Saeima ir pieņēmusi un Valsts
prezidents izsludina šādu likumu:
Par Latvijas Republikas valdības un Izraēlas Valsts valdības konvenciju par nodokļu dubultās uzlikšanas un nodokļu nemaksāšanas novēršanu attiecībā uz ienākuma un kapitāla nodokļiem

1.pants. 2006.gada 20.februārī Jeruzalemē parakstītā Latvijas Republikas valdības un Izraēlas Valsts valdības konvencija par nodokļu dubultās uzlikšanas un nodokļu nemaksāšanas novēršanu attiecībā uz ienākuma un kapitāla nodokļiem (turpmāk — Konvencija) un tās 2006.gada 20.februārī Jeruzalemē parakstītais protokols (turpmāk — Protokols) ar šo likumu tiek pieņemti un apstiprināti. 

2.pants. Konvencija un Protokols stājas spēkā Konvencijas 28.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

3.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināma Konvencija un Protokols latviešu un angļu valodā.

KONVENCIJA PAR NODOKĻU DUBULTĀS UZLIKŠANAS UN NODOKĻU NEMAKSĀŠANAS NOVĒRŠANU ATTIECĪBĀ UZ IENĀKUMA UN KAPITĀLA NODOKĻIEM

Latvijas Republikas valdība un Izraēlas Valsts valdība, apliecinādamas vēlēšanos noslēgt Konvenciju par nodokļu dubultās uzlikšanas un nodokļu nemaksāšanas novēršanu attiecībā uz ienākuma un kapitāla nodokļiem, vienojas:

 

1.pants

Personas, uz kurām attiecas Konvencija

Šī Konvencija attiecas uz personām, kas ir vienas Līgumslēdzējas Valsts vai abu Līgumslēdzēju Valstu rezidenti.

 

2.pants

Nodokļi, uz kuriem attiecas Konvencija

1. Šī Konvencija attiecas uz ienākuma un kapitāla nodokļiem, ko iekasē Līgumslēdzējas Valsts vai arī tās pašvaldību labā neatkarīgi no šo nodokļu iekasēšanas veida.

2. Par ienākuma un kapitāla nodokļiem uzskatāmi visi nodokļi, ko uzliek kopējam ienākumam, kopējam kapitālam vai ienākuma vai kapitāla daļai, tajā skaitā nodokļi, ko uzliek kapitāla pieaugumam no kustamā un nekustamā īpašuma atsavināšanas, nodokļi, ko uzliek uzņēmumu izmaksātajai kopējai darba algas vai darba samaksas summai, un nodokļi no kapitāla vērtības pieauguma.

3. Esošie nodokļi, uz kuriem attiecas šī Konvencija, konkrēti ir:

a) Latvijā:

(i) uzņēmumu ienākuma nodoklis;

(ii) iedzīvotāju ienākuma nodoklis;

(iii) nekustamā īpašuma nodoklis;

(turpmāk — Latvijas nodokļi);

b) Izraēlā:

(i) ienākuma nodoklis un sabiedrību nodoklis (ietverot arī kapitāla pieauguma nodokli);

(ii) nodoklis par nekustamā īpašuma atsavināšanā gūto ienākumu saskaņā ar likumu par nekustamā īpašuma aplikšanu ar nodokļiem;

(turpmāk — Izraēlas nodokļi).

4. Konvenciju piemēro arī jebkuriem identiskiem vai pēc būtības līdzīgiem nodokļiem, kas tiks ieviesti pēc Konvencijas parakstīšanas datuma, lai papildinātu vai aizstātu esošos nodokļus. Abu Līgumslēdzēju Valstu kompetentās iestādes savstarpēji informē viena otru par visiem nozīmīgiem grozījumiem šo valstu attiecīgajos nodokļu normatīvajos aktos.

 

3.pants

Vispārīgās definīcijas

1. Ja no konteksta neizriet citādi, šajā Konvencijā:

a)

(i) termins "Latvija" nozīmē Latvijas Republiku, un, lietots ģeogrāfiskā nozīmē, tas apzīmē Latvijas Republikas teritoriju un jebkuru citu Latvijas Republikas teritoriālajiem ūdeņiem piegulošu teritoriju, kurā saskaņā ar Latvijas normatīvajiem aktiem un starptautiskajām tiesībām tiek īstenotas Latvijas tiesības uz jūras un zemes dzīlēm un tur esošajiem dabas resursiem;

(ii) termins "Izraēla" nozīmē Izraēlas Valsti, un, lietots ģeogrāfiskā nozīmē, tas nozīmē teritoriju, kurā Izraēlas Valsts valdība īsteno nodokļu uzlikšanas tiesības, teritoriālo jūru, kā arī teritoriālajai jūrai pieguļošas jūras teritorijas, to jūras un zemes dzīles, attiecībā uz kurām Izraēlas Valsts saskaņā ar starptautiskajām tiesībām un Izraēlas Valsts normatīvajiem aktiem īsteno suverēnās tiesības, citas tiesības un jurisdikciju;

b) termini "Līgumslēdzēja Valsts" un "otra Līgumslēdzēja Valsts" atkarībā no konteksta nozīmē Latviju vai Izraēlu;

c) termins "persona" nozīmē fizisko personu, sabiedrību un jebkuru citu personu apvienību;

d) termins "sabiedrība" nozīmē jebkuru korporatīvu personu apvienību vai jebkuru vienību, kas nodokļu uzlikšanas nolūkos tiek uzskatīta par korporatīvu personu apvienību;

e) termini "Līgumslēdzējas Valsts uzņēmums" un "otras Līgumslēdzējas Valsts uzņēmums" attiecīgi nozīmē uzņēmumu, ko vada Līgumslēdzējas Valsts rezidents, un uzņēmumu, ko vada otras Līgumslēdzējas Valsts rezidents;

f) termins "starptautiskā satiksme" nozīmē jebkurus pārvadājumus ar jūras vai gaisa transportu, ko veic Līgumslēdzējas Valsts uzņēmums, izņemot, ja jūras vai gaisa transporta līdzekļi pārvietojas vienīgi otras Līgumslēdzējas Valsts iekšienē;

g) termins "kompetentā iestāde" nozīmē:

(i) Latvijā —Finanšu ministriju vai tās pilnvarotu pārstāvi;

(ii) Izraēlā —finanšu ministru vai viņa pilnvarotu pārstāvi;

h) termins "pilsonis" nozīmē:

(i) ikvienu fizisku personu, kurai ir Līgumslēdzējas Valsts pilsonība;

(ii) ikvienu juridisku personu, personālsabiedrību vai asociāciju, kuras statuss izriet no Līgumslēdzējā Valstī spēkā esošajiem normatīvajiem aktiem.

2. Šīs Konvencijas piemērošanai jebkurā laikā Līgumslēdzēja Valsts lietos jebkuru terminu, kas šeit nav definēts, ja no konteksta neizriet citādi, tikai tādā nozīmē, kādā tas attiecīgajā laikā lietots šīs Līgumslēdzējas Valsts normatīvajos aktos attiecībā uz nodokļiem, uz kuriem attiecas šī Konvencija, turklāt jebkuram termina skaidrojumam saskaņā ar piemērojamajiem nodokļu normatīvajiem aktiem būs prioritāte pār šī termina skaidrojumu saskaņā ar citiem šīs valsts normatīvajiem aktiem.

 

4.pants

Rezidents

1. Šajā Konvencijā termins "Līgumslēdzējas Valsts rezidents" nozīmē jebkuru personu, kas saskaņā ar šīs valsts normatīvajiem aktiem ir pakļauta aplikšanai ar nodokļiem, pamatojoties uz tās pastāvīgo dzīvesvietu, rezidenci, vadības atrašanās vietu, inkorporācijas (reģistrācijas) vietu vai atbilstoši jebkuram citam līdzīga rakstura kritērijam, un ietver arī šo valsti un pašvaldības. Tomēr šis termins neietver tās personas, kurām šajā valstī tiek uzlikti nodokļi tikai attiecībā uz to ienākumiem no šajā valstī esošajiem peļņas avotiem vai tur izvietoto kapitālu.

2. Ja saskaņā ar 1.daļas noteikumiem fiziska persona ir abu Līgumslēdzēju Valstu rezidents, tās statuss tiks noteikts šādi:

a) šī persona tiks uzskatīta par rezidentu tikai tajā valstī, kurā ir tās pastāvīgā dzīvesvieta; ja tās pastāvīgā dzīvesvieta ir abās valstīs, šī persona tiks uzskatīta tikai par tās valsts rezidentu, ar kuru tai ir ciešākas personiskās un ekonomiskās attiecības (vitālo interešu centrs);

b) ja nav iespējams noteikt valsti, kurā šai personai ir vitālo interešu centrs, vai arī tai nav pastāvīgas dzīvesvietas nevienā no abām valstīm, šī persona tiks uzskatīta tikai par tās valsts rezidentu, kas tai ir ierastā mītnes zeme;

c) ja šai personai ierastā mītnes zeme ir abas valstis vai nav neviena no tām, tā tiks uzskatīta tikai par tās valsts rezidentu, kuras pilsonis ir šī persona;

d) ja šī persona ir abu valstu pilsonis vai nav nevienas šīs valsts pilsonis, Līgumslēdzēju Valstu kompetentās iestādes izšķir šo jautājumu, savstarpēji vienojoties.

3. Ja saskaņā ar 1.daļas noteikumiem persona, kas nav fiziska persona, ir abu Līgumslēdzēju Valstu rezidents, Līgumslēdzēju Valstu kompetentās iestādes var atrisināt šo jautājumu savstarpēji vienojoties. Ja šādas vienošanās nav, tad šīs Konvencijas piemērošanai minētā persona nebūs tiesīga pieprasīt jebkuru atvieglojumu, ko piešķir saskaņā ar šo Konvenciju.

 

5.pants

Pastāvīgā pārstāvniecība

1. Šajā Konvencijā termins "pastāvīgā pārstāvniecība" nozīmē noteiktu vietu, kur uzņēmums pilnīgi vai daļēji veic uzņēmējdarbību.

2. Termins "pastāvīgā pārstāvniecība" ietver:

a) uzņēmuma vadības atrašanās vietu;

b) filiāli;

c) kantori;

d) fabriku;

e) darbnīcu; un

f) šahtu, naftas vai gāzes ieguves vietu, akmeņlauztuves vai jebkuru citu dabas resursu ieguves vietu.

3. a) Būvlaukums, celtniecības, montāžas vai instalācijas projekts, vai ar tiem saistīta pārraudzības darbība, tiks uzskatīta par pastāvīgo pārstāvniecību, ja šie būvdarbi, projekts vai darbība notiek ilgāk par divpadsmit mēnešiem;

b) Līgumslēdzējā Valstī veiktās darbības, kas saistītas ar šīs valsts jūras un zemes dzīļu dabas resursu pētīšanu vai iegūšanu, tiks uzskatītas par tādām, kas veiktas izmantojot šajā valstī pastāvīgo pārstāvniecību, ja jebkurā divpadsmit mēnešu periodā šādas darbības tiek veiktas laika posmā vai laika posmos, kas kopumā pārsniedz 30 dienas.

4. Neatkarīgi no šī panta iepriekšējo daļu noteikumiem termins "pastāvīgā pārstāvniecība" neietver:

a) ēku un iekārtu izmantošanu tikai un vienīgi uzņēmumam piederošo preču vai izstrādājumu uzglabāšanai, demonstrēšanai vai piegādēm;

b) uzņēmumam piederošos preču vai izstrādājumu krājumus, kas paredzēti tikai un vienīgi uzglabāšanai, demonstrēšanai vai piegādēm;

c) uzņēmumam piederošos preču vai izstrādājumu krājumus, kas paredzēti tikai un vienīgi pārstrādei citā uzņēmumā;

d) pastāvīgu darbības vietu, kas paredzēta tikai un vienīgi preču vai izstrādājumu iepirkšanai uzņēmuma vajadzībām vai informācijas vākšanai uzņēmuma vajadzībām;

e) pastāvīgu darbības vietu, kas paredzēta tikai un vienīgi, lai veiktu uzņēmuma vajadzībām jebkādu citu sagatavošanas vai palīgdarbību;

f) pastāvīgu darbības vietu, kas paredzēta tikai un vienīgi, lai nodarbotos ar a) līdz e) punktā minētajām darbībām jebkādā to kombinācijā, ja kopējam darbības veidam ir sagatavošanas vai palīgdarbības raksturs.

5. Neatkarīgi no 1. un 2.daļas noteikumiem, ja persona, kas nav 6.daļā minētais neatkarīga statusa aģents, darbojas uzņēmuma labā un tai ir piešķirtas pilnvaras noslēgt līgumus uzņēmuma vārdā, un tā Līgumslēdzējā Valstī parasti izmanto šīs pilnvaras, tad tiek uzskatīts, ka šis uzņēmums izmanto pastāvīgo pārstāvniecību šajā Līgumslēdzējā Valstī attiecībā uz jebkuru šīs personas uzņēmuma labā veikto darbību, izņemot, ja šī persona veic 4.daļā minētās darbības, kurām, notiekot pastāvīgajā darbības vietā, šī vieta nevar tikt uzskatīta par pastāvīgo pārstāvniecību saskaņā ar 4.daļas noteikumiem.

6. Tiks uzskatīts, ka uzņēmumam nav pastāvīgās pārstāvniecības Līgumslēdzējā Valstī, ja uzņēmums veic uzņēmējdarbību šajā valstī, vienīgi izmantojot brokeri, tirdzniecības aģentu vai jebkuru citu neatkarīga statusa aģentu, ar nosacījumu, ka šīs personas veic savu parasto uzņēmējdarbību.

7. Fakts, ka sabiedrība — Līgumslēdzējas Valsts rezidents kontrolē sabiedrību, kas ir otras Līgumslēdzējas Valsts rezidents vai kura veic uzņēmējdarbību šajā otrā valstī, izmantojot pastāvīgo pārstāvniecību vai kādā citā veidā, vai ir pakļauta šādas sabiedrības kontrolei, pats par sevi nepārvērš vienu no šīm sabiedrībām par otras sabiedrības pastāvīgo pārstāvniecību.

 

6.pants

Ienākums no nekustamā īpašuma

1. Ienākumu, ko Līgumslēdzējas Valsts rezidents gūst no nekustamā īpašuma (arī ienākumu no lauksaimniecības un mežkopības), kas atrodas otrā Līgumslēdzējā Valstī, var aplikt ar nodokļiem šajā otrā valstī.

2. Terminam "nekustamais īpašums" būs tāda nozīme, kāda tam ir tās Līgumslēdzējas Valsts normatīvajos aktos, kurā atrodas attiecīgais īpašums. Jebkurā gadījumā šis termins ietver īpašumu, kas ir piederīgs nekustamajam īpašumam, mājlopus un iekārtas, ko izmanto lauksaimniecībā un mežsaimniecībā, tiesības, uz kurām attiecas zemes īpašuma tiesību vispārīgie noteikumi, jebkuras nekustamā īpašuma pirkšanas tiesību izmantošanas tiesības vai līdzīgas tiesības iegūt nekustamo īpašumu, nekustamā īpašuma lietojuma tiesības un tiesības uz mainīgiem vai nemainīgiem maksājumiem kā atlīdzību par derīgo izrakteņu iegulu, dabas atradņu un citu dabas resursu izmantošanu vai tiesībām tos izmantot, tiesības uz īpašumu, kas var tikt radīts, veicot jūras un zemes dzīļu dabas resursu pētīšanu un ieguvi, ieskaitot tiesības uz līdzdalību īpašumā vai peļņā, kuru var gūt šis īpašums. Kuģi, liellaivas un gaisa transporta līdzekļi netiks uzskatīti par nekustamo īpašumu.

3. 1.daļas noteikumi tiks piemēroti attiecībā uz ienākumu no nekustamā īpašuma tiešas izmantošanas, izīrēšanas vai izmantošanas citā veidā.

4. 1. un 3.daļas noteikumi tiks piemēroti arī attiecībā uz ienākumu no uzņēmuma nekustamā īpašuma, kā arī attiecībā uz ienākumu no nekustamā īpašuma, ko izmanto neatkarīgu individuālu pakalpojumu sniegšanai.

 

7.pants

Uzņēmējdarbības peļņa

1. Līgumslēdzējas Valsts uzņēmuma peļņa tiks aplikta ar nodokļiem tikai šajā valstī, izņemot, ja uzņēmums veic uzņēmējdarbību otrā Līgumslēdzējā Valstī, izmantojot tur esošo pastāvīgo pārstāvniecību. Ja uzņēmums veic uzņēmējdarbību minētajā veidā, uzņēmuma peļņu var aplikt ar nodokļiem otrā valstī, bet tikai to peļņas daļu, ko var attiecināt uz šo pastāvīgo pārstāvniecību.

2. Saskaņā ar 3.daļas noteikumiem, ja Līgumslēdzējas Valsts uzņēmums veic uzņēmējdarbību otrā Līgumslēdzējā Valstī, izmantojot tur esošo pastāvīgo pārstāvniecību, katrā Līgumslēdzējā Valstī uz šo pastāvīgo pārstāvniecību attiecināms tāds peļņas daudzums, kādu tā varētu gūt, ja nepārprotami būtu atsevišķs uzņēmums, kas veic vienādu vai līdzīgu uzņēmējdarbību vienādos vai līdzīgos apstākļos un darbojas pilnīgi neatkarīgi no uzņēmuma, kurš izmanto šo pastāvīgo pārstāvniecību.

3. Nosakot pastāvīgās pārstāvniecības peļņu Līgumslēdzējā Valstī, tiks atļauts atskaitīt izdevumus, kas radušies pastāvīgās pārstāvniecības vajadzībām tās atrašanās valstī vai citur, tajā skaitā operatīvos un vispārējos administratīvos izdevumus.

4. Ja Līgumslēdzējā Valstī peļņu, kas attiecināma uz pastāvīgo pārstāvniecību, nosaka, sadalot uzņēmuma kopīgo peļņu proporcionāli starp tā struktūrvienībām, 2.daļa neaizliedz Līgumslēdzējai Valstij kā parasti pēc šī principa noteikt peļņas daļu, kurai uzliek nodokļus; izmantotajai sadales metodei tomēr jābūt tādai, lai rezultāts atbilstu šajā pantā ietvertajiem principiem.

5. Uz pastāvīgo pārstāvniecību netiks attiecināta peļņa tikai tāpēc vien, ka tā ir iegādājusies preces vai izstrādājumus uzņēmuma, kura pastāvīgā pārstāvniecība tā ir, vajadzībām.

6. Lai piemērotu iepriekšējo daļu noteikumus, peļņa, ko attiecina uz pastāvīgo pārstāvniecību, katru gadu ir nosakāma ar vienu un to pašu metodi, izņemot, ja ir pietiekams iemesls rīkoties citādi.

7. Ja peļņā ir ietverti citos šīs Konvencijas pantos atsevišķi aplūkotie ienākuma veidi, šī panta noteikumi neietekmēs šo citu pantu noteikumus.

 

8.pants

Kuģniecība un gaisa transports

1. Līgumslēdzējas Valsts uzņēmuma peļņa no jūras vai gaisa transporta līdzekļu izmantošanas starptautiskajā satiksmē tiks aplikta ar nodokļiem tikai šajā valstī.

2. 1.daļas noteikumi attiecas arī uz peļņu, kas gūta no piedalīšanās pulā, kopējā uzņēmējdarbībā vai starptautiskās satiksmes transporta aģentūrā.

 

9.pants

Saistītie uzņēmumi

1. Ja:

a) Līgumslēdzējas Valsts uzņēmums tieši vai netieši piedalās otras Līgumslēdzējas Valsts uzņēmuma vadībā vai kontrolē vai arī tam pieder daļa no šī uzņēmuma kapitāla; vai

b) vienas un tās pašas personas tieši vai netieši piedalās Līgumslēdzējas Valsts uzņēmuma un otras Līgumslēdzējas Valsts uzņēmuma vadībā vai kontrolē vai arī tām pieder daļa no šo uzņēmumu kapitāla, un jebkurā no šiem gadījumiem šo divu uzņēmumu komerciālās vai finanšu attiecības veido vai nodibina pēc noteikumiem, kas atšķiras no tiem noteikumiem, kuri būtu spēkā starp diviem neatkarīgiem uzņēmumiem, tad jebkura peļņa, ko gūtu viens no uzņēmumiem, bet iepriekšminēto noteikumu ietekmē nav guvis, var tikt iekļauta šī uzņēmuma peļņā, un tai var atbilstoši uzlikt nodokļus.

2. Ja Līgumslēdzēja Valsts iekļauj šīs valsts uzņēmuma peļņā un attiecīgi uzliek nodokļus tai peļņai, attiecībā uz kuru otrā valstī otras Līgumslēdzējas Valsts uzņēmumam ir uzlikts nodoklis, un šī iekļautā peļņa ir tāda peļņa, kuru būtu guvis pirmās Līgumslēdzējas Valsts uzņēmums, ja attiecības starp šiem diviem uzņēmumiem būtu bijušas tādas, kādas pastāvētu starp diviem neatkarīgiem uzņēmumiem, tad otrai valstij ir jāveic atbilstošas korekcijas attiecībā uz nodokļa lielumu, kāds tiek uzlikts šai peļņai otrā valstī. Nosakot šīs korekcijas, ņem vērā citus šīs Konvencijas noteikumus un, ja nepieciešams, rīko Līgumslēdzēju Valstu kompetento iestāžu konsultācijas.

 

10.pants

Dividendes

1. Dividendes, ko sabiedrība — Līgumslēdzējas Valsts rezidents izmaksā otras Līgumslēdzējas Valsts rezidentam, var aplikt ar nodokļiem šajā otrā valstī.

2. Tomēr šīs dividendes var arī aplikt ar nodokļiem atbilstoši attiecīgās valsts normatīvajiem aktiem tajā Līgumslēdzējā Valstī, kuras rezidents ir sabiedrība, kas izmaksā dividendes, bet, ja šo dividenžu īstenais īpašnieks ir otras Līgumslēdzējas Valsts rezidents, nodoklis nedrīkst pārsniegt:

a) 5 procentus no dividenžu kopapjoma, ja dividenžu īstenais īpašnieks ir sabiedrība (kas nav personālsabiedrība), kas tieši pārvalda vismaz 10 procentus tās sabiedrības kapitāla, kura izmaksā dividendes;

b) neatkarīgi no a) punkta noteikumiem — 10 procentus no dividenžu kopapjoma, ja dividenžu īstenais īpašnieks ir sabiedrība, kas tieši pārvalda vismaz 10 procentus tās sabiedrības kapitāla, kura izmaksā dividendes, ja dividendes tiek izmaksātas no peļņas, kura saskaņā ar Izraēlas investīciju veicināšanas likumu ir atbrīvota no nodokļa, vai kurai nodoklis tiek uzlikts pēc likmes, kas ir zemāka nekā parastā Izraēlas nodokļa likme;

c) 15 procentus no dividenžu kopapjoma visos pārējos gadījumos.

Šī daļa neietekmēs sabiedrības aplikšanu ar nodokļiem attiecībā uz peļņu, no kuras tiek izmaksātas dividendes.

3. Termins "dividendes" šajā pantā nozīmē ienākumu no akcijām, "jouissance" akcijām (dod tiesības uz sabiedrības īpašuma daļu tās likvidācijas gadījumā) vai "jouissance" tiesībām (tiesības piedalīties sabiedrības peļņas sadalē, neatbildot par sabiedrības saistībām), raktuvju akcijām, dibinātāju akcijām vai citām tādām tiesībām piedalīties peļņas sadalē, kuras nav parāda prasības, kā arī ienākumu no citām tiesībām, uz ko saskaņā ar tās valsts normatīvajiem aktiem, kuras rezidents ir sabiedrība, kas veic peļņas sadali, attiecas tāds pats nodokļu uzlikšanas režīms kā uz ienākumu no akcijām.

4. 1. un 2.daļas noteikumus nepiemēro, ja dividenžu īstenais īpašnieks, kas ir Līgumslēdzējas Valsts rezidents, veic uzņēmējdarbību otrā Līgumslēdzējā Valstī, kuras rezidents ir sabiedrība, kas izmaksā dividendes, izmantojot tur esošo pastāvīgo pārstāvniecību, vai arī sniedz neatkarīgus individuālos pakalpojumus šajā otrā valstī, izmantojot tajā izvietoto pastāvīgo bāzi, un ja līdzdalība, par kuru tiek izmaksātas dividendes, ir faktiski saistīta ar šo pastāvīgo pārstāvniecību vai pastāvīgo bāzi. Šajā gadījumā atkarībā no apstākļiem piemēro 7. vai 14.panta noteikumus.

5. Ja sabiedrība — Līgumslēdzējas Valsts rezidents gūst peļņu vai ienākumus otrā Līgumslēdzējā Valstī, šī otra valsts nedrīkst nedz uzlikt jebkādus nodokļus šīs sabiedrības izmaksātajām dividendēm, izņemot, ja dividendes tiek izmaksātas otras valsts rezidentam vai ja līdzdalība, par kuru tiek izmaksātas dividendes, ir faktiski saistīta ar pastāvīgo pārstāvniecību vai pastāvīgo bāzi šajā otrā valstī; nedz arī uzlikt nesadalītās peļņas nodokli sabiedrības nesadalītajai peļņai pat tad, ja izmaksātās dividendes vai nesadalītā peļņa pilnīgi vai daļēji sastāv no otrā valstī gūtās peļņas vai ienākuma.

 

11.pants

Procenti

1. Procentus, kas rodas Līgumslēdzējā Valstī un tiek izmaksāti otras Līgumslēdzējas Valsts rezidentam, var aplikt ar nodokļiem šajā otrā valstī.

2. Tomēr šos procentus var arī aplikt ar nodokļiem atbilstoši attiecīgās valsts normatīvajiem aktiem tajā Līgumslēdzējā Valstī, kurā tie rodas, bet, ja šo procentu īstenais īpašnieks ir otras Līgumslēdzējas Valsts rezidents, tad nodoklis nedrīkst pārsniegt:

a) 5 procentus no procentu kopapjoma, ja procenti rodas Līgumslēdzējā Valstī un tiek maksāti par jebkāda veida aizdevumu, ko piešķīrusi otras Līgumslēdzējas Valsts banka;

b) 10 procentus no procentu kopapjoma visos pārējos gadījumos.

3. Neatkarīgi no 1. un 2.daļas noteikumiem:

a) procentiem, kas rodas Latvijā nodokļi tiks uzlikti tikai Izraēlā, ja procenti tiek maksāti par aizdevumu, ko piešķīrusi, vai attiecībā uz aizdevumu, parāda prasību, vai kredītu, ko garantējusi vai apdrošinājusi:

(i) Izraēlas Valsts valdība, vai tās pašvaldība; vai

(ii) Izraēlas Centrālā Banka; vai

(iii) jebkura institūcija ārējās tirdzniecības darījumu apdrošināšanai vai finansēšanai, kas pilnībā pieder Izraēlas Valstij;

b) procentiem, kas rodas Izraēlā, nodokļi tiks uzlikti tikai Latvijā, ja procenti tiek maksāti par aizdevumu, ko piešķīrusi, vai attiecībā uz aizdevumu, parāda prasību, vai kredītu, ko garantējusi vai apdrošinājusi:

(i) Latvijas valdība vai tās pašvaldība; vai

(ii) Latvijas Banka; vai

(iii) jebkura institūcija ārējās tirdzniecības darījumu apdrošināšanai vai finansēšanai, kas pilnībā pieder Latvijas Republikai;

c) procentiem, kas rodas Līgumslēdzējā Valstī, tiks uzlikti nodokļi tikai otrā Līgumslēdzējā Valstī, ja procentu saņēmējs ir otras valsts rezidents — otras Līgumslēdzējas Valsts uzņēmums, kas ir procentu īstenais īpašnieks, un procenti tiek maksāti par parādu saistībām, kuras izveidojušās, ja šis uzņēmums pārdod uz nomaksu pirmās minētās valsts uzņēmumam jebkādas preces vai ražošanas, komerciālās vai zinātniskās iekārtas, izņemot gadījumus, kad šāda pārdošana ir veikta vai parādu saistības ir izveidojušās starp saistītām personām.

4. Šajā pantā termins "procenti" nozīmē ienākumu no jebkāda veida parāda prasībām neatkarīgi no tā, vai tās ir vai nav nodrošinātas ar hipotēku un vai tām ir vai nav tiesības piedalīties parādnieka peļņas sadalē, un it īpaši ienākumu no valdības vērtspapīriem un ienākumu no obligācijām vai parādzīmēm, tajā skaitā prēmijas un balvas, kas piederīgas šiem vērtspapīriem, obligācijām vai parādzīmēm. Termins "procenti" neietver jebkādu ienākumu, kas tiek uzskatīts par dividendēm saskaņā ar 10.panta noteikumiem. Soda naudas, kas saņemtas par laikā neveiktajiem maksājumiem, netiks uzskatītas par procentiem šī panta noteikumu piemērošanai.

5. 1., 2. un 3.daļas noteikumi netiks piemēroti, ja procentu īstenais īpašnieks, kas ir Līgumslēdzējas Valsts rezidents, veic uzņēmējdarbību otrā Līgumslēdzējā Valstī, kurā šie procenti rodas, izmantojot tur esošo pastāvīgo pārstāvniecību, vai arī sniedz neatkarīgus individuālos pakalpojumus šajā otrā valstī, izmantojot tajā izvietoto pastāvīgo bāzi, un parāda prasības, uz kuru pamata tiek maksāti procenti, ir faktiski saistītas ar šo pastāvīgo pārstāvniecību vai pastāvīgo bāzi. Šajā gadījumā atkarībā no apstākļiem piemēro 7. vai 14.panta noteikumus.

6. Ja procentu maksātājs ir Līgumslēdzējas Valsts rezidents, tiks uzskatīts, ka procenti rodas šajā valstī. Tomēr, ja persona, kas izmaksā procentus, neatkarīgi no tā, vai šī persona ir Līgumslēdzējas Valsts rezidents vai nav, izmanto Līgumslēdzējā Valstī esošo pastāvīgo pārstāvniecību vai tur izvietoto pastāvīgo bāzi, sakarā ar ko radušās parādu saistības, par kurām tiek maksāti procenti, un šos procentus izmaksā (sedz) pastāvīgā pārstāvniecība vai pastāvīgā bāze, tiks uzskatīts, ka šie procenti rodas tajā valstī, kurā atrodas pastāvīgā pārstāvniecība vai pastāvīgā bāze.

7. Ja, pamatojoties uz īpašām attiecībām starp procentu maksātāju un procentu īsteno īpašnieku vai starp viņiem abiem un kādu citu personu, procentu summa, kas attiecas uz parāda prasībām, par kurām tā tiek izmaksāta, pārsniedz summu, par kādu būtu varējuši vienoties procentu maksātājs un procentu īstenais īpašnieks, ja starp viņiem nebūtu minēto īpašo attiecību, tad šī panta noteikumi tiks piemēroti tikai attiecībā uz pēdējo minēto summu. Šādā gadījumā maksājumu daļai, kas pārsniedz šo summu, nodokļus uzliek atbilstoši katras Līgumslēdzējas Valsts normatīvajiem aktiem, ņemot vērā šīs Konvencijas pārējos noteikumus.

 

12.pants

Autoratlīdzība

1. Autoratlīdzībai, kas rodas Līgumslēdzējā Valstī un ko izmaksā otras Līgumslēdzējas Valsts rezidentam, var uzlikt nodokļus šajā otrā valstī.

2. Tomēr šādai autoratlīdzībai var arī uzlikt nodokļus atbilstoši attiecīgās valsts normatīvajiem aktiem tajā Līgumslēdzējā Valstī, kurā tā rodas, bet, ja autoratlīdzības īstenais īpašnieks ir otras Līgumslēdzējas Valsts rezidents, nodoklis nedrīkst pārsniegt 5 procentus no autoratlīdzības kop­apjoma.

3. Termins "autoratlīdzība" šajā pantā nozīmē jebkāda veida maksājumus, ko saņem kā kompensāciju par jebkuru autortiesību izmantošanu vai par tiesībām izmantot jebkuras autortiesības uz literāru, mākslas vai zinātnisku darbu, tajā skaitā kinofilmas, par jebkura patenta, firmas zīmes, dizaina vai modeļa, plāna, slepenas formulas vai procesa izmantošanu vai par to izmantošanas tiesībām, vai par ražošanas, komerciālo vai zinātnisko iekārtu izmantošanu vai par tiesībām tās izmantot, vai par informāciju attiecībā uz ražošanas, komerciālo vai zinātnisko pieredzi.

4. 1. un 2.daļas noteikumi netiks piemēroti, ja autoratlīdzības īstenais īpašnieks, kas ir Līgumslēdzējas Valsts rezidents, veic uzņēmējdarbību otrā Līgumslēdzējā Valstī, kurā rodas autoratlīdzība, izmantojot tur esošo pastāvīgo pārstāvniecību, vai arī sniedz neatkarīgus individuālos pakalpojumus šajā otrā valstī, izmantojot tajā izvietoto pastāvīgo bāzi, un ja tiesības vai īpašums, par kuriem tiek maksāta autoratlīdzība, ir faktiski saistīti ar šo pastāvīgo pārstāvniecību vai pastāvīgo bāzi. Šajā gadījumā atkarībā no apstākļiem piemēro 7. vai 14.panta noteikumus.

5. Ja autoratlīdzības maksātājs ir Līgumslēdzējas Valsts rezidents, tiks uzskatīts, ka autoratlīdzība rodas šajā valstī. Tomēr, ja persona, kas izmaksā autoratlīdzību, neatkarīgi no tā, vai šī persona ir Līgumslēdzējas Valsts rezidents vai nav, izmanto Līgumslēdzējā Valstī esošo pastāvīgo pārstāvniecību vai tur izvietoto pastāvīgo bāzi, ar kuru ir faktiski saistītas tiesības vai īpašums, attiecībā uz kuru tiek maksātas autoratlīdzības, un ja šo autoratlīdzību izmaksā (sedz) pastāvīgā pārstāvniecība vai pastāvīgā bāze, tiks uzskatīts, ka autoratlīdzība rodas tajā valstī, kurā atrodas pastāvīgā pārstāvniecība vai pastāvīgā bāze.

6. Ja, pamatojoties uz īpašām attiecībām starp autoratlīdzības maksātāju un autoratlīdzības īsteno īpašnieku vai starp viņiem abiem un kādu citu personu, autor­atlīdzības summa, kas attiecas uz izmantošanu, tiesībām vai informāciju, par kuru tā tiek maksāta, pārsniedz autoratlīdzības summu, par kādu būtu varējuši vienoties maksātājs un īstenais īpašnieks, ja starp viņiem nebūtu minēto īpašo attiecību, tad šī panta noteikumi tiks piemēroti tikai attiecībā uz pēdējo minēto summu. Šajā gadījumā maksājuma daļai, kas pārsniedz šo summu nodokļus uzliek atbilstoši katras Līgumslēdzējas Valsts normatīvajiem aktiem, ņemot vērā šīs Konvencijas pārējos noteikumus.

 

13.pants

Kapitāla pieaugums

1. Kapitāla pieaugumam, ko Līgumslēdzējas Valsts rezidents gūst, atsavinot 6.pantā minēto otrā Līgumslēdzējā Valstī esošo nekustamo īpašumu, var uzlikt nodokļus šajā otrā valstī.

2. Kapitāla pieaugumam, ko Līgumslēdzējas Valsts rezidents gūst atsavinot akcijas vai tām pielīdzināmu jebkāda veida līdzdalību, kas vairāk nekā 50 procentus no vērtības tieši vai netieši iegūst no nekustamā īpašuma, kas atrodas otrā Līgumslēdzējā Valstī, var uzlikt nodokļus šajā otrā valstī.

3. Kapitāla pieaugumam, kas gūts, atsavinot kustamo īpašumu, kurš ir daļa no Līgumslēdzējas Valsts uzņēmuma pastāvīgās pārstāvniecības uzņēmējdarbības īpašuma otrā Līgumslēdzējā Valstī, vai atsavinot kustamo īpašumu, kas ir piederīgs Līgumslēdzējas Valsts rezidenta pastāvīgajai bāzei otrā Līgumslēdzējā Valstī, kura izveidota neatkarīgo individuālo pakalpojumu sniegšanai, arī kapitāla pieaugumam no šādas pastāvīgās pārstāvniecības (atsevišķi vai kopā ar visu uzņēmumu) atsavināšanas vai šādas pastāvīgās bāzes atsavināšanas, var uzlikt nodokļus otrā Līgumslēdzējā Valstī.

4. Kapitāla pieaugumam, ko Līgumslēdzējas Valsts uzņēmums, kas izmanto jūras vai gaisa transporta līdzekļus starptautiskajā satiksmē, gūst atsavinot starptautiskajā satiksmē izmantotos jūras vai gaisa transporta līdzekļus vai atsavinot kustamo īpašumu, kas ir piederīgs šādu transporta līdzekļu izmantošanai, tiks uzlikti nodokļi tikai šajā valstī.

5. Kapitāla pieaugums, kas gūts, atsavinot jebkuru tādu īpašumu, kurš atšķiras no 1., 2., 3. un 4.daļā minētā īpašuma, tiks aplikts ar nodokļiem tikai tajā Līgumslēdzējā Valstī, kuras rezidents ir šī īpašuma atsavinātājs, ja šis rezidents ir minētā kapitāla pieauguma īstenais īpašnieks.

 

14.pants

Neatkarīgie individuālie pakalpojumi

1. Līgumslēdzējas Valsts rezidenta — fiziskas personas ienākumi, kas gūti, sniedzot profesionālus pakalpojumus vai veicot cita veida neatkarīgu darbību, tiks aplikti ar nodokļiem tikai šajā valstī, izņemot, ja šī persona savas darbības vajadzībām izmanto tai regulāri pieejamu pastāvīgo bāzi otrā valstī. Ja tiek izmantota šāda pastāvīgā bāze, ienākumus var aplikt ar nodokļiem arī otrā valstī, bet tikai tik lielā mērā, kādā tie ir attiecināmi uz šo pastāvīgo bāzi. Šī panta piemērošanai, ja Līgumslēdzējas Valsts rezidents — fiziskā persona uzturas otrā Līgumslēdzējā Valstī laika posmu vai laika posmus, kuri kopumā pārsniedz 183 dienas jebkurā 12 mēnešu periodā, kas sākas vai beidzas attiecīgajā taksācijas gadā, tiks uzskatīts, ka šī persona izmanto regulāri pieejamu pastāvīgo bāzi otrā Līgumslēdzējā Valstī, un ienākums, kas gūts par otrā valstī veiktajām iepriekšminētajām darbībām, tiks attiecināts uz šo pastāvīgo bāzi.

2. Termins "profesionālā darbība" ietver neatkarīgu zinātnisko, literāro, māksliniecisko, izglītojošo vai pedagoģisko darbību, kā arī ārsta, jurista, inženiera, arhitekta, zobārsta un grāmatveža neatkarīgu darbību.

 

15.pants

Ienākums par algotu darbu

1. Saskaņā ar 16., 18. un 19.panta noteikumiem darba algai, samaksai un citai līdzīgai atlīdzībai, kuru Līgumslēdzējas Valsts rezidents saņem par algotu darbu, tiks uzlikti nodokļi tikai šajā valstī, ja vien algotais darbs netiek veikts otrā Līgumslēdzējā Valstī. Ja algotais darbs tiek veikts otrā Līgumslēdzējā Valstī, par to saņemtajai atlīdzībai var uzlikt nodokļus šajā otrā valstī.

2. Neatkarīgi no 1.daļas noteikumiem atlīdzībai, kuru Līgumslēdzējas Valsts rezidents saņem par algotu darbu, kas tiek veikts otrā Līgumslēdzējā Valstī, tiks uzlikti nodokļi tikai pirmajā minētajā valstī, ja:

a) atlīdzības saņēmējs ir atradies otrā valstī laika posmu vai laika posmus, kas kopumā nepārsniedz 183 dienas jebkurā divpadsmit mēnešu periodā, kas sākas vai beidzas attiecīgajā taksācijas gadā; un

b) atlīdzību maksā darba devējs, kas nav otras valsts rezidents, vai cita persona tāda darba devēja labā; un

c) atlīdzību neizmaksā (nesedz) pastāvīgā pārstāvniecība vai pastāvīgā bāze, kuru darba devējs izmanto otrā valstī.

3. Neatkarīgi no šī panta iepriekšējo daļu noteikumiem atlīdzībai, ko saņem par algotu darbu, kas tiek veikts uz Līgumslēdzējas Valsts uzņēmuma starptautiskajā satiksmē izmantota jūras vai gaisa transporta līdzekļa, var uzlikt nodokļus šajā valstī.

 

16.pants

Direktoru atalgojums

Direktoru atalgojumam un citiem līdzīgiem maksājumiem, ko Līgumslēdzējas Valsts rezidents saņem kā direktoru padomes vai citas līdzīgas institūcijas loceklis sabiedrībā, kas ir otras Līgumslēdzējas Valsts rezidents, var uzlikt nodokļus šajā otrā valstī.

 

17.pants

Mākslinieki un sportisti

1. Neatkarīgi no 14. un 15.panta noteikumiem ienākumam, ko gūst Līgumslēdzējas Valsts rezidents kā izpildītājmākslinieks, kā teātra, kino, radio vai televīzijas mākslinieks, mūziķis vai arī kā sportists par savu individuālo darbību otrā Līgumslēdzējā Valstī, var uzlikt nodokļus šajā otrā valstī.

2. Ja izpildītājmākslinieka vai sportista ienākums par viņa individuālo darbību attiecīgajā jomā tiek maksāts nevis pašam izpildītājmāksliniekam vai sportistam, bet citai personai, šādam ienākumam neatkarīgi no 7., 14. un 15.panta noteikumiem var uzlikt nodokļus tajā Līgumslēdzējā Valstī, kurā tiek veikta izpildītājmākslinieka vai sportista darbība.

3. 1. un 2.daļas noteikumi netiks piemēroti ienākumam par Līgumslēdzējā Valstī veikto izpildītājmākslinieka vai sportista darbību, ja vizīte Līgumslēdzējā Valstī ir pilnībā vai galvenokārt atbalstīta no vienas vai abu Līgumslēdzēju Valstu naudas līdzekļiem. Šajā gadījumā, atkarībā no apstākļiem, ienākumam nodokļi tiek uzlikti saskaņā ar 14. vai 15. panta noteikumiem.

 

18.pants

Pensijas

1. Saskaņā ar 19.panta 2.daļas noteikumiem pensijai un citai līdzīgai atlīdzībai, ko Līgumslēdzējas Valsts rezidents saņem par iepriekš veikto algoto darbu, tiks uzlikti nodokļi tikai šajā valstī.

2. Neatkarīgi no šī panta 1.daļas noteikumiem un 19.panta 2.daļas noteikumiem, pensijām un citai atlīdzībai, kas tiek izmaksāta saskaņā ar Līgumslēdzējas Valsts sociālās apdrošināšanas normatīvajiem aktiem, nodokļi tiks uzlikti tikai šajā valstī.

 

19.pants

Valsts dienests

1. a) Darba algai, samaksai un citai līdzīgai atlīdzībai, kas nav pensija un kuru fiziskajai personai izmaksā Līgumslēdzēja Valsts vai tās pašvaldība par šai valstij vai pašvaldībai sniegtajiem pakalpojumiem, tiks uzlikti nodokļi tikai šajā valstī.

b) Tomēr šādai darba algai, samaksai un citai līdzīgai atlīdzībai tiks uzlikti nodokļi tikai otrā Līgumslēdzējā Valstī, ja pakalpojumi ir sniegti šajā otrā valstī un šī fiziskā persona ir tāds šīs valsts rezidents, kas:

(i) ir šīs valsts pilsonis; vai

(ii) nav kļuvis par šīs valsts rezidentu tikai un vienīgi, lai sniegtu šos pakalpojumus.

2. a) Jebkurai pensijai, kuru fiziskajai personai izmaksā Līgumslēdzēja Valsts vai tās pašvaldība, vai kas tiek izmaksāta no to izveidotajiem fondiem par pakalpojumiem, ko šī persona sniegusi šai valstij vai pašvaldībai, tiks uzlikti nodokļi tikai šajā valstī.

b) Tomēr šādai pensijai tiks uzlikti nodokļi tikai otrā Līgumslēdzējā Valstī, ja šī fiziskā persona ir šīs otras valsts rezidents un pilsonis.

3. 15., 16., 17. un 18.panta noteikumus piemēro darba algai, samaksai, citai līdzīgai atlīdzībai un pensijai, kuru izmaksā par pakalpojumiem, kas sniegti sakarā ar Līgumslēdzējas Valsts vai tās pašvaldības veikto uzņēmējdarbību.

 

20.pants

Studenti

Maksājumiem, ko uzturēšanās, studiju vai stažēšanās vajadzībām saņem students vai māceklis, kurš ir vai tieši pirms ierašanās Līgumslēdzējā Valstī bija otras Līgumslēdzējas Valsts rezidents un kurš pirmajā minētajā valstī ir ieradies vienīgi studiju vai stažēšanās nolūkā, šajā valstī netiks uzlikti nodokļi, ja šādi maksājumi ir no avotiem, kas neatrodas šajā valstī.

 

21.pants

Citi ienākumi

1. Citiem šīs Konvencijas iepriekšē­jos pantos neatrunātiem Līgumslēdzējas Valsts rezidenta ienākumiem neatkarīgi no to rašanās vietas tiks uzlikti nodokļi tikai šajā valstī.

2. 1.daļas noteikumi netiks piemēroti ienākumam, kas nav ienākums no 6.panta 2.daļā definētā nekustamā īpašuma, ja šī ienākuma saņēmējs, kurš ir Līgumslēdzējas Valsts rezidents, veic uzņēmējdarbību otrā Līgumslēdzējā Valstī, izmantojot tur esošo pastāvīgo pārstāvniecību, vai sniedz neatkarīgus individuālos pakalpojumus šajā otrā valstī, izmantojot tur izvietoto pastāvīgo bāzi, un ja tiesības vai īpašums, par ko tiek saņemts šis ienākums, ir faktiski saistīti ar šo pastāvīgo pārstāvniecību vai pastāvīgo bāzi. Šajā gadījumā atkarībā no apstākļiem piemēro šīs Konvencijas 7. vai 14. panta noteikumus.

 

22.pants

Kapitāls

1. Kapitālam, ko pārstāv 6.pantā minētais Līgumslēdzējas Valsts rezidenta nekustamais īpašums, kas atrodas otrā Līgumslēdzējā Valstī, var uzlikt nodokļus šajā otrā valstī.

2. Kapitālam, ko pārstāv kustamais īpašums, kas ir daļa no īpašuma, ko Līgumslēdzējas Valsts uzņēmuma pastāvīgā pārstāvniecība izmanto uzņēmējdarbībā, vai kapitālam, ko pārstāv kustamais īpašums, kas ir piederīgs Līgumslēdzējas Valsts rezidenta pastāvīgajai bāzei otrā Līgumslēdzējā Valstī, kura tiek izmantota neatkarīgu individuālo pakalpojumu sniegšanai, var uzlikt nodokļus šajā otrā valstī.

3. Kapitālam, ko pārstāv jūras un gaisa transporta līdzekļi, kurus Līgumslēdzējas Valsts uzņēmums izmanto starptautiskajā satiksmē, kā arī kustamais īpašums, kas piederīgs šo jūras vai gaisa transporta līdzekļu izmantošanai, tiks uzlikti nodokļi tikai šajā valstī.

4. Visiem pārējiem Līgumslēdzējas Valsts rezidenta kapitāla elementiem tiks uzlikti nodokļi tikai šajā valstī.

 

23.pants

Nodokļu dubultās uzlikšanas novēršana

1. Latvijā nodokļu dubultā uzlikšana tiks novērsta šādi:

a) Ja Latvijas rezidents gūst ienākumu vai tam pieder kapitāls, kam saskaņā ar šo Konvenciju var uzlikt nodokļus Izraēlā, tad, ja vien Latvijas nacionālajos normatīvajos aktos netiek paredzēti labvēlīgāki noteikumi, Latvija atļauj:

(i) samazināt šī rezidenta ienākuma nodokli par summu, kas ir vienāda ar Izraēlā samaksāto ienākuma nodokli;

(ii) samazināt šī rezidenta kapitāla nodokli par summu, kas ir vienāda ar Izraēlā samaksāto kapitāla nodokli.

Šie samazinājumi tomēr nevienā gadījumā nedrīkst pārsniegt tādu ienākuma nodokļa vai kapitāla nodokļa daļu, kāda ir aprēķināta Latvijā pirms šī samazinājuma piemērošanas un kura atkarībā no apstākļiem ir attiecināma uz ienākumu vai kapitālu, kam var uzlikt nodokļus Izraēlā.

b) lai piemērotu šīs daļas a) punktu, ja sabiedrība — Latvijas rezidents saņem dividendes no sabiedrības — Izraēlas rezidenta, kurā tai pieder vismaz 10 procentu akciju ar pilnām balsstiesībām, tad Izraēlā samaksātajā nodoklī tiks ietverts ne tikai par dividendēm samaksātais nodoklis, bet arī atbilstoša daļa no nodokļa, kas samaksāts par sabiedrības peļņu, no kuras tika maksātas dividendes.

2. Izraēlā nodokļu dubultā uzlikšana tiks novērsta šādi:

a) ja Izraēlas rezidents gūst ienākumu vai tam pieder kapitāls, kam saskaņā ar šo Konvenciju var uzlikt nodokļus Latvijā, tad, saskaņā ar Izraēlas normatīvajiem aktiem par ārvalstu nodokļu atskaitīšanu, neietekmējot šajā daļā ietverto vispārīgo principu, Izraēla atļauj samazināt šī rezidenta ienākuma nodokli vai kapitāla nodokli par summu, kas ir vienāda ar Latvijā attiecīgi samaksāto ienākuma vai kapitāla nodokli;

b) ja minētais ienākums ir dividendes, ko sabiedrība — Latvijas rezidents izmaksā sabiedrībai — Izraēlas rezidentam, kam pieder vismaz 25 procenti akciju kapitāla sabiedrībā, kura izmaksā dividendes, tad nodokļa samazinājumā tiks ietverts arī nodoklis, ko sabiedrība, kas izmaksā dividendes, ir samaksājusi par ienākumu no kura tiek izmaksātas dividendes.

Šie samazinājumi tomēr nevienā gadījumā nedrīkst pārsniegt tādu ienākuma nodokļa vai kapitāla nodokļa daļu, kāda ir aprēķināta Izraēlā pirms šī samazinājuma piemērošanas un kura atkarībā no apstākļiem ir attiecināma uz ienākumu vai kapitālu, kam var uzlikt nodokļus Latvijā.

3. Ja saskaņā ar jebkuriem Konvencijas noteikumiem Līgumslēdzējas Valsts rezidenta gūtais ienākums vai tam piederošais kapitāls šajā valstī tiek atbrīvots no nodokļu uzlikšanas, tad, aprēķinot šā rezidenta nodokli par atlikušo ienākumu vai kapitālu, šī valsts var ņemt vērā atbrīvoto ienākumu vai kapitālu.

 

24.pants

Diskriminācijas nepieļaušana

1. Uz Līgumslēdzējas Valsts pilsoņiem otrā Līgumslēdzējā Valstī neattieksies nodokļu uzlikšana vai ar to saistītas prasības, kas ir apgrūtinošākas nekā nodokļu uzlikšana vai ar to saistītās prasības, kuras tādos pašos apstākļos, jo īpaši saistībā ar rezidenci, attiecas vai var tikt attiecinātas uz šīs otras valsts pilsoņiem. Šis noteikums neatkarīgi no 1.panta noteikumiem attiecas arī uz personām, kuras nav vienas Līgumslēdzējas Valsts vai abu Līgumslēdzēju Valstu rezidenti.

2. Nodokļu uzlikšana Līgumslēdzējas Valsts uzņēmuma pastāvīgajai pārstāvniecībai otrā Līgumslēdzējā Valstī nevar būt nelabvēlīgāka nekā nodokļu uzlikšana šīs otras valsts uzņēmumiem, kas veic tādu pašu darbību. Šo noteikumu nedrīkst iztulkot tā, ka tas uzliek Līgumslēdzējai Valstij pienākumu piešķirt otras Līgumslēdzējas Valsts rezidentiem jebkādu personisku atvieglojumu, atlaidi un samazinājumu attiecībā uz nodokļu uzlikšanu, kādus šī valsts piešķir tās rezidentiem, ņemot vērā viņu civilstāvokli vai ģimenes saistības.

3. Izņemot gadījumus, kad piemērojami 9.panta 1.daļas, 11.panta 7.daļas vai 12.panta 6.daļas noteikumi, procenti, autoratlīdzības un citi maksājumi, ko Līgumslēdzējas Valsts uzņēmums izmaksā otras Līgumslēdzējas Valsts rezidentam, nosakot šī uzņēmuma apliekamo peļņu, ir jāatskaita pēc tādiem pašiem noteikumiem kā tad, ja tie tiktu izmaksāti pirmās minētās valsts rezidentam. Tāpat arī Līgumslēdzējas Valsts uzņēmuma parādi otras Līgumslēdzējas Valsts rezidentam, nosakot šāda uzņēmuma apliekamā kapitāla vērtību, ir jāatskaita pēc tādiem pašiem noteikumiem kā tad, ja tie attiektos uz pirmās minētās valsts rezidentu.

4. Līgumslēdzējas Valsts uzņēmumus, kuru kapitāls pilnīgi vai daļēji, tieši vai netieši pieder vienam vai vairākiem otras Līgumslēdzējas Valsts rezidentiem vai to pilnīgi vai daļēji, tieši vai netieši kontrolē minētie rezidenti, pirmajā valstī nevar pakļaut jebkādai nodokļu uzlikšanai vai jebkurām ar to saistītām prasībām, kas atšķiras no nodokļu uzlikšanas un ar to saistītām prasībām, kurām tiek vai var tikt pakļauti līdzīgi pirmās minētās valsts uzņēmumi, vai kuras ir apgrūtinošākas par tām.

5. Šī panta noteikumi neatkarīgi no 2.panta noteikumiem attiecas uz visu veidu un nosaukumu nodokļiem.

 

25.pants

Savstarpējās saskaņošanas procedūra

1. Ja persona uzskata, ka vienas Līgumslēdzējas Valsts vai abu Līgumslēdzēju Valstu rīcība attiecībā uz šo personu izraisa vai izraisīs nodokļu uzlikšanu, kas neatbilst šīs Konvencijas noteikumiem, šī persona var neatkarīgi no šo valstu nacionālajos normatīvajos aktos paredzētajiem tiesiskajiem līdzekļiem iesniegt sūdzību izskatīšanai tās Līgumslēdzējas Valsts kompetentajai iestādei, kuras rezidents ir šī persona, vai arī, ja sūdzība attiecas uz 24.panta 1.daļu, — tās Līgumslēdzējas Valsts kompetentajai iestādei, kuras pilsonis ir šī persona. Sūdzība iesniedzama izskatīšanai triju gadu laikā pēc pirmā paziņojuma par rīcību, kas izraisījusi šīs Konvencijas noteikumiem neatbilstošu nodokļu uzlikšanu.

2. Ja kompetentā iestāde sūdzību uzskata par pamatotu un pati nespēj panākt apmierinošu risinājumu, tā cenšas savstarpēji vienoties ar otras Līgumslēdzējas Valsts kompetento iestādi, lai novērstu šai Konvencijai neatbilstošu nodokļu uzlikšanu. Jebkura šāda panāktā vienošanās ir jāizpilda neatkarīgi no Līgumslēdzējas Valsts nacionālajos normatīvajos aktos noteiktajiem laika ierobežojumiem.

3. Līgumslēdzēju Valstu kompetentajām iestādēm ir jācenšas savstarpējas vienošanās ceļā atrisināt jebkurus sarežģījumus vai novērst šaubas, kas var rasties, interpretējot vai piemērojot šo Konvenciju. Tās var arī savstarpēji konsultēties, lai novērstu nodokļu dubulto uzlikšanu šajā Konvencijā neparedzētos gadījumos.

4. Lai panāktu vienošanos iepriekšējās daļās minētajos jautājumos, Līgumslēdzēju Valstu kompetentās iestādes var tieši sazināties viena ar otru, kā arī šāda viedokļu apmaiņa var notikt ar Līgumslēdzēju Valstu kompetento iestāžu pārstāvju komisijas starpniecību.

 

26.pants

Informācijas apmaiņa

1. Līgumslēdzēju Valstu kompetentās iestādes apmainās ar informāciju, kas nepieciešama šīs Konvencijas noteikumu izpildīšanai vai nacionālo normatīvo aktu prasību izpildei par nodokļiem, uz kuriem attiecas šī Konvencija, tiktāl, ciktāl šie normatīvie akti nav pretrunā ar šo Konvenciju. Konvencijas 1.pants neierobežo informācijas apmaiņu. Jebkura informācija, ko saņem Līgumslēdzēja Valsts, ir jāuzskata par tikpat slepenu kā informācija, kas tiek iegūta saskaņā ar šīs valsts normatīvajiem aktiem, un var tikt izpausta tikai tām personām vai varas iestādēm (arī tiesām un pārvaldes iestādēm), kas ir iesaistītas nodokļu, uz kuriem attiecas šī Konvencija, aprēķināšanā, iekasēšanā, piespiedu līdzekļu lietošanā, lietu iztiesāšanā vai apelāciju izskatīšanā saistībā ar šiem nodokļiem. Šīm personām vai varas iestādēm šī informācija jāizmanto vienīgi iepriekšminētajos nolūkos. Tās drīkst izpaust šo informāciju atklātās tiesas sēdēs vai tiesas nolēmumos.

2. 1.daļas noteikumus nedrīkst izskaidrot tādējādi, ka tie uzliktu Līgumslēdzējai Valstij pienākumu:

a) veikt administratīvus pasākumus, kas neatbilst vienas vai otras Līgumslēdzējas Valsts normatīvajiem aktiem un administratīvajai praksei;

b) sniegt informāciju, kas nav pieejama saskaņā ar vienas vai otras Līgumslēdzējas Valsts normatīvajiem aktiem vai parasti piemērojamo administratīvo praksi;

c) sniegt informāciju, kas var atklāt jebkuru tirdzniecības, uzņēmējdarbības, ražošanas, komerciālo vai profesionālo noslēpumu vai tehnoloģijas procesu, vai arī sniegt informāciju, kuras izpaušana būtu pretrunā ar sabiedrības interesēm (ordre public).

 

27.pants

Diplomātisko un konsulāro pārstāvniecību personāls

Nekas šajā Konvencijā neietekmē diplomātisko misiju vai konsulāro pārstāvniecību personāla fiskālās privilēģijas, kuras tam piešķir starptautisko tiesību vispārējie noteikumi vai īpašu vienošanos noteikumi.

 

28.pants

Stāšanās spēkā

1. Līgumslēdzēju Valstu valdības rakstveidā diplomātiskā ceļā informē viena otru par to, ka ir izpildītas to normatīvajos aktos noteiktās prasības, kas nepieciešamas, lai šī Konvencija stātos spēkā.

2. Šī Konvencija stājas spēkā ar 1.daļā minētā pēdējā paziņojuma datumu, un tās noteikumi abās Līgumslēdzējās Valstīs tiek piemēroti:

a) attiecībā uz nodokļiem, ko ietur ienākuma izmaksas brīdī — ienākumam, kas gūts tā kalendārā gada janvāra pirmajā dienā vai pēc tās kalendārajā gadā, kas seko gadam, kurā šī Konvencija stājas spēkā;

b) attiecībā uz pārējiem nodokļiem — nodokļiem, kas maksājami jebkurā taksācijas gadā, kas sākas tā kalendārā gada janvāra pirmajā dienā vai pēc tās kalendārajā gadā, kas seko gadam, kurā šī Konvencija stājas spēkā.

 

29.pants

Darbības izbeigšana

Šī Konvencija ir spēkā tik ilgi, kamēr viena Līgumslēdzēja Valsts tās darbību izbeidz. Katra Līgumslēdzēja Valsts var izbeigt šīs Konvencijas darbību, diplomātiskā ceļā iesniedzot rakstveida paziņojumu par izbeigšanu vismaz sešus mēnešus pirms jebkura kalendārā gada beigām. Šajā gadījumā Konvencijas darbība abās Līgumslēdzējās Valstīs tiek izbeigta:

a) attiecībā uz nodokļiem, ko ietur ienākuma izmaksas brīdī — ienākumam, kas gūts tā kalendārā gada janvāra pirmajā dienā vai pēc tās kalendārajā gadā, kas seko gadam, kurā ir saņemts paziņojums par izbeigšanu;

b) attiecībā uz pārējiem nodokļiem — nodokļiem, kas maksājami jebkurā taksācijas gadā, kas sākas tā kalendārā gada janvāra pirmajā dienā vai pēc tās kalendārajā gadā, kas seko gadam, kurā ir saņemts paziņojums par izbeigšanu.

To apliecinot, būdami pienācīgi pilnvaroti, šo Konvenciju ir parakstījuši.

Konvencija sastādīta Jeruzalemē divos eksemplāros 2006.gada 20.februārī, kas atbilst Ebreju kalendāra 5766.gada 22.ševatam, latviešu, ebreju un angļu valodā, turklāt visi teksti ir vienlīdz autentiski. Atšķirīgas interpretācijas gadījumā noteicošais ir teksts angļu valodā.

PROTOKOLS

Latvijas Republikas valdības un Izraēlas Valsts valdības Konvencijas par nodokļu dubultās uzlikšanas un nodokļu nemaksāšanas novēršanu attiecībā uz ienākuma un kapitāla nodokļiem parakstīšanas brīdī puses ir vienojušās, ka turpmāk minētie noteikumi ir Konvencijas neatņemama sastāvdaļa.

1. Attiecībā uz 2.panta 2.daļu

Tiek saprasts, ka nodokļi, ar ko tiek apliktas uzņēmumu izmaksātās kopējās darba algas vai samaksas, arī tiks uzskatīti par ienākuma nodokļiem, bet sociālās apdrošināšanas iemaksas un jebkuri līdzīgi maksājumi netiks uzskatīti par ienākuma nodokļiem.

2. Attiecībā uz 3.panta 2.daļu

Attiecībā uz Izraēlu, termins "normatīvie akti" 3.panta 2.daļā ietver norādījumus, noteikumus, administratīvos norādījumus un Izraēlas Valsts tiesu nolēmumus.

3. Attiecībā uz 4.panta 3.daļu

a) Ja persona, kas nav fiziska persona, ir abu Līgumslēdzēju Valstu rezidents, un Līgumslēdzēju Valstu kompetentās iestādes cenšas noteikt tās statusu savstarpējas vienošanās ceļā, kompetentajām iestādēm ir jāņem vērā tādi faktori kā faktiskās vadības atrašanās vieta, inkorporācijas vai citādas izveidošanas vieta un jebkuri citi svarīgi faktori.

b) Tiek saprasts, ka 3.daļas noteikumi ir piemērojami tik ilgi, kamēr Latvija savos nacionālajos normatīvajos aktos par rezidences noteikšanas kritēriju neuzskatīs faktiskās vadības atrašanās vietu. Tiklīdz šāds kritērijs tiek ieviests, Latvijas kompetentā iestāde informē Izraēlas kompetento iestādi, un iespējami īsākā laikā, par kuru vienosies Līgumslēdzēju Valstu kompetentās iestādes, 3.daļas pašreizējās redakcijas vietā tiks piemēroti šādi noteikumi:

"3. Ja saskaņā ar 1.daļas noteikumiem persona, kas nav fiziskā persona, ir abu Līgumslēdzēju Valstu rezidents, tad tiks uzskatīts, ka šī persona ir tās valsts rezidents, kurā atrodas tās faktiskās vadības vieta."

4. Attiecībā uz 5.panta 6.daļu

Tiek saprasts, ka šādu aģentu nevar uzskatīt par neatkarīga statusa aģentu šajā daļā minētajā nozīmē, ja viņa darbība pilnīgi vai gandrīz pilnīgi tiek veikta uzņēmuma labā.

5. Attiecībā uz 6.panta 3.daļu un 13.panta 1.daļu

Tiek saprasts, ka viss ienākums un kapitāla pieaugums, kas gūts no 6.pantā minētā nekustamā īpašuma, kas atrodas Līgumslēdzējā Valstī, atsavināšanas, var tikt aplikts ar nodokli šajā valstī saskaņā ar 13.panta noteikumiem.

6. Attiecībā uz 7.panta 3.daļu

Tiek saprasts, ka šīs daļas noteikumi neattiecas uz tādiem izdevumiem, kas nebūtu atskaitāmi, ja pastāvīgā pārstāvniecība būtu atsevišķs tās Līgumslēdzējas Valsts uzņēmums, kurā tā atrodas.

7. Attiecībā uz 11.panta 3.daļu

Tiek saprasts, ka a) (iii) punktā minētā institūcija ir Izraēlas eksporta apdrošināšanas sabiedrība ASHR'A (ASHR'A, the Israel Export Insurance Corp.Ltd).

8. Attiecībā uz 12.panta 3.daļu

Tiek saprasts, ka jebkuras autortiesības uz literāru, mākslas vai zinātnisku darbu iekļauj autortiesības uz filmām vai ierakstiem un citiem attēla vai skaņas reprodukcijas līdzekļiem, radio vai televīzijas pārraidēm.

9. Attiecībā uz 16.pantu

Tiek saprasts, ka 16.pantu nepiemēro atalgojumam, ko šajā pantā minētās padomes vai līdzīgas institūcijas loceklis saņem saistībā ar jebkuru citu viņa veikto darbību, kas nav padomes vai līdzīgas institūcijas locekļa darbība.

10. Nodokļa atvieglojumi

Tiek saprasts, ka šajā Konvencijā noteiktos nodokļu atvieglojumus Līgumslēdzējas Valsts rezidentam otras Līgumslēdzējas Valsts nodokļu iestāde piemēros ar nosacījumu, ka tiek uzrādīta rezidences apliecība, kurā norādīts attiecīgais ienākums un kuru ir parakstījusi pirmās Līgumslēdzējas Valsts nodokļu iestāde.

11. Nodokļu nemaksāšanas vai izvairīšanās no nodokļu maksāšanas novēršana

Šī Konvencija neierobežo Līgumslēdzējas Valsts tiesības piemērot tās nacionālos normatīvos aktus par nodokļu nemaksāšanas vai izvairīšanās no nodokļu maksāšanas novēršanu.

Protokols sastādīts Jeruzalemē divos eksemplāros 2006.gada 20.februārī, kas atbilst Ebreju kalendāra 5766.gada 22.ševatam, latviešu, ebreju un angļu valodā, turklāt visi teksti ir vienlīdz autentiski. Atšķirīgas interpretācijas gadījumā noteicošais ir teksts angļu valodā.

CONVENTION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF LATVIA AND THE GOVERNMENT OF THE STATE OF ISRAEL
FOR THE AVOIDANCE OF DOUBLE TAXATION AND THE PREVENTION OF FISCAL EVASION WITH RESPECT TO TAXES ON INCOME AND ON CAPITAL

The Government of the Republic of Latvia and the Government of the State of Israel,

DESIRING to conclude a Convention for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income and on capital,

HAVE AGREED as follows:

 

Article 1

Persons covered

This Convention shall apply to persons who are residents of one or both of the Contracting States.

 

Article 2

Taxes covered

1. This Convention shall apply to taxes on income and on capital imposed on behalf of a Contracting State or of its local authorities, irrespective of the manner in which they are levied.

2. There shall be regarded as taxes on income and on capital all taxes imposed on total income, on total capital, or on elements of income or of capital, including taxes on gains from the alienation of movable or immovable property, taxes on the total amounts of wages or salaries paid by enterprises, as well as taxes on capital appreciation.

3. The existing taxes to which the Convention shall apply are in particular:

a) in Latvia:

(i) the enterprise income tax (uzņēmumu ienākuma nodoklis);

(ii) the personal income tax (iedzīvotāju ienākuma nodoklis);

(iii) the immovable property tax (nekustamā īpašuma nodoklis);

(hereinafter referred to as "Latvian tax");

b) in Israel:

(i) the income tax and company tax (including tax on capital gains);

(ii) the tax imposed on gains from the alienation of real property according to the Real Estate Taxation Law;

(hereinafter referred to as "Israeli tax").

4. The Convention shall apply also to any identical or substantially similar taxes that are imposed after the date of signature of the Convention in addition to, or in place of, the existing taxes. The competent authorities of the Contracting States shall notify each other of any significant changes which have been made in their respective taxation laws.

 

Article 3

General definitions

1. For the purposes of this Convention, unless the context otherwise requires:

a) (i) the term "Latvia" means the Republic of Latvia and, when used in the geographical sense, means the territory of the Republic of Latvia and any other area adjacent to the territorial waters of the Republic of Latvia within which under the laws of Latvia and in accordance with international law, the rights of Latvia may be exercised with respect to the sea bed and its subsoil and their natural resources;

(ii) the term "Israel" means the State of Israel and when used in a geographical sense comprises the territory in which the Government of the State of Israel has taxation rights, including its territorial sea, as well as those maritime areas adjacent to the outer limit of the territorial sea, including seabed and subsoil thereof over which the State of Israel, in accordance with international law and the laws of the State of Israel, exercises its sovereign or other rights and jurisdiction;

b) the terms "a Contracting State" and "the other Contracting State" mean Latvia or Israel, as the context requires;

c) the term "person" includes an individual, a company and any other body of persons;

d) the term "company" means any body corporate or any entity that is treated as a body corporate for tax purposes;

e) the terms "enterprise of a Contracting State" and "enterprise of the other Contracting State" mean respectively an enter­prise carried on by a resident of a Contracting State and an enterprise carried on by a resident of the other Contracting State;

f) the term "international traffic" means any transport by a ship or aircraft operated by an enterprise of a Contracting State, except when the ship or aircraft is operated solely between places in the other Contracting State;

g) the term "competent authority" means:

(i) in Latvia, the Ministry of Finance or its authorised representative;

(ii) in Israel, the Minister of Finance or his authorised representative;

h) the term "national" means:

(i) any individual possessing the nationality of a Contracting State;

(ii) any legal person, partnership or association deriving its status as such from the laws in force in a Contracting State.

2. As regards the application of the Convention at any time by a Contracting State, any term not defined therein shall, unless the context otherwise requires, have the meaning that it has at that time under the law of that State for the purposes of the taxes to which the Convention applies, any meaning under the applicable tax laws of that State prevailing over a meaning given to the term under other laws of that State.

 

Article 4

Resident

1. For the purposes of this Convention, the term "resident of a Contracting State" means any person who, under the laws of that State, is liable to tax therein by reason of his domicile, residence, place of management, place of incorporation or any other criterion of a similar nature, and also includes that State and any local authority thereof. This term, however, does not include any person who is liable to tax in that State in respect only of income from sources in that State or capital situated therein.

2. Where by reason of the provisions of paragraph 1 an individual is a resident of both Contracting States, then his status shall be determined as follows:

a) he shall be deemed to be a resident only of the State in which he has a permanent home available to him; if he has a permanent home available to him in both States, he shall be deemed to be a resident only of the State with which his personal and economic relations are closer (centre of vital interests);

b) if the State in which he has his centre of vital interests cannot be determined, or if he has not a permanent home available to him in either State, he shall be deemed to be a resident only of the State in which he has an habitual abode;

c) if he has an habitual abode in both States or in neither of them, he shall be deemed to be a resident only of the State of which he is a national;

d) if he is a national of both States or of neither of them, the competent authorities of the Contracting States shall settle the question by mutual agreement.

3. Where by reason of the provisions of paragraph 1 a person other than an individual is a resident of both Contracting States, the competent authorities of the Contracting States may settle the question by mutual agreement. In the absence of such agreement, for the purposes of the Convention, the person shall not be entitled to claim any benefits provided by this Convention.

 

Article 5

Permanent establishment

1. For the purposes of this Convention, the term "permanent establishment" means a fixed place of business through which the business of an enterprise is wholly or partly carried on.

2. The term "permanent establishment" includes especially:

a) a place of management;

b) a branch;

c) an office;

d) a factory;

e) a workshop, and

f) a mine, an oil or gas well, a quarry or any other place of extraction of natural resources.

3. a) A building site or construction, assembly or installation project or a supervisory activity connected therewith constitutes a permanent establishment only if it lasts more than 12 months;

b) Activities carried on offshore in a Contracting State in connection with the exploration or exploitation of the sea bed and subsoil and their natural resources situated in that State shall be deemed to be carried on through a permanent establishment situated in that State, if such activities are carried on for a period or periods exceeding in the aggregate 30 days in any twelve-month period.

4. Notwithstanding the preceding provisions of this Article, the term "permanent establishment" shall be deemed not to include:

a) the use of facilities solely for the purpose of storage, display or delivery of goods or merchandise belonging to the enterprise;

b) the maintenance of a stock of goods or merchandise belonging to the enterprise solely for the purpose of storage, display or delivery;

c) the maintenance of a stock of goods or merchandise belonging to the enterprise solely for the purpose of processing by another enterprise;

d) the maintenance of a fixed place of business solely for the purpose of purchasing goods or merchandise or of collecting information, for the enterprise;

e) the maintenance of a fixed place of business solely for the purpose of carrying on, for the enterprise, any other activity of a preparatory or auxiliary character;

f) the maintenance of a fixed place of business solely for any combination of activities mentioned in sub-paragraphs a) to e), provided that the overall activity of the fixed place of business resulting from this combination is of a preparatory or auxiliary character.

5. Notwithstanding the provisions of paragraphs 1 and 2, where a person — other than an agent of an independent status to whom paragraph 6 applies — is acting on behalf of an enterprise and has, and habitually exercises, in a Contracting State an authority to conclude contracts in the name of the enterprise, that enterprise shall be deemed to have a permanent establishment in that State in respect of any activities which that person undertakes for the enterprise, unless the activities of such person are limited to those mentioned in paragraph 4 which, if exercised through a fixed place of business, would not make this fixed place of business a permanent establishment under the provisions of that paragraph.

6. An enterprise shall not be deemed to have a permanent establishment in a Contracting State merely because it carries on business in that State through a broker, general commission agent or any other agent of an independent status, provided that such persons are acting in the ordinary course of their business.

7. The fact that a company which is a resident of a Contracting State controls or is controlled by a company which is a resident of the other Contracting State, or which carries on business in that other State (whether through a permanent establishment or otherwise), shall not of itself constitute either company a permanent establishment of the other.

 

Article 6

Income from immovable property

1. Income derived by a resident of a Contracting State from immovable property (including income from agriculture or forestry) situated in the other Contracting State may be taxed in that other State.

2. The term "immovable property" shall have the meaning which it has under the law of the Contracting State in which the property in question is situated. The term shall in any case include property accessory to immovable property, livestock and equip­ment used in agriculture and forestry, rights to which the provisions of general law respecting landed property apply, any option or similar right to acquire immovable property, usufruct of immovable property and rights to variable or fixed payments as consideration for the working of, or the right to work, mineral deposits, sources and other natural resources, rights to assets to be produced by the exploration or exploitation of the sea bed and subsoil and their natural resources, including rights to interests in or to the benefit of such assets; ships, boats and aircraft shall not be regarded as immovable property.

3. The provisions of paragraph 1 shall apply to income derived from the direct use, letting, or use in any other form of immovable property.

4. The provisions of paragraphs 1 and 3 shall also apply to the income from immovable property of an enterprise and to income from immovable property used for the performance of independent personal services.

 

Article 7

Business profits

1. The profits of an enterprise of a Contracting State shall be taxable only in that State unless the enterprise carries on business in the other Contracting State through a permanent establishment situated therein. If the enterprise carries on business as aforesaid, the profits of the enterprise may be taxed in the other State but only so much of them as is attributable to that permanent establishment.

2. Subject to the provisions of paragraph 3, where an enterprise of a Contracting State carries on business in the other Contracting State through a permanent establishment situated therein, there shall in each Contracting State be attributed to that permanent establishment the profits which it might be expected to make if it were a distinct and separate enterprise engaged in the same or similar activities under the same or similar conditions and dealing wholly independently with the enterprise of which it is a permanent establishment.

3. In determining the profits of a permanent establishment, there shall be allowed as deductions expenses which are incurred for the purposes of the permanent establishment, including executive and general administrative expenses so incurred, whether in the State in which the permanent establishment is situated or elsewhere.

4. Insofar as it has been customary in a Contracting State to determine the profits to be attributed to a permanent establish­ment on the basis of an apportionment of the total profits of the enterprise to its various parts, nothing in paragraph 2 shall preclude that Contracting State from determining the profits to be taxed by such an apportionment as may be customary; the method of apportionment adopted shall, however, be such that the result shall be in accordance with the principles contained in this Article.

5. No profits shall be attributed to a permanent establishment by reason of the mere purchase by that permanent establishment of goods or merchandise for the enterprise.

6. For the purposes of the preceding paragraphs, the profits to be attributed to the permanent establishment shall be determined by the same method year by year unless there is good and sufficient reason to the contrary.

7. Where profits include items of income which are dealt with separately in other Articles of this Convention, then the provisions of those Articles shall not be affected by the provisions of this Article.

 

Article 8

Shipping and air transport

1. Profits of an enterprise of a Contracting State from the operation of ships or aircraft in international traffic shall be taxable only in that State.

2. The provisions of paragraph 1 shall also apply to profits from the participation in a pool, a joint business or an inter­national operating agency.

 

Article 9

Associated enterprises

1. Where

a) an enterprise of a Contracting State participates directly or indirectly in the management, control or capital of an enter­prise of the other Contracting State, or

b) the same persons participate directly or indirectly in the management, control or capital of an enterprise of a Contracting State and an enterprise of the other Contracting State,

and in either case conditions are made or imposed between the two enterprises in their commercial or financial relations which differ from those which would be made between independent enter­prises, then any profits which would, but for those conditions, have accrued to one of the enterprises, but, by reason of those conditions, have not so accrued, may be included in the profits of that enterprise and taxed accordingly.

2. Where a Contracting State includes in the profits of an enterprise of that State — and taxes accordingly — profits on which an enterprise of the other Contracting State has been charged to tax in that other State and the profits so included are profits which would have accrued to the enterprise of the first-mentioned State if the conditions made between the two enterprises had been those which would have been made between independent enterprises, then that other State shall make an appropriate adjustment to the amount of the tax charged therein on those profits. In determining such adjustment, due regard shall be had to the other provisions of this Convention and the competent authorities of the Contracting States shall if necessary consult each other.

 

Article 10

Dividends

1. Dividends paid by a company which is a resident of a Contracting State to a resident of the other Contracting State may be taxed in that other State.

2. However, such dividends may also be taxed in the Contracting State of which the company paying the dividends is a resident and according to the laws of that State, but if the beneficial owner of the dividends is a resident of the other Contracting State, the tax so charged shall not exceed:

a) 5 per cent of the gross amount of the dividends if the beneficial owner is a company (other than a partnership) which holds directly at least 10 per cent of the capital of the company paying the dividends;

b) 10 per cent of the gross amount of the dividends, notwithstanding the provisions of sub-paragraph a), if the beneficial owner is a company which holds directly at least 10 per cent of the capital of the company paying the dividends where the dividends are paid out of profits which by virtue of provisions in the Israeli Law of Encouragement of Investments in Israel are exempt from tax or subject to tax at a rate that is lower than the normal rate of Israeli company tax;

c) 15 per cent of the gross amount of the dividends in all other cases.

This paragraph shall not affect the taxation of the company in respect of the profits out of which the dividends are paid.

3. The term "dividends" as used in this Article means income from shares, "jouissance" shares or "jouissance" rights, mining shares, founders' shares or other rights, not being debt claims, participating in profits, as well as income from other rights which is subjected to the same taxation treatment as income from shares by the laws of the State of which the company making the distribution is a resident.

4. The provisions of paragraphs 1 and 2 shall not apply if the beneficial owner of the dividends, being a resident of a Contracting State, carries on business in the other Contracting State of which the company paying the dividends is a resident, through a permanent establishment situated therein, or performs in that other State independent personal services from a fixed base situated therein, and the holding in respect of which the dividends are paid is effectively connected with such permanent establishment or fixed base. In such case the provisions of Article 7 or Article 14, as the case may be, shall apply.

5. Where a company which is a resident of a Contracting State derives profits or income from the other Contracting State, that other State may not impose any tax on the dividends paid by the company, except insofar as such dividends are paid to a resident of that other State or insofar as the holding in respect of which the dividends are paid is effectively connected with a permanent establishment or a fixed base situated in that other State, nor subject the company's undistributed profits to a tax on the company's undistributed profits, even if the dividends paid or the undistributed profits consist wholly or partly of profits or income arising in such other State.

 

Article 11

Interest

1. Interest arising in a Contracting State and paid to a resident of the other Contracting State may be taxed in that other State.

2. However, such interest may also be taxed in the Contracting State in which it arises and according to the laws of that State, but if the beneficial owner of the interest is a resident of the other Contracting State, the tax so charged shall not exceed:

a) 5 per cent of the gross amount of the interest arising in a Contracting State and paid on any loan of whatever kind granted by a bank of the other Contracting State;

b) 10 per cent of the gross amount of the interest in all other cases.

3. Notwithstanding the provisions of paragraphs 1 and 2,

a) interest arising in Latvia shall be taxable only in Israel if the interest is paid to or in respect of a loan, debt claim or credit that is guaranteed or insured by:

(i) the Government of the State of Israel or a local authority thereof; or

(ii) the Central Bank of Israel; or

(iii) any institution for insurance or financing of international trade transactions which is wholly owned by the State of Israel;

b) interest arising in Israel shall be taxable only in Latvia if the interest is paid to or in respect of a loan, debt claim or credit that is guaranteed or insured by:

(i) the Government of Latvia or a local authority thereof; or

(ii) the Bank of Latvia; or

(iii) any institution for insurance or financing of international trade transactions which is wholly owned by the Republic of Latvia;

c) interest arising in a Contracting State shall be taxable only in the other Contracting State if the recipient is a resident of that other State, and such recipient is an enterprise of that other State and is the beneficial owner of the interest, and the interest is paid with respect to indebtedness arising on the sale on credit, by that enterprise, of any merchandise or industrial, commercial or scientific equipment to an enterprise of the first-mentioned State, except where the sale or indebtedness is between related persons.

4. The term "interest" as used in this Article means income from debt claims of every kind, whether or not secured by mortgage and whether or not carrying a right to participate in the debtor's profits, and in particular, income from government securities and income from bonds or debentures, including premiums and prizes attaching to such securities, bonds or debentures. The term "interest" shall not include any income which is treated as a dividend under the provisions of Article 10. Penalty charges for late payment shall not be regarded as interest for the purpose of this Article.

5. The provisions of paragraphs 1, 2 and 3 shall not apply if the beneficial owner of the interest, being a resident of a Contracting State, carries on business in the other Contracting State in which the interest arises through a permanent establishment situated therein or performs in that other State independent personal services from a fixed base situated therein, and the debt claim in respect of which the interest is paid is effectively connected with such permanent establishment or fixed base. In such case the provisions of Article 7 or Article 14, as the case may be, shall apply.

6. Interest shall be deemed to arise in a Contracting State when the payer is a resident of that State. Where, however, the person paying the interest, whether he is a resident of a Contracting State or not, has in a Contracting State a permanent establishment or a fixed base in connection with which the indebtedness on which the interest is paid was incurred, and such interest is borne by such permanent establishment or fixed base, then such interest shall be deemed to arise in the State in which the permanent establishment is situated.

7. Where, by reason of a special relationship between the payer and the beneficial owner or between both of them and some other person, the amount of the interest, having regard to the debt claim for which it is paid, exceeds the amount which would have been agreed upon by the payer and the beneficial owner in the absence of such relationship, the provisions of this Article shall apply only to the last mentioned amount. In such case, the excess part of the payments shall remain taxable according to the laws of each Contracting State, due regard being had to the other provisions of this Convention.

 

Article 12

Royalties

1. Royalties arising in a Contracting State and paid to a resident of the other Contracting State may be taxed in that other State.

2. However, such royalties may also be taxed in the Contracting State in which they arise and according to the laws of that State, but if the beneficial owner of the royalties is a resident of the other Contracting State, the tax so charged shall not exceed 5 per cent of the gross amount of the royalties.

3. The term "royalties" as used in this Article means payments of any kind received as a consideration for the use of, or the right to use, any copyright of literary, artistic or scientific work including cinematograph films, any patent, trade mark, design or model, plan, secret formula or process, or for the use of, or the right to use, industrial, commercial or scientific equipment, or for information concerning industrial, commercial or scientific experience.

4. The provisions of paragraphs 1 and 2 shall not apply if the beneficial owner of the royalties, being a resident of a Contracting State, carries on business in the other Contracting State in which the royalties arise through a permanent establishment situated therein, or performs in that other State independent personal services from a fixed base situated therein and the right or property in respect of which the royalties are paid is effectively connected with such permanent establishment or fixed base. In such case the provisions of Article 7 or Article 14, as the case may be, shall apply.

5. Royalties shall be deemed to arise in a Contracting State when the payer is a resident of that State. Where, however, the person paying the royalties, whether he is a resident of a Contracting State or not, has in a Contracting State a permanent establishment or a fixed base in connection with which the liability to pay the royalties was incurred, and such royalties are borne by such permanent establishment or fixed base, then such royalties shall be deemed to arise in the State in which the permanent establishment or fixed base is situated.

6. Where, by reason of a special relationship between the payer and the beneficial owner or between both of them and some other person, the amount of the royalties, having regard to the use, right or information for which they are paid, exceeds the amount which would have been agreed upon by the payer and the beneficial owner in the absence of such relationship, the provisions of this Article shall apply only to the last mentioned amount. In such case, the excess part of the payments shall remain taxable according to the laws of each Contracting State, due regard being had to the other provisions of this Convention.

 

Article 13

Capital gains

1. Gains derived by a resident of a Contracting State from the alienation of immovable property referred to in Article 6 and situated in the other Contracting State may be taxed in that other State.

2. Gains derived by a resident of a Contracting State from the alienation of shares or of a comparable interest of any kind deriving more than 50 per cent of their value directly or indirectly from immovable property situated in the other Contracting State may be taxed in that other State.

3. Gains from the alienation of movable property forming part of the business property of a permanent establishment which an enterprise of a Contracting State has in the other Contracting State, or of movable property pertaining to a fixed base available to a resident of a Contracting State in the other Contracting State for the purpose of performing independent personal services, including such gains from the alienation of such a permanent establishment (alone or with the whole enterprise) or of such fixed base, may be taxed in that other State.

4. Gains derived by an enterprise of a Contracting State operating ships or aircraft in international traffic from the alienation of ships or aircraft operated in international traffic or movable property pertaining to the operation of such ships or aircraft, shall be taxable only in that State.

5. Gains from the alienation of any property other than that referred to in paragraphs 1, 2, 3 and 4 shall be taxable only in the Contracting State of which the alienator is a resident, if that resident is the beneficial owner of such capital gains.

 

Article 14

Independent Personal Services

1. Income derived by an individual who is a resident of a Contracting State in respect of professional services or other activities of an independent character shall be taxable only in that State unless he has a fixed base regularly available to him in the other Contracting State for the purpose of performing his activities. If he has such a fixed base, the income may be taxed in the other State but only so much of it as is attributable to that fixed base. For this purpose, where an individual who is a resident of a Contracting State stays in the other Contracting State for a period or periods exceeding in the aggregate 183 days in any twelve month period commencing or ending in the fiscal year concerned, he shall be deemed to have a fixed base regularly available to him in that other State and the income that is derived from his activities referred to above that are performed in that other State shall be attributable to that fixed base.

2. The term "professional services" includes especially independent scientific, literary, artistic, educational or teaching activities as well as the independent activities of physicians, lawyers, engineers, architects, dentists and accountants.

 

Article 15

Income from employment

1. Subject to the provisions of Articles 16, 18 and 19, salaries, wages and other similar remuneration derived by a resident of a Contracting State in respect of an employment shall be taxable only in that State unless the employment is exercised in the other Contracting State. If the employment is so exercised, such remuneration as is derived therefrom may be taxed in that other State.

2. Notwithstanding the provisions of paragraph 1, remuneration derived by a resident of a Contracting State in respect of an employment exercised in the other Contracting State shall be taxable only in the first mentioned State if:

a) the recipient is present in the other State for a period or periods not exceeding in the aggregate 183 days in any twelve month period commencing or ending in the fiscal year concerned, and

b) the remuneration is paid by, or on behalf of, an employer who is not a resident of the other State, and

c) the remuneration is not borne by a permanent establishment or a fixed base which the employer has in the other State.

3. Notwithstanding the preceding provisions of this Article, remuneration derived in respect of an employment exercised aboard a ship or aircraft operated in international traffic by an enterprise of a Contracting State may be taxed in that State.

 

Article 16

Directors' fees

Directors' fees and other similar payments derived by a resident of a Contracting State in his capacity as a member of the board of directors or any other similar organ of a company which is a resident of the other Contracting State may be taxed in that other State.

 

Article 17

Artistes and sportsmen

1. Notwithstanding the provisions of Articles 14 and 15, income derived by a resident of a Contracting State as an entertainer, such as a theatre, motion picture, radio or television artiste, or a musician, or as a sportsman, from his personal activities as such exercised in the other Contracting State, may be taxed in that other State.

2. Where income in respect of personal activities exercised by an entertainer or a sportsman in his capacity as such accrues not to the entertainer or sportsman himself but to another person, that income may, notwithstanding the provisions of Articles 7, 14 and 15, be taxed in the Contracting State in which the activities of the entertainer or sportsman are exercised.

3. The provisions of paragraphs 1 and 2 shall not apply to income derived from activities exercised in a Contracting State by an entertainer or sportsman if the visit to that State is wholly or mainly supported by public funds of one or both of the Contracting States. In such a case, the income shall be taxable in accordance with the provisions of Article 14 or 15, as the case may be.

 

Article 18

Pensions

1. Subject to the provisions of paragraph 2 of Article 18, pensions and other similar remuneration paid to a resident of a Contracting State in consideration of past employment shall be taxable only in that State.

2. Notwithstanding the provisions of paragraph 1 of this Article and paragraph 2 of Article 19, pensions and other remuneration paid under the social security legislation of a Contracting State shall be taxable only in that State.

 

Article 19

Government service

1. a) Salaries, wages and other similar remuneration, other than a pension, paid by a Contracting State or a local authority thereof to an individual in respect of services rendered to that State or authority shall be taxable only in that State.

b) However, such salaries, wages and other similar remuneration shall be taxable only in the other Contracting State if the services are rendered in that State and the individual is a resident of that State who:

(i) is a national of that State; or

(ii) did not become a resident of that State solely for the purpose of rendering the services.

2. a) Any pension paid by, or out of funds created by, a Contracting State or a local authority thereof to an individual in respect of services rendered to that State or authority shall be taxable only in that State.

b) However, such pension shall be taxable only in the other Contracting State if the individual is a resident of, and a national of, that State.

3. The provisions of Articles 15, 16, 17 and 18 shall apply to such salaries, wages, other similar remuneration and to pensions in respect of services rendered in connection with a business carried on by a Contracting State or a local authority thereof.

 

Article 20

Students

Payments which a student or business apprentice who is or was immediately before visiting a Contracting State a resident of the other Contracting State and who is present in the first?mentioned State solely for the purpose of his education or training receives for the purpose of his maintenance, education or training shall not be taxed in that State, provided that such payments arise from sources outside that State.

 

Article 21

Other income

1. Items of income of a resident of a Contracting State, wherever arising, not dealt with in the foregoing Articles of this Convention shall be taxable only in that State.

2. The provisions of paragraph 1 shall not apply to income, other than income from immovable property as defined in paragraph 2 of Article 6, if the recipient of such income, being a resident of a Contracting State, carries on business in the other Contracting State through a permanent establishment situated therein, or performs in that other State independent personal services from a fixed base situated therein, and the right or property in respect of which the income is paid is effectively connected with such permanent establishment or fixed base. In such case the provisions of Article 7 or Article 14, as the case may be, shall apply.

 

Article 22

Capital

1. Capital represented by immovable property referred to in Article 6, owned by a resident of a Contracting State and situated in the other Contracting State, may be taxed in that other State.

2. Capital represented by movable property forming part of the business property of a permanent establishment which an enter­prise of a Contracting State has in the other Contracting State or by movable property pertaining to a fixed base available to a resident of a Contracting State in the other Contracting State for the purpose of performing independent personal services, may be taxed in that other State.

3. Capital represented by ships and aircraft operated in international traffic by an enterprise of a Contracting State and by movable property pertaining to the operation of such ships and aircraft, shall be taxable only in that State.

4. All other elements of capital of a resident of a Contracting State shall be taxable only in that State.

 

Article 23

Elimination of double taxation

1. In Latvia, double taxation shall be eliminated as follows:

a) Where a resident of Latvia derives income or owns capital which, in accordance with this Convention, may be taxed in Israel, unless a more favourable treatment is provided in its domestic law, Latvia shall allow:

(i) as a deduction from the tax on the income of that resident, an amount equal to the income tax paid thereon in Israel;

(ii) as a deduction from the tax on the capital of that resident, an amount equal to the capital tax paid thereon in Israel.

Such deduction in either case shall not, however, exceed that part of the income tax or capital tax in Latvia, as computed before the deduction is given, which is attributable, as the case may be, to the income or the capital which may be taxed in Israel.

b) For the purposes of sub-paragraph a), where a company that is a resident of Latvia receives a dividend from a company that is a resident of Israel in which it owns at least 10 per cent of its shares having full voting rights, the tax paid in Israel shall include not only the tax paid on the dividend, but also the appropriate portion of the tax paid on the underlying profits of the company out of which the dividend was paid.

2. In Israel double taxation shall be eliminated as follows:

a) Where a resident of Israel derives income or owns capital which, in accordance with the provisions of this Convention, may be taxed in Latvia, Israel shall (subject to the laws of Israel regarding the allowance of a credit of foreign taxes, which shall not affect the general principle contained in this paragraph) allow as a deduction from the tax on the income or on the capital of that resident, an amount equal to the income tax or the capital tax, respectively, paid in Latvia.

b) Where such income is a dividend paid by a company which is a resident of Latvia to a company which is a resident of Israel and which owns not less than 25 per cent of the share capital of the company paying the dividend, the credit shall take into account tax paid by that company in respect of its income out of which the dividends were distributed.

Such deduction in either case shall not, however, exceed that part of the income tax or capital tax, as computed before the deduction is given, which is attributable, as the case may be, to the income or the capital which may be taxed in Latvia.

3. Where in accordance with any provision of the Convention income derived or capital owned by a resident of a Contracting State is exempt from tax in that State, such State may nevertheless, in calculating the amount of tax on the remaining income or capital of such resident, take into account the exempted income or capital.

 

Article 24

Non-discrimination

1. Nationals of a Contracting State shall not be subjected in the other Contracting State to any taxation or any requirement connected therewith, which is other or more burdensome than the taxation and connected requirements to which nationals of that other State in the same circumstances, in particular with respect to residence, are or may be subjected. This provision shall, notwithstanding the provisions of Article l, also apply to persons who are not residents of one or both of the Contracting States.

2. The taxation on a permanent establishment which an enterprise of a Contracting State has in the other Contracting State shall not be less favorably levied in that other State than the taxation levied on enterprises of that other State carrying on the same activities. This provision shall not be construed as obliging a Contracting State to grant to residents of the other Contracting State any personal allowances, reliefs and reductions for taxation purposes on account of civil status or family responsibilities which it grants to its own residents.

3. Except where the provisions of paragraph 1 of Article 9, paragraph 7 of Article 11, or paragraph 6 of Article 12, apply, interest, royalties and other disbursements paid by an enterprise of a Contracting State to a resident of the other Contracting State shall, for the purpose of determining the taxable profits of such enterprise, be deductible under the same conditions as if they had been paid to a resident of the first mentioned State. Similarly, any debts of an enterprise of a Contracting State to a resident of the other Contracting State shall, for the purpose of determining the taxable capital of such enterprise, be deductible under the same conditions as if they had been contracted to a resident of the first mentioned State.

4. Enterprises of a Contracting State, the capital of which is wholly or partly owned or controlled, directly or indirectly, by one or more residents of the other Contracting State, shall not be subjected in the first mentioned State to any taxation or any requirement connected therewith which is other or more burden­some than the taxation and connected requirements to which other similar enterprises of the first mentioned State are or may be subjected.

5. The provisions of this Article shall, notwithstanding the provisions of Article 2, apply to taxes of every kind and description.

 

Article 25

Mutual agreement procedure

1. Where a person considers that the actions of one or both of the Contracting States result or will result for him in taxation not in accordance with the provisions of this Convention, he may, irrespective of the remedies provided by the domestic law of those States, present his case to the competent authority of the Contracting State of which he is a resident or, if his case comes under paragraph 1 of Article 24, to that of the Contracting State of which he is a national. The case must be presented within three years from the first notification of the action resulting in taxation not in accordance with the provisions of the Convention.

2. The competent authority shall endeavor, if the objection appears to it to be justified and if it is not itself able to arrive at a satisfactory solution, to resolve the case by mutual agreement with the competent authority of the other Contracting State, with a view to the avoidance of taxation which is not in accordance with the Convention. Any agreement reached shall be implemented notwithstanding any time limits in the domestic law of the Contracting States.

3. The competent authorities of the Contracting States shall endeavor to resolve by mutual agreement any difficulties or doubts arising as to the interpretation or application of the Convention. They may also consult together for the elimination of double taxation in cases not provided for in the Convention.

4. The competent authorities of the Contracting States may communicate with each other directly, including through a joint commission consisting of themselves or their representatives, for the purpose of reaching an agreement in the sense of the preceding paragraphs.

 

Article 26

Exchange of information

1. The competent authorities of the Contracting States shall exchange such information as is necessary for carrying out the provisions of this Convention or of the domestic laws of the Contracting States concerning taxes covered by this Convention insofar as the taxation thereunder is not contrary to the Convention. The exchange of information is not restricted by Article 1. Any information received by a Contracting State shall be treated as secret in the same manner as information obtained under the domestic laws of that State and shall be disclosed only to persons or authorities (including courts and administrative bodies) concerned with the assessment or collection of, the enforcement or prosecution in respect of, or the determination of appeals in relation to the taxes covered by the Convention. Such persons or authorities shall use the information only for such purposes. They may disclose the information in public court proceedings or in judicial decisions.

2. In no case shall the provisions of paragraph 1 be construed so as to impose on a Contracting State the obligation:

a) to carry out administrative measures at variance with the laws and the administrative practice of that or of the other Contracting State;

b) to supply information which is not obtainable under the laws or in the normal course of the administration of that or of the other Contracting State;

c) to supply information which would disclose any trade, business, industrial, commercial or professional secret or trade process, or information, the disclosure of which would be contrary to public policy (ordre public).

 

Article 27

Members of diplomatic missions and consular posts

Nothing in this Convention shall affect the fiscal privileges of members of diplomatic missions and consular posts under the general rules of international law or under the provisions of special agreements.

 

Article 28

Entry into force

1. The Governments of the Contracting States shall notify each other in writing, through diplomatic channels, that the procedures required by their law for the entry into force of this Convention have been satisfied.

2. The Convention shall enter into force on the date of the later of the notifications referred to in paragraph 1 and its provisions shall have effect in both Contracting States:

a) in respect of taxes withheld at source, on income derived on or after the first day of January of the calendar year following the year in which this Convention enters into force;

b) in respect of other taxes, for taxes chargeable for any fiscal year beginning on or after the first day of January of the calendar year following the year in which this Convention enters into force.

 

Article 29

Termination

This Convention shall remain in force until terminated by a Contracting State. Either Contracting State may terminate the Convention, through diplomatic channels, by giving notice of termination in writing at least six months before the end of any calendar year. In such event, the Convention shall cease to have effect in both Contracting States:

a) in respect of taxes withheld at source, on income derived on or after the first day of January of the calendar year following the year in which the notice has been given;

b) in respect of other taxes, for taxes chargeable for any fiscal year beginning on or after the first day of January of the calendar year following the year in which the notice has been given.

IN WITNESS WHEREOF, the undersigned, duly authorized thereto, have signed this Convention.

PROTOCOL
of Latvia and the Government of the State of Israel for the Avoidance of Double Taxation and the Prevention of Fiscal Evasion with Respect to Taxes on Income and Capital, the undersigned have agreed that the following provisions shall form an integral part of the Convention:

1. Ad Article 2 paragraph 2

It is understood that taxes on total amounts of wages or salaries paid by enterprises shall also be regarded as taxes on income, but social security charges or any other similar charges shall not be regarded as taxes on income.

2. Ad Article 3 paragraph 2

With respect to Israel, the term "law" in paragraph 2 of Article 3 includes rules, regulations, administrative directives and court decisions of the State of Israel.

3. Ad Article 4 paragraph 3

a) Where a person other than an individual is a resident of both Contracting States and the competent authorities are trying to settle the question by mutual agreement, they shall have regard to such factors as the place of effective management, the place where it was incorporated or otherwise constituted and any other relevant factors.

b) It is understood that the provisions of paragraph 3 are applicable as long as the place of effective management criterion for the determination of residence is not used under the domestic legislation of Latvia. In the case of implementation of such criterion the competent authority of Latvia shall inform the competent authority of Israel as soon as such criteria is implemented, and the following provisions shall be applicable instead of the provisions of paragraph 3 from the earliest possible date as determined by the competent authorities of both Contracting States:

"3. Where by reason of the provisions of paragraph 1 a person other than an individual is a resident of both Contracting States, then it shall be deemed to be a resident of the State in which its place of effective management is situated."

4. Ad Article 5 paragraph 6

It is understood that when the activities of such an agent are devoted wholly or almost wholly on behalf of that enterprise, he will not be considered an agent of an independent status within the meaning of this paragraph.

5. Ad Article 6 paragraph 3 and Article 13 paragraph 1

It is understood that all income and gains from the alienation of immovable property referred to in Article 6 and situated in a Contracting State may be taxed in that State in accordance with the provisions of Article 13.

6. Ad Article 7 paragraph 3

It is understood that the provisions of this paragraph do not apply to expenses which would not be deductible if the permanent establishment were a separate enterprise of the Contracting State in which is located.

7. Ad Article 11 paragraph 3

It is understood that ASHR'A — the Israel Export Insurance Corp. Ltd. is the institution referred to in sub-paragraph a) (iii).

8. Ad Article 12 paragraph 3

It is understood that any copyright of literary, artistic or scientific work encompasses copyright of films or tapes and other means of image or sound reproduction for radio or television broad-casting.

9. Ad Article 16

It is understood that Article 16 shall not apply to any remuneration paid to a member of any board or organ referred to in this Article in connection with his performance of any function other than his function as a member of such body or organ.

10. Tax relief

Relief provided in this Convention to a resident of a Contacting State by the tax authorities of the other Contracting State, shall be conditioned upon the presentation of a certificate of residence indicating the relevant income, signed by the tax authorities of the first Contracting State.

11. Prevention of tax evasion or tax avoidance

This Convention shall not prevent a Contracting State from applying its domestic law on the prevention of tax evasion or tax avoidance.
