Par Konvenciju par precētu sieviešu pilsonību, Konvenciju par bezvalstniecības samazināšanu un Konvenciju pret spīdzināšanu un citiem nežēlīgas, necilvēcīgas vai pazemojošas izturēšanās vai sodīšanas veidiem

Ārlietu ministrija nosūta publicēšanai:

1. 1957.gada 20.februāra Konvenciju par precētu sieviešu pilsonību;

2. 1961.gada 30.augusta Konvenciju par bezvalstniecības samazināšanu;

3. 1984.gada 10.decembra Konvenciju pret spīdzināšanu un citiem nežēlīgas, necilvēcīgas vai pazemojošas izturēšanās vai sodīšanas veidiem.

Konvencija par precētu sieviešu pilsonību stājās spēkā Latvijas Republikā 1992.gada 13.jūlijā. Tā apstiprināta ar Augstākās Padomes 1990.gada 4.maija deklarāciju "Par Latvijas Republikas pievienošanos starptautisko tiesību dokumentiem cilvēktiesību jautājumos" (27.punkts).

Konvencija par bezvalstniecības samazināšanu stājās spēkā Latvijas Republikā 1992.gada 13.jūlijā. Tā apstiprināta ar Augstākās Padomes 1990.gada 4.maija deklarāciju "Par Latvijas Republikas pievienošanos starptautisko tiesību dokumentiem cilvēktiesību jautājumos" (28.punkts).

Konvencija pret spīdzināšanu un citiem nežēlīgas, necilvēcīgas vai pazemojošas izturēšanās vai sodīšanas veidiem stājās spēkā Latvijas Republikā 1992.gada 14.maijā. Tā apstiprināta ar Augstākās Padomes 1990.gada 4.maija deklarāciju "Par Latvijas Republikas pievienošanos starptautisko tiesību dokumentiem cilvēktiesību jautājumos" (20.punkts).

Minēto konvenciju teksti līdz šim nav publicēti.

Convention on the Nationality of Married Women
Done at New York, on 20 February 1957

The Contracting States,

Recognizing that, conflicts in law in practice with reference to nationality arise as a result of provisions concerning the loss or acquisition of nationality by women as a result of marriage, of its dissolution or of the change of nationality by the husband during marriage,

Recognizing that, in article 15 of the Universal Declaration of Human Rights, the General Assembly of the United Nations has proclaimed that "everyone has the right to a nationality" and that "no one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality",

Desiring to co-operate with the United Nations in promoting universal respect for, and observance of, human rights and fundamental freedoms for all without distinction as to sex,

Hereby agree as hereinafter provided:

Article 1

Each Contracting State agrees that neither the celebration nor the dissolution of a marriage between one of its nationals and an alien, nor the change of nationality by the husband during marriage, shall automatically affect the nationality of the wife.

Article 2

Each Contracting State agrees that neither the voluntary acquisition of the nationality of another State nor the renunciation of its nationality by one of its nationals shall prevent the retention of its nationality by the wife of such national.

Article 3

1. Each Contracting State agrees that the alien wife of one of its nationals may, at her request, acquire the nationality of her husband through specially privileged naturalization procedures; the grant of such nationality may be subject to such limitations as may be imposed in the interests of national security or public policy.

2. Each Contracting State agrees that the present Convention shall not be construed as affecting any legislation or judicial practice by which the alien wife of one of its nationals may, at her request, acquire her husband's nationality as a matter of right.

Article 4

1. The present Convention shall be open for signature and ratification on behalf of any State Member of the United Nations and also on behalf of any other State which is or hereafter becomes a member of any specialized agency of the United Nations, or which is or hereafter becomes a Party to the Statute of the International Court of Justice, or any other State to which an invitation has been addressed by the General Assembly of the United Nations.

2. The present Convention shall be ratified and the instruments of ratification shall be deposited with the Secretary-General of the United Nations.

Article 5

1. The present Convention shall be open for accession to all States referred to in paragraph 1 of article 4.

2. Accession shall be effected by the deposit of an instrument of accession with the Secretary-General of the United Nations.

Article 6

1. The present Convention shall come into force on the ninetieth day following the date of deposit of the sixth instrument of ratification or accession.

2. For each State ratifying or acceding to the Convention after the deposit of the sixth instrument of ratification or accession, the Convention shall enter into force on the ninetieth day after deposit by such State of its instrument of ratification or accession.

Article 7

1. The present Convention shall apply to all non-self-governing, trust, colonial and other non-metropolitan territories for the international relations of which any Contracting State is responsible; the Contracting State concerned shall, subject to the provisions of paragraph 2 of the present article, at the time of signature, ratification or accession declare the non-metropolitan territory or territories to which the Convention shall apply ipso facto as a result of such signature, ratification or accession.

2. In any case in which, for the purpose of nationality, a non-metropolitan territory is not treated as one with the metropolitan territory, or in any case in which the previous consent of a non-metropolitan territory is required by the constitutional laws or practices of the Contracting State or of the non-metropolitan territory for the application of the Convention to that territory, that Contracting State shall endeavour to secure the needed consent of the non-metropolitan territory within the period of twelve months from the date of signature of the Convention by that Contracting State, and when such consent has been obtained the Contracting State shall notify the Secretary-General of the United Nations. The present Convention shall apply to the territory or territories named in such notification from the date of its receipt by the Secretary-General.

3. After the expiry of the twelve-month period mentioned in paragraph 2 of the present article, the Contracting States concerned shall inform the Secretary-General of the results of the consultations with those non-metropolitan territories for whose international relations they are responsible and whose consent to the application of the present Convention may have been withheld.

Article 8

1. At the time of signature, ratification or accession, any State may make reservations to any article of the present Convention other than articles 1 and 2.

2. If any State makes a reservation in accordance with paragraph 1 of the present article, the Convention, with the exception of those provisions to which the reservation relates, shall have effect as between the reserving State and the other Parties. The Secretary-General of the United Nations shall communicate the text of the reservation to all States which are or may become Parties to the Convention. Any State Party to the Convention or which thereafter becomes a Party may notify the Secretary-General that it does not agree to consider itself bound by the Convention with respect to the State making the reservation. This notification must be made, in the case of a State already a Party, within ninety days from the date of the communication by the Secretary-General; and, in the case of a State subsequently becoming a Party, within ninety days from the date when the instrument of ratification or accession is deposited. In the event that such a notification is made, the Convention shall not be deemed to be in effect as between the State making the notification and the State making the reservation.

3. Any State making a reservation in accordance with paragraph 1 of the present article may at any time withdraw the reservation, in whole or in part, after it has been accepted, by a notification to this effect addressed to the Secretary-General of the United Nations. Such notification shall take effect on the date on which it is received.

Article 9

1. Any Contracting State may denounce the present Convention by written notification to the Secretary-General of the United Nations. Denunciation shall take effect one year after the date of receipt of the notification by the Secretary-General.

2. The present Convention shall cease to be in force as from the date when the denunciation which reduces the number of Parties to less than six becomes effective.

Article 10

Any dispute which may arise between any two or more Contracting States concerning the interpretation or application of the present Convention which is not settled by negotiation, shall, at the request of any one of the parties to the dispute, be referred to the International Court of Justice for decision, unless the parties agree to another mode of settlement.

Article 11

The Secretary-General of the United Nations shall notify all States Members of the United Nations and the non-member States contemplated in paragraph 1 of article 4 of the present Convention of the following:

(a) Signatures and instruments of ratification received in accordance with article 4;

(b) Instruments of accession received in accordance with article 5;

(c) The date upon which the present Convention enters into force in accordance with article 6;

(d) Communications and notifications received in accordance with article 8;

(e) Notifications of denunciation received in accordance with paragraph 1 of article 9;

(f) Abrogation in accordance with paragraph 2 of article 9.

Article 12

1. The present Convention, of which the Chinese, English, French, Russian and Spanish texts shall be equally authentic, shall be deposited in the archives of the United Nations.

2. The Secretary-General of the United Nations shall transmit a certified copy of the Convention to all States Members of the United Nations and to the non-member States contemplated in paragraph 1 of article 4.



 

Konvencija par precētu sieviešu pilsonību
Ņujorkā, 1957. gada 20. februārī

Līgumslēdzējas valstis,

atzīstot to, ka cēlonis tiesību normu kolīzijām par pilsonību ir noteikumi, kuri attiecas uz pilsonības zaudēšanu vai iegūšanu, kas notiek tad, ja sievietes stājas laulībā, vai tad, ja laulība tiek šķirta, vai tad, ja vīrs laulības laikā maina pilsonību;

ņemot vērā to, ka Apvienoto Nāciju Organizācijas Ģenerālā asambleja Vispārējās cilvēktiesību deklarācijas 15. pantā ir pasludinājusi: "ikvienam cilvēkam ir tiesības uz pilsonību" un "nevienam nevar patvaļīgi atņemt pilsonību vai liegt tiesības mainīt pilsonību";

vēloties sadarboties ar Apvienoto Nāciju Organizāciju, lai sekmētu cilvēktiesību un pamatbrīvību vispārēju respektēšanu un ievērošanu attiecībā uz visiem cilvēkiem neatkarīgi no to dzimuma,

ir vienojušās par turpmāko.

1. pants

Ikviena Līgumslēdzēja valsts piekrīt tam, ka ne laulības noslēgšana, ne laulības šķiršana starp kādu no tās pilsoņiem un ārvalstnieku, ne vīra pilsonības maiņa laulības laikā nedrīkst ipso facto skart sievas pilsonību.

2. pants

Ikviena Līgumslēdzēja valsts piekrīt: tas, ka šīs valsts pilsonis pieņem citas valsts pilsonību vai atsakās no savas pilsonības, nedrīkst liegt šā pilsoņa sievai saglabāt savu pilsonību.

3. pants

1. Ikviena Līgumslēdzēja valsts piekrīt tam, ka ārvalstniece, kas ir laulībā ar kādu no tās pilsoņiem, drīkst pēc pašas vēlēšanās pieņemt sava vīra pilsonību īpašā atvieglotā naturalizācijas kārtībā; šādas pilsonības piešķiršana var būt saistīta ar ierobežojumiem, kurus nosaka valsts drošības vai sabiedriskās kārtības interesēs.

2. Ikviena Līgumslēdzēja valsts piekrīt: šo konvenciju nedrīkst interpretēt tā, ka tā skartu tiesību aktus vai tiesu praksi, saskaņā ar kuriem ārvalstniece, kas ir laulībā ar kādu no tās pilsoņiem, drīkst likumīgi pēc sava lūguma pieņemt sava vīra pilsonību.

4. pants

1. Šī konvencija ir atvērta parakstīšanai un ratificēšanai visām Apvienoto Nāciju Organizācijas dalībvalstīm, kā arī visām tām valstīm, kuras ir vai kuras kļūs kādas Apvienoto Nāciju Organizācijas specializētās aģentūras locekles vai kuras ir pievienojušās vai pievienosies Starptautiskās Tiesas Statūtiem, un visām citām valstīm, kuras Apvienoto Nāciju Organizācijas Ģenerālā asambleja uzaicinājusi kļūt par šīs konvencijas dalībvalstīm.

2. Šī konvencija ir jāratificē, un ratifikācijas instrumentus deponē Apvienoto Nāciju Organizācijas ģenerālsekretāram.

5. pants

1. Šai konvencijai var pievienoties visas valstis, kas minētas 4. panta 1. punktā.

2. Pievienošanās notiek, deponējot pievienošanās instrumentu Apvienoto Nāciju Organizācijas ģenerālsekretāram.

6. pants

1. Šī konvencija stājas spēkā deviņdesmitajā dienā pēc tam, kad deponēts sestais ratifikācijas vai pievienošanās instruments.

2. Attiecībā uz ikvienu valsti, kas šo konvenciju ratificējusi vai tai pievienojusies pēc tam, kad deponēts sestais ratifikācijas vai pievienošanās instruments, šī konvencija stājas spēkā deviņdesmitajā dienā pēc tam, kad deponēts tās ratifikācijas vai pievienošanās instruments.

7. pants

1. Šī konvencija attiecas uz visām teritorijām, kam nav savas pārvaldes, aizbildnības teritorijām, koloniālajām teritorijām un pārējām teritorijām, kuras nav valsts pamatteritorijas un par kuru starptautiskajām attiecībām atbildīga ir kāda no Līgumslēdzējām valstīm; ar nosacījumu, ka tiek ievēroti šā panta 2. punkta noteikumi, attiecīgā Līgumslēdzēja valsts parakstīšanas, ratifikācijas vai pievienošanās brīdī paziņo, uz kuru vai kurām teritorijām, kas nav valsts pamatteritorija, šī konvencija ipso facto attiecas minētās parakstīšanas, ratifikācijas vai pievienošanās dēļ.

2. Ikvienā gadījumā, kad saistībā ar pilsonību kāda teritorija, kas nav valsts pamatteritorija, netiek uzskatīta par pamatteritorijas daļu, un ikvienā gadījumā, kad saskaņā ar Līgumslēdzējas valsts vai attiecīgās teritorijas, kas nav valsts pamatteritorija, konstitucionālajiem likumiem vai praksi šo konvenciju uz minēto teritoriju, kas nav valsts pamatteritorija, var attiecināt tad, ja iepriekš saņemta šīs teritorijas piekrišana, Līgumslēdzējai valstij nepieciešamā piekrišana no attiecīgās teritorijas, kas nav valsts pamatteritorija, jācenšas iegūt divpadsmit mēnešu laikā no dienas, kad šī Līgumslēdzēja valsts parakstījusi Konvenciju, un tad, kad minētā piekrišana ir saņemta, attiecīgā Līgumslēdzēja valsts par to paziņo Apvienoto Nāciju Organizācijas ģenerālsekretāram. Kopš dienas, kad ģenerālsekretārs šo paziņojumu ir saņēmis, Konvencija attiecas uz paziņojumā minēto teritoriju vai teritorijām.

3. Pēc tam, kad beidzies šā panta 2. punktā minētais divpadsmit mēnešu termiņš, attiecīgās Līgumslēdzējas valstis informē ģenerālsekretāru par to, kādi ir rezultāti viņu konsultācijām ar teritorijām, kuras nav valsts pamatteritorija un par kuru starptautiskajām attiecībām tās ir atbildīgas, un kuru piekrišana šīs konvencijas piemērošanai nav saņemta.

8. pants

1. Konvenciju parakstot, ratificējot vai tai pievienojoties, ikviena valsts var izdarīt atrunas attiecībā uz jebkuru šīs konvencijas pantu, izņemot 1. un 2. pantu.

2. Ja kāda valsts izdarījusi atrunu saskaņā ar šā panta 1. punktu, tad starp valsti, kas šo atrunu izdarījusi, un pārējām dalībvalstīm, šī konvencija joprojām ir spēkā, izņemot tos noteikumus, attiecībā uz kuriem minētā atruna ir izdarīta. Apvienoto Nāciju Organizācijas ģenerālsekretārs konkrētās atrunas tekstu izsūta visām valstīm, kuras ir šīs konvencijas dalībvalstis vai var par tām kļūt. Ikviena valsts, kura ir šīs konvencijas dalībvalsts vai kura par to kļūst, var ģenerālsekretāram darīt zināmu to, ka tā nav ar mieru uzskatīt, ka šī konvencija tai ir saistoša attiecībā uz valsti, kas izdarījusi minēto atrunu. Valstīm, kuras ir Konvencijas dalībvalstis, šis paziņojums jāsniedz deviņdesmit dienu laikā pēc ģenerālsekretāra paziņojuma, bet valstīm, kuras par Konvencijas dalībvalstīm kļūs vēlāk, - deviņdesmit dienu laikā pēc ratifikācijas vai pievienošanās instrumenta deponēšanas. Ja ir sniegts šāds paziņojums, Konvencija nebūs spēkā starp valsti, kas sniegusi minēto paziņojumu, un valsti, kas izdarījusi atrunu.

3. Ikviena valsts, kas izdarījusi atrunu saskaņā ar šā panta 1. punktu, jebkurā laikā pēc šīs atrunas pieņemšanas var pilnīgi vai daļēji to atsaukt, iesniedzot paziņojumu Apvienoto Nāciju Organizācijas ģenerālsekretāram. Šis paziņojums stājas spēkā tā saņemšanas dienā.

9. pants

1. Ikviena Līgumslēdzēja valsts šo konvenciju var denonsēt, par to rakstiski paziņojot Apvienoto Nāciju Organizācijas ģenerālsekretāram. Denonsēšana stājas spēkā tad, kad pagājis gads, kopš ģenerālsekretārs šo paziņojumu saņēmis.

2. Šī konvencija zaudē spēku dienā, kad stājas spēkā denonsēšana, kuras dēļ šīs konvencijas dalībvalstu skaits kļūst mazāks par sešām.

10. pants

Visas domstarpības, kuras starp divām vai vairāk Līgumslēdzējām valstīm rodas par šīs konvencijas interpretāciju vai piemērošanu un kuras nevar atrisināt ar sarunām, pēc vienas strīdā iesaistītās puses pieprasījuma nododamas izlemšanai Starptautiskajai Tiesai, ja vien strīdā iesaistītās puses nevienojas par citu domstarpību izšķiršanas veidu.

11. pants

Apvienoto Nāciju Organizācijas ģenerālsekretārs visas Apvienoto Nāciju Organizācijas dalībvalstis un valstis, kas nav Apvienoto Nāciju Organizācijas dalībvalstis, bet ir minētas šīs konvencijas 4. panta 1. punktā, informē:

a) par parakstīšanu un par ratifikācijas instrumentu deponēšanu saskaņā ar 4. pantu,

b) par pievienošanās instrumenta deponēšanu saskaņā ar 5. pantu,

c) par datumu, kurā šīs konvencija saskaņā ar 6. pantu stājas spēkā,

d) par paziņojumiem, kas saņemti saskaņā ar 8. pantu,

e) par denonsēšanas paziņojumiem, kas saņemti saskaņā ar 9. panta 1. punktu,

f) par to, ka šī konvencija zaudējusi spēku saskaņā ar 9. panta 2. punktu.

12. pants

1. Šo konvenciju, kuras teksti angļu, franču, krievu, ķīniešu un spāņu valodā ir vienlīdz autentiski, deponē Apvienoto Nāciju Organizācijas arhīvā.

2. Apvienoto Nāciju Organizācijas ģenerālsekretārs šīs konvencijas apliecinātās kopijas pārsūta visām Apvienoto Nāciju Organizācijas dalībvalstīm, kā arī tām valstīm, kuras nav Apvienot Nāciju Organizācijas dalībvalstis, bet ir minētas 4. panta 1. punktā.



 

Convention on the Reduction of Statelessness

Adopted on 30 August 1961 by a conference of plenipotentiaries which met in 1959 and reconvened in 1961 in pursuance of General Assembly resolution 896 (IX) of 4 December 1954

entry into force 13 December 1975, in accordance with article 18

The Contracting States,

Acting in pursuance of resolution 896 (IX), adopted by the General Assembly of the United Nations on 4 December 1954,

Considering it desirable to reduce statelessness by international agreement,

Have agreed as follows:

Article 1

1. A Contracting State shall grant its nationality to a person born in its territory who would otherwise be stateless. Such nationality shall be granted:

(a) At birth, by operation of law, or

(b) Upon an application being lodged with the appropriate authority, by or on behalf of the person concerned, in the manner prescribed by the national law. Subject to the provisions of paragraph 2 of this article, no such application may be rejected. A Contracting State which provides for the grant of its nationality in accordance with subparagraph (b) of this paragraph may also provide for the grant of its nationality by operation of law at such age and subject to such conditions as may be prescribed by the national law.

2. A Contracting State may make the grant of its nationality in accordance with subparagraph (b) of paragraph 1 of this article subject to one or more of the following conditions:

(a) That the application is lodged during a period, fixed by the Contracting State, beginning not later than at the age of eighteen years and ending not earlier than at the age of twenty-one years, so, however, that the person concerned shall be allowed at least one year during which he may himself make the application without having to obtain legal authorization to do so;

(b) That the person concerned has habitually resided in the territory of the Contracting State for such period as may be fixed by that State, not exceeding five years immediately preceding the lodging of the application nor ten years in all;

(c) That the person concerned has neither been convicted of an offence against national security nor has been sentenced to imprisonment for a term of five years or more on a criminal charge;

(d) That the person concerned has always been stateless.

3. Notwithstanding the provisions of paragraphs 1 (b) and 2 of this article, a child born in wedlock in the territory of a Contracting State, whose mother has the nationality of that State, shall acquire at birth that nationality if it otherwise would be stateless.

4. A Contracting State shall grant its nationality to a person who would otherwise be stateless and who is unable to acquire the nationality of the Contracting State in whose territory he was born because he has passed the age for lodging his application or has not fulfilled the required residence conditions, if the nationality of one of his parents at the time of the person's birth was that of the Contracting State first above-mentioned. If his parents did not possess the same nationality at the time of his birth, the question whether the nationality of the person concerned should follow that of the father or that of the mother shall be determined by the national law of such Contracting State. If application for such nationality is required, the application shall be made to the appropriate authority by or on behalf of the applicant in the manner prescribed by the national law. Subject to the provisions of paragraph 5 of this article, such application shall not be refused.

5. The Contracting State may make the grant of its nationality in accordance with the provisions of paragraph 4 of this article subject to one or more of the following conditions:

(a) That the application is lodged before the applicant reaches an age, being not less than twenty-three years, fixed by the Contracting State;

(b) That the person concerned has habitually resided in the territory of the Contracting State for such period immediately preceding the lodging of the application, not exceeding three years, as may be fixed by that State;

(c) That the person concerned has always been stateless.

Article 2

A foundling found in the territory of a Contracting State shall, in the absence of proof to the contrary, be considered to have been born within that territory of parents possessing the nationality of that State.

Article 3

For the purpose of determining the obligations of Contracting States under this Convention, birth on a ship or in an aircraft shall be deemed to have taken place in the territory of the State whose flag the ship flies or in the territory of the State in which the aircraft is registered, as the case may be.

Article 4

1. A Contracting State shall grant its nationality to a person, not born in the territory of a Contracting State, who would otherwise be stateless, if the nationality of one of his parents at the time of the person's birth was that of that State. If his parents did not possess the same nationality at the time of his birth, the question whether the nationality of the person concerned should follow that of the father or that of the mother shall be determined by the national law of such Contracting State. Nationality granted in accordance with the provisions of this paragraph shall be granted:

(a) At birth, by operation of law, or

(b) Upon an application being lodged with the appropriate authority, by or on behalf of the person concerned, in the manner prescribed by the national law. Subject to the provisions of paragraph 2 of this article, no such application may be rejected.

2. A Contracting State may make the grant of its nationality in accordance with the provisions of paragraph 1 of this article subject to one or more of the following conditions:

(a) That the application is lodged before the applicant reaches an age, being not less than twenty-three years, fixed by the Contracting State;

(b) That the person concerned has habitually resided in the territory of the Contracting State for such period immediately preceding the lodging of the application, not exceeding three years, as may be fixed by that State;

(c) That the person concerned has not been convicted of an offence against national security;

(d) That the person concerned has always been stateless.

Article 5

1. If the law of a Contracting State entails loss of nationality as a consequence of any change in the personal status of a person such as marriage, termination of marriage, legitimation, recognition or adoption, such loss shall be conditional upon possession or acquisition of another nationality.

2. If, under the law of a Contracting State, a child born out of wedlock loses the nationality of that State in consequence of a recognition of affiliation, he shall be given an opportunity to recover that nationality by written application to the appropriate authority, and the conditions governing such application shall not be more rigorous than those laid down in paragraph 2 of article I of this Convention.

Article 6

If the law of a Contracting State provides for loss of its nationality by a person's spouse or children as a consequence of that person losing or being deprived of that nationality, such loss shall be conditional upon their possession or acquisition of another nationality.

Article 7

1. (a) If the law of a Contracting State entails loss or renunciation of nationality, such renunciation shall not result in loss of nationality unless the person concerned possesses or acquires another nationality;

(b) The provisions of subparagraph (a) of this paragraph shall not apply where their application would be inconsistent with the principles stated in articles 13 and 14 of the Universal Declaration of Human Rights approved on 10 December 1948 by the General Assembly of the United Nations.

2. A national of a Contracting State who seeks naturalization in a foreign country shall not lose his nationality unless he acquires or has been accorded assurance of acquiring the nationality of that foreign country.

3. Subject to the provisions of paragraphs 4 and 5 of this article, a national of a Contracting State shall not lose his nationality, so as to become stateless, on the ground of departure, residence abroad, failure to register or on any similar ground.

4. A naturalized person may lose his nationality on account of residence abroad for a period, not less than seven consecutive years, specified by the law of the Contracting State concerned if he fails to declare to the appropriate authority his intention to retain his nationality.

5. In the case of a national of a Contracting State, born outside its territory, the law of that State may make the retention of its nationality after the expiry of one year from his attaining his majority conditional upon residence at that time in the territory of the State or registration with the appropriate authority.

6. Except in the circumstances mentioned in this article, a person shall not lose the nationality of a Contracting State, if such loss would render him stateless, notwithstanding that such loss is not expressly prohibited by any other provision of this Convention.

Article 8

1. A Contracting State shall not deprive a person of his nationality if such deprivation would render him stateless.

2. Notwithstanding the provisions of paragraph 1 of this article, a person may be deprived of the nationality of a Contracting State:

(a) In the circumstances in which, under paragraphs 4 and 5 of article 7, it is permissible that a person should lose his nationality;

(b) Where the nationality has been obtained by misrepresentation or fraud.

3. Notwithstanding the provisions of paragraph 1 of this article, a Contracting State may retain the right to deprive a person of his nationality, if at the time of signature, ratification or accession it specifies its retention of such right on one or more of the following grounds, being grounds existing in its national law at that time:

(a) That, inconsistently with his duty of loyalty to the Contracting State, the person:

(i) Has, in disregard of an express prohibition by the Contracting State rendered or continued to render services to, or received or continued to receive emoluments from, another State, or

(ii) Has conducted himself in a manner seriously prejudicial to the vital interests of the State;

(b) That the person has taken an oath, or made a formal declaration, of allegiance to another State, or given definite evidence of his determination to repudiate his allegiance to the Contracting State.

4. A Contracting State shall not exercise a power of deprivation permitted by paragraphs 2 or 3 of this article except in accordance with law, which shall provide for the person concerned the right to a fair hearing by a court or other independent body.

Article 9

A Contracting State may not deprive any person or group of persons of their nationality on racial, ethnic, religious or political grounds.

Article 10

1. Every treaty between Contracting States providing for the transfer of territory shall include provisions designed to secure that no person shall become stateless as a result of the transfer. A Contracting State shall use its best endeavours to secure that any such treaty made by it with a State which is not a Party to this Convention includes such provisions.

2. In the absence of such provisions a Contracting State to which territory is transferred or which otherwise acquires territory shall confer its nationality on such persons as would otherwise become stateless as a result of the transfer or acquisition.

Article 11

The Contracting States shall promote the establishment within the framework of the United Nations, as soon as may be after the deposit of the sixth instrument of ratification or accession, of a body to which a person claiming the benefit of this Convention may apply for the examination of his claim and for assistance in presenting it to the appropriate authority.

Article 12

1. In relation to a Contracting State which does not, in accordance with the provisions of paragraph 1 of article 1 or of article 4 of this Convention, grant its nationality at birth by operation of law, the provisions of paragraph 1 of article 1 or of article 4, as the case may be, shall apply to persons born before as well as to persons born after the entry into force of this Convention.

2. The provisions of paragraph 4 of article 1 of this Convention shall apply to persons born before as well as to persons born after its entry into force.

3. The provisions of article 2 of this Convention shall apply only to foundlings found in the territory of a Contracting State after the entry into force of the Convention for that State.

Article 13

This Convention shall not be construed as affecting any provisions more conducive to the reduction of statelessness which may be contained in the law of any Contracting State now or hereafter in force, or may be contained in any other convention, treaty or agreement now or hereafter in force between two or more Contracting States.

Article 14

Any dispute between Contracting States concerning the interpretation or application of this Convention which cannot be settled by other means shall be submitted to the International Court of Justice at the request of any one of the parties to the dispute.

Article 15

1. This Convention shall apply to all non-self-governing, trust, colonial and other non-metropolitan territories for the international relations of which any Contracting State is responsible; the Contracting State concerned shall, subject to the provisions of paragraph 2 of this article, at the time of signature, ratification or accession, declare the non-metropolitan territory or territories to which the Convention shall apply ipso facto as a result of such signature, ratification or accession.

2. In any case in which, for the purpose of nationality, a non-metropolitan territory is not treated as one with the metropolitan territory, or in any case in which the previous consent of a non-metropolitan territory is required by the constitutional laws or practices of the Contracting State or of the non-metropolitan territory for the application of the Convention to that territory, that Contracting State shall endeavour to secure the needed consent of the non-metropolitan territory within the period of twelve months from the date of signature of the Convention by that Contracting State, and when such consent has been obtained the Contracting State shall notify the Secretary General of the United Nations. This Convention shall apply to the territory or territories named in such notification from the date of its receipt by the Secretary-General.

3. After the expiry of the twelve-month period mentioned in paragraph 2 of this article, the Contracting States concerned shall inform the Secretary-General of the results of the consultations with those non-metropolitan territories for whose international relations they are responsible and whose consent to the application of this Convention may have been withheld.

Article 16

1. This Convention shall be open for signature at the Headquarters of the United Nations from 30 August 1961 to 31 May 1962.

2. This Convention shall be open for signature on behalf of:

(a) Any State Member of the United Nations;

(b) Any other State invited to attend the United Nations Conference on the Elimination or Reduction of Future Statelessness;

(c) Any State to which an invitation to sign or to accede may be addressed by the General Assembly of the United Nations.

3. This Convention shall be ratified and the instruments of ratification shall be deposited with the Secretary-General of the United Nations.

4. This Convention shall be open for accession by the States referred to in paragraph 2 of this article. Accession shall be effected by the deposit of an instrument of accession with the Secretary-General of the United Nations.

Article 17

1. At the time of signature, ratification or accession any State may make a reservation in respect of articles 11, 14 or 15.

2. No other reservations to this Convention shall be admissible.

Article 18

1. This Convention shall enter into force two years after the date of the deposit of the sixth instrument of ratification or accession.

2. For each State ratifying or acceding to this Convention after the deposit of the sixth instrument of ratification or accession, it shall enter into force on the ninetieth day after the deposit by such State of its instrument of ratification or accession or on the date on which this Convention enters into force in accordance with the provisions of paragraph I of this article, whichever is the later.

Article 19

1. Any Contracting State may denounce this Convention at any time by a written notification addressed to the Secretary-General of the United Nations. Such denunciation shall take effect for the Contracting State concerned one year after the date of its receipt by the Secretary-General.

2. In cases where, in accordance with the provisions of article 15, this Convention has become applicable to a non-metropolitan territory of a Contracting State, that State may at any time thereafter, with the consent of the territory concerned, give notice to the Secretary-General of the United-Nations denouncing this Convention separately in respect to that territory. The denunciation shall take effect one year after the date of the receipt of such notice by the Secretary-General, who shall notify all other Contracting States of such notice and the date of receipt thereof.

Article 20

1. The Secretary-General of the United Nations shall notify all Members of the United Nations and the non-member States referred to in article 16 of the following particulars:

(a) Signatures, ratifications and accessions under article 16;

(b) Reservations under article 17;

(c) The date upon which this Convention enters into force in pursuance of article 18;

(d) Denunciations under article 19.

2. The Secretary-General of the United Nations shall, after the deposit of the sixth instrument of ratification or accession at the latest, bring to the attention of the General Assembly the question of the establishment, in accordance with article 11, of such a body as therein mentioned.

Article 21

This Convention shall be registered by the Secretary-General of the United Nations on the date of its entry into force.

IN WITNESS WHEREOF the undersigned Plenipotentiaries have signed this Convention.

Līgumslēdzējas valstis

saskaņā ar Apvienoto Nāciju Organizācijas Ģenerālās Asamblejas 1954. gada 4. decembrī pieņemto Rezolūciju 896 (IX),

uzskatīdamas par vēlamu samazināt bezvalstniecību ar starptautisku nolīgumu,

ir vienojušās par turpmāko.

1. pants

1. Līgumslēdzēja valsts pilsonību piešķir personai, kas dzimusi tās teritorijā un pretējā gadījumā būtu bezvalstnieks. Šādu pilsonību piešķir:

a) saskaņā ar likumu personai piedzimstot vai

b) attiecīgajai personai pašai vai tās vārdā iesniedzot pieteikumu kompetentajai iestādei valsts tiesību aktos noteiktā kārtībā. Saskaņā ar šā panta 2. punkta noteikumiem iesniegtus pieteikumus nedrīkst noraidīt. Līgumslēdzēja valsts, kas paredz pilsonības piešķiršanu atbilstoši šā punkta b) apakšpunktam, var paredzēt arī pilsonības piešķiršanu saskaņā ar likumu tādā vecumā un ievērojot tādus nosacījumus, kādus paredz valsts tiesību akti.

2. Līgumslēdzēja valsts pilsonības piešķiršanai atbilstoši šā panta 1. punkta b) apakšpunktam var piemērot vienu vai vairākus šādus nosacījumus:

a) pieteikums jāiesniedz līgumslēdzējas valsts noteiktā laika posmā, kas sākas ne vēlāk kā astoņpadsmit gadu vecumā un beidzas ne agrāk kā divdesmit viena gada vecumā, bet tā, lai attiecīgajai personai būtu vismaz viens gads laika pašai iesniegt pieteikumu bez vajadzības saņemt pilnvarojumu, lai to darītu;

b) attiecīgā persona ir pastāvīgi dzīvojusi līgumslēdzējas valsts teritorijā šīs valsts noteiktu laika posmu, kas nepārsniedz piecus gadus tieši pirms pieteikuma iesniegšanas vai kopā desmit gadus;

c) attiecīgā persona nav bijusi notiesāta par noziegumu pret valsts drošību, vai sodīta par noziegumu ar brīvības atņemšanu uz pieciem vai vairāk gadiem;

d) attiecīgā persona vienmēr ir bijusi bezvalstnieks.

3. Neatkarīgi no šā panta 1. punkta b) apakšpunkta un 2. punkta noteikumiem bērns, kas piedzimis laulībā līgumslēdzējas valsts teritorijā un kura mātei ir šīs valsts pilsonība, piedzimstot iegūst šo pilsonību, ja pretējā gadījumā viņš būtu bezvalstnieks.

4. Līgumslēdzēja valsts piešķir pilsonību personai, kas pretējā gadījumā būtu bezvalstnieks un kas nevar iegūt tās līgumslēdzējas valsts pilsonību, kuras teritorijā šī persona piedzimusi, tāpēc ka viņa pārsniegusi pieteikuma iesniegšanai paredzēto vecumu vai nav ievērojusi vajadzīgos pastāvīgās uzturēšanās nosacījumus, ja vienam no vecākiem šīs personas piedzimšanas laikā ir bijusi iepriekš minētās līgumslēdzējas valsts pilsonība. Ja vecākiem bērna piedzimšanas laikā nav bijusi viena un tā pati pilsonība, jautājumu par to, vai attiecīgajam bērnam piešķirama tēva vai mātes pilsonība, nosaka šīs līgumslēdzējas valsts tiesību akti. Ja pilsonības iegūšanai jāiesniedz pieteikums, to iesniedz kompetentajā iestādē attiecīgā persona vai tas tiek iesniegts viņas vārdā saskaņā ar šīs valsts tiesību aktiem. Saskaņā ar šā panta 5. punkta noteikumiem iesniegtus pieteikumus nedrīkst noraidīt.

5. Līgumslēdzēja valsts pilsonības piešķiršanai atbilstoši šā panta 4. punkta noteikumiem var piemērot vienu vai vairākus šādus nosacījumus:

a) pieteikums ir jāiesniedz, pirms attiecīgā persona sasniegusi līgumslēdzējas valsts noteikto vecumu, kas nav mazāks par divdesmit trīs gadiem;

b) attiecīgā persona tieši pirms pieteikuma iesniegšanas ir pastāvīgi dzīvojusi līgumslēdzējas valsts teritorijā šīs valsts noteiktu laika posmu, kas nepārsniedz trīs gadus;

c) attiecīgā persona vienmēr ir bijusi bezvalstnieks.

2. pants

Bērns atradenis, kas atrasts līgumslēdzējas valsts teritorijā, tiek uzskatīts par šīs valsts teritorijā dzimušu bērnu, kura vecākiem ir šīs valsts pilsonība, ja vien nav pierādījumu par pretējo.

3. pants

Lai noteiktu līgumslēdzēju valstu pienākumus saskaņā ar šo konvenciju, bērna piedzimšana uz kuģa vai gaisa kuģī tiek uzskatīta par notikušu tās valsts teritorijā, kura ir kuģa karogvalsts, vai tās valsts teritorijā, kurā reģistrēts gaisa kuģis.

4. pants

1. Līgumslēdzēja valsts piešķir pilsonību personai, kas nav dzimusi līgumslēdzējas valsts teritorijā un kas citādi būtu bezvalstnieks, ja attiecīgās personas dzimšanas laikā vienam no viņas vecākiem ir bijusi šīs valsts pilsonība. Ja vecākiem šīs personas dzimšanas laikā nav bijusi viena un tā pati pilsonība, jautājumu par to, vai šai personai piešķirama tēva vai mātes pilsonība, nosaka šīs līgumslēdzējas valsts tiesību akti. Saskaņā ar šā punkta noteikumiem pilsonību piešķir:

a) saskaņā ar likumu personai piedzimstot vai

b) attiecīgajai personai pašai vai viņas vārdā iesniedzot pieteikumu kompetentajā iestādē, kā to paredz valsts tiesību akti. Saskaņā ar šā panta 2. punkta noteikumiem iesniegtus pieteikumus nedrīkst noraidīt.

2. Līgumslēdzējas valsts pilsonības piešķiršanai atbilstoši šā panta 1. punkta noteikumiem var piemērot vienu vai vairākus šādus nosacījumus:

a) pieteikums jāiesniedz pirms attiecīgā persona sasniegusi līgumslēdzējas valsts noteikto vecumu, kas nav mazāks par divdesmit trīs gadiem;

b) attiecīgā persona tieši pirms pieteikuma iesniegšanas ir pastāvīgi dzīvojusi līgumslēdzējas valsts teritorijā šīs valsts noteiktu laika posmu, kas nepārsniedz trīs gadus;

c) attiecīgā persona nav bijusi notiesāta par nodarījumu pret valsts drošību;

d) attiecīgā persona vienmēr ir bijusi bezvalstnieks.

5. pants

1. Ja līgumslēdzējas valsts tiesību akti paredz pilsonības zaudēšanu saistībā ar ģimenes stāvokļa maiņu, piemēram, laulībām, laulības izbeigšanu, leģitimāciju, atzīšanu vai adopciju, šāda pilsonības zaudēšana ir saistāma ar nosacījumu par citas valsts pilsonības esamību vai iegūšanu.

2. Ja saskaņā ar līgumslēdzējas valsts tiesību aktiem ārlaulībā dzimis bērns zaudē šīs valsts pilsonību paternitātes noteikšanas dēļ, viņam ir iespēja šo pilsonību atjaunot, iesniedzot rakstveida pieteikumu kompetentajai iestādei, un nosacījumi, kas reglamentē šādu pieteikumu iesniegšanu, nedrīkst būt stingrāki par tiem, kas paredzēti šīs konvencijas 1. panta 2. punktā.

6. pants

Ja līgumslēdzējas valsts tiesību akti paredz, ka pilsonības zaudēšanas vai atņemšanas gadījumā to zaudē arī personas laulātais vai bērni, tad šāda pilsonības zaudēšana ir saistāma ar nosacījumu par citas pilsonības esamību vai iegūšanu.

7. pants

1. a) Ja līgumslēdzējas valsts tiesību akti paredz pilsonības zaudēšanu vai atteikšanos no tās, šāda atteikšanās nerada pilsonības zaudēšanu, ja vien attiecīgajai personai nav citas valsts pilsonības vai viņa neiegūst šādu pilsonību;

b) šā punkta a) apakšpunkta noteikumus nepiemēro, ja to piemērošana būtu pretrunā principiem, kas noteikti Apvienoto Nāciju Organizācijas Ģenerālās Asamblejas 1948. gada 10. decembrī apstiprinātās Vispārējās Cilvēktiesību deklarācijas 13. un 14. pantā.

2. Līgumslēdzējas valsts pilsonis, kas vēlas naturalizēties kādā ārvalstī, nezaudē savu pilsonību, kamēr nav ieguvis šīs ārvalsts pilsonību vai nav saņēmis apstiprinājumu par tās iegūšanu.

3. Saskaņā ar šā panta 4. un 5. punkta noteikumiem līgumslēdzējas valsts pilsonis nezaudē savu pilsonību un nekļūst par bezvalstnieku, izbraucot no valsts, dzīvojot ārvalstīs, nereģistrējoties vai cita līdzīga iemesla dēļ.

4. Naturalizēta persona var zaudēt savu pilsonību, ja viņa dzīvo ārvalstīs laika posmu, ko paredz līgumslēdzējas valsts tiesību akti un kas nav īsāks par septiņiem secīgiem gadiem, ja šī persona nepaziņo kompetentajai iestādei savu nodomu saglabāt pilsonību.

5. Ja līgumslēdzējas valsts pilsonis ir dzimis ārpus tās teritorijas, šīs valsts tiesību aktos var paredzēt, ka viņa pilsonība saglabājas gadu pēc viņa pilngadības sasniegšanas, ja šajā laikā viņš apmetas uz dzīvi šajā valstī vai reģistrējas kompetentajā iestādē.

6. Izņemot šajā pantā minētos apstākļus, persona nezaudē līgumslēdzējas valsts pilsonību, ja tās zaudēšanas dēļ persona kļūtu par bezvalstnieku, neatkarīgi no tā, ka citi šīs konvencijas noteikumi šādu pilsonības zaudēšanu tieši neaizliedz.

8. pants

1. Līgumslēdzēja valsts neatņem personai pilsonību, ja atņemšanas gadījumā šī persona kļūtu par bezvalstnieku.

2. Neskarot šā panta 1. punkta noteikumus, personai var atņemt līgumslēdzējas valsts pilsonību:

a) apstākļos, kad saskaņā ar 7. panta 4. un 5. punktu ir pieļaujams, ka persona zaudē pilsonību;

b) ja pilsonība iegūta, sagrozot faktus vai ar krāpšanu.

3. Neatkarīgi no šā panta 1. punkta noteikumiem līgumslēdzēja valsts var paturēt tiesības atņemt personai pilsonību, ja, parakstot vai ratificējot šo konvenciju vai pievienojoties tai, valsts paziņo par savu nodomu paturēt šādas tiesības, norādot vienu vai vairākus no turpmāk minētiem iemesliem, kas attiecīgajā laikā noteikti šīs valsts tiesību aktos:

a) pretēji savam lojalitātes pienākumam pret līgumslēdzēju valsti šī persona,

i) neņemot vērā līgumslēdzējas valsts skaidru aizliegumu, ir sniegusi vai turpinājusi sniegt pakalpojumus citai valstij vai saņēmusi vai turpinājusi saņemt citas valsts atlīdzību, vai

ii) ar savu uzvedību ir nopietni kaitējusi valsts būtiski svarīgām interesēm;

b) šī persona ir devusi pavalstniecības zvērestu vai oficiāli paziņojusi par lojalitāti citai valstij vai sniegusi konkrētus pierādījumus par savu nodomu atteikties no lojalitātes šai līgumslēdzējai valstij.

4. Līgumslēdzēja valsts neīsteno tiesības atņemt pilsonību atbilstoši šā panta 2. vai 3. punktam citādi, kā vien saskaņā ar tiesību aktiem, kas paredz attiecīgajai personai tiesības uz lietas taisnīgu izskatīšanu tiesā vai citā neatkarīgā iestādē.

9. pants

Līgumslēdzēja valsts nedrīkst atņemt pilsonību nevienai personai vai personu grupai rasistisku, etnisku, reliģisku vai politisku iemeslu dēļ.

10. pants

1. Katrā līgumslēdzēju valstu noslēgtā līgumā, kas paredz kādas teritorijas nodošanu, ietver noteikumus, kuru mērķis ir nodrošināt, lai šādas nodošanas dēļ neviena persona nekļūtu par bezvalstnieku. Līgumslēdzēja valsts dara visu iespējamo, lai nodrošinātu to, ka tādi noteikumi ir iekļauti ikvienā šādā līgumā, ko tā noslēdz ar valsti, kura nav šīs konvencijas puse.

2. Ja šādu noteikumu nav, līgumslēdzēja valsts, kurai tiek nodota teritorija vai kura citādi iegūst teritoriju, piešķir savu pilsonību tām personām, kuras citādi šīs teritorijas nodošanas vai iegūšanas dēļ kļūtu par bezvalstniekiem.

11. pants

Līgumslēdzējas valstis pēc sestā ratifikācijas vai pievienošanās instrumenta deponēšanas, cik drīz vien iespējams, veicina tādas struktūras izveidi Apvienoto Nāciju Organizācijā, kurā persona, kas pieprasa šajā konvencijā paredzētās priekšrocības, var lūgt šīs prasības izskatīšanu un palīdzību tās iesniegšanai kompetentajā iestādē.

12. pants

1. Attiecībā uz līgumslēdzēju valsti, kas, ievērojot šīs konvencijas 1. panta 1. punkta vai 4. panta noteikumus, nepiešķir pilsonību personai saskaņā ar likumu, viņai piedzimstot, 1. panta 1. punkta vai 4. panta noteikumus piemēro gan personām, kas dzimušas pirms šīs konvencijas stāšanās spēkā, gan personām, kas dzimušas pēc tās stāšanās spēkā.

2. Šīs konvencijas 1. panta 4. punkta noteikumi attiecas gan uz personām, kas dzimušas pirms šīs konvencijas stāšanās spēkā, gan uz personām, kas dzimušas pēc tās stāšanās spēkā.

3. Šīs konvencijas 2. panta noteikumi attiecas tikai uz bērniem atradeņiem, kas atrasti līgumslēdzējas valsts teritorijā pēc šīs konvencijas stāšanās spēkā šajā valstī.

13. pants

Šī konvencija nav interpretējama tādējādi, ka tā ietekmē bezvalstniecības samazināšanai vēl labvēlīgākus noteikumus, kas var būt ietverti jebkuras līgumslēdzējas valsts tiesību aktos, kuri jau ir spēkā vai stāsies spēkā, vai jebkurā citā konvencijā, līgumā vai nolīgumā, kas ir spēkā vai stāsies spēkā starp divām vai vairākām līgumslēdzējām valstīm.

14. pants

Jebkādus strīdus starp līgumslēdzējām valstīm par šīs konvencijas interpretēšanu vai piemērošanu, kurus nevar izšķirt citādi, pēc jebkuras strīdā iesaistītās puses pieprasījuma nodod izskatīšanai Starptautiskajā tiesā.

15. pants

1. Šī konvencija attiecas uz visām teritorijām, kurās nav savas pašpārvaldes, aizbildnības teritorijām, koloniālajām un citām teritorijām, kas nav valsts pamatteritorijas un par kuru starptautiskajām attiecībām atbild kāda no līgumslēdzējām valstīm. Attiecīgā līgumslēdzēja valsts atbilstoši šā panta 2. punkta noteikumiem konvencijas parakstīšanas vai ratificēšanas laikā vai pievienojoties tai, paziņo par teritoriju vai teritorijām, kuras nav valsts pamatteritorijas un kurām šī konvencija parakstīšanas, ratifikācijas vai pievienošanās dēļ ipso facto ir piemērojama.

Visos gadījumos, kad attiecībā uz pilsonību teritorija, kas nav valsts pamatteritorija, netiek pielīdzināta valsts pamatteritorijai, kā arī gadījumos, kad šīs konvencijas piemērošanai teritorijā, kas nav valsts pamatteritorija, saskaņā ar līgumslēdzējas valsts vai šīs teritorijas konstitucionālajām tiesībām vai praksi vajadzīga šīs teritorijas iepriekšēja piekrišana, attiecīgā līgumslēdzēja valsts dara visu iespējamo, lai nodrošinātu, ka teritorija, kas nav valsts pamatteritorija, dotu vajadzīgo piekrišanu divpadsmit mēnešu laikā no brīža, kad šī līgumslēdzēja valsts parakstījusi šo konvenciju, un pēc šādas piekrišanas saņemšanas līgumslēdzēja valsts par to paziņo Apvienoto Nāciju Organizācijas ģenerālsekretāram. Konvencija ir piemērojama teritorijai vai teritorijām, kas minētas šādā paziņojumā, no brīža, kad ģenerālsekretārs saņēmis šo paziņojumu.

3. Pēc šā panta 2. punktā minētā divpadsmit mēnešu termiņa izbeigšanās attiecīgās līgumslēdzējas valstis informē ģenerālsekretāru par to, kādas sekmes ir gūtas sarunās ar teritorijām, kuras nav šo valstu pamatteritorijas un par kuru starptautiskajām attiecībām tās ir atbildīgas, un kuru piekrišana šīs konvencijas piemērošanai nav saņemta.

16. pants

1. Šo konvenciju var parakstīt Apvienoto Nāciju Organizācijas mītnē no 1961. gada 30. augusta līdz 1962. gada 31. maijam.

2. Šo konvenciju var parakstīt:

a) jebkura Apvienoto Nāciju Organizācijas dalībvalsts,

b) jebkura cita valsts, kas aicināta piedalīties Apvienoto Nāciju Organizācijas konferencē par bezvalstniecības turpmāku izskaušanu vai samazināšanu,

c) jebkura valsts, kurai Apvienoto Nāciju Organizācijas Ģenerālā Asambleja nosūtījusi uzaicinājumu parakstīt šo konvenciju vai pievienoties tai.

3. Šo konvenciju ratificē un ratifikācijas instrumentus deponē Apvienoto Nāciju Organizācijas ģenerālsekretāram.

4. Šai konvencijai var pievienoties šā panta 2. punktā minētās valstis. Pievienošanās notiek, deponējot pievienošanās instrumentu Apvienoto Nāciju Organizācijas ģenerālsekretāram.

17. pants

1. Katra valsts, parakstot vai ratificējot šo konvenciju, vai pievienojoties tai, var izdarīt atrunas attiecībā uz 11., 14. vai 15. pantu.

2. Citas atrunas attiecībā uz šo konvenciju nav pieļaujamas.

18. pants

1. Šī konvencija stājas spēkā divus gadus pēc tās dienas, kurā deponēts sestais ratifikācijas vai pievienošanās instruments.

2. Visās valstīs, kas ratificējušas šo konvenciju vai pievienojušās tai pēc sestā ratifikācijas vai pievienošanās instrumenta deponēšanas, tā stājas spēkā deviņdesmitajā dienā pēc tam, kad attiecīgā valsts deponējusi savu ratifikācijas vai pievienošanās instrumentu, vai dienā, kurā šī konvencija stājas spēkā saskaņā ar šā panta 1. punkta noteikumiem, atkarībā no tā, kurš notikums ir vēlāks.

19. pants

1. Jebkura līgumslēdzēja valsts var jebkurā laikā denonsēt šo konvenciju, adresējot rakstisku paziņojumu Apvienoto Nāciju Organizācijas ģenerālsekretāram. Attiecībā uz konkrēto līgumslēdzēju valsti denonsēšana stājas spēkā vienu gadu pēc dienas, kurā ģenerālsekretārs saņēmis šo paziņojumu.

2. Gadījumos, kad saskaņā ar 15. panta noteikumiem šī konvencija ir kļuvusi piemērojama līgumslēdzējas valsts teritorijā, kas nav valsts pamatteritorija, šī valsts var jebkurā laikā pēc tam ar attiecīgās teritorijas piekrišanu paziņot Apvienoto Nāciju Organizācijas ģenerālsekretāram par šīs konvencijas denonsēšanu tikai attiecībā uz šo teritoriju. Denonsēšana stājas spēkā vienu gadu pēc dienas, kurā ģenerālsekretārs saņēmis šādu paziņojumu, un ģenerālsekretārs par šo paziņojumu un tā saņemšanas datumu informē visas pārējās līgumslēdzējas valstis.

20. pants

1. Apvienoto Nāciju Organizācijas ģenerālsekretārs visām Apvienoto Nāciju Organizācijas dalībvalstīm un 16. pantā minētajām trešajām valstīm paziņo par:

a) parakstīšanu, ratifikāciju un pievienošanos saskaņā ar 16. pantu,

b) atrunām saskaņā ar 17. pantu,

c) šīs konvencijas spēkā stāšanās datumu saskaņā ar 18. pantu,

d) denonsēšanu saskaņā ar 19. pantu.

2. Apvienoto Nāciju Organizācijas ģenerālsekretārs ne vēlāk kā pēc sestā ratifikācijas vai pievienošanās instrumenta deponēšanas vērš Ģenerālās Asamblejas uzmanību uz jautājumu par 11. pantā minētās struktūras izveidošanu saskaņā ar minēto pantu.

21. pants

Šo konvenciju Apvienoto Nāciju Organizācijas ģenerālsekretārs reģistrē tās spēkā stāšanās dienā.

To apliecinot, attiecīgi pilnvarotas personas ir parakstījušas šo konvenciju.

Ņujorkā, tūkstoš deviņi simti sešdesmit pirmā gada trīsdesmitajā augustā, vienā eksemplārā, kura teksts angļu, franču, krievu, ķīniešu un spāņu valodā ir vienlīdz autentisks, kuru deponē Apvienoto Nāciju Organizācijas arhīvos un kura apstiprinātas kopijas Apvienoto Nāciju Organizācijas ģenerālsekretārs nosūta visām Apvienoto Nāciju Organizācijas dalībvalstīm un šīs konvencijas 16. pantā minētajām trešajām valstīm.



 

Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment

Adopted and opened for signature, ratification and accession by General Assembly resolution 39/46 of 10 December 1984 entry into force 26 June 1987, in accordance with article 27 (1)

The States Parties to this Convention,

Considering that, in accordance with the principles proclaimed in the Charter of the United Nations, recognition of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world,

Recognizing that those rights derive from the inherent dignity of the human person,

Considering the obligation of States under the Charter, in particular Article 55, to promote universal respect for, and observance of, human rights and fundamental freedoms,

Having regard to article 5 of the Universal Declaration of Human Rights and article 7 of the International Covenant on Civil and Political Rights, both of which provide that no one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment,

Having regard also to the Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, adopted by the General Assembly on 9 December 1975,

Desiring to make more effective the struggle against torture and other cruel, inhuman or degrading treatment or punishment throughout the world,

Have agreed as follows:

PART I

Article 1

1. For the purposes of this Convention, the term "torture" means any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity. It does not include pain or suffering arising only from, inherent in or incidental to lawful sanctions.

2. This article is without prejudice to any international instrument or national legislation which does or may contain provisions of wider application.

Article 2

1. Each State Party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction.

2. No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political in stability or any other public emergency, may be invoked as a justification of torture.

3. An order from a superior officer or a public authority may not be invoked as a justification of torture.

Article 3

1. No State Party shall expel, return ("refouler") or extradite a person to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture.

2. For the purpose of determining whether there are such grounds, the competent authorities shall take into account all relevant considerations including, where applicable, the existence in the State concerned of a consistent pattern of gross, flagrant or mass violations of human rights.

Article 4

1. Each State Party shall ensure that all acts of torture are offences under its criminal law. The same shall apply to an attempt to commit torture and to an act by any person which constitutes complicity or participation in torture.

2. Each State Party shall make these offences punishable by appropriate penalties which take into account their grave nature.

Article 5

1. Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences referred to in article 4 in the following cases:

(a) When the offences are committed in any territory under its jurisdiction or on board a ship or aircraft registered in that State;

(b) When the alleged offender is a national of that State;

(c) When the victim is a national of that State if that State considers it appropriate.

2. Each State Party shall likewise take such measures as may be necessary to establish its jurisdiction over such offences in cases where the alleged offender is present in any territory under its jurisdiction and it does not extradite him pursuant to article 8 to any of the States mentioned in paragraph 1 of this article.

3. This Convention does not exclude any criminal jurisdiction exercised in accordance with internal law.

Article 6

1. Upon being satisfied, after an examination of information available to it, that the circumstances so warrant, any State Party in whose territory a person alleged to have committed any offence referred to in article 4 is present shall take him into custody or take other legal measures to ensure his presence. The custody and other legal measures shall be as provided in the law of that State but may be continued only for such time as is necessary to enable any criminal or extradition proceedings to be instituted.

2. Such State shall immediately make a preliminary inquiry into the facts.

3. Any person in custody pursuant to paragraph 1 of this article shall be assisted in communicating immediately with the nearest appropriate representative of the State of which he is a national, or, if he is a stateless person, with the representative of the State where he usually resides.

4. When a State, pursuant to this article, has taken a person into custody, it shall immediately notify the States referred to in article 5, paragraph 1, of the fact that such person is in custody and of the circumstances which warrant his detention. The State which makes the preliminary inquiry contemplated in paragraph 2 of this article shall promptly report its findings to the said States and shall indicate whether it intends to exercise jurisdiction.

Article 7

1. The State Party in the territory under whose jurisdiction a person alleged to have committed any offence referred to in article 4 is found shall in the cases contemplated in article 5, if it does not extradite him, submit the case to its competent authorities for the purpose of prosecution.

2. These authorities shall take their decision in the same manner as in the case of any ordinary offence of a serious nature under the law of that State. In the cases referred to in article 5, paragraph 2, the standards of evidence required for prosecution and conviction shall in no way be less stringent than those which apply in the cases referred to in article 5, paragraph 1.

3. Any person regarding whom proceedings are brought in connection with any of the offences referred to in article 4 shall be guaranteed fair treatment at all stages of the proceedings.

Article 8

1. The offences referred to in article 4 shall be deemed to be included as extraditable offences in any extradition treaty existing between States Parties. States Parties undertake to include such offences as extraditable offences in every extradition treaty to be concluded between them.

2. If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it may consider this Convention as the legal basis for extradition in respect of such offences. Extradition shall be subject to the other conditions provided by the law of the requested State.

3. States Parties which do not make extradition conditional on the existence of a treaty shall recognize such offences as extraditable offences between themselves subject to the conditions provided by the law of the requested State.

4. Such offences shall be treated, for the purpose of extradition between States Parties, as if they had been committed not only in the place in which they occurred but also in the territories of the States required to establish their jurisdiction in accordance with article 5, paragraph 1.

Article 9

1. States Parties shall afford one another the greatest measure of assistance in connection with criminal proceedings brought in respect of any of the offences referred to in article 4, including the supply of all evidence at their disposal necessary for the proceedings.

2. States Parties shall carry out their obligations under paragraph 1 of this article in conformity with any treaties on mutual judicial assistance that may exist between them.

Article 10

1. Each State Party shall ensure that education and information regarding the prohibition against torture are fully included in the training of law enforcement personnel, civil or military, medical personnel, public officials and other persons who may be involved in the custody, interrogation or treatment of any individual subjected to any form of arrest, detention or imprisonment.

2. Each State Party shall include this prohibition in the rules or instructions issued in regard to the duties and functions of any such person.

Article 11

Each State Party shall keep under systematic review interrogation rules, instructions, methods and practices as well as arrangements for the custody and treatment of persons subjected to any form of arrest, detention or imprisonment in any territory under its jurisdiction, with a view to preventing any cases of torture.

Article 12

Each State Party shall ensure that its competent authorities proceed to a prompt and impartial investigation, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction.

Article 13

Each State Party shall ensure that any individual who alleges he has been subjected to torture in any territory under its jurisdiction has the right to complain to, and to have his case promptly and impartially examined by, its competent authorities. Steps shall be taken to ensure that the complainant and witnesses are protected against all ill-treatment or intimidation as a consequence of his complaint or any evidence given.

Article 14

1. Each State Party shall ensure in its legal system that the victim of an act of torture obtains redress and has an enforceable right to fair and adequate compensation, including the means for as full rehabilitation as possible. In the event of the death of the victim as a result of an act of torture, his dependants shall be entitled to compensation.

2. Nothing in this article shall affect any right of the victim or other persons to compensation which may exist under national law.

Article 15

Each State Party shall ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings, except against a person accused of torture as evidence that the statement was made.

Article 16

1. Each State Party shall undertake to prevent in any territory under its jurisdiction other acts of cruel, inhuman or degrading treatment or punishment which do not amount to torture as defined in article 1, when such acts are committed by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity. In particular, the obligations contained in articles 10, 11, 12 and 13 shall apply with the substitution for references to torture of references to other forms of cruel, inhuman or degrading treatment or punishment.

2. The provisions of this Convention are without prejudice to the provisions of any other international instrument or national law which prohibits cruel, inhuman or degrading treatment or punishment or which relates to extradition or expulsion.

PART II

Article 17

1. There shall be established a Committee against Torture (hereinafter referred to as the Committee) which shall carry out the functions hereinafter provided. The Committee shall consist of ten experts of high moral standing and recognized competence in the field of human rights, who shall serve in their personal capacity. The experts shall be elected by the States Parties, consideration being given to equitable geographical distribution and to the usefulness of the participation of some persons having legal experience.

2. The members of the Committee shall be elected by secret ballot from a list of persons nominated by States Parties. Each State Party may nominate one person from among its own nationals. States Parties shall bear in mind the usefulness of nominating persons who are also members of the Human Rights Committee established under the International Covenant on Civil and Political Rights and who are willing to serve on the Committee against Torture.

3. Elections of the members of the Committee shall be held at biennial meetings of States Parties convened by the Secretary-General of the United Nations. At those meetings, for which two thirds of the States Parties shall constitute a quorum, the persons elected to the Committee shall be those who obtain the largest number of votes and an absolute majority of the votes of the representatives of States Parties present and voting.

4. The initial election shall be held no later than six months after the date of the entry into force of this Convention. At least four months before the date of each election, the Secretary-General of the United Nations shall address a letter to the States Parties inviting them to submit their nominations within three months. The Secretary-General shall prepare a list in alphabetical order of all persons thus nominated, indicating the States Parties which have nominated them, and shall submit it to the States Parties.

5. The members of the Committee shall be elected for a term of four years. They shall be eligible for re-election if renominated. However, the term of five of the members elected at the first election shall expire at the end of two years; immediately after the first election the names of these five members shall be chosen by lot by the chairman of the meeting referred to in paragraph 3 of this article.

6. If a member of the Committee dies or resigns or for any other cause can no longer perform his Committee duties, the State Party which nominated him shall appoint another expert from among its nationals to serve for the remainder of his term, subject to the approval of the majority of the States Parties. The approval shall be considered given unless half or more of the States Parties respond negatively within six weeks after having been informed by the Secretary-General of the United Nations of the proposed appointment.

7. States Parties shall be responsible for the expenses of the members of the Committee while they are in performance of Committee duties.

Article 18

1. The Committee shall elect its officers for a term of two years. They may be re-elected.

2. The Committee shall establish its own rules of procedure, but these rules shall provide, inter alia, that:

(a) Six members shall constitute a quorum;

(b) Decisions of the Committee shall be made by a majority vote of the members present.

3. The Secretary-General of the United Nations shall provide the necessary staff and facilities for the effective performance of the functions of the Committee under this Convention.

4. The Secretary-General of the United Nations shall convene the initial meeting of the Committee. After its initial meeting, the Committee shall meet at such times as shall be provided in its rules of procedure.

5. The States Parties shall be responsible for expenses incurred in connection with the holding of meetings of the States Parties and of the Committee, including reimbursement to the United Nations for any expenses, such as the cost of staff and facilities, incurred by the United Nations pursuant to paragraph 3 of this article.

Article 19

1. The States Parties shall submit to the Committee, through the Secretary-General of the United Nations, reports on the measures they have taken to give effect to their undertakings under this Convention, within one year after the entry into force of the Convention for the State Party concerned. Thereafter the States Parties shall submit supplementary reports every four years on any new measures taken and such other reports as the Committee may request.

2. The Secretary-General of the United Nations shall transmit the reports to all States Parties.

3. Each report shall be considered by the Committee which may make such general comments on the report as it may consider appropriate and shall forward these to the State Party concerned. That State Party may respond with any observations it chooses to the Committee.

4. The Committee may, at its discretion, decide to include any comments made by it in accordance with paragraph 3 of this article, together with the observations thereon received from the State Party concerned, in its annual report made in accordance with article 24. If so requested by the State Party concerned, the Committee may also include a copy of the report submitted under paragraph 1 of this article.

Article 20

1. If the Committee receives reliable information which appears to it to contain well-founded indications that torture is being systematically practised in the territory of a State Party, the Committee shall invite that State Party to co-operate in the examination of the information and to this end to submit observations with regard to the information concerned.

2. Taking into account any observations which may have been submitted by the State Party concerned, as well as any other relevant information available to it, the Committee may, if it decides that this is warranted, designate one or more of its members to make a confidential inquiry and to report to the Committee urgently.

3. If an inquiry is made in accordance with paragraph 2 of this article, the Committee shall seek the co-operation of the State Party concerned. In agreement with that State Party, such an inquiry may include a visit to its territory.

4. After examining the findings of its member or members submitted in accordance with paragraph 2 of this article, the Commission shall transmit these findings to the State Party concerned together with any comments or suggestions which seem appropriate in view of the situation.

5. All the proceedings of the Committee referred to in paragraphs 1 to 4 of this article shall be confidential, and at all stages of the proceedings the co-operation of the State Party shall be sought. After such proceedings have been completed with regard to an inquiry made in accordance with paragraph 2, the Committee may, after consultations with the State Party concerned, decide to include a summary account of the results of the proceedings in its annual report made in accordance with article 24.

Article 21

1. A State Party to this Convention may at any time declare under this article that it recognizes the competence of the Committee to receive and consider communications to the effect that a State Party claims that another State Party is not fulfilling its obligations under this Convention. Such communications may be received and considered according to the procedures laid down in this article only if submitted by a State Party which has made a declaration recognizing in regard to itself the competence of the Committee. No communication shall be dealt with by the Committee under this article if it concerns a State Party which has not made such a declaration. Communications received under this article shall be dealt with in accordance with the following procedure;

(a) If a State Party considers that another State Party is not giving effect to the provisions of this Convention, it may, by written communication, bring the matter to the attention of that State Party. Within three months after the receipt of the communication the receiving State shall afford the State which sent the communication an explanation or any other statement in writing clarifying the matter, which should include, to the extent possible and pertinent, reference to domestic procedures and remedies taken, pending or available in the matter;

(b) If the matter is not adjusted to the satisfaction of both States Parties concerned within six months after the receipt by the receiving State of the initial communication, either State shall have the right to refer the matter to the Committee, by notice given to the Committee and to the other State;

(c) The Committee shall deal with a matter referred to it under this article only after it has ascertained that all domestic remedies have been invoked and exhausted in the matter, in conformity with the generally recognized principles of international law. This shall not be the rule where the application of the remedies is unreasonably prolonged or is unlikely to bring effective relief to the person who is the victim of the violation of this Convention;

(d) The Committee shall hold closed meetings when examining communications under this article;

(e) Subject to the provisions of subparagraph (c), the Committee shall make available its good offices to the States Parties concerned with a view to a friendly solution of the matter on the basis of respect for the obligations provided for in this Convention. For this purpose, the Committee may, when appropriate, set up an ad hoc conciliation commission;

(f) In any matter referred to it under this article, the Committee may call upon the States Parties concerned, referred to in subparagraph (b), to supply any relevant information;

(g) The States Parties concerned, referred to in subparagraph (b), shall have the right to be represented when the matter is being considered by the Committee and to make submissions orally and/or in writing;

(h) The Committee shall, within twelve months after the date of receipt of notice under subparagraph (b), submit a report:

(i) If a solution within the terms of subparagraph (e) is reached, the Committee shall confine its report to a brief statement of the facts and of the solution reached;

(ii) If a solution within the terms of subparagraph (e) is not reached, the Committee shall confine its report to a brief statement of the facts; the written submissions and record of the oral submissions made by the States Parties concerned shall be attached to the report.

In every matter, the report shall be communicated to the States Parties concerned.

2. The provisions of this article shall come into force when five States Parties to this Convention have made declarations under paragraph 1 of this article. Such declarations shall be deposited by the States Parties with the Secretary-General of the United Nations, who shall transmit copies thereof to the other States Parties. A declaration may be withdrawn at any time by notification to the Secretary-General. Such a withdrawal shall not prejudice the consideration of any matter which is the subject of a communication already transmitted under this article; no further communication by any State Party shall be received under this article after the notification of withdrawal of the declaration has been received by the Secretary-General, unless the State Party concerned has made a new declaration.

Article 22

1. A State Party to this Convention may at any time declare under this article that it recognizes the competence of the Committee to receive and consider communications from or on behalf of individuals subject to its jurisdiction who claim to be victims of a violation by a State Party of the provisions of the Convention. No communication shall be received by the Committee if it concerns a State Party which has not made such a declaration.

2. The Committee shall consider inadmissible any communication under this article which is anonymous or which it considers to be an abuse of the right of submission of such communications or to be incompatible with the provisions of this Convention.

3. Subject to the provisions of paragraph 2, the Committee shall bring any communications submitted to it under this article to the attention of the State Party to this Convention which has made a declaration under paragraph 1 and is alleged to be violating any provisions of the Convention. Within six months, the receiving State shall submit to the Committee written explanations or statements clarifying the matter and the remedy, if any, that may have been taken by that State.

4. The Committee shall consider communications received under this article in the light of all information made available to it by or on behalf of the individual and by the State Party concerned.

5. The Committee shall not consider any communications from an individual under this article unless it has ascertained that:

(a) The same matter has not been, and is not being, examined under another procedure of international investigation or settlement;

(b) The individual has exhausted all available domestic remedies; this shall not be the rule where the application of the remedies is unreasonably prolonged or is unlikely to bring effective relief to the person who is the victim of the violation of this Convention.

6. The Committee shall hold closed meetings when examining communications under this article.

7. The Committee shall forward its views to the State Party concerned and to the individual.

8. The provisions of this article shall come into force when five States Parties to this Convention have made declarations under paragraph 1 of this article. Such declarations shall be deposited by the States Parties with the Secretary-General of the United Nations, who shall transmit copies thereof to the other States Parties. A declaration may be withdrawn at any time by notification to the Secretary-General. Such a withdrawal shall not prejudice the consideration of any matter which is the subject of a communication already transmitted under this article; no further communication by or on behalf of an individual shall be received under this article after the notification of withdrawal of the declaration has been received by the Secretary-General, unless the State Party has made a new declaration.

Article 23

The members of the Committee and of the ad hoc conciliation commissions which may be appointed under article 21, paragraph 1 (e), shall be entitled to the facilities, privileges and immunities of experts on mission for the United Nations as laid down in the relevant sections of the Convention on the Privileges and Immunities of the United Nations.

Article 24

The Committee shall submit an annual report on its activities under this Convention to the States Parties and to the General Assembly of the United Nations.

PART III

Article 25

1. This Convention is open for signature by all States.

2. This Convention is subject to ratification. Instruments of ratification shall be deposited with the Secretary-General of the United Nations.

Article 26

This Convention is open to accession by all States. Accession shall be effected by the deposit of an instrument of accession with the Secretary General of the United Nations.

Article 27

1. This Convention shall enter into force on the thirtieth day after the date of the deposit with the Secretary-General of the United Nations of the twentieth instrument of ratification or accession.

2. For each State ratifying this Convention or acceding to it after the deposit of the twentieth instrument of ratification or accession, the Convention shall enter into force on the thirtieth day after the date of the deposit of its own instrument of ratification or accession.

Article 28

1. Each State may, at the time of signature or ratification of this Convention or accession thereto, declare that it does not recognize the competence of the Committee provided for in article 20.

2. Any State Party having made a reservation in accordance with paragraph 1 of this article may, at any time, withdraw this reservation by notification to the Secretary-General of the United Nations.

Article 29

1. Any State Party to this Convention may propose an amendment and file it with the Secretary-General of the United Nations. The Secretary General shall thereupon communicate the proposed amendment to the States Parties with a request that they notify him whether they favour a conference of States Parties for the purpose of considering an d voting upon the proposal. In the event that within four months from the date of such communication at least one third of the States Parties favours such a conference, the Secretary General shall convene the conference under the auspices of the United Nations. Any amendment adopted by a majority of the States Parties present and voting at the conference shall be submitted by the Secretary-General to all the States Parties for acceptance.

2. An amendment adopted in accordance with paragraph 1 of this article shall enter into force when two thirds of the States Parties to this Convention have notified the Secretary-General of the United Nations that they have accepted it in accordance with their respective constitutional processes.

3. When amendments enter into force, they shall be binding on those States Parties which have accepted them, other States Parties still being bound by the provisions of this Convention and any earlier amendments which they have accepted.

Article 30

1. Any dispute between two or more States Parties concerning the interpretation or application of this Convention which cannot be settled through negotiation shall, at the request of one of them, be submitted to arbitration. If within six months from the date of the request for arbitration the Parties are unable to agree on the organization of the arbitration, any one of those Parties may refer the dispute to the International Court of Justice by request in conformity with the Statute of the Court.

2. Each State may, at the time of signature or ratification of this Convention or accession thereto, declare that it does not consider itself bound by paragraph 1 of this article. The other States Parties shall not be bound by paragraph 1 of this article with respect to any State Party having made such a reservation.

3. Any State Party having made a reservation in accordance with paragraph 2 of this article may at any time withdraw this reservation by notification to the Secretary-General of the United Nations.

Article 31

1. A State Party may denounce this Convention by written notification to the Secretary-General of the United Nations. Denunciation becomes effective one year after the date of receipt of- the notification by the Secretary-General .

2. Such a denunciation shall not have the effect of releasing the State Party from its obligations under this Convention in regard to any act or omission which occurs prior to the date at which the denunciation becomes effective, nor shall denunciation prejudice in any way the continued consideration of any matter which is already under consideration by the Committee prior to the date at which the denunciation becomes effective.

3. Following the date at which the denunciation of a State Party becomes effective, the Committee shall not commence consideration of any new matter regarding that State.

Article 32

The Secretary-General of the United Nations shall inform all States Members of the United Nations and all States which have signed this Convention or acceded to it of the following:

(a) Signatures, ratifications and accessions under articles 25 and 26;

(b) The date of entry into force of this Convention under article 27 and the date of the entry into force of any amendments under article 29;

(c) Denunciations under article 31.

Article 33

1. This Convention, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.

2. The Secretary-General of the United Nations shall transmit certified copies of this Convention to all States.



 

Konvencija pret spīdzināšanu un citiem nežēlīgas, necilvēcīgas vai pazemojošas izturēšanās vai sodīšanas veidiem

Pieņemta un atvērta parakstīšanas, ratificēšanas un pievienošanās procedūrai ar Ģenerālās Asamblejas 1984. gada 10. decembra Rezolūciju 39/46
stājusies spēkā 1987. gada 26. jūnijā saskaņā ar 27. panta 1. punkta noteikumiem

Šīs Konvencijas dalībvalstis,

ievērojot, ka saskaņā ar Apvienoto Nāciju Organizācijas Statūtos proklamētajiem principiem visu cilvēku saimes locekļu vienlīdzīgu un neatņemamu tiesību atzīšana ir brīvības, taisnīguma un vispārēja miera pamats,

atzīstot, ka šīs tiesības izriet no cilvēkam piemītošās pašcieņas,

ievērojot, ka saskaņā ar Statūtiem un jo īpaši ar to 55. pantu valstīm ir pienākums veicināt cilvēktiesību un pamatbrīvību vispārēju respektēšanu un ievērošanu,

ņemot vērā Vispārējās cilvēktiesību deklarācijas 5. pantu un Starptautiskā Pakta par pilsoniskajām un politiskajām tiesībām 7. pantu, kas nosaka, ka nevienu nedrīkst pakļaut spīdzināšanai vai nežēlīgas, necilvēcīgas vai pazemojošas izturēšanās vai sodīšanas veidiem,

ņemot vērā arī Deklarāciju par visu personu aizsardzību pret spīdzināšanu un citiem nežēlīgas, necilvēcīgas vai pazemojošas izturēšanās vai sodīšanas veidiem, kuru Ģenerālā asambleja pieņēmusi 1975. gada 9. decembrī,

vēloties visā pasaulē padarīt efektīvāku cīņu pret spīdzināšanu un citiem nežēlīgas, necilvēcīgas vai pazemojošas izturēšanās vai sodīšanas veidiem,

ir vienojušās par turpmāko.

I DAĻA

1. pants

1. Šajā Konvencijā termins "spīdzināšana" nozīmē jebkādu aktu, ar kuru kādai personai tīši tiek nodarītas stipras fiziskas vai garīgas sāpes vai ciešanas, lai no tās vai no kādas trešās personas iegūtu ziņas vai atzīšanos, lai sodītu par kādu darbību, kuru šī persona vai kāda trešā persona veikusi vai par kuras veikšanu šo personu vai kādu trešo personu tur aizdomās, lai šo personu vai kādu trešo personu iebaidītu vai uz šo personu vai kādu trešo personu izdarītu spiedienu vai jebkāda cita iemesla dēļ, kura pamatā ir jebkāda veida diskriminācija, ja šādas sāpes vai ciešanas nodara valsts amatpersona vai kāda cita persona, kas rīkojas kā valsts amatpersona, vai ja tās tiek nodarītas šādu personu veiktas kūdīšanas dēļ vai ar to tiešu vai netiešu piekrišanu. Šis termins nenozīmē sāpes vai ciešanas, ko rada tikai un vienīgi likumīgas sankcijas, kas ir šādu sankciju daļa vai kas rodas saistībā ar šādām sankcijām.

2. Šis pants neskar nevienu tādu starptautisku instrumentu vai tādu valsts tiesību aktu, kas ietver vai var ietvert plašāk piemērojamus noteikumus.

2. pants

1. Katra dalībvalsts veic efektīvus likumdošanas, administratīvos, tiesas vai citus pasākumus, lai nepieļautu, ka tās jurisdikcijai pakļautajā teritorijā notiek spīdzināšanas akti.

2. Nekādi ārkārtas apstākļi, lai kādi tie būtu, piemēram, kara stāvoklis vai kara draudi, iekšējā politiskā nestabilitāte vai jebkāds cits ārkārtas stāvoklis, nevar būt par attaisnojumu spīdzināšanai.

3. Augstākstāvošas amatpersonas vai valsts iestādes pavēle nevar būt par attaisnojumu spīdzināšanai.

3. pants

1. Neviena dalībvalsts nedrīkst izsūtīt, nosūtīt atpakaļ vai izdot kādu personu citai valstij, ja pastāv pamatots iemesls uzskatīt, ka šai personai var draudēt spīdzināšana.

2. Lai noteiktu, vai šāds iemesls pastāv, kompetentās iestādes ņem vērā visus attiecīgos apsvērumus un attiecīgā gadījumā to, ka konkrētajā valstī tiek sistemātiski pieļauti nopietni, acīmredzami un masveidīgi cilvēktiesību pārkāpumi.

4. pants

1. Katra dalībvalsts nodrošina, lai visi spīdzināšanas akti būtu uzskatāmi par noziegumiem saskaņā ar tās krimināltiesību aktiem. Tas pats attiecas uz spīdzināšanas mēģinājumu un uz jebkādas personas veiktām darbībām, kuras uzskatāmas par līdzdalību vai piedalīšanos spīdzināšanā.

2. Katra dalībvalsts par šādiem noziegumiem nosaka attiecīgus sodus, kuros tiek ņemts vērā to smagums.

5. pants

1. Katra dalībvalsts veic pasākumus, kas nepieciešami, lai noteiktu savu jurisdikciju attiecībā uz 4. pantā minētajiem noziegumiem šādos gadījumos:

a) ja noziegumi izdarīti jebkurā tās jurisdikcijai pakļautā teritorijā vai uz jūras vai gaisa kuģa, kas reģistrēts attiecīgajā valstī;

b) ja iespējamais noziedznieks ir attiecīgās valsts valstspiederīgais;

c) ja upuris ir attiecīgās valsts valstspiederīgais un ja attiecīgā valsts uzskata to par lietderīgu.

2. Katra dalībvalsts veic arī pasākumus, kas nepieciešami, lai noteiktu savu jurisdikciju attiecībā uz šādiem noziegumiem gadījumos, kad iespējamais noziedznieks atrodas jebkurā tās jurisdikcijai pakļautā teritorijā un tā viņu saskaņā ar 8. pantu neizdod nevienai no šī panta 1. punktā minētajām valstīm.

3. Šī Konvencija neierobežo krimināltiesisko jurisdikciju, ko īsteno saskaņā ar valsts tiesību aktiem.

6. pants

1. Ikviena dalībvalsts, kuras teritorijā atrodas persona, ko tur aizdomās par to, ka tā izdarījusi kādu no 4. pantā minētajiem noziegumiem, ja tā pēc savā rīcībā esošās informācijas izskatīšanas uzskata, ka apstākļi to prasa, šo personu tur ieslodzījumā vai veic citus juridiskos pasākumus, lai nodrošinātu šīs personas klātbūtni. Turēšana ieslodzījumā un citi šādi juridiskie pasākumi tiek veikti saskaņā ar attiecīgās valsts tiesību aktiem, taču tos var piemērot tikai tik ilgi, cik nepieciešams kriminālprocesa vai izdošanas procedūru uzsākšanai.

2. Šāda valsts nekavējoties veic iepriekšējo izmeklēšanu, lai konstatētu attiecīgos faktiskos apstākļus.

3. Jebkurai personai, kas apcietināta saskaņā ar šī panta 1. punktu, nodrošina iespēju nekavējoties sazināties ar tuvāko tās valsts atbilstošo pārstāvi, kuras valstspiederīgais tā ir, vai gadījumā, ja tā ir bezvalstnieks, ar tās valsts pārstāvi, kurā tā parasti dzīvo.

4. Gadījumos, kad kāda valsts saskaņā ar šo pantu apcietina kādu personu, tā nekavējoties paziņo 5. panta 1. punktā minētajām valstīm par to, ka šāda persona tiek turēta ieslodzījumā, un par apstākļiem, kas bijuši par pamatu tās turēšanai ieslodzījumā. Valsts, kas veic šī panta 2. punktā paredzēto iepriekšējo izmeklēšanu, nekavējoties paziņo minētajām valstīm par tās konstatējumiem un norāda, vai tā paredz īstenot savu jurisdikciju.

7. pants

1. Dalībvalsts, kuras jurisdikcijai pakļautajā teritorijā ir atklāta persona, ko tur aizdomās par to, ka tā izdarījusi kādu no 4. pantā minētajiem noziegumiem, 5. pantā paredzētajos gadījumos, ja tā attiecīgo personu neizdod, nodod attiecīgo lietu savām kompetentajām iestādēm, lai sāktu kriminālprocesu.

2. Šīs iestādes savu lēmumu pieņem tādā pašā veidā kā jebkura cita parasta smaga rakstura nozieguma gadījumā saskaņā ar attiecīgās valsts tiesību aktiem. Šīs Konvencijas 5. panta 2. punktā minētajos gadījumos prasības attiecībā uz pierādījumiem, kas nepieciešami kriminālprocesam un notiesāšanai, nekādā ziņā nedrīkst būt mazāk stingras nekā prasības, ko piemēro 5. panta 1. punktā minētajos gadījumos.

3. Ikvienai personai, pret kuru uzsākts kriminālprocess saistībā ar kādu no 4. pantā minētajiem noziegumiem, tiek garantēta taisnīga attieksme visās attiecīgā procesa stadijās.

8. pants

1. Šīs Konvencijas 4. pantā minētie noziegumi ir uzskatāmi par iekļautiem jebkurā izdošanas līgumā, kas ir spēkā starp dalībvalstīm. Dalībvalstis apņemas šādus noziegumus iekļaut ikvienā izdošanas līgumā, ko tās noslēgs.

2. Ja dalībvalsts, kas izdošanu saista ar to, ka pastāv attiecīgs līgums, saņem izdošanas pieprasījumu no citas dalībvalsts, ar kuru tai nav izdošanas līguma, tā attiecībā uz šādiem noziegumiem par izdošanas juridisko pamatu var uzskatīt šo Konvenciju. Uz izdošanu attiecas visi citi nosacījumi, ko paredz pieprasījumu saņēmušās valsts tiesību akti.

3. Dalībvalstis, kas izdošanu nesaista ar to, ka pastāv attiecīgs līgums, savā starpā minētos noziegumus atzīst par noziegumiem, par kuriem var izdot, ievērojot nosacījumus, ko paredz pieprasījumu saņēmušās valsts tiesību akti.

4. Attiecībā uz izdošanu dalībvalstis šādus noziegumus savstarpēji uzskata par noziegumiem, kas izdarīti ne vien vietā, kur tie notikuši, bet arī to valstu teritorijā, kurām jānosaka sava jurisdikcija saskaņā ar 5. panta 1. punktu.

9. pants

1. Dalībvalstis cita citai sniedz vislielāko iespējamo palīdzību attiecībā uz kriminālprocesu, kas uzsākts saistībā ar kādu no 4. pantā minētajiem noziegumiem, tostarp attiecībā uz visu to pierādījumu nodošanu, kas ir to rīcībā un kas ir nepieciešami konkrētā procesa vajadzībām.

2. Dalībvalstis savas šī panta 1. punktā paredzētās saistības pilda saskaņā ar visiem līgumiem par savstarpēju tiesisko palīdzību, kas starp tām varētu būt noslēgti.

10. pants

1. Katra dalībvalsts nodrošina, lai izglītošana un informācija par spīdzināšanas aizliegumu tiktu pilnībā ietverta programmās, pēc kurām sagatavo civilo vai militāro tiesībaizsardzības iestāžu personālu, medicīnisko personālu, valsts amatpersonas un citas personas, kas varētu būt saistītas ar aizturētu, apcietinātu vai jebkādā citā veidā ieslodzītu personu turēšanu ieslodzījumā vai nopratināšanu vai izturēšanos pret šādām personām.

2. Katra dalībvalsts šo aizliegumu iekļauj noteikumos vai instrukcijās, kas pieņemti attiecībā uz šādu personu pienākumiem un uzdevumiem.

11. pants

Katra dalībvalsts sistemātiski pārrauga nopratināšanas noteikumus, instrukcijas, metodes un praksi, kā arī kārtību, kas nosaka jebkurā tās jurisdikcijai pakļautā teritorijā aizturētu, apcietinātu vai jebkādā citā veidā ieslodzītu personu turēšanu ieslodzījumā un izturēšanos pret šādām personām, lai nepieļautu nekādus spīdzināšanas gadījumus.

12. pants

Katra dalībvalsts nodrošina, lai tās kompetentās iestādes veiktu ātru un objektīvu izmeklēšanu ikreiz, kad var pamatoti uzskatīt, ka kādā tās jurisdikcijai pakļautā teritorijā notikusi spīdzināšana.

13. pants

Katra dalībvalsts nodrošina, lai jebkurai personai, kas apgalvo, ka tā tikusi spīdzināta jebkurā šīs valsts jurisdikcijai pakļautā teritorijā, būtu tiesības iesniegt sūdzību šīs valsts kompetentajās iestādēs, kas šādu sūdzību ātri un objektīvi izskata. Jāveic pasākumi, lai nodrošinātu sūdzības iesniedzēja un liecinieku aizsardzību pret jebkāda veida sliktu izturēšanos vai iebiedēšanu iesniegtās sūdzības vai sniegto liecību dēļ.

14. pants

1. Katra dalībvalsts savā tiesību sistēmā spīdzināšanas upurim paredz tiesisko aizsardzību un tiesības uz taisnīgu un atbilstošu kompensāciju, tostarp līdzekļus, kas nepieciešami pēc iespējas pilnīgākai rehabilitācijai. Gadījumā, ja upuris spīdzināšanas dēļ ir miris, tiesības uz kompensāciju saņem viņa mantinieki.

2. Neviens šī panta noteikums neierobežo nekādas upura vai citu personu tiesības uz kompensāciju, kuras var pastāvēt saskaņā ar attiecīgās valsts tiesību aktiem.

15. pants

Katra dalībvalsts nodrošina, lai nevienu izteikumu, par kuru ir konstatēts, ka tas iegūts ar spīdzināšanu, nevarētu izmantot kā pierādījumu nevienā tiesvedībā, izņemot pret spīdzināšanā apsūdzēto personu, lai pierādītu, ka šāds izteikums ticis izdarīts.

16. pants

1. Katra dalībvalsts apņemas visās tās jurisdikcijai pakļautajās teritorijās aizliegt citus nežēlīgas, necilvēcīgas vai pazemojošas izturēšanās un sodīšanas aktus, ko nevar uzskatīt par spīdzināšanu, kā tā definētā 1. pantā, ja šādus aktus veic valsts amatpersona vai kāda cita persona, kas rīkojas ar oficiālām pilnvarām, vai ja tos veic šādu personu veiktas kūdīšanas dēļ vai ar to tiešu vai netiešu piekrišanu. Tostarp 10., 11., 12. un 13. pantā paredzētās saistības piemēro, atsauces uz spīdzināšanu aizstājot ar atsaucēm uz citiem nežēlīgas, necilvēcīgas vai pazemojošas izturēšanās un sodīšanas veidiem.

2. Šīs Konvencijas noteikumi neskar citu starptautisko instrumentu vai valstu tiesību aktu noteikumus, kas aizliedz nežēlīgu, necilvēcīgu vai pazemojošu izturēšanos vai sodīšanu vai kas attiecas uz izdošanu vai izraidīšanu.

II DAĻA

17. pants

1. Tiek izveidota Spīdzināšanas aizlieguma komiteja (turpmāk tekstā - Komiteja), kura pilda turpmāk izklāstītos uzdevumus. Komiteju veido desmit eksperti, kam ir izcilas morālās īpašības un atzīta kompetence cilvēktiesību jomā, un viņi savus pienākumus veic neatkarīgi. Ekspertus ievēlē dalībvalstis, ievērojot taisnīgu ģeogrāfisko sadalījumu un to, ka būtu lietderīgi, ja Komitejā būtu dažas personas ar juridisku pieredzi.

2. Komitejas locekļus ar aizklātu balsošanu ievēlē no dalībvalstu izvirzīto kandidātu saraksta. Katra dalībvalsts var izvirzīt vienu kandidātu no savu valstspiederīgo vidus. Dalībvalstis ņem vērā, ka būtu lietderīgi izvirzīt tās personas, kas ir arī saskaņā ar Starptautisko Paktu par pilsoniskajām un politiskajām tiesībām nodibinātās Cilvēktiesību komitejas locekļi un kas ir gatavas strādāt Spīdzināšanas aizlieguma komitejā.

3. Komitejas locekļus ievēlē dalībvalstu sanāksmēs, ko Apvienoto Nāciju Organizācijas ģenerālsekretārs sasauc reizi divos gados. Šajās sanāksmēs, kuru kvorumu veido divas trešdaļas dalībvalstu, par Komitejā ievēlētiem uzskatāmi tie kandidāti, kas saņem visvairāk balsu un absolūtu vairākumu to dalībvalstu pārstāvju balsu, kuras piedalās sanāksmē un balso.

4. Pirmās vēlēšanas notiek ne vēlāk kā sešus mēnešus pēc šīs Konvencijas spēkā stāšanās dienas. Vismaz četrus mēnešus pirms katru vēlēšanu dienas Apvienoto Nāciju Organizācijas ģenerālsekretārs nosūta dalībvalstīm vēstuli, aicinot tās trīs mēnešu laikā iesniegt savu kandidātu vārdus. Ģenerālsekretārs sagatavo šādā veidā izvirzīto personu sarakstu alfabēta secībā, norādot dalībvalstis, kas šīs personas izvirzījušas, un minēto sarakstu iesniedz dalībvalstīm.

5. Komitejas locekļus ievēlē uz četriem gadiem. Ja viņu kandidatūru izvirza atkārtoti, viņus var ievēlēt no jauna. Tomēr pieciem no pirmajās vēlēšanās ievēlētajiem locekļiem pilnvaru termiņš beidzas pēc diviem gadiem; šos piecus locekļus nosaka ar izlozi, ko šī panta 3. punktā minētās sanāksmes priekšsēdētājs veic tūlīt pēc pirmajām vēlēšanām.

6. Ja kāds Komitejas loceklis nomirst, atkāpjas vai kāda cita iemesla dēļ vairs nevar pildīt Komitejas locekļa pienākumus, tad dalībvalsts, kas bija viņu izvirzījusi, ar dalībvalstu vairākuma piekrišanu uz atlikušo pilnvaru termiņa daļu ieceļ citu ekspertu no savu valstspiederīgo vidus. Uzskatāms, ka šāda piekrišana ir saņemta, ja vien sešu nedēļu laikā pēc tam, kad Apvienoto Nāciju Organizācijas ģenerālsekretārs tās informējis par ierosināto iecelšanu, nav iebildusi puse vai vairāk dalībvalstu.

7. Dalībvalstis uzņemas segt Komitejas locekļu izdevumus laikā, kad viņi pilda Komitejas uzdevumus.

18. pants

1. Komiteja ievēlē savu Prezidiju uz diviem gadiem. Prezidija locekļus var ievēlēt atkārtoti.

2. Komiteja pieņem savu reglamentu, tomēr reglamentā cita starpā jābūt šādiem noteikumiem:

a) seši locekļi veido kvorumu;

b) Komitejas lēmumus pieņem ar klātesošo locekļu balsu vairākumu.

3. Apvienoto Nāciju Organizācijas ģenerālsekretārs nodrošina personālu un materiālos līdzekļus, kas nepieciešami, lai Komiteja varētu efektīvi veikt funkcijas, kas tai uzticētas saskaņā ar šo Konvenciju.

4. Apvienoto Nāciju Organizācijas ģenerālsekretārs sasauc Komitejas pirmo sanāksmi. Pēc savas pirmās sanāksmes Komiteja sanāk tad, kad to paredz tās reglaments.

5. Dalībvalstis uzņemas segt izdevumus, kas rodas saistībā ar dalībvalstu un Komitejas sanāksmju rīkošanu, tostarp atlīdzināt Apvienoto Nāciju Organizācijai jebkurus izdevumus, piemēram, personāla un materiālo līdzekļu izmaksas, kas Apvienoto Nāciju Organizācijai radušies saistībā ar šī panta 3. punkta noteikumu izpildi.

19. pants

1. Dalībvalstis ar Apvienoto Nāciju Organizācijas ģenerālsekretāra starpniecību Komitejai iesniedz ziņojumus par pasākumiem, ko tās veikušas, lai īstenotu savas saistības saskaņā ar šo Konvenciju, viena gada laikā pēc tam, kad šī Konvencija stājusies spēkā attiecīgajai dalībvalstij. Pēc tam dalībvalstis reizi četros gados iesniedz papildu ziņojumus par jebkādiem jauniem veiktajiem pasākumiem, kā arī citus ziņojumus, ko Komiteja varētu pieprasīt.

2. Apvienoto Nāciju Organizācijas ģenerālsekretārs šos ziņojumus nosūta visām dalībvalstīm.

3. Katru ziņojumu izskata Komiteja, kura par ziņojumu var izdarīt vispārīga rakstura piezīmes, ko tā uzskata par atbilstošām, un kura šīs piezīmes nosūta attiecīgajai dalībvalstij. Šī dalībvalsts var Komitejai kā atbildi nosūtīt jebkādus apsvērumus, ko tā uzskata par lietderīgiem.

4. Komiteja pēc saviem ieskatiem var nolemt jebkuras piezīmes, ko tā izdarījusi saskaņā ar šī panta 3. punktu, kopā ar apsvērumiem, kas par tām saņemti no attiecīgās dalībvalsts, iekļaut savā gada ziņojumā, ko tā sagatavo saskaņā ar 24. pantu. Pēc attiecīgās dalībvalsts lūguma Komiteja var iekļaut arī saskaņā ar šī panta 1. punktu iesniegtā ziņojuma eksemplāru.

20. pants

1. Ja Komiteja saņem ticamu informāciju, kurā pēc tās domām ir pamatotas norādes, ka kādas dalībvalsts teritorijā tiek sistemātiski izmantota spīdzināšana, Komisija aicina šo dalībvalsti sadarboties minētās informācijas pārbaudīšanā un šajā sakarībā iesniegt savus apsvērumus par attiecīgo informāciju.

2. Ņemot vērā visus apsvērumus, ko varētu būt iesniegusi attiecīgā dalībvalsts, kā arī visu citu attiecīgo informāciju, kas ir tās rīcībā, Komiteja, ja tā uzskata par lietderīgu, var uzdot vienam vai vairākiem Komitejas locekļiem veikt konfidenciālu izmeklēšanu un steidzami sniegt Komitejai attiecīgu ziņojumu.

3. Ja tiek veikta šī panta 2. punktā paredzētā izmeklēšana, Komiteja cenšas sadarboties ar attiecīgo dalībvalsti. Ar šīs dalībvalsts piekrišanu šāda izmeklēšana var ietvert arī tās teritorijas apmeklējumu.

4. Izskatījusi secinājumus, ko attiecīgais Komitejas loceklis vai locekļi iesnieguši saskaņā ar šī panta 2. punktu, Komiteja šos secinājumus nosūta attiecīgajai dalībvalstij kopā ar jebkādām piezīmēm vai ierosinājumiem, ko tā uzskata par lietderīgiem, ņemot vērā konkrēto situāciju.

5. Visu šī panta 1. līdz 4. punktā minēto darbu Komiteja veic konfidenciāli, un visos šī darba posmos tai jācenšas sadarboties ar attiecīgo dalībvalsti. Pēc šāda darba pabeigšanas attiecībā uz izmeklēšanu, kas veikta saskaņā ar 2. punktu, Komiteja pēc konsultācijām ar attiecīgo dalībvalsti var nolemt savā ikgadējā ziņojumā, ko tā gatavo saskaņā ar 24. pantu, ietvert īsu pārskatu par šī darba rezultātiem.

21. pants

1. Ikviena šīs Konvencijas dalībvalsts var jebkurā brīdī saskaņā ar šo pantu deklarēt, ka tā atzīst Komitejas kompetenci pieņemt un izskatīt paziņojumus, kuros dalībvalsts apgalvo, ka kāda cita dalībvalsts nepilda savas saistības saskaņā ar šo Konvenciju. Šādus paziņojumus var pieņemt un izskatīt saskaņā ar šajā pantā izklāstītajām procedūrām tikai tādā gadījumā, ja tos iesniegusi dalībvalsts, kas deklarējusi, ka tā attiecībā pret sevi atzīst Komitejas kompetenci. Komiteja neizskata paziņojumus saskaņā ar šo pantu, ja tie attiecas uz dalībvalsti, kas nav izdarījusi šādu deklarāciju. Saskaņā ar šo pantu saņemtos paziņojumus izskata, ievērojot šādu procedūru:

a) ja kāda dalībvalsts uzskata, ka cita dalībvalsts nepilda šīs Konvencijas noteikumus, tā var ar rakstisku paziņojumu vērst šīs dalībvalsts uzmanību uz šo jautājumu. Triju mēnešu laikā pēc šāda paziņojuma saņemšanas attiecīgā valsts rakstveidā sniedz šādu paziņojumu nosūtījušajai valstij paskaidrojumu vai jebkādu citu rakstisku informāciju, izskaidrojot attiecīgo jautājumu; šādā paskaidrojumā vai informācijā, ciktāl tas iespējams un ir lietderīgi, jānorāda, kādas iekšējās procedūras un pasākumi jau ir veikti, tiek veikti vai var tikt veikti attiecīgajā jautājumā;

b) ja jautājums netiek atrisināts abām dalībvalstīm pieņemamā veidā sešu mēnešu laikā pēc tam, kad attiecīgā valsts saņēmusi sākotnējo ziņojumu, jebkurai no šīm valstīm ir tiesības iesniegt minēto jautājumu izskatīšanai Komitejai, paziņojot par to Komitejai un otrai valstij;

c) Komiteja lietu, kas tai iesniegta saskaņā ar šo pantu, izskata tikai pēc tam, kad tā ir pārliecinājusies, ka saskaņā ar vispāratzītajiem starptautisko tiesību principiem attiecīgajā lietā ir izmantoti un izlietoti visi pieejamie iekšējie tiesiskās aizsardzības līdzekļi. Šis noteikums neattiecas uz gadījumiem, kad šādu līdzekļu piemērošana tiek nepamatoti novilcināta vai kad ir mazticams, ka tie varētu reāli palīdzēt personai, kas ir šīs Konvencijas pārkāpuma upuris;

d) šajā pantā paredzētos ziņojumus Komiteja izskata slēgtās sanāksmēs;

e) ievērojot c) apakšpunkta noteikumus, Komiteja attiecīgajām dalībvalstīm sniedz vidutāja pakalpojumus, lai, ievērojot šajā Konvencijā paredzētās saistības, konkrētajā jautājumā rastu miermīlīgu risinājumu. Šim nolūkam Komiteja, ja nepieciešams, var izveidot ad hoc samierināšanas komisiju;

f) saistībā ar ikvienu lietu, kas iesniegta izskatīšanai Komitejā saskaņā ar šo pantu, tā var prasīt, lai konkrētās dalībvalstis, kas minētas b) apakšpunktā, iesniedz attiecīgu informāciju;

g) iesaistītajām dalībvalstīm, kas minētas b) apakšpunktā, ir tiesības uz to, ka to pārstāvis piedalās attiecīgā jautājuma izskatīšanā Komitejā, un tiesības mutiski un/vai rakstiski darīt zināmus savus apsvērumus;

h) Komiteja divpadsmit mēnešu laikā pēc b) apakšpunktā paredzētā paziņojuma saņemšanas dienas sniedz ziņojumu:

i) ja risinājums ir rasts saskaņā ar e) apakšpunkta noteikumiem, tad Komiteja savā ziņojumā īsi izklāsta attiecīgos faktiskos apstākļus un panākto risinājumu;

ii) ja risinājums nav rasts saskaņā ar e) apakšpunkta noteikumiem, tad Komiteja savā ziņojumā īsi izklāsta attiecīgos faktiskos apstākļus; ziņojumam pievieno attiecīgo dalībvalstu sniegtos rakstiskos apsvērumus un mutisko apsvērumu protokolu.

Katrā lietā šo ziņojumu nosūta attiecīgajām dalībvalstīm.

2. Šī panta noteikumi stāsies spēkā tad, kad piecas šīs Konvencijas dalībvalstis būs izdarījušas šī panta 1. punktā minētās deklarācijas. Šādas deklarācijas dalībvalstis deponē Apvienoto Nāciju Organizācijas ģenerālsekretāram, kurš šo deklarāciju kopijas nosūta pārējām dalībvalstīm. Deklarāciju jebkurā laikā var atsaukt, par to informējot ģenerālsekretāru. Šāds atsaukums nevar ietekmēt neviena tāda jautājuma izskatīšanu, par kuru jau ir iesniegts šajā pantā paredzētais paziņojums; pēc tam, kad ģenerālsekretārs ir ticis informēts par deklarācijas atsaukumu, no nevienas dalībvalsts netiek pieņemti nekādi jauni paziņojumi, ja vien attiecīgā valsts neizdara jaunu deklarāciju.

22. pants

1. Ikviena šīs Konvencijas dalībvalsts var jebkurā brīdī saskaņā ar šo pantu deklarēt, ka tā atzīst Komitejas kompetenci pieņemt un izskatīt paziņojumus no indivīdiem, kas ir pakļauti tās jurisdikcijai un kuri apgalvo, ka ir kļuvuši par upuri tam, ka kāda dalībvalsts nepilda šīs Konvencijas noteikumus, vai šādu indivīdu vārdā. Komiteja nepieņem nevienu paziņojumu, kas attiecas uz dalībvalsti, kura nav izdarījusi šādu deklarāciju.

2. Komiteja atzīst par nepieņemamu jebkādu saskaņā ar šo pantu iesniegtu paziņojumu, kas ir anonīms vai ko tā uzskata par šādu paziņojumu iesniegšanas tiesību ļaunprātīgu izmantošanu, vai kas nav saderīgs ar šīs Konvencijas noteikumiem.

3. Ievērojot 2. punkta noteikumus, Komiteja visus saskaņā ar šo pantu iesniegtos paziņojumus dara zināmus tai šīs Konvencijas dalībvalstij, kura izdarījusi šī panta 1. punktā minēto deklarāciju un par kuru tiek apgalvots, ka tā ir pārkāpusi kādu no šīs Konvencijas noteikumiem. Sešu mēnešu laikā minētā valsts iesniedz Komitejai rakstveida paskaidrojumus vai informāciju, izskaidrojot attiecīgo jautājumu un attiecīgā gadījumā norādot līdzekļus, ko tā varētu izmantot, lai labotu konkrēto situāciju.

4. Komiteja saskaņā ar šo pantu saņemtos paziņojumus izskata, ņemot vērā visu informāciju, ko tai iesniedzis konkrētais indivīds vai kas iesniegta šī indivīda vārdā un ko iesniegusi attiecīgā dalībvalsts.

5. Komiteja neizskata nekādus iesniegtus indivīdu paziņojumus saskaņā ar šo pantu, ja vien tā nav pārliecinājusies, ka:

a) tā pati lieta nav izskatīta vai netiek izskatīta kādā citā starptautiskās izmeklēšanas vai noregulēšanas procedūrā;

b) konkrētais indivīds ir izlietojis visus pieejamos iekšējos tiesiskās aizsardzības līdzekļus; šis noteikums neattiecas uz gadījumiem, kad šādu līdzekļu piemērošana tiek nepamatoti novilcināta vai kad ir mazticams, ka tie varētu reāli palīdzēt personai, kas ir šīs Konvencijas pārkāpuma upuris;

6. Šajā pantā paredzētos ziņojumus Komiteja izskata slēgtās sanāksmēs.

7. Komiteja savu viedokli dara zināmu attiecīgajai dalībvalstij un konkrētajam indivīdam.

8. Šī panta noteikumi stāsies spēkā tad, kad piecas šīs Konvencijas dalībvalstis būs izdarījušas šī panta 1. punktā minētās deklarācijas. Šādas deklarācijas dalībvalstis deponē Apvienoto Nāciju Organizācijas ģenerālsekretāram, kurš šo deklarāciju kopijas nosūta pārējām dalībvalstīm. Deklarāciju jebkurā laikā var atsaukt, par to informējot ģenerālsekretāru. Šāds atsaukums nevar ietekmēt neviena tāda jautājuma izskatīšanu, par kuru jau ir iesniegts šajā pantā paredzētais paziņojums; pēc tam, kad ģenerālsekretārs ir ticis informēts par deklarācijas atsaukumu, netiek pieņemti nekādi jauni indivīdu vai viņu vārdā sniegti paziņojumi, ja vien attiecīgā valsts neizdara jaunu deklarāciju.

23. pants

Komitejas un ad hoc samierināšanas komisiju locekļiem, kas varētu tikt iecelti saskaņā ar 21. panta 1. punkta e) apakšpunktu, ir tiesības uz atvieglojumiem, privilēģijām un imunitātēm, kas atzītas ekspertiem, kuri rīkojas Apvienoto Nāciju Organizācijas uzdevumā, kā paredzēts Konvencijas par Apvienoto Nāciju Organizācijas privilēģijām un imunitātēm attiecīgajās sadaļās.

24. pants

Komiteja sniedz dalībvalstīm un Apvienoto Nāciju Organizācijas Ģenerālajai asamblejai ikgadēju ziņojumu par darbu, ko tā veikusi saskaņā ar šo Konvenciju.

III DAĻA

25. pants

1. Šo Konvenciju var parakstīt visas valstis.

2. Šī Konvencija ir jāratificē. Ratifikācijas instrumentus deponē Apvienoto Nāciju Organizācijas ģenerālsekretāram.

26. pants

Šai Konvencijai var pievienoties visas valstis. Pievienošanās notiek deponējot pievienošanās instrumentu Apvienoto Nāciju Organizācijas ģenerālsekretāram.

27. pants

1. Šī Konvencija stājas spēkā trīsdesmitajā dienā pēc divdesmitā ratifikācijas vai pievienošanās instrumenta deponēšanas Apvienoto Nāciju Organizācijas ģenerālsekretāram.

2. Katrai valstij, kas šo Konvenciju ratificē vai tai pievienojas pēc divdesmitā ratifikācijas vai pievienošanās instrumenta deponēšanas, šī Konvencija stājas spēkā trīsdesmitajā dienā pēc šīs valsts ratifikācijas vai pievienošanās instrumenta deponēšanas.

28. pants

1. Ikviena valsts, parakstot vai ratificējot šo Konvenciju vai tai pievienojoties, var deklarēt, ka tā neatzīst kompetenci, kas Komitejai piešķirta 20. pantā.

2. Ikviena dalībvalsts, kas izdarījusi atrunu saskaņā ar šī panta 1. punktu, var jebkurā laikā savu atrunu atsaukt, par to paziņojot Apvienoto Nāciju Organizācijas ģenerālsekretāram.

29. pants

1. Ikviena šīs Konvencijas dalībvalsts var ierosināt grozījumu un savu priekšlikumu iesniegt Apvienoto Nāciju Organizācijas ģenerālsekretāram. Apvienoto Nāciju Organizācijas ģenerālsekretārs ierosināto grozījumu nosūta dalībvalstīm, lūdzot paziņot, vai tās atbalsta dalībvalstu konferences rīkošanu, lai attiecīgo priekšlikumu izskatītu un lai par to balsotu. Ja četru mēnešu laikā pēc šāda paziņojuma datuma vismaz viena trešdaļa dalībvalstu atbalsta šādas konferences rīkošanu, ģenerālsekretārs sasauc konferenci Apvienoto Nāciju Organizācijas vadībā. Ikvienu grozījumu, kas pieņemts ar konferencē klātesošo un balsojušo dalībvalstu vairākumu, ģenerālsekretārs iesniedz visām dalībvalstīm apstiprināšanai.

2. Saskaņā ar šī panta 1. punktu pieņemts grozījums stājas spēkā pēc tam, kad divas trešdaļas šīs Konvencijas dalībvalstu ir Apvienoto Nāciju Organizācijas ģenerālsekretāram paziņojušas, ka tās šo grozījumu ir pieņēmušas saskaņā ar savu konstitucionālo procedūru.

3. Kad grozījumi stājas spēkā, tie kļūst saistoši visām tām dalībvalstīm, kas tos pieņēmušas, bet citām dalībvalstīm ir saistoši šīs Konvencijas noteikumi un visi iepriekšējie labojumi, ko tās pieņēmušas.

30. pants

1. Visas domstarpības, kuras starp divām vai vairāk dalībvalstīm rodas par šīs Konvencijas interpretāciju vai piemērošanu un kuras nevar atrisināt ar sarunām, pēc vienas no šo dalībvalstu pieprasījuma izskata šķīrējtiesā. Ja sešu mēnešu laikā no dienas, kurā pieprasīta izskatīšana šķīrējtiesā, attiecīgajām pusēm nav izdevies vienoties par šķīrējtiesas izveides kārtību, jebkura no šīm pusēm attiecīgās domstarpības var iesniegt izskatīšanai Starptautiskajā tiesā, iesniedzot pieteikumu saskaņā ar Starptautiskās tiesas Statūtiem.

2. Katra dalībvalsts, parakstot vai ratificējot šo Konvenciju vai tai pievienojoties, var deklarēt, ka šī panta 1. punkts tai nav saistošs. Pārējām dalībvalstīm šī panta 1. punkts nav saistošs attiecībā uz jebkuru dalībvalsti, kas izdarījusi šādu atrunu.

3. Ikviena dalībvalsts, kas izdarījusi atrunu saskaņā ar šī panta 2. punktu, var jebkurā laikā savu atrunu atsaukt, par to paziņojot Apvienoto Nāciju Organizācijas ģenerālsekretāram.

31. pants

1. Ikviena dalībvalsts var šo Konvenciju denonsēt, par to rakstveidā paziņojot Apvienoto Nāciju Organizācijas ģenerālsekretāram. Denonsācija stājas spēkā vienu gadu pēc tam, kad ģenerālsekretārs saņēmis attiecīgu paziņojumu.

2. Šāda denonsācija attiecīgo dalībvalsti neatbrīvo no šajā Konvencijā paredzētajām saistībām attiecībā uz jebkādu darbību vai bezdarbību, kas notikusi pirms datuma, kurā denonsācija stājusies spēkā, un denonsācija nekādā veidā neietekmē tādu jautājumu turpmāko izskatīšanu, ko Komiteja jau ir sākusi izskatīt pirms datuma, kurā denonsācija stājusies spēkā.

3. Pēc datuma, kurā kādas valsts veikta denonsācija stājas spēkā, Komiteja nesāk izskatīt nevienu jaunu jautājumu, kas attiecas uz šo valsti.

32. pants

Apvienoto Nāciju Organizācijas ģenerālsekretārs informē visas Apvienoto Nāciju Organizācijas dalībvalstis un visas valstis, kas parakstījušas šo Konvenciju vai tai pievienojušās, par:

a) parakstīšanu, ratifikāciju vai pievienošanos saskaņā ar 25. un 26. pantu;

b) šīs Konvencijas spēkā stāšanās datumu saskaņā ar 27. pantu un ikviena grozījuma spēkā stāšanās datumu saskaņā ar 29. pantu;

c) denonsāciju saskaņā ar 31. pantu.

33. pants

1. Šo Konvenciju, kuras teksti angļu, arābu, franču, krievu, ķīniešu un spāņu valodā ir vienlīdz autentiski, deponē Apvienoto Nāciju Organizācijas ģenerālsekretāram.

2. Apvienoto Nāciju Organizācijas ģenerālsekretārs šīs Konvencijas apstiprinātas kopijas nosūta visām valstīm.
