešanai.

8.pants

Aizsardzība no pakļaušanas tabakas dūmiem

1. Puses atzīst, ka pastāv nepārprotami zinātniski pierādījumi tam, ka pakļaušana tabakas dūmiem izraisa nāvi, slimības un invaliditāti.

2. Katra Puse pieņems un ieviesīs esošajai valsts jurisdikcijā attiecīgajās jomās, saskaņā ar valsts likumdošanu, un aktīvi veicinās citos jurisdikcijas līmeņos efektīvus likumdošanas, izpildvaras, administratīvos un/vai citus pasākumus, kas nodrošina aizsardzību no pakļaušanas tabakas dūmiem darba vietās iekštelpās, sabiedriskajā transportā, sabiedriskās iekštelpās un, kur piemērojams, citās sabiedriskās vietās.

9.pants

Tabakas izstrādājumu satura regulēšana

Pušu Konference, konsultējoties ar kompetentām starptautiskām struktūrām, piedāvās vadlīnijas tabakas izstrādājumu satura pārbaudei, mērīšanai un izplūdei, un šī satura un izplūdes regulēšanai. Katra Puse, kur to ir apstiprinājušas kompetentas valsts iestādes, pieņems un ieviesīs efektīvas likumdošanas izpildvaras, administratīvās un citas metodes šādai pārbaudei, mērīšanai un regulēšanai.

10. pants.

Tabakas izstrādājumu atklāšanas regulēšana

Katra Puse, saskaņā ar tās valsts likumdošanu, pieņems un ieviesīs efektīvus likumdošanas, izpildvaras, administratīvos un citus pasākumus, kas prasa tabakas izstrādājumu ražotājiem un importētājiem atklāt valdības iestādēm informāciju par tabakas izstrādājumu saturu un izplūdi.

Katra Puse tālāk attiecīgi pieņems un ieviesīs efektīvus pasākumus informācijas izpaušanai sabiedrībai par tabakas izstrādājumu toksiskajām sastāvdaļām un to radītajām izplūdēm.

11.pants

Tabakas izstrādājumu iepakošana un marķēšana

1. Katra Puse trīs gadu laikā pēc šīs Konvencijas stāšanās spēkā attiecīgajai Pusei, pieņems un ieviesīs, saskaņā ar tās valsts likumdošanu, efektīvus pasākumus, lai nodrošinātu sekojošo:

(a) tabakas izstrādājumu iepakojums un marķēšana nesekmē tabakas izstrādājumu jebkādā nepareizā, maldinošā, dezinformējošā vai līdzīga veidā ar nolūku radīt kļūdainu priekšstatu par tā īpašībām, veselības sekām, riskiem vai izplūdi, ieskaitot jebkuru termiņu, aprakstu un preču zīmi, tēlainu vai jebkādu citu zīmi, kas tieši vai netieši rada maldinošu iespaidu par to, ka īpašais tabakas izstrādājums ir mazāk kaitīgs kā citi tabakas izstrādājumi. Tie var ietvert tādus terminus kā "zems nikotīna līmenis", "viegls", "ultra-viegls" vai "maigs"; un

(b) katrai paciņai un tabakas izstrādājumu paciņai un jebkādam ārējam iepakojumam un šādu izstrādājumu marķēšanai arī ir jāietver veselības brīdinājumi, kas apraksta postošās tabakas lietošanas sekas, un var ietvert citus atbilstošus paziņojumus. Šie brīdinājumi un ziņojumi:

(i) ir jāapstiprina kompetentai valsts institūcijai;

(ii) tiem ir jāmainās;

(iii) tiem ir jābūt lieliem, skaidriem, acīmredzamiem un salasāmiem;

(iv) tiem būtu jāpārstāv 50% vai vairāk no galvenās teksta izkārtojuma platības, bet ne mazāk kā 30% no galvenās teksta izkārtojuma platības;

(v) var būt attēlu vai piktogrammu formā.

2. Katrai paciņai un tabakas izstrādājuma iepakojumam un jebkuram šādu tabakas izstrādājumu ārējam iepakojumam un marķējumam, papildus šī panta 1(b) paragrāfā noteiktajiem brīdinājumiem, ir jāsatur informācija par attiecīgajām tabakas izstrādājumu sastāvdaļām un izplūdi, kā to nosaka valsts iestādes.

3. Katra Puse pieprasīs, lai brīdinājumi un cita tekstuālā informācija, noteikta šī panta paragrāfos 1(b) un 2, parādītos uz katras paciņas un tabakas izstrādājumu paciņas un uz jebkura šādu izstrādājumu ārējā iepakojuma un marķējuma tās pamata valodā vai valodās.

4. Šī panta nolūkā termins "ārējais iepakojums un marķējums" attiecībā uz tabakas izstrādājumiem ir attiecināms uz jebkuru iepakojumu un marķējumu, kuru izmanto izstrādājumu mazumtirdzniecībā.

12.pants

Izglītība, komunikācija, apmācība un sabiedrības apziņa

Katra Puse sekmēs un nostiprinās sabiedrības apziņu par tabakas uzraudzības jautājumiem, izmantojot visus pieejamos komunikāciju instrumentus, kur piemērots. Līdz šim, katra Puse pieņems un ieviesīs efektīvus likumdošanas, izpildvaras, administratīvos un citus pasākumus, lai veicinātu:

(a) plašu pieeju iedarbīgām un visaptverošām izglītības un sabiedrības apziņas programmām par veselības riskiem, ieskaitot tabakas patēriņa kaitīgus ieradumus veicinošās īpašības un pakļaušanu tabakas dūmiem;

(b) sabiedrības apziņa par tabakas patēriņa veselības riskiem un pakļaušanu tabakas dūmiem, un par ieguvumiem, pārtraucot lietot tabaku un dzīves veidu brīvu no smēķēšanas, kā noteikts pantā 14.2;

(c) sabiedrības pieejamība, saskaņā ar valsts likumdošanu, plašai informācijai par tabakas industriju, kā atbilstošu šīs Konvencijas mērķim;

(d) iedarbīga un atbilstoša apmācība vai jūtīguma radīšana un apziņas programmas par tabakas uzraudzību, kas paredzētas tādiem cilvēkiem, kā veselības darbiniekiem, sabiedriskajiem darbiniekiem, sociālajiem darbiniekiem, mēdiju profesionāļiem, pasniedzējiem, lēmumu pieņēmējiem, administratoriem un citām iesaistītām personām;

(e) apzināšanās un sabiedrības un privāto aģentūru un nevalstisko organizāciju, nesaistītu ar tabaka industriju, iesaistīšanās, starpsektoru programmu un stratēģiju izstrādē tabakas uzraudzībai; un

(f) sabiedrības apziņa un pieejamība informācijai, attiecībā uz tabakas ražošanas un patēriņa kaitīgām veselības, ekonomiskajām un vides sekām.

13.pants

Tabakas reklāma, veicināšana un sponsorēšana

1. Puses atzīst, ka vispārējs aizliegums reklamēt, veicināt un sponsorēt samazinātu tabakas izstrādājumu patēriņu.

2. Katra Puse, saskaņā ar tās konstitūciju vai konstitucionālajiem principiem, uzņemas vispārēju aizliegumu visa veida tabakas izstrādājumu reklāmai, veicināšanai un sponsorēšanai. Tas ietvers, atbilstoši Puses spēkā esošajai vides likumdošanai un pieejamajiem tehniskajiem līdzekļiem, vispārēju aizliegumu uz pārrobežu reklāmu, veicināšanu un sponsorēšanu, kuras izcelsme ir Puses teritorija. Attiecībā uz šo piecu gadu laikā pēc Konvencijas stāšanās spēkā attiecīgās Puses valstī, katra Puse uzņemsies atbilstošus likumdošanas, izpildvaras, administratīvos un/vai citus pasākumus un attiecīgi ziņos, saskaņā ar 21. pantu.

3. Puse, kura nav tādā situācijā, lai uzņemtos vispārēju aizliegumu saskaņā ar tās konstitūciju vai konstitucionālajiem principiem, pielietos ierobežojumus visa veida tabakas reklāmai, veicināšanai un sponsorēšanai. Tas ietvers, saskaņā ar valsts Puses vides likumdošanu un pieejamajiem tehniskajiem līdzekļiem, ierobežojumus vai vispārēju aizliegumu reklāmai, veicināšanai un sponsorēšanai, kuras izcelsme teritorija ir Puses valsts ar pārrobežu sekām. Attiecībā uz šo, katra Puse uzņemsies atbilstošus likumdošanas, izpildvaras, administratīvos un/vai citus pasākumus un attiecīgi ziņos, saskaņā ar 21. pantu.

4. Kā minimums un saskaņā ar tās konstitūciju vai konstitūcijas principiem, katra Puse:

(a) aizliegs visa veida tabakas reklāmu, veicināšanu un sponsorēšanu, kas sekmē tabakas izstrādājumu lietošanu, ar jebkādiem maldīgiem, dezinformējošiem vai viltus vai līdzīgiem līdzekļiem, lai radītu kļūdainu priekšstatu par tā īpašībām, veselības sekām, riskiem vai izplūdi;

(b) pieprasīs, lai veselības vai citi atbilstoši brīdinājumi vai paziņojumi būtu izvietoti uz visām tabakas reklāmām un, kur atbilstošs, veicināšanai un sponsorēšanai;

(c) ierobežos tiešās vai netiešās iniciatīvas, kas iedrošina tabakas izstrādājumu pirkšanu sabiedrībā;

(d) pieprasīs, ja tam nav vispārējs aizliegums, attiecīgām valsts institūcijām izpaust izdevumus tabakas industrijā par reklāmu, veicināšanu un sponsorēšanu, kas vēl nav aizliegta. Šīs institūcijas var izlemt padarīt šos skaitļus pieejamus, saskaņā ar valsts likumdošanu, sabiedrībai un Pušu Konferencei, saskaņā ar 21.pantu;

(e) uzņemsies vispārēju aizliegumu vai, ja Puse nav tādā situācijā, lai uzņemtos vispārēju aizliegumu saskaņā ar tas konstitūciju vai konstitūcijas principiem, ierobežot reklāmu, veicināšanu un sponsorēšanu radio, televīzijā, drukas mēdijos un, kur atbilstošs, tādos kā internets, piecu gadu laikā; un

(f) aizliegs vai, ja Puse nav tādā situācijā, lai uzņemtos vispārēju aizliegumu, saskaņā ar tās konstitūciju vai konstitūcijas principiem, ierobežot tabakas sponsorēšanu starptautiska mēroga pasākumos, aktivitātēs un/vai piedalīšanos tajos.

5. Puses tiek iedrošinātas ieviest pasākumus ārpus 4.paragrāfā noteiktajām saistībām.

6. Puses sadarbosies tehnoloģiju un citu līdzekļu attīstībā, kas nepieciešami pārrobežu reklāmas ierobežošanai.

7. Pusēm, kurām ir noteikts aizliegums noteiktu tabakas veidu reklāmai, veicināšanai un sponsorēšanai, ir suverēnas tiesības aizliegt tos pārrobežu reklāmas, veicināšanas un sponsorēšanas veidus, kas ieiet to teritorijā, un aplikt tos ar līdzīgām soda naudām kā tās, kuras tiek pielietotas vietējām reklāmām, veicināšanai un sponsorēšanai, kuras izcelsmes teritorija ir Puses valsts, saskaņā ar to valstu likumdošanu. Šis paragrāfs neapstiprina nevienu īpašu naudas sodu.

8. Puses apsvērs iespēju izstrādāt protokolu, kas nosaka atbilstošus pasākumus, kam nepieciešama starptautiska sadarbība vispārējai pārrobežu reklāmai, veicināšanai un sponsorēšanai.

14.pants

Pieprasījuma samazināšanas pasākumi attiecībā uz atkarību no tabakas un pārtraukšanu

1. Katra Puse izstrādās un izplatīs atbalstošas, vispārējas un integrētas vadlīnijas, pamatotas uz zinātniskiem pierādījumiem un vislabāko praksi, ņemot vērā valsts apstākļus un prioritātes, un veiks efektīvus pasākumus, lai veicinātu tabakas lietošanas pārtraukšanu un adekvātu ārstēšanu no tabakas atkarības.

2. Līdz šim Puses centīsies paveikt sekojošo:

(a) izstrādāt un ieviest efektīvas programmas ar mērķi veicināt tabakas izmantošanas pārtraukšanu, tādās vietās kā izglītības iestādes, veselības aprūpes iestādes, darba vietas un sporta iestādes;

(b) iekļaut diagnostikas un atkarības no tabakas ārstēšanu un konsultāciju pakalpojumus par tabakas lietošanas pārtraukšanu valsts veselības un izglītības programmās, plānos un stratēģijās ar veselības darbinieku, sabiedrisko darbinieku un sociālo darbinieku piedalīšanos, kur piemērojams;

(c) izveidot diagnostikas, konsultāciju, profilakses un ārstēšanas no tabakas atkarības programmas veselības aprūpes iestādēs un rehabilitācijas centros; un

(d) sadarboties ar citām Pusēm ar mērķi sekmēt ārstēšanas no tabakas atkarības pieejamību, ieskaitot farmaceitiskos izstrādājumus, saskaņā ar 22.pantu. Šādi produkti un sastāvdaļas var ietvert zāles, produktus, kurus izmanto zāļu administrēšanai un diagnostikai, kur piemērojams.

IV daļa: PASĀKUMI TABAKAS PIEDĀVĀJUMA SAMAZINĀŠANAI

15.pants

Nelegāla tirdzniecība ar tabakas izstrādājumiem

1. Puses atzīst, ka visu nelegālās tirdzniecības veidu ierobežošana ar tabakas izstrādājumiem, ieskaitot kontrabandu, nelegālu ražošanu un viltošanu, kā arī attiecīgo valsts likumdošanu izstrāde un ieviešana, papildus reģionālajiem, mazāka mēroga administratīvi reģionālajiem un globālajiem līgumiem ir būtiski tabakas uzraudzības komponenti.

2. Katra Puse pieņems un ieviesīs efektīvus likumdošanas, izpildvaras, administratīvos un citus pasākumus, lai nodrošinātu to, ka visi tabakas izstrādājumu iepakojumi un paciņas un jebkādi šādu produktu ārējie iepakojumi ir marķēti tā, lai palīdzētu Pusēm noteikt tabakas izstrādājumu izcelsmi un, saskaņā ar valsts likumdošanu un attiecīgajiem divpusējiem un daudzpusējiem līgumiem, palīdzētu Pusēm noteikt novirzīšanās punktu un kontrolēt, dokumentēt un uzraudzīt tabakas izstrādājumu kustību un to juridisko statusu. Papildus, katra Puse veiks sekojošo:

(a) pieprasīs, lai vienības paciņas un tabakas izstrādājumu paciņas mazumtirdzniecībai un vairumtirdzniecībai, kuras tiek izmantotas tirdzniecībai vietējā tirgū ietver paziņojumu: "Pārdošana atļauta tikai (ievietot valsts, nacionālo, reģionālo vai federālas vienības nosaukumu)" vai izvietot jebkuru citu efektīvu apzīmējumu, norādot gala saņēmēju vai tādu apzīmējumu, kas palīdzētu noteikt to, vai produktu var likumīgi pārdot vietējā tirgū; un

(b) apsvērt, kur atbilstošs, praktisku izsekošanas režīmu, kas arī tālāk nodrošinātu sadales sistēmu un palīdzētu nelikumīgās tirdzniecības izmeklēšanā.

3. Katra Puse pieprasīs, lai informācija uz iepakojuma vai marķējuma, noteikta šī panta 2.paragrāfā, būtu izvietota salasāmā veidā un/vai parādītos uz tās pamata valodā vai valodās.

4. Katra Puse, ar nolūku ierobežot nelegālo tabakas izstrādājumu tirdzniecību, uzņemsies sekojošo:

(a) uzraudzīs un savāks datus par pārrobežu tabakas izstrādājumu tirdzniecību, ieskaitot nelegālo tirdzniecību un informācijas apmaiņu starp muitām un citām varas iestādēm, kur atbilstošs, un saskaņā ar valsts likumdošanu un attiecīgajiem divpusējiem vai daudzpusējiem līgumiem;

(b) ieviesīs vai nostiprinās likumdošanu ar attiecīgajiem naudas sodiem un līdzekļiem pret nelikumīgu tirdzniecību ar tabakas izstrādājumiem, ieskaitot viltojumus un kontrabandas cigaretes;

(c) veikt attiecīgus pasākumus, lai nodrošinātu to, ka visas konfiscētās ražošanas iekārtas, viltotās un kontrabandas cigaretes un citi tabakas izstrādājumi tiek iznīcināti, izmantojot videi draudzīgas metodes, kur iespējams, vai tiek novietotas saskaņā ar valsts likumdošanu;

(d) pieņemt un ieviest pasākumus, lai uzraudzītu, dokumentētu un kontrolētu tabakas izstrādājumu glabāšanu un izplatīšanu, kurus glabā vai pārvieto, un, kas ir pakļauti nodokļu vai nodevu maksāšanai, saskaņā ar attiecīgo jurisdikciju; un

(e) veikt pasākumus, kur piemērojams, lai nodrošinātu ieņēmumu konfiskāciju, kas iegūti no nelegālas tabakas izstrādājumu tirdzniecības.

5. Pusēm ir jāsniedz informācija, kas savākta saskaņā ar šī panta apakšpunktiem 4(a) un 4(d), kur piemērots, apkopotā veidā periodiskajos ziņojumos Pušu Konferencei, saskaņā ar 21.pantu.

6. Puses, kur piemērojams, un saskaņā ar valsts likumdošanu, veicinās sadarbību starp valsts aģentūrām, kā arī attiecīgajām reģionālajām un starptautiskajām starpvalstu organizācijām, attiecībā uz izmeklēšanu, lietu ierosināšanu un tiesvedību, ar nolūku ierobežot tabakas izstrādājumu nelegālo tirdzniecību. Īpašs uzsvars ir jāliek uz sadarbību starp reģionālajiem un mazāka administratīvā iedalījuma reģionālajiem līmeņiem, lai apkarotu nelikumīgo tirdzniecību ar tabakas izstrādājumiem.

7. Katra Puse centīsies pieņemt un ieviest pasākumus ar tālejošām sekām, ieskaitot licencēšanu, kur piemērojams, lai kontrolētu vai regulētu tabakas izstrādājumu ražošanu un izplatīšanu ar mērķi ierobežot nelegālo tirdzniecību.

16.pants

Pārdošana nepilngadīgajiem un nepilngadīgo iesaistīšana tirdzniecībā

1. Katra Puse pieņems un ieviesīs iedarbīgus likumdošanas, izpildvaras, administratīvos un citus pasākumus, kur piemērojams, attiecīgajā valdības līmenī, lai aizliegtu tabakas izstrādājumu tirdzniecību nepilngadīgām personām, saskaņā ar vietējo, valsts likumdošanu vai personām, kas jaunākas par astoņpadsmit gadiem. Šie pasākumi var ietvert sekojošo:

(a) pieprasīt, lai visi tabakas izstrādājumu tirgotāji izvieto skaidru un saskatāmu uzrakstu tirdzniecības telpu iekšpusē par tabakas produktu tirdzniecības aizliegumu nepilngadīgajiem, un, šaubu gadījumā, pieprasa katram tabakas produktu pircējam uzrādīt apliecību par pilngadības sasniegšanu;

(b) aizliegt tabakas produktu tirdzniecību jebkurā veidā, kur tie ir tieši pieejami veikala plauktos;

(c) aizliegt saldumu, uzkodu, rotaļlietu un citu objektu ražošanu un tirdzniecību tabakas produktu formā, kas piesaistītu nepilngadīgo uzmanību; un

(d) nodrošināt to, ka tabakas produktu automāti attiecīgās jurisdikcijas ietvaros nav pieejami nepilngadīgajiem un neveicina tabakas produktu tirdzniecību nepilngadīgajiem.

2. Katra Puse aizliegs vai aizliegs veicināt tabakas izstrādājumu izplatīšanu par velti sabiedrībai un īpaši nepilngadīgajiem.

3. Katra Puse centīsies aizliegt cigarešu tirdzniecību individuāli vai mazās paciņās, kas palielina šādu produktu pieejamību nepilngadīgajiem.

4. Puses atzīst, ka nolūkā palielināt savu efektivitāti, pasākumi tabakas produktu tirdzniecības novēršanai un nepilngadīgajiem, kur piemērojams, ir jāievieš saskaņā ar citiem šajā Konvencijā noteiktajiem nosacījumiem.

5. Puse, parakstot, ratificējot, pieņemot, apstiprinot vai pievienojoties šai Konvencijai vai jebkurā laikā pēc tam, ar rakstiskas saistošas deklarācijas palīdzību, var demonstrēt apņemšanos aizliegt tabakas izstrādājumu tirdzniecības automātu ieviešanu tās jurisdikcijas ietvaros vai, kur piemērojams, pilnīgu tabakas produktu automātu aizliegumu. Deklarācija, saskaņā ar šo pantu, tiks izplatīta ar Depozitārija starpniecību visām Konvencijas Pusēm.

6. Katra Puse pieņems un ieviesīs iedarbīgus likumdošanas, izpildvaras, administratīvos un citus pasākumus, ieskaitot naudas sodus tirgotājiem un izplatītājiem, lai nodrošinātu atbilstību šī panta 1.-5. paragrāfos noteiktajām saistībām.

7. Katrai Pusei, kur piemērojams, būtu jāpieņem un jāievieš efektīvi likumdošanas, izpildvaras, administratīvie vai citi pasākumi, lai aizliegtu tabakas produktu tirdzniecību personām, kuras jaunākas par vietējās, valsts likumdošanas noteikto vecumu vai jaunākas par astoņpadsmit gadiem.

17.pants

Atbalsta nodrošināšana ekonomiski dzīvotspējīgām alternatīvām aktivitātēm

Puses, sadarbojoties viena ar otru un ar kompetentām starptautiskām un reģionālām starpvalstu organizācijām, veicinās, kur piemērots, ekonomiski dzīvotspējīgas alternatīvas tabakas industrijas attīstību strādniekiem, audzētājiem, atkarībā no gadījuma, individuāliem tirgotājiem.

V daļa: VIDES AIZSARDZĪBA

18.pants

Vides un cilvēku veselības aizsardzība

Puses, realizējot savas saistības šīs Konvencijas ietvaros, vienojas pievērst pienācīgu uzmanību vides aizsardzībai un cilvēku veselībai attiecībā uz vidi tabakas kultivēšanas un ražošanas aspektā savās attiecīgajās teritorijās.

VI daļa: JAUTĀJUMI ATTIECĪBĀ UZ ATBILDĪBU

19.pants

Atbildība

1. Tabakas uzraudzības nolūkā Puses apsvērs iespēju veikt likumīgas darbības vai sekmēt esošo likumu izmantošanu, kur nepieciešams, lai risinātu kriminālo un civilo atbildību, ieskaitot kompensāciju, kur piemērojams.

2. Puses sadarbosies viena ar otru informācijas apmaiņā ar Pušu Konferences starpniecību, saskaņā ar 21.pantu, ieskaitot sekojošo:

(a) informācija par sekām uz veselību tabakas produktu lietošanas un pakļaušanas tabakas dūmiem rezultātā, saskaņā ar pantu 20.3(a); un

(b) informācija par likumdošanu un spēkā esošajiem noteikumiem, kā arī par atbilstošo jurisprudenci.

3. Puses, kur piemērojams, un savstarpēji vienojoties, tās valsts likumdošanas, politikas, likuma prakses un piemērojamo esošo savstarpējo līgumu ietvaros, piedāvās palīdzēt viena otrai tiesvedības gadījumos, attiecībā uz kriminālo atbildību, saskaņā ar šo Konvenciju.

4. Konvencija nekāda veidā neietekmēs vai neierobežos jebkuras Pušu piekļūšanas tiesības viena otras tiesām, kur šādas tiesības pastāv.

5. Pušu Konference var apsvērt, ja iespējams, agrīnā stadijā, ņemot vērā paveikto darbu attiecīgajā starptautiskajā forumā, jautājumus, kas attiecas uz atbildību, ieskaitot atbilstošu starptautisko pieeju šiem jautājumiem un atbilstošus atbalsta līdzekļus, pēc pieprasījuma, Puses, savas likumdošanas ietvaros un attiecībā uz citām aktivitātēs, darbosies saskaņā ar šo pantu.

VII daļa: ZINĀTNISKĀ UN TEHNISKĀ SADARBĪBA UN INFORMĀCIJAS KOMUNIKĀCIJA

20.pants

Informācijas izpēte, novērošana un apmaiņa

1. Puses apņemas attīstīt un veicināt valsts mēroga izpēti un koordinēt izpētes programmas reģionālajos un starptautiskajos līmeņos tabakas uzraudzības jomā. Līdz šim, katra Puse uzņemas veikt sekojošo:

(a) ierosināt un sadarboties, tieši vai ar kompetentu starptautisko un reģionālo starpvalstu organizāciju starpniecību un citām struktūrām, izpētes veikšanā un zinātnisko novērtējumu sniegšanā, un to darot veicināt un iedrošināt pētījumus, kas risina noteicošos faktorus un tabakas patēriņa sekas un pakļaušanu tabakas dūmiem, kā arī pētījumus alternatīvu graudaugu identificēšanai; un

(b) veicināt un nostiprināt līdz ar kompetentu starptautisku un reģionālo starpvalstu organizāciju un citu struktūru palīdzību, apmācību un atbalstu visām tabakas uzraudzības aktivitātēs iesaistītajām pusēm, ieskaitot pētījumus, ieviešanu un novērtēšanu.

2. Puses, kur piemērojams, izveidos programmas valsts, reģionālajai un globālai tabakas patēriņa un pakļaušanai tabakas dūmiem novērošanai un to nozīmei, veidiem, noteicošajiem faktoriem un sekām. Līdz šim, Puses integrēs tabakas novērošanas programmas valsts, reģionālajās un globālajās veselības novērošanas programmās tādā veidā, lai dati ir salīdzināmi un tos varētu analizēt reģionālā un starptautiskā līmenī, kur piemērojams.

3. Puses atzīst finansu un tehniskās palīdzības nozīmīgumu no starptautiskām un reģionālām starpvalstu organizācijām un citām struktūrām. Katra Puse uzņemsies sekojošo:

(a) izveidot progresīvu valsts sistēmu epidemioloģiskai tabakas patēriņa novērošanai un ar to saistītiem sociāliem, ekonomiskiem un veselības indikatoriem;

(b) sadarboties ar kompetentām starptautiskām un reģionālām starpvalstu organizācijām un citām struktūrām, ieskaitot valsts un nevalstiskas aģentūras reģionālajā un globālajā novērošanā un informācijas apmaiņā, attiecībā uz šī panta 3(a) paragrāfā noteiktajiem indikatoriem; un

(c) sadarboties ar Pasaules Veselības organizāciju vispārējo vadlīniju vai procedūru izstrādē, kuras nosaka uz tabaku attiecināmu datu definēšanas savākšanā, analīzē un izplatīšanā.

4. Puses, saskaņā ar valsts likumdošanu, veicinās un sekmēs publiski pieejamu zinātnisko, tehnisko, sociālekonomisko, komerciālo un likumdošanas informāciju, kā arī informāciju attiecībā uz tabakas industrijas praksi un tabakas kultivēšanu, kas attiecas uz šo Konvenciju, un to darot, ņems vērā un apsvērs Pušu attīstības valstu un Pušu valstu ar pārejas ekonomiku īpašās vajadzības. Katra Puse uzņemsies:

(a) progresīvi izveidot un uzturēt papildinātas likumu un noteikumu datu bāzes par tabakas uzraudzību un, kur piemērojams, informāciju par tās ieviešanu, kā arī piemērotu jurisprudenci, un sadarboties reģionālo un globālo tabakas uzraudzības programmu izstrādē;

(b) progresīvi izveidot un uzturēt papildinātus datus no valsts novērošanas programmām, saskaņā ar šī panta 3(a) paragrāfu; un

(c) sadarboties ar kompetentām starptautiskām organizācijām ar mērķi progresīvi izveidot un uzturēt globālu sistēmu, nolūkā regulāri savākt un izplatīt informāciju par tabakas ražošanu un tabaka industrijas aktivitātēm, kurām ir ietekme uz Konvenciju vai valsts tabakas uzraudzības aktivitātēm.

5. Pusēm būtu jāsadarbojas reģionālajās un starptautiskajās starpvalstu organizācijās un finansu un attīstības institūcijās, kuras dalībnieces tās ir, ar mērķi veicināt un iedrošināt tehniskās un finansu palīdzības sniegšanu Sekretariātam, nolūkā palīdzēt Pušu attīstības valstīm un Pušu valstīm ar pārejas ekonomiku, lai tās varētu izpildīt savas saistības attiecībā uz pētījumiem, novērošanu un informācijas apmaiņu.

21.pants

Ziņošana un informācijas apmaiņa

1. Katra Puse iesniegs Pušu Konferencei ar Sekretariāta starpniecību periodiskus ziņojumus par šīs Konvencijas ieviešanu, un ziņojumam ir jāietver sekojošais:

(a) informācija par likumdošanas, izpildvaras, administratīvajiem vai citiem pasākumiem, attiecībā uz šīs Konvencijas ieviešanu;

(b) informācija, kur piemērojams, vai jebkādi ierobežojumi vai šķēršļi, ar kuriem jāsaskaras Konvencijas ieviešanā, un par pasākumiem šo šķēršļu pārvarēšanā;

(c) informācija, kur piemērojams, par finansu un tehnisko palīdzību, kuru sniedza vai kura saņemta par tabakas uzraudzības aktivitātēm;

(d) informācija par novērošanu un pētījumiem, kā noteikts 20.pantā; un

(e) informācija, kas noteikta 6.3, 13.2, 13.3, 13.4(d), 15.5 un 19.2.pantos.

2. Pušu Konference noteiks šādas ziņošanas biežumu un formātu visām Pusēm. Katra Puse sastādīs savu sākuma ziņojumu divu gadu laikā pēc Konvencijas stāšanās spēkā attiecīgajai Pusei.

3. Pušu Konference, saskaņā ar 22. un 26.pantu apsvērs iespēju palīdzēt attīstības valstu Pusēm un valstu Pusēm ar pārejas ekonomiku, pēc viņu pieprasījuma, lai izpildītu šai pantā noteiktās saistības.

4. Ziņošana un informācijas apmaiņa šīs Konvencijas ietvaros ir pakļauta valsts likumdošanai attiecībā uz konfidencialitāti un slepenību. Puses aizsargās, savstarpēji vienojoties, jebkuru konfidenciālu informāciju, attiecībā uz kuru notiek apmaiņa.

22.pants

Sadarbība zinātniskajā, tehniskajā un likumdošanas jomās un attiecīgās ekspertīzes nodrošināšana

1. Puses sadarbosies tieši vai ar kompetentu starptautisku organizāciju starpniecību ar mērķi nostiprināt savu spēju izpildīt no šīs Konvencijas izrietošās saistības, ņemot vērā attīstības valstu Pušu un Pušu valstu ar pārejas ekonomiku vajadzības. Šāda sadarbība veicinās tehniskās, zinātniskās un likumdošanas ekspertīzes un tehnoloģijas nodošanu, savstarpēji vienojoties, lai izveidotu un nostiprinātu valstu tabakas uzraudzības stratēģijas, plānus un programmas ar mērķi, tai skaitā, paveikt sekojošo:

(a) tehnoloģiju, zināšanu, prasmju, spēju un attiecīgās ekspertīzes tabakas uzraudzības jomā attīstības, nodošanas un iegūšanas veicināšanu;

(b) tehniskās, zinātniskās, likumdošanas un citas ekspertīzes nodrošināšana, lai izveidotu un nostiprinātu valsts tabakas uzraudzības stratēģijas, plānus un programmas ar mērķi ieviest Konvenciju, tai skaitā:

(i) palīdzēt, pēc pieprasījuma, spēcīgas likumdošanas bāzes izveidē, kā arī tehnisko programmu izstrādē, ieskaitot uzsākšanas novēršanu, pārtraukšanas veicināšanu un aizsardzību no pakļaušanas tabakas dūmiem;

(ii) palīdzēt, kur piemērojams, tabakas audzētājiem attīstīt piemērotas, ekonomiski un likumīgi dzīvotspējīgas alternatīvas iztikas līdzekļu iegūšanai ekonomiski dzīvotspējīga veidā; un

(iii) palīdzēt, kur piemērojams, tabakas audzētājiem novirzīt lauksaimniecības graudaugu ražošanu uz alternatīvu graudaugu audzēšanu ekonomiski dzīvotspējīgā veidā;

(c) atbalstīt atbilstošu apmācību vai jūtīguma attīstības programmas atbilstošam personālam, saskaņā ar 12.pantu;

(d) nepieciešamo materiālu, iekārtu un piegāžu nodrošināšana, kur piemērojams, kā arī loģistikas atbalsts tabakas uzraudzības stratēģijām, plāniem un programmām;

(e) tabakas uzraudzības metožu identifikācija, ieskaitot vispārēju nikotīna atkarības ārstēšanu; un

(f) pētījumu veicināšana, kur piemērojams, ar mērķi palielināt nikotīna atkarības ārstēšanas pieejamību.

2. Pušu Konference veicinās un sekmēs tehnisko, zinātnisko un likumdošanas ekspertīzes un tehnoloģiju nodošanu līdztekus finansu atbalstam, saskaņā ar 26.pantu.

VIII daļa: INSTITUCIONĀLĀ KĀRTĪBA UN FINANSU RESURSI

23.pants

Pušu Konference

1. Pušu Konference līdz ar šo ir izveidota. Konferences pirmo sesiju sasauks Pasaules Veselības organizācija ne vēlāk kā vienu gadu pēc šīs Konvencijas stāšanās spēkā. Konference noteiks turpmāko regulāro sesiju norises vietu un laiku tās pirmajā sesijā.

2. Konferences Pušu ārkārtas sesijas notiks citā laikā, kā to uzskatīs par nepieciešamu Konference, vai pēc rakstiska jebkuras Puses pieprasījuma, nodrošinot to, ka Konvencijas Sekretariāts šo pieprasījumu sešu mēnešu laikā ir nodevis Pusēm un to atbalsta viena trešdaļa no Pusēm.

3. Pušu Konference vienprātīgi pieņems Procedūras Noteikumus tās pirmajā sesijā.

4. Pušu Konference vienprātīgi pieņems finansu noteikumus pati sev, kā arī finansējumu jebkurai vadošai filiālei, ko tā var izveidot, kā arī finansu nodrošinājumu, kas nodrošina vadošā Sekretariāta funkcionēšanu. Katrā kārtējā sesijā tā pieņems budžetu finansu periodam līdz nākamajai kārtējai sesijai.

5. Pušu Konference regulāri pārskatīs Konvencijas ieviešanu un pieņems lēmumus, kas nepieciešami tās efektīvas ieviešanas veicināšanai un var pieņemt Konvencijas protokolus, pielikumus un grozījumus, saskaņā ar 28., 29. un 33.pantu. Līdz šim, tā paveiks sekojošo:

(a) veicinās un sekmēs informācijas apmaiņu, saskaņā ar 20. un 21.pantu;

(b) veicinās un vadīs attīstību un periodiski uzlabos salīdzināmas metodoloģijas pētījumiem datu savākšanai, papildus tām, kas definētas 20.pantā, saistītas uz Konvencijas ieviešanu;

(c) veicinās, kur piemērojams, stratēģiju, plānu un programmu, kā arī politiku, likumdošanas un citu pasākumu, kur piemērojams, attīstību, ieviešanu un novērtēšanu;

(d) apsvērs Pušu iesniegtos ziņojumus, saskaņā ar 21.pantu, un pieņemt regulāros ziņojumus par Konvencijas ieviešanu;

(e) veicinās un sekmēs finansu resursu mobilizāciju Konvencijas ieviešanai saskaņā ar 26.pantu;

(f) izveidos tādas filiāles, kādas būtu nepieciešamas, lai sasniegtu Konvencijas mērķi;

(g) pieprasīs, kur piemērojams, pakalpojumus un sadarbību, un informācijas sniegšanu, no kompetentām un saistītām organizācijām un struktūrām Apvienoto Nāciju sistēmā, un no citām starptautiskām un reģionālām starpvalstu organizācijām un nevalstiskām organizācijām un struktūrām, kā līdzekli Konvencijas ieviešanas nostiprināšanai; un

(h) apsvērs citas darbības, kur piemērojams, Konvencijas mērķa sasniegšanai tās ieviešanas gaitā, uzkrātās pieredzes kontekstā.

6. Pušu Konference izveidos kritērijus novērotāju dalībai lietu izskatīšanas gaitā.

24.pants

Sekretariāts

1. Pušu Konference iecels pastāvīgu sekretariātu un veiks organizatoriskos pasākumus tā funkcionēšanai. Pušu Konference centīsies to paveikt savā pirmajā sesijā.

2. Līdz tam brīdim, kamēr tiks izveidots pastāvīgs sekretariāts, sekretariāta funkcijas šīs Konvencijas ietvaros nodrošinās Pasaules Veselības organizācija.

3. Sekretariāta funkcijas būs sekojošas:

(a) veikt Pušu Konferences un jebkuras filiāles struktūras organizatoriskos pasākumus un nodrošināt tos ar pakalpojumiem, kur tas nepieciešams;

(b) pārsūtīt saņemtos ziņojumus, saskaņā ar Konvenciju;

(c) nodrošināt atbalstu Pusēm, īpaši attīstības valstu Pusēm un Pusēm ar pārejas ekonomiku, pēc pieprasījuma, faktu savākšanu un informācijas komunikāciju, kas nepieciešama saskaņā ar Konvencijas nosacījumiem;

(d) sagatavot ziņojumus par tās aktivitātēm Konvencijas ietvaros, saskaņā ar Pušu Konvencijas vadlīnijām un iesniegt tos Pušu Konferencei;

(e) nodrošināt, Pušu Konferences vadībā, nepieciešamo koordināciju ar kompetentām starptautiskām un reģionālām starpvalstu organizācijām un citām struktūrām;

(f) iesaistīties, Pušu Konferences vadībā, šādās administratīvās vai līgumslēdzēju struktūrās, kādas var būt nepieciešamas efektīvai tās funkciju izpildei; un

(g) veikt citas sekretariāta funkcijas, kā noteikts Konvencijā un jebkurā no tās protokoliem un tādas funkcijas, kādas varētu noteikt Pušu Konference.

25.pants

Attiecības starp Pušu Konferenci un starpvalstu organizācijām

Pušu Konference var pieprasīt kompetentu starptautisko un reģionālo starpvalstu organizāciju, ieskaitot finansu un attīstības institūciju, sadarbību ar mērķi nodrošināt tehnisko un finansu sadarbību šīs Konvencijas mērķu sasniegšanai.

26.pants

Finansu resursi

1. Puses atzīst finansu resursu svarīgo lomu šīs Konvencijas mērķa sasniegšanā.

2. Katra Puse nodrošinās finansu atbalstu attiecībā uz tās valsts aktivitātēm, kas paredzētas Konvencijas mērķa sasniegšanai, saskaņā ar tās valsts plāniem, prioritātēm un programmām.

3. Puses, kur piemērojams, veicinās divpusējo, reģionālo, mazāku administratīvo reģionu un citu daudzpusējo kanālu izmantošanu, lai nodrošinātu finansējumu daudzsektoru vispārējo tabakas uzraudzības programmu attīstību un nostiprināšanu Pušu attīstības valstīm un Pušu valstīm ar pārejas ekonomiku. Tādejādi, ekonomiski dzīvotspējīgas alternatīvas tabakas ražošanai, ieskaitot graudaugu diversificēšanas jautājumu, kuru atbalstītu valsts izstrādātas stratēģijas ilgtspējīgas attīstības kontekstā.

4. Puses, kas pārstāvētas attiecīgās reģionālās un starptautiskās starpvalstu organizācijās un finansu un attīstības institūcijās, iedrošinās šīs struktūras sniegt finansu palīdzību Pušu attīstības valstīm un Pušu valstīm ar pārejas ekonomiku, lai palīdzētu tām pildīt savas saistības Konvencijas ietvaros, neierobežojot to dalības tiesības šajās organizācijās.

5. Puses vienojas par sekojošo:

(a) palīdzēt Pusēm pildīt savas saistības šīs Konvencijas ietvaros, visi attiecīgie potenciālie un esošie resursi, finansu, tehniskie un cita veida resursi, gan valsts un privātie, kuri ir pieejami tabakas uzraudzības aktivitātēm, ir jāmobilizē un jāizmanto par labu visām Pusēm, īpaši attīstības valstīs un valstīs ar pārejas ekonomiku;

(b) Sekretariāts sniegs konsultācijas Pušu attīstības valstīm un Pušu valstīm ar pārejas ekonomiku, pēc pieprasījuma, ar pieejamajiem finansu resursiem, lai veicinātu to saistību izpildi šīs Konvencijas ietvaros;

(c) Pušu Konference savā pirmajā sesijā pārskatīs esošos un potenciālos palīdzības avotus un mehānismus, pamatojoties uz Sekretariāta veikto pētījumu un citu saistīto informāciju, un apsvērs to adekvātumu; un

(d) Pušu Konference ņems vērā pārskata rezultātus, nosakot nepieciešamību uzlabot esošos mehānismus vai izveidot brīvprātīgu globālo fondu vai citus atbilstošus finansu mehānismus, lai novadītu papildus finansu resursus, pēc vajadzības, Pušu attīstības valstīm un Pušu valstīm ar pārejas ekonomiku, lai palīdzētu izpildīt Konvencijas mērķus.

IX daļa: STRĪDU ATRISINĀŠANA

27.pants

Strīdu atrisināšana

1. Strīda gadījumā starp divām vai vairākām Pusēm, attiecībā uz šīs Konvencijas pielietošanas interpretāciju, iesaistītās Puses centīsies atrisināt strīdu sarunu ceļā vai jebkurā mierīgā veidā pēc savas izvēles, ieskaitot starpniecību, labos nodomus vai samierināšanu. Neveiksmes gadījumā panākt izlīgumu labo nodomu, starpniecības vai samierināšanās ceļā, tas neatbrīvos puses no atbildības turpināt atrisināt strīdu.

2. Ratificējot, pieņemot, apstiprinot, formāli apstiprinot vai pievienojoties Konvencijai, vai jebkurā laikā pēc tam, Valsts vai reģionālā ekonomiskā integrācijas organizācija var paziņot rakstiski deklarācijas veidā Depozitārijam par to, ka strīds, kas nav atrisināts saskaņā ar šī panta 1.paragrāfu, tas pieņem, kā obligātu, speciālu (ad hoc) arbitrāžu, saskaņā ar Pušu Konferences vienprātīgi pieņemtām procedūrām.

3. Šī panta nosacījumi tiks pielietoti attiecībā uz jebkuru starp pusēm noslēgto protokolu, ja vien tur nav noteikts savādāk.

X daļa: KONVENCIJAS IZSTRĀDE

28.pants

Šīs Konvencijas grozījumi

1. Jebkura no Pusēm var piedāvāt grozījumus šai Konvencijai. Pušu Konference izskatīs šādus grozījumus.

2. Pušu Konference pieņems šādus grozījumus. Sekretariāts vismaz sešus mēnešus pirms sesijas, kad ir piedāvāts apstiprināt šos grozījumus, izplatīs jebkura piedāvāta Konvencijas grozījuma tekstu Pusēm. Sekretariāts arī izplatīs piedāvātos grozījumus Konvencijas parakstītājiem un, informācijas nolūkā, Depozitārijam.

3. Puses pieliks visas pūles, lai vienprātīgi vienotos par jebkuru piedāvāto Konvencijas grozījumu. Ja visas pūles panākt vienošanos tiek izmantotas un vienošanās nav panākta, grozījumi ir jāatbalsta vismaz trīs ceturtdaļām balsu vairākuma no klātesošajām Pusēm balsojuma sesijā. Šī panta nolūkā, klātesošās Puses un balsojošās Puses piestāda un balso ar apstiprinošu vai negatīvu balsojumu. Sekretariāts nodos jebkuru pieņemto grozījumu Depozitārijam, kas to tālāk izplatīs visām Pusēm akceptēšanai.

4. Akceptēšanas instrumenti, attiecībā uz grozījumu, tiks glabāti Depozitārijā. Grozījums, akceptēts saskaņā ar šī panta 3.paragrāfu, stāsies spēkā tām Pusēm, kuras to akceptēja deviņdesmitajā dienā pēc tam, kad to būs saņēmis Depozitārijs, ar akceptēšanas instrumentu un to būs akceptējušas vismaz divas trešdaļas no Konvencijas Pusēm.

5. Grozījums stāsies spēkā jebkurai citai Pusei deviņdesmitajā dienā pēc tam, kad Puse nodos glabāšanā Depozitārijam tās akceptēšanas instrumentu, attiecībā uz minēto grozījumu.

29.pants

Konvencijas pielikumu akceptēšana un grozījumi

1. Šīs Konvencijas pielikumi un ar to saistītie grozījumi tiks piedāvāti, pieņemti un stāsies spēkā saskaņā ar 28.pantā noteikto procedūru.

2. Konvencijas pielikumi būs neatņemama sastāvdaļa un, ja vien nav skaidri noteikts savādāk, atsauce uz Konvenciju sastāda vienlaicīgi atsauci uz jebkuru ar to saistītajiem pielikumiem.

3. Pielikumi tiks ierobežoti ar sarakstiem, formām un jebkādu aprakstošu materiālu attiecībā uz procedūru, zinātniskajiem, tehniskajiem vai administratīvajiem jautājumiem.

XI daļa: NOSLĒGUMA NOSACĪJUMI

30.pants

Iebildumi

Nekādi iebildumi nevar tikt veikti attiecībā uz šo Konvenciju.

31.pants

Izstāšanās

1. Jebkurā laikā divus gadus pēc Konvencijas stāšanās spēkā dienas kādai no Pusēm, tā Puse var izstāties no Konvencijas, iesniedzot rakstisku paziņojumu Depozitārijam.

2. Jebkura šāda izstāšanās stāsies spēkā, beidzoties vienam gadam no dienas, kad Depozitārijs saņēma paziņojumu par izstāšanos, vai jebkurā vēlākā datumā, kā tas var būt noteikts izstāšanās paziņojumā.

3. Jebkura no Pusēm, kas izstājas no Konvencijas, tiks uzskatīta kā izstājusies no jebkura no protokoliem, kur tā bija iestājusies kā Puse.

32.pants

Balss tiesības

1. Katrai šīs Konvencijas Pusei būs viena balss, izņemot gadījumus, kā tas noteikts šī panta 2.paragrāfā.

2. Reģionālās ekonomiskās integrācijas organizācijas, savas kompetences ietvaros, izmantos savas balss tiesības ar balsu skaitu, kas vienāds ar to Dalībvalstu skaitu, kas ir Konvencijas Puses. Šāda organizācijas neizmantos savas tiesības balsot, ja jebkura no tās Dalībvalstīm izmantos savas tiesības un otrādi.

33.pants

Protokoli

1. Jebkura no Pusēm var piedāvāt protokolus. Pušu Konference izskatīs šādus protokolus.

2. Pušu Konference var pieņemt Konvencijas protokolus. Visas pūles tiks pieliktas šādu protokolu pieņemšanas laikā, lai panāktu vienprātību. Ja visas pūles panākt vienošanos ir izmantotas un vienošanās nav panākta, protokols, ļaunākajā gadījumā, tiks pieņemts ar Pušu trīs ceturtdaļu vairākuma balsojumu no klātesošajām Pusēm balsojumu sesijā. Šī panta nolūkā, klātesošās Puses un klātesošās balsojošās Puses kā balsošanas līdzekli izmantos apstiprinošu vai negatīvu balsojumu.

3. Sekretariāts vismaz sešus mēnešus pirms sesijas, kad ir piedāvāta apstiprināšana, izplatīs jebkura piedāvāta protokola tekstu visām Pusēm.

4. Tikai un vienīgi Konvencijas Puses var būt protokola puses.

5. Jebkurš Konvencijas protokols būs saistošs tikai apspriežamā protokola pusēm. Tikai protokolā iesaistītās puses var pieņemt lēmumus attiecībā uz jautājumiem, kas ekskluzīvi attiecas uz apspriežamo protokolu.

6. Prasības, lai jebkurš protokols stātos spēkā, tiks izstrādātas ar attiecīgo instrumentu.

34.pants

Paraksts

Šī Konvencija būs atvērta parakstam visām Pasaules Veselības organizācijas Dalībvalstīm un jebkurām Valstīm, kas nav Pasaules Veselības organizācijas, bet ir Apvienoto Nāciju dalībnieces un reģionālajām ekonomiskās integrācijas organizācijām, Pasaules Veselības organizācijas galvenajā mītnē Ženēvā no 2003.gada 16. ūnija līdz 2003.gada 22.jūnijam, un pēc tam Apvienoto Nāciju galvenajā mītnē Ņujorkā no 2003.gada 30.jūnija līdz 2004.gada 29.jūnijam.

35.pants

Ratifikācija, akceptēšana, apstiprināšana, formāla apstiprināšana vai pievienošanās

1. Šī Konvencija būs pakļauta Valstu ratifikācijai, akceptēšanai, pieņemšanai vai pievienošanai un reģionālo ekonomisko integrācija organizāciju formālai apstiprināšanai vai pievienošanai. Tā būs atvērta pievienošanai no dienas, kad Konvencija ir slēgta parakstam. Ratifikācijas, akceptēšanas, apstiprināšanas, formālas apstiprināšanas vai pievienošanās instrumenti tiks glabāti Depozitārijā.

2. Visas šīs Konvencijas saistības būs saistošas jebkurai reģionālās ekonomiskās integrācijas organizācijai, kura kļūst par Konvencijas Pusi, bet neviena no tās Dalībvalstīm nav Puse. Šo organizāciju gadījumā, ja viena vai vairākas Dalībvalstis ir Konvencijas Puse, organizācija un tās Dalībvalstis izlems par to attiecīgo atbildības jomu attiecīgo saistību izpildei šīs Konvencijas ietvaros. Šādos gadījumos, organizācija un Dalībvalstis nebūs tiesīgas izmantot savas tiesības Konvencijas ietvaros vienlaicīgi.

3. Reģionālās ekonomiskās integrācijas organizācijas, attiecībā uz saviem instrumentiem saistībā ar formālu apstiprinājumu vai saviem pievienošanās instrumentiem, demonstrēs savu kompetenci attiecībā uz jautājumiem, kurus nosaka Konvencija. Šīs organizācijas arī informēs Depozitāriju, kas savukārt informēs Puses, par jebkuru būtisku grozījumu savas kompetences ietvaros.

36.pants

Stāšanās spēkā

1. Šī Konvencija stāsies spēkā deviņdesmitajā dienā pēc četrdesmitā ratifikācijas, akceptēšanas, apstiprināšanas, formālā apstiprināšanas vai pievienošanās instrumenta deponēšanas Depozitārijā.

2. Katrai Valstij, kas ratificē vai apstiprina Konvenciju vai pievienojas pēc tam, kad šī panta 1.paragrāfā definētie spēkā stāšanās nosacījumi ir izpildīti, Konvencija stāsies spēkā deviņdesmitajā dienā pēc datuma, kad tās ratifikācijas, akceptēšanas, apstiprināšanas vai pievienošanās instrumenti ir deponēti.

3. Katrai reģionālajai ekonomiskās integrācijas organizācijai formālās apstiprināšanas instrumenta vai pievienošanās instrumenta deponēšana notiek pēc tam, kad šajā pantā 1.paragrāfā noteiktie spēkā stāšanās nosacījumi ir izpildīti, Konvencija stāsies spēkā deviņdesmitajā dienā, kas seko formālās apstiprināšanas vai pievienošanās instrumenta deponēšanai.

4. Šī panta nolūkā, jebkuru instrumentu, kurus ir deponējusi reģionālā ekonomiskās integrācijas organizācija, netiks uzskatīts kā papildus instruments tiem, kurus ir deponējušas organizācijas Dalībvalstis.

37.pants

Depozitārijs

Apvienoto Nāciju Ģenerālsekretārs būs šīs Konvencijas Depozitārijs un ar to saistītie grozījumi un protokoli un pielikumi, pieņemti saskaņā ar 28., 29. un 33.pantiem.

38.pants

Autentisks teksts

Šīs Konvencijas oriģināls, no kura arābu, ķīniešu, angļu, franču, krievu un spāņu valodas ir līdzvērtīgi autentiskas, tiks deponētas pie Apvienoto Nāciju Ģenerālsekretāra.

PAR PIERĀDĪJUMU apakšā parakstījušies, likumīgi pilnvaroti rīkoties, ir parakstījuši šo Konvenciju.

PARAKSTĪTS ŽENĒVĀ divi tūkstoši trešā gada divdesmit pirmajā maijā.
